These findings are based on review of existing city documents and submitted items by the applicant received March 7, 2014, and January 22, 2015. Proposal — The applicant proposes to construct a new 3,616 square foot carpet storage/prep building, accessory to an existing retail store. 2. Comprehensive Plan &'Zoning Designation — The subject property is located within the Commercial Enterprise (CE) comprehensive plan and zoning designation. The property's proposed use as a retail carpet outlet is a permitted use within the CE zoning designation pursuant to FWRC 19,40.070. 3, Review Process — Per FWRC 19.15.030.2, "Improvements and/or additions to an existing developed site that are exempt from SEPA and exceed the thresholds in subsection (1) of this section shall be reviewed using Process II..." The proposed building falls within this criteria. In addition, retail uses located in the CE zone are subject to development review procedures of Process Il `Site Plan Review' set forth in FWRC Chapter 19.60. Process II review requires no public notice period and concludes with a written decision issued by the Director of Community Development. Appeals of the director's decision are conducted by the city's hearing examiner. 4. Environmental Review — The proposed improvements are exempt from environmental review. The new building will be less than 12,000 square feet; the improvements are consistent with the State Environmental Policy Act (SEPA) "minor new construction" flexible thresholds as set forth in FWRC 14.15.030. Nonconforming Developmeni —The existing site is nonconforming in regards to certain site development standards such as landscaping. Per FWRC 19.30.090(1)(a)(ii), if any aspect, structure, improvement, or development does not conform to the current development regulations, the aspect, structure, improvement, or development must be brought into conformance if: a. (ii) A new and separate structure is being constructed on an already developed site, the applicant shall comply with all development regulations applicable to the geographic portion of the site on which the new structure and any related improvements are to be constructed. The applicant's proposal demonstrates conformance with regard to zoning regulations, such as landscaping, for the applicable geographic portion of the site. Specifically, the applicant is adding a new five-foot wide landscaping buffer south of the proposed addition. Carpet Plus New Storage Building File #14-101055-00-UP / Doc. Height — The height of the development is approximately 16 feet above average building elevation, which is below the 40-foot height maximum. Setbacks — The required front yard for use is a five-foot setback. Per FWRC 19.240.070 note 1, the minimum side and rear yards shall be 20 feet along residential zones and 5 feet along all other zones. Adjacent parcels in all directions are zoned CE, so a five-foot side and rear yard setback are applicable. The new building is greater than five feet from all property lines, which exceeds the requirement. 8. Lot Coverage — No maximum lot coverage applies. Instead, the buildable area will be determined by other site development regulations, i.e., required yards, landscaping, surface water facility, etc. 9. Parking — Pursuant to FWRC 19.240.070, retail use shall provide one parking space for each 300 square feet of Gross Floor Area (GFA). Because the proposed building is intended for storage/prep it is viewed as an accessory storage building subject to the parking requirements associated with warehouse uses at a ratio of one space for each 1,000 square feet of gross floor area. Therefore, the new addition requires four parking spaces. The total number of existing parking spaces on -site is adequate for the existing and proposed buildings. 10. Landscaping — FWRC 19.125.060(9) contains required widths for landscaping in the CE zone. The required landscaping is five feet of Type III along all property lines. FWRC 19.30.090(1)(a)(ii) addresses the requirement to upgrade the nonconforming required landscaping near the new building (in this case along the south property line in the vicinity of the new building). The site plan shows five feet of Type III landscaping as required by code. No new parking is proposed; therefore, no change to interior parking lot landscaping is required. 11. Minimum Tree Density Requirement — The existing site has insufficient tree density based on the lot size and required tree density of 20 units per acre in the CE zone. FWRC 19.120.130(5)(a) requires that one tree unit be added for each 500 square feet of new building GFA. The applicant proposes to add 3,600 square feet of new GFA, and is therefore, required to provide a total of seven new tree units. The applicant's proposed landscaping totals 1.5 tree units. The decision is therefore conditioned to require the applicant to install an additional 5.5 tree units, or alternatively utilize the off -site mitigation or fee -in lieu provisions of FWRC 19.120.140. 12. Community Design Guidelines — The proposed building, as conditioned, complies with the provisions of FWRC Chapter 19.115, "Community Design Guidelines," that are reasonably related and applicable to the area of development as detailed below. In this instance, most of the guidelines are not applicable because the new building is located away from the right-of-way and is generally screened from view by the existing retail building. 13. Transportation — The project will not add vehicle trips to the roadway system. Therefore, no concurrency, traffic impact fee, or frontage improvements are required. 14. Stormwater — There are no stormwater requirements for this project. If the project changes (i.e., additional removal/replacement of impervious surfaces), then the site may trigger the nonconforming water quality code (19.30.120), since the current project gets the site to within about 200 square feet of triggering that code section. Water/Sewer — Lakehaven Utility District is the water and sewer service provider. Service connections for the new building need to be obtained by the applicant. 16. Building Permit —The city is currently reviewing the building permit (file #13-105802-01-00-CO). No work may begin until the building permit is approved. Please contact the Permit Center at 253- 835-2607, or permitcenter@cityoffederalway.com, if you have any questions regarding the building permit. 17. Decision Criteria — Staff finds the proposal is consistent with applicable site plan approval criteria required for Process II as set forth in FWRC 19.60.050. The proposal is consistent with the city's comprehensive plan; applicable provisions of FWRC Title 19, "Zoning and Development Code"; public health, safety, and welfare; and streets and utilities in the area are adequate to serve the anticipated demand from the proposal. As conditioned, the proposal is consistent with Community Design Guideline decisional criteria set forth in FWRC Chapter 19.115. Final construction drawings will be reviewed for compliance with specific regulations, conditions of approval, and other applicable city requirements. These findings shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. Ancheyev: Below is my second set of review comments on the above proposal. With this resubmittal, the proposed building is increased in size from approximately 2,500 square feet to approximately 3,600 square feet. The resubmittal to the land use application received on July 30, 2014, did not respond to any of the nine review comments I had made (or the previous review comments on the building permit application) and does not serve to further the project. The building permit application resubmittal received on August 15, 2014, is partially responsive. I have based the below set of comments on the August 15, 2014, building permit resubmittal plans. Planning Division Review Comments 1. A completed Hazardous Materials Inventory Checklist as requested in the city's February 7, 2014, review letter on your original building permit application and March 28, 2014, Process II review letter has not been submitted. Please submit this item. 2. It appears you are no longer requesting a landscaping modification to relocate landscaping to the front property line. We will proceed accordingly. Please submit details depicting the proposed landscaping along the south side of the proposed building. This landscaping is required to meet the standards of .Federal Way Revised Code (FWRC) 19.125.050(3). 3. As previously mentioned, the site plan is required to be prepared by a certified professional licensed in the state of Washington. Please provide a site plan stamped by a professional surveyor, architect, or engineer. The south property corners need to be marked in the field (at the time of building permit inspection). You have provided a separate survey drawing by email. To be clear, the site plan itself must be stamped. I notice that the existing building has now shifted (for the third time) by as much as five feet from where it was depicted on various plan sets (original submittal showed it on the property line, the second submittal showed it five feet from property line, and the August 15 submittal shows it on the property line). The site plan still does not identify the number of tree units proposed for the site. Please identify the proposed tree units per FWRC 19.120.120 (we need to know the diameter of planted trees at breast height). Notice that because the building is increased in size, additional tree units are required to be planted. 5. The site plan now does a better job of clearly identifying existing as opposed to proposed improvements. It is still not clear if the fencing/gate bisecting the lot is existing or proposed. Please identify the type and height of fence. Barbed wire and razor wire fencing are not allowed. Chain link fencing, if utilized, must utilize vinyl,coated_niesh, powder -coated poles, dark color(s), and architectural element(s), such as pole caps and/or decorative grid pattern (FWRC 19.115.090[1][f]). The site"plan still does not show the retaining wall west of the existing retail building. Show the location of this feature. 6. The site plan continues to be identified as an "as -built." Please remove this reference as it is not an as - built drawing. 7. Again, please identify the distance that the proposed gutter of the storage building intrudes into the five- foot south setback. You will have amend the building permit application and contact the permit center for an adjustment in the permit fees 2) IBC 503.1.2 Buildings on same lot. Two or more buildings on the same lot shall be regulated as separate buildings or shall be considered as portions of one building if the building height of each building and the aggregate building area of the buildings are within the limitations of Table 503 as modified by Sections 504 and 506. The provisions of this code applicable to the aggregate building shall be applicable to each building. Also see IBC 705.3 building on the same lot. The issue is if the buildings are regulated as one building you exceed 5000 sq. ft. and per city code FWRC 13.31.050 this would require the installation of fire sprinklers system. Also note that building over 3000 sq. ft. require the installation fire alarm system per FWRC 13.31.040. You do have some options as to how you proceed. Separate the buildings with fire walls or sprinkle the buildings. I will not be able to proceed with the review until you inform the city with witch direction are going to proceed. This is an illegal non -conforming development. I have been transferred the project to implement the conditions of the approval. In speaking with Isaac Conlen the minimum tree units and required landscaping have not been installed on the site per building permit and land use conditions. As you discussed with Isaac a fee -in -lieu of providing trees shall be paid to the City of Federal Way's city forestry account. Your temporary certificate of occupancy expires within 30 days of issuance. After discussing with the Building Official, installation of landscaping and provision of trees or off -site mitigation paid in lieu is a requirement for the issuance of new certificate of occupancy. Staff will be following up on this project and monitoring the site. Before issuing a permanent certificate of occupancy the Planning Division requires a revision to the existing planting. During the site inspection I observed issues with the installation. The trees will not survive with the gravel placed on top of the root ball and around the root flare. A second temporary certificate of occupancy will be issued for 30 days. Please call to schedule a second inspection. A code violation will be placed on the property upon TOC expiration if the tree installation is not remedied. Please remove the stones and replace with soil covered with at least two inches of mulch. For the long term, trees must be installed to survive overtime. Related landscaping regulations found under Chapter 19.125 of the Federal Way Revised Code are as follows: (14) Landscape areas shall be covered with at least two inches of mulch to minimize evaporation where plant materials will cover and three inches of mulch over bare soil. (12) Grass and required landscaping areas shall contain at least four inches of topsoil at finish grade. Mulch shall be used in conjunction with landscaping in all planting areas to meet xeriscaping goals, assist vegetative growth and maintenance or to visually compliment plant material.
