The proposed modifications are to use a small portion of the store's parking lot to display and store lawn and garden supplies and related items. The proposed area will be 280 feet by 50 feet, and will have a 6 foot -tall fence built around it. The Process I application was submitted March 7, 2014. Your proposal is found to be consistent with provisions of Federal Way Revised Code (FWRC) Chapter 19.55, `Process I -- Director's Approval', and Chapter 19.240, `Commercial Enterprise (CE).' Your Process I proposal is hereby approved. FINDINGS The Process I land use approval is supported by the following statement of facts: Zoning do Land Use — The zoning designation for the subject property is Commercial Enterprise (CE). Retail establishments are permitted in this zone pursuant to FWRC 19.240.070. Furthermore, the use of a portion of the parking lot for garden and lawn sales constitutes an accessory use --outdoor retail spaces featuring lawn and garden supplies are normally associated with general retail stores and are clearly secondary to the main Walmart establishment. Pursuant to FWRC 19.265.010 `Accessory uses, buildings, and structures,' the proposed use is permitted. 2. Review Process —According to submitted materials, the applicant proposes to dedicate a portion of the existing parkin; lot to outdoor sales of lawn, garden, and related supplies. The lot will be 280 feet by 50 feet in area, and a 6 foot -tall fence will be built along the perimeter. The use of this portion of the parking lot is subject to Process I Director's Approval pursuant to FWRC 19.15.030(l) `Minor improvements.' 3. Development standards —Outdoor commercial uses such as the proposed garden sales lot are subject to the development regulations outlined in FWRC 19.125.170 `Commercial and industrial uses.' However, FWRC 19.125.070(4)(e) states that the following use is exempt frorn some of the specific development requirements of section 19.125.070: `Year-round outdoor sales and storage of lawn and garden stock,, which are accessory to the indoor sale of the same goods and services; provided, that the use does not include outdoor play equipment, storage sheds, furniture or mechanical equipment.' 14-101056 The proposed use of the parking lot for outdoor sales complies with all applicable regulations contained in this code section. The fencing is not required to be screened from view. Regarding the loss of parking spaces associated with this proposal, general retail establishments within the CE zone require 1 parking space for every 300 square feet of gross floor area, pursuant to FWRC 19.240.070. For the subject property, a minimum of 691 parking spaces are required. According to submitted materials, the proposed garden retail space will occupy 40 parking spaces. After subtracting these spaces, the Walmart will still provide 858 parking spaces and thus complies with this portion of code. 4. State Environmental Policy Act (SEPA) —The project is exempt from SEPA review as it meets the exemptions of WAC 197-11-800(3), as it is a minor alteration to an existing structure_ No new floor area will be added. 5. Process I Thresholds — The proposed improvements do not reduce landscaping, buffering, open space, or public areas; do not change the location of utilities or easements; and create no impacts to sensitive areas or significant trees. Since these are additions and improvements to a developed site, it is subject to Process I Land Use Review. CLOSING This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this site. The effective date of this decision is March 17"', 2014, or three days from the date of this letter. Pursuant to FWRC 19.55.050, any person who received notice of this administrative decision may appeal the decision to the Federal Way )-Hearing Examiner by March 9, 2014. Any appeal must be in the form of a letter delivered to the Department of Community and Economic Development with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision. No work on the proposal can commence until the end of the appeal period. In that you are the only party of record, the appeal period is hereby waived (assuming you do not wish to appeal the decision). This Process I approval is valid for one year from the effective date of this decision. If no further action is taken within one year, this decision will expire. Per FWRC 19.15.110, a two-year extension may be granted if a written request is submitted to the City's Department of Community and Economic Development at least 30 days prior to the expiration of the decision. The opportunity to have these goods displayed on our lot will allow our customers of Federal Way to purchase these items at lower prices than any business in the area. The proposed lot will be 280ft long and 50ft wide. This will occupy less than 40 parking spots, none of which are designated as handicapped spaces. The area is shaded on the prints that are attached with this letter. We intend on having a chain link fence professionally built around it for theft control, and the desired height of the fence will be 6ft, unless the City of Federal Way would like it changed. The proposed section is located directly in front of our garden center, and this is the section of the parking lot that is used the least by our customers as it is the furthest away from our main entrances.
