1. Content & Form ofApplication —Please provide the following applicable items as identified in Bulletin #038
"Boundary Line Adjustment" and content requirements of Federal Wray Revised Code (FWRC) 18.10.030:
• Location of environmentally critical areas and their buffers (see below for more details.)
• Location of all structures shown on lots with distances shown to existing and proposed lot
lines if within 50 feet. The footprint of the warehouse building should be added to the BLA
drawing if at the time of recording the building is constructed.
2. There is an existing structure on the neighboring property (parcel #202104-9047) that encroaches into
the site. The note needs to clarify that the BLA is not creating the non -conforming condition. The note
should be revised to: "Existing structure & overhang extend 5.2' over existing property boundag."
3. As conditions of approval of the Tilt 348 development project, restoration planting, maintenance
(including bond}, and year -year monitoring of the enhancement area are required. Provide documentation
and/or legal agreement as to who will be maintaining the wetland buffer restoration and enhancement
area. This document will need to be recorded and depicted on the BLA drawing.
If there is another option you propose to document maintenance over of the buffer enhancement area,
please feel free to contact me with the proposal and we can discuss.

4. The BLA map will need to include and identify the full title and final date of the Soundview Consultants
Wetland Delineation.
The BLA map will need to be revised to include the final steam and wetland delineations and
corresponding buffers.
6. A note regarding'wetland areas must be provided on the BLA drawing. The following is an example of
acceptable language: Native preservation shall be preserved for the purpose of preventing harm to
pro�erty and Cher enviponment, including but not limited to, controlling surface water runoff and erosion,
maintaining slope stability, buffering, and protecting plants, fish, and animal habitat. Removal or
disturbance of vegetation and landscaping within the critical area or buffer is prohibited except as
necessary for maintenance or replacement with approval by the City of Federal Way.
7. Add the city file number (19-101768-00-SU) in the space provided in the Title Block on all three sheets.

1. Show the area that will be set aside for the non -motorized path on the drawing, and provide a place for
the recording number.
2. Legal descriptions formatted on 8.5" x 11" and meeting all King County recording requirements, must be
provided for the non -motorized path. An easement will be required within the proposed access road for
the Tilt building. A tract X for future dedication will be required within all areas not within the proposed
road. A plan is enclosed.
3. The legal description for 202104-9027 cannot be followed using the drawing provided on sheet 2. While I
realize that this feeble description was not your creation, the property must be locatable within the
section, township, and range on the drawing.
4. Explain why the legal description for 202104-9131 contains two "parcels" within the same legal description.
Is this a title report error? If the duplicate legal description is not required, it should be removed to reduce
confusion.
5. Show "Parcel 5" from the legal description for 9131 on the drawing.
6. The title report and written legal description on sheet 1 for 202104-9131 match, but they do not match
the drawing on sheet 2. Please resolve.
7. Provide the areas of the existing lots on the drawing.
8. Lot closure calculations must be stamped by the surveyor.
9. Please clarify the lot closure calculation for APN 9027. Where is segment 2 on the drawing? Are
segments 3-6 depicting APN 9131, which should be excepted out? Is the area of APN 9131 included in
the total area shown in the lot closure for APN 9027?

10. Set permanent survey control monuments at the lot corners and the directional changes along the
wedand buffer/property line. Notify staff when these are completed.
CLOSING
Once the revisions listed above are made, provide four paper copies of the BLA document with the enclosed
resubmittal form.
Pursuant to FWRC 18.05.080, if an applicant fails to provide additional information to the city within 180
days of being notified that such information is requested, the application shall be deemed null and void and
the city shall have no duty to process, review, or issue any decisions with respect to such an application.

Dear Mr. Philippides:
The City of Federal Way has completed an administrative review of the Boundary Line Adjustment (BLA)
application to adjust the interior lot lines between tax parcels 202104-9027 (owned by Neumeier Holdings,
LLC) and 202104-9131 (owned by Lakebaven Water & Sewer District). Zoning for the subject property is
Commercial Enterprise (CE). The application was deemed complete on May 2, 2019.
The Department of Community Development hereby approves the BLA based on the survey drawing
prepared by Barghausen Consulting Engineers, Inc., received on April 15, 2019, and resubmitted on July 12,
2019, December 20, 2019, and January 15, 2020.
DECISIONAL CRITERIA
City staff has determined the BLA meets decisional criteria set forth in Federal Way Revised Code (FWRC)
Chapter 18.10:
1. The BLA is a minor alteration in the location of lot boundaries on existing lots. The proposal is to adjust
the interior lot line between tax parcels. The BLA will not increase the number of lots, nor dindnish the
size of open space or other protected environments.
2. The BLA will not diminish the size of any lot so as to result in a lot of less square footage than prescribed
in the CE zoning district. FWRC Chapter 19.240 does not contain prescriptive lot size minimums for the
proposed project.
3. The BLA will not result in the reduction of setbacks or site coverage to less than prescribed in the CE
zoning district. Besides the existing structure and overhang extended over the existing property line of
Parcel A, depicted on the BLA drawing, all setbacks are maintained. No site (lot) coverage limitations are
prescribed for this use in the CE zone.
4. All lots resulting from the BLA will be in conformance with the design standards of the city's subdivision
title.

REVISIONS TO BLA DRAWING
The following comments must be revised on the final BLA drawings prior to recording.
1. Clearly depict and label the stream buffer boundaries on the BLA drawing, per the approved Buffer
Enhancement Plan, prepared by Soundview Consultants.
2. The Tract "X" and Non -Motorized Path easements must be recorded prior to the BLA being recorded.
The King County recording number associated with the easements must be added to Sheet 2 of the BLA
drawing.
RECORDING
Pursuant to FWRC 18.10.060, all BLAs shall be recorded with the King County Division of Elections and
Records. To finalize the BLA process, please use the enclosed Resubmittallnformation form and submit to the
Permit Center one signed and notarized drawing (mylar or paper) for city signatures. Do not fold the final
BLA drawing.
After city signatures are obtained, the applicant must obtain the King County Assessor's signature and record
the BLA with King County Recorder's Office. Please return one conformed copy of the BLA to the city
immediately after recording. No changes to the BLA drawing are allowed following city signature. If the
county recording process necessitates revisions to the BLA drawing, you must request and receive approval
of any change from city staff prior to recording.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and

Description of Addendum
This addendum involves the replacement of an existing 16-inch water main with a new 16-inch water
main. The new water main is required by Lakehaven Water & Sewer District due to the proposed amount
of fill materials that is to be placed over the existing main. The new 16-inch water main is to be installed
at a higher elevation then the existing main using standard practices.
A DNS was issued on October 19, 2018, for the Tile 348 (Panattoni Development) project and no SEPA
mitigation was required or appeal filed. A SEPA Addendum is necessary for this minor revision to the
proposal due to the size of the replacement water main of 16 inches. Pursuant to WAC 197-11-800(23)(b),
utility lines greater than 12 inches are not categorically exempt.
No new or substantially different environmental impacts are anticipated.

TEMPORARY WETLAND BUFFER MAINTENANCE EASEMENT
This Temporary Wetland Buffer Maintenance Easement is made and entered into by and between
Lakehaven Water and Sewer District, a Washington municipal corporation, as grantor ("Lakehaven"), and
Neumeier Holdings LLC, a Washington limited liability company, as grantee ("Neumeier").
WHEREAS, Lakehaven is the legal owner of that certain real property located in Federal Way, King
County, Washington, legally described as follows (the "Lakehaven Property"):

AND WHEREAS, as part of its development of the Neumeier Property, the City of Federal Way (the
"City") requires Neumeier to establish a buffer restoration and enhancement area, and provide
maintenance for the buffer restoration and enhancement area located on the Lakehaven Property along
the common boundary between the Lakehaven Property and the Neumeier Property;
AND WHEREAS, Neumeier therefore desires to access a portion of the Lakehaven Property from time to
time in order to maintain the buffer restoration and enhancement area;
NOW, THEREFORE, Lakehaven and Neumeier hereby mutually agree as follows:
1. Lakehaven hereby grants, bargains, sells, conveys, and confirms forever unto Neumeier and its
successors and/or assigns a perpetual non-exclusive Temporary Wetland Buffer Maintenance
Easement over, through, across, and upon a portion of the Lakehaven Property, said portion
being legally described as follows (the "Easement Area"):

2. This Temporary Wetland Buffer Maintenance Easement shall be for access purposes to complete
the herein described maintenance of the buffer restoration and enhancement area located on the
Lakehaven Property along the common boundary between the Lakehaven Property and the
Neumeier Property.
3. The term of this Temporary Wetland Buffer Maintenance Easement shall be from recording of this
document until the earliest of: a) EVENT; or b) DATE, upon either of which this Temporary
Wetland Buffer Maintenance Easement shall automatically terminate and be of no further force or
effect.
4. Neumeier shall have the right, without prior institution of suit or proceeding at law, to enter upon
the Easement Area and such additional portions of the Lakehaven Property as reasonably

necessary to access the Easement Area for purposes consistent with the provisions of this
Temporary Wetland Buffer Maintenance Easement.
5. Neumeier's maintenance of the buffer restoration and enhancement area within the Easement
Area shall include:
Goal 1 - Improve and protect Stream Z and Wetland A by restoring and enhancing the shared
buffer.
Objective 1- Establish dense cover of native trees, shrubs, and grasses and forbs within the
shared buffer to create diverse horizontal and vertical vegetation structure and improve
wildlife habitat.
Performance Standard 1.1 — By the end of Year 5, the buffer area (excluding utility
easement within the Steam Z buffer area) will have at least 3 species of native trees,
3 species of native shrubs and 3 species of native herbaceous vegetation (native
volunteer species included) present in all areas of enhanced buffer. To be considered,
the native species must make up at least 5 percent of the vegetation class.
Performance Standard 1.2 — Minimum plant survivorship will be at 100 percent of
installed plants at the end of Year 1 (replacement of lost plants allowed), 85 percent at
the end of Year 2, 80 percent at the end of Year 3, and 75 percent at the end of Year 5.
Survivorship measurement will be based upon net stem density after Year 1. Native
volunteer species may be counted towards survivorship totals.
Performance Standard 1.3 — Minimum native woody species cover in the buffer
restoration and enhancement area will be a minimum 30 percent total cover at the end of
Year 3 and 50 percent at the end of Year 5.
Performance Standard 1.4 — Minimum native herbaceous species cover in the
restoration and enhancement area will be a minimum 5 percent total cover at the end of
Year 3 and 10 percent at the end of Year 5.
Performance Standard 1.5 — Non-native invasive plants will not make up more than
20 percent total cover in any growing season during the monitoring period following
Year 1.
Maintenance and Monitoring Plan
Neumeier will maintain the buffer restoration and enhancement area, keeping it free of non-native
invasive vegetation, trash, and yard waste.
The buffer restoration and enhancement actions will require continued monitoring and
maintenance to ensure the enhancement actions are successful. Therefore, the enhancement
site will be monitored for a period of 5 years with formal inspections by a qualified Wetland
Scientist. Monitoring events will be scheduled at the time of construction, 30 days after planting,
and late in the first through final year's growing seasons in Years 1, 2, 3, and 5.
Monitoring will consist of plant counts and percent cover measurements at permanent monitoring
stations, walk-through surveys to identify invasive species presence and dead or dying
enhancement plantings, photographs taken at fixed locations, wildlife observations, and general
qualitative habitat and buffer function observations.

To determine percent cover, observed vegetation will be identified and recorded by species and
an estimate of areal cover of dominant species within each sampling plot. Circular sample plots
approximately 30 feet in diameter (706 square feet) are centered at each monitoring station. The
sample plots encompass the specified wetland areas and terminate at the observed wetland
boundary. Trees and shrubs within each 30-foot diameter monitoring plot will be recorded by
species and areal cover. Herbaceous vegetation is sampled from a 10-foot diameter (78.5 square
feet) area within each monitoring plot, established at the same location as the center of each tree
and shrub sample plot. Herbaceous vegetation within each monitoring plot will be recorded by
species, including an estimate of percent areal cover. A list of observed tree, shrub, and
herbaceous species including percent areal cover of each species and wetland status will be
included within the monitoring report. Routine maintenance is necessary to ensure the integrity
and success of the enhancement actions. Long-term management actions include continuous
invasive plant removal, removal of potential garbage, and ensuring survival of native plant
species.
Reporting
Following each monitoring event, a brief monitoring report detailing the current ecological status
of the stream and wetland buffers, measurement of performance standards, and management
recommendations will be prepared and submitted to the City of Federal Way within 90 days of
each monitoring event to ensure full compliance with the enhancement plan, performance
standards, and regulatory conditions of approval.
Contingency Plans
If monitoring results indicate that performance standards are not being met or if unauthorized
alterations or degradations are evident due to anthropologic disturbance, it may be necessary to
implement all or part of the contingency plan. Careful attention to maintenance is essential in
ensuring that problems do not arise. Should any portion of the site fail to meet the success
criteria, a contingency plan will be developed and implemented with regulatory approval. Such
plans are adaptive and should be prepared on a case -by -case basis to reflect the failed
enhancement characteristics. Contingency plans can include additional plant installation, erosion
control, and plant substitutions including type, size, and location.
Contingency/maintenance activities may include, but are not limited to:
A. Replacing plants lost to vandalism, drought, or disease, as necessary;
B. Replacing any plant species with a 20 percent or greater mortality rate after 2 growing
seasons with the same species or native species of similar form and function;
C. Irrigating the enhancement areas only as necessary during dry weather if plants appear
to be too dry, with a minimal quantity of water;
D. Reseeding/replanting and/or repair of enhancement areas as necessary if erosion,
sedimentation, or unauthorized clearing occurs;
E. Spot treating non-native invasive plant species;
F. Removing all trash or undesirable debris from the wetland and buffer areas as necessary;
G. Removing additional shrub species to ensure better light penetration to herbaceous
groundcover.

All costs associated with maintenance of the Easement Area during the term of this Temporary
Wetland Buffer Maintenance Easement shall be borne by Neumeier. After accessing the
Lakehaven Property pursuant to the terms herein, Neumeier shall restore any portion of the
Lakehaven Property outside of the Easement Area utilized for access to a condition reasonably
equivalent to its condition prior to entry by Neumeier. Neumeier shall exercise its best effort not
to damage any private improvements within the Lakehaven Property, but if damage occurs,
Neumeier shall repair and/or replace said improvements at its sole expense.
7. No obstructions of any kind whatsoever shall be allowed within the Easement Area that would
impede the ingress and egress for the purposes herein defined.
8. This Temporary Wetland Buffer Maintenance Easement shall be a covenant running with the land
forever and shall be binding upon the owners of the Lakehaven Property and the Neumeier
Property and their respective successors and/or assigns. The Lakehaven Property and the
Neumeier Property shall be held, used, leased, sold, and/or conveyed subject to the terms of this
easement.
9. Neumeier agrees to indemnify, defend, and hold Lakehaven and its successors and assigns
harmless from any and all liability associated with Neumeier's, its licensees', or invitees' use or
maintenance of the Easement Area.
10. In any suit or other proceeding brought by any of the parties to this Temporary Wetland Buffer
Maintenance Easement, arising out of, or pertaining to this Temporary Wetland Buffer
Maintenance Easement, the substantially prevailing party shall be entitled to recover its
reasonable attorneys' fees and all costs and expenses from the substantially non -prevailing party,
in addition to any other relief.
