Based on additional information that has come to light, this letter supersedes the October 22, 2009, email addressing this issue. Following review of the relevant factors, staff has determined your business would not constitute a change of use as defined by Federal Way Revised Code (FWRC) 19.05.030. The following analysis provides a basis for this determination. STAFF ANALYSIS Pursuant to FWRC 19.05.030, change of use means the general character of a use has been modified. This determination shall include, but not be limited to, a review of: hours of operation; required parking; traffic generation; general appearance; type, extent or amount of indoor or outdoor storage; and constituents of surface water discharge or runoff. Staff has provided a response to each of the six change of use criteria. 1. Hours of Operation — The proposed hours of operation of a used vehicle sales business would be typical of general retail sales, which would be less intensive than the 24-hour per day nature of a tow lot. Therefore, impacts would be less than what previously existed. 2. Required Parking — The auto sales use consists of approximately 600 square feet of office space and approximately 3,000 square feet of vehicle sales lot area for a total of approximately 3,600 square feet. The parking ratio for auto sales is one stall for each 300 square feet of business area, for a total of 12 stalls. A set stall to square footage ratio for tow lots is not established in code. The small area of conversion (3,600 square feet); however, is unlikely to result in a significant increase in required parking. More to the point, the applicant has adequate area for customer/staff parking inside the rear fenced area of the lot. Therefore, impacts would be similar to what previously existed. 3. Traffic Generation —Trip generations for used vehicle sales and tow lots are not known in the absence of trip generation studies. The city's Traffic Division was consulted with regard to differences in traffic generation between the two uses and has come to the File li10-100757-00 AD Doc. Therefore, impacts are similar to what previously existed. 4. General Appearance —No exterior modification of the building is being proposed. The exterior will be identical to what previously existed. Therefore, impacts are similar to or wvekss t ryfa.�,previoussly existed. Type, Extent, or Amount of Indoor or Outdoor Storage —As noted above, tow vehicles and impounded vehicles with varying levels of upkeep will no longer be stored on site. A small number of vehicles for sale will be located on the front of the property. Therefore, impacts will be similar to or less than what previously existed. 6. Constituents of Surface Water Discharge or Runoff — No increase in impervious surfaces is being proposed. The condition of the sales vehicles is likely to be better, on average, than the condition of the random vehicles towed to the lot and thus would likely contribute less pollution to stormwater leaving the site. Therefore, impacts will be less than what previously existed. CLOSING This letter will be forwarded to Code Enforcement Officer Greg Vause who is assigned to your violation case. A new business license will be required for the new location. This correspondence does not waive compliance with any applicable existing or future codes or regulations. Im leasing the building from Alex Kobets and before starting my business, i did some research and was told i can have a car lot here cause its zoned for this kind of business. To my knowledge, there use to be a Genes Towng at this location and i figured the two business were really close to each other and i figured it wouldnt be a problem. Im new to running a business thats why i didnt know i had to have something from the city and a change of use , so I apoligize for unententionally skipping that step. My goal right now is to work with the city to create a business where i can benefit the community and work with the city to have my business be open to the public. I will carry around 15-20 cars at the most and have 6 spots for the public parking including 1 handicapped spot. We made the front lot bigger so it can be more accesible to the public.
