Dear Mr. Sabin:
The Department of Community Development is in receipt of your Process I application to build a 720 square
foot pre-engineered freestanding structure for vehicle washing at the Cascade Sawing and Drilling site located
at 27500 16t" Avenue South. The Process I application is hereby approved pursuant to conclusions based on
findings made by the department's Planning Division. Please note that this approval is limited to land use
review of the proposed improvements and does not constitute building permit approval that is required prior
to construction.
CONCLUSIONS
The subject property is zoned Community Business (BC). Pursuant to the Federal Way Revised Code (FWRC)
19.15.030(1), "Review Processes for Improvements and Additions to Developed Sites," additions to an
existing developed site that are exempt from the State Environmental Policy Act (SEPA) shall be processed
using Process I, Director's Approval; provided the improvements and/or additions do not exceed 25 percent
of the gross floor area of the existing use, or 2,000 square feet of new gross floor area. The proposed addition
is 720 square feet, which is approximately 6 percent of the existing building (12,200 square feet); therefore, it
is subject to Process I.
Based on the findings below, the proposed improvements to the developed site meet the following Process I
approval criteria of FWRC Chapter 19.55, "Director's Approval":
(1) The proposal complies with the provisions of FWRC Tide 19, "Zoning and Development
Code," and all other applicable law.
(2) The health, safety, and welfare of the citizens of the city are preserved.
FINDINGS OF FACT
1. Proposal— The applicant submitted a Process I application on May 10, 2016, to add a 720 square foot pre-
engineered freestanding structure for vehicle washing.

2. Comprehensive flan & Zoning Designation — The subject property is located within the Conununity Business
comprehensive plan designation and BC zone.
3. Use Process — The application is subject to Process I, Director's Approval, pursuant to FWRC 19.15.030(1).
4. Noncanforming Devl l6pNent —'The principal structure was built in 1968, prior to the city's incorporation, and
is considered a nonconformng development. Pursuant to FWRC 19.30.090, "Nonconformance," a
nonconforming development must be brought into conformance if, "An applicant proposes to add to the
subject property either 2,500 square feet of new gross floor area or more, or 25 percent of the gross floor
area or more of the building(s) on the subject property, whichever is less, within any consecutive 36-
month time -period commencing at the time of building permit issuance." The proposal is for the addition
of a 720 square foot free standing structure, which is approximately 6 percent of the gross floor area of
the existing building; therefore, the site is not required to meet existing regulations.
5. Height — The proposed height of the car wash is 10 feet, which complies with the maximum 35 foot
height for this use.
6. Setbacks— The setbacks are 0 feet for office in the BC zone. The proposed location complies with
required setbacks.
7. Community Design Guidelines Compliance — The location of the proposed structure is not visible from any
right-of-ways, therefore it is exempt from FWRC 19.115.060(2),I wluch requires building modulation or
screening.
8. Environmental Review — SEPA review is not required based on its size.2
9. Review by other Divisions and Departments — Staff from the city's Planning and Building Divisions and Public
Works Department, and representatives from Lakehaven Utility District and South King Fire and Rescue
reviewed the Process I application. The only comments received on the Process I was from the
Lakehaven Utility District (enclosed). You may have already received comments on your building permit
(#16-102228-00-CO), and/or will be receiving comments from the other reviewers.
LAND USE REVIEW FEE
A zoning review fee of $155.00 must be submitted prior to building permit issuance. Please see the enclosed
invoice.
BUILDING PERMIT ISSUANCE REQUIRED
The department's Building Division will review the building permit for these improvements once submitted.
No work may begin until the building permit is issued.

APPEALS
The effective date of this decision is June 20, 2016. Pursuant to FWRC 19.55.050, "Appeals," any person
who receives a notice of this administrative decision may appeal the decision to the Federal Way Hearing
Examiner by July 8, 2016. Any appeal must be in the form of a letter delivered to the Department of
Community Development with the established fee.
In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal
this decision). Waiver of the right to appeal does not affect the effective date of this decision. No work on the
proposal may begin until the end of the appeal period.

Existing Use The existing use is an Office and Maintenance Shop. Vehicles and equipment
associated with off -site sawing concrete and drilling are stored on -site. This use
does not fit cleanly into any zoning category. It is more similar to "Contractor's
yards for storage of commercial equipment, vehicles, bulk building materials, and
similar items," which is only allowed in the Commercial Enterprise (CE) Zone. If we

SUMMARY
SITE WORK TO INCLUDE: The removal of the existing asphalt to accommodate the
proposed vehicle wash area which will include 1 ea. 18' x 40' concrete slab (6" of
concrete and 4" crushed rock), 100 feet of 8" x 2' concrete stem walls (on 3 sides of
the perimeter of the new canopy) and 1 ea. 18' x 40'x 15' open canopy to be placed
on top of the new concrete stem walls
ALSO INCLUDDED: There will be 242 LF of 6" PVC D3034 Sewer pipe, 3 ea. Clean outs,
1 ea. TY 1 catch basin and 1 ea. CPS-25 OWS. This will also include any restoration

Based on a phone conversation you had with the Permit Center, it is my understand that you are preparing plans to
construct a canopy and/or carport.
A Process I land use review will be required as it is an improvement/addition to a developed site (FWRC 19.15.030).
There is potential that any storage use may need to be screened if visible from the right of way or adjacent property.
Four copies of a site plan and elevations drawings will be required with the Process I application submittal. If you
want to provide me with some more information I can let you know if additional landscaping/screening is required.
What is the current use of the building? Will the structure be attached to the building? Office and
Maintenance shop
It is my understanding that the improvement it is more like a carport structure vs. a canopy. The City's
definition of a canopy is a permanent, rigid, roof -like structure that projects from a building as a shelter, with
no habitable space above it. Can you verify that it's more of a carport/tent like structure, a description of the
improvement. This structure is a canopy cover for a carwash for washing company vehicles.
Is the proposed structure going to be used for outdoor storage? If so, is material stored visible from a right
of way? I was incorrect in the description I gave you, there will be no storage and it is on the back side of the
building out of site from the ROW
Will the proposed structure take up any parking or landscaping? No, it is,within 2 feet of the existing
building.
