The Federal Way Hearing Examiner will hear any appeal of this Process II decision. Please be advised that since you are the only party of record for this application, appeal. The City must receive this waiver in writing. Waiver of the right to appeal does not affect the issuance date. Zoning —Zoning for the subject site is Business Park (BP). This zoning district permits Fabrication, Assembly and Distribution uses pursuant to Federal Way City Code (FWCC) Section 22-860. The project is subject to Process H, Site Plan Review, as it does not meet the land use process exemptions under FWCC Sections 22-32 and 22-32.2. Nonconformance — FWCC Section 22-334 establishes under what circumstances an existing nonconforming structure must be brought into conformance. The value of the proposed building elevation to "Building B" is $14,000. The applicant has submitted an appraisal of "Building B" which indicates the value of the structure is $200,000. No nonconformance threshold is triggered by the proposed building elevation. 4. Outdoor Storage Areas — The applicant has proposed the following outdoor storage areas: 1) a 40' x 162' outdoor storage area located to the north of Building A; 2) outdoor storage areas along all four sides of Building B, and, 3) a 20 x 40 outdoor storage area to the east of Building D. All proposed outdoor storage areas are proposed on existing paved surfaces. Pursuant to FWCC Section 22-1113, commercial outdoor storage must comply with the following: a. Required buffers for the primary use. Pursuant to FWCC Section 22-860, the required yards for the property are 50 feet from the front property line (east property line), 20 feet from the side property lines (north and south property lines), and 0 feet from the rear property line (west property line). The proposed outdoor storage areas satisfy this requirement. b. A minimum six-foot high solid screening fence or other appropriate screening approved by the Director of Community Development is required around the outside edge of the area devoted to the outdoor use, activity, or storage. Existing chainlink fence along the north and west property lines in the areas of the outdoor storage shall be augmented with screening slats to create a sight barrier. The remaining outdoor storage areas are screened from adjacent properties by existing structures and topography to the east. C. The proposed outdoor storage area is not located in the required yards adjoining the residential properties to the south. d. The proposed outdoor storage will not inhibit safe vehicular and pedestrian movement to, from, and on the subject property. Correspondence No expansion beyond the approved outdoor storage areas is permitted on the property without required land use approval. Accessible Parkin — The applicant has provided an accessible stall along the south fagade of the building, pursuant to Building Division requirements. 6. Pursuant to FWCC Section 22-394(b), and the forgoing findings, the proposal is found to be consistent with the Federal Way Comprehensive Plan; all applicable provisions of the FWCC; and with the public health, safety, and welfare. 7. Final construction drawings will be reviewed for compliance with specific regulations and other applicable City requirements. A building permit is required for this project. These findings shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. Process 11 application to elevate and re -side an existing 11,100 square -foot manufacturing building located at 35703 16"' Avenue South, and to create three outdoor storage areas in the immediate vicinity of this structure. The 207,516 square -foot subject property contains a total of six structures, all of which are currently vacant. The site was last used by the Federal Way School District as a storage facility; prior to this use the site operated as a Plastics Manufacturing business. In order for the City to continue review of your proposal, the following information must be provided: 1) Planning A. Provide a site plan of Building B at an enlarged scale that allows for accurate delineation in square feet of the area proposed for outdoor storage. All outdoor storage areas must be located on paved surfaces, and these areas should be delineated with paint striping. The delineation of the storage areas on the site plan and on the actual paved areas is intended to establish approved outdoor storage areas and prevent unauthorized expansion of outdoor storage areas on the property. B. The submitted elevations show large openings on the north and south facades of the structure. Prior to the unauthorized raising of the structure, the building was enclosed- Pursuant to Federal Way City Code (FWCC) Section 22-861, Special Regulations and Notes, the impacts of fabrication, assembly, and distribution use may be no greater than the impacts of other uses permitted in the zone. As such, in order to contain the noise generating impacts of the use, the proposed building alterations are required to include some means of fully enclosing the structure, such as compatible attached siding or metal sliding doors. C. Indicate.what screening, if any, is proposed along the property lines. D. Pursuant to FWCC Section 22-334(5), when the use conducted on the subject property has ceased for more than one year, the applicant shall repair, and/or restore the improvements on the site, such as drainage, landscaping, curbing, parking, parking lot landscaping, etc., to a condition as near as physically possible to the condition required by the requirements of approval of the existing development. Based on site inspection, this requirement would apply to the restriping of parking stalls in the geographic location of Building B. Be advised that the applicant is also required, as a component of compliance with the nonconformance section of the code, to remove all rubble and debris, whether construction related or not, from the site prior to occupancy. 2) Public Works A. The applicant shall provide an itemized estimate of costs of the proposed improvements to Building `B', including, but not limited to the following: building structural improvements, improvements to bring building into compliance with building code, costs to bring building into compliance for fire protection/suppression requirements, all other proposed interior and exterior improvements to the building, and any costs associated with the temporary storage area(s). The estimate must also include the recent un-permitted improvements done to date. B. Itemized cost estimate(s) of proposed improvements to any of the other building(s) on the site. Public Works will determine, based on these estimates, whether the costs associated with the site improvements will meet or exceed thresholds set forth for street frontage or water quality improvements. 3) Lakehaven Utility District Please see the enclosed memorandum from Brian Asbury, March 3, 2005. 4) Federal Way Fire Department An automatic fire sprinkler was required and is still required for existing building B. The automatic fire sprinkler system that was in building B shall be altered/repaired, subject to the approval of the Fire Department. Please be advised that the value of repairing or replacing the automatic sprinkler system must be included in the above -referenced project value estimates. Please coordinate with Greg Brozek of the Federal Way Fire Department (253-946-7241) for information related to Fire Department requirements. 5) Building Division Please refer to the enclosed memorandum from Scott Sproul, Plans Examiner, for information related to accessible parking requirements. We will have sliding doors with matching siding to that of the rest of the structure. C. Screening has been installed on the chain link fencing along the southwest corner of the property and along the south fence, just to the west of building C. This will block the visual impacts of the site to the adjacent neighbors to the south. D. The van accessible parking stall for Building B is indicated on the Site Plan B and will be striped and appropriate signage installed. E. All garbage and debris from construction will be removed from the site. 2) Public Works A. The following budget is the total improvements to the site that are incurred or will be incurred prior to occupancy. A Water Use Questionnaire has be filled out and side sewer permit application has been received and is pending. 4) Federal Way Fire Department An automatic fire sprinkler was required when the building was used for storage of highly flammable plastics materials. The original structure was an open building with no siding on the north or the south walls. Even with open walls, the highly flammable nature of the plastics materials stored in Building B required the automatic fire sprinkler system. At this moment, there are large piles of recycled materials in various, appropriate, non -permeable areas stored outside. During the process of our purchase, we observed numerous pallets of wood stored inside and outside of the buildings, transported to and from the site. An adjoining neighbor to the site on the south was a prior owner (actually his father). They ran a construction business and earth moving business there for many years prior to leasing it to the plastics manufacturing company. During their ownership, heavy equipment, i.e., forklifts, loaders, back hoes, excavators, welding, trucking, etc. all took place inside and outside of the buildings with a regular frequency. Another local business owner we spoke with almost went to work for the plastics company and also confirmed the use of the entire yard and buildings in their staging for manufacturing or fabrication and subsequent shipping. This occurred prior to the incorporation of the City of Federal Way and after the City's incorporation. No major improvements are expected for the existing buildings and grounds other than what we have submitted in the engineering plans for Building B. Sub -lessees will meet all federal, state, and city requirements. Buildings A, C, E and F would be sub -leased out to another tenant fitting the approved business park zoning. It should be noted that the current zoning for the land is designated as business -park. Let me say for the record that we regret having selected the house mover/contractor we hired for lifting Building B. Since the drawings for the remodel of the building were in hand, they incorrectly assumed this was sufficient. The electrical contractor that we selected for the electrical repairs did secure a permit and we are in the process of securing the sewer permit with Lake Haven. Moving forward, we ask you to consider the following comments and allow us to move through the Process II — Site Plan Review and not through the Process III which requires a SEPA review. Frankly, the time delay this will cause will likely require us to abandon the project and loose our down payment and the monies put into the site work to date. I have reviewed the documents that Jane Gamble presented containing historical background information on this site. Two of documents we received reference incomplete applications for other business and we will address applicable sections to our project as the site review determines appropriate to our project. The memo from Deb Parker dated 3/15/99, Interoffice Memorandum from the Federal Way Department of Public Works indicates that there might be a 25% cost threshold that would necessitate some public works improvements. Our project costs are remarkably different and don't approach the 25% threshold described in this document. A recent appraisal (11/23/2003) shows the subject property and improvements valuer! at $1,700,000. This is our purchase price of the property as well. The buildings themselves in the current state were valued at $586,000 two years ago. The current value of the buildings is at a minimum $820,000, simply based on the rise is steel prices in the last 12 months. Using the old appraisal value for the buildings, the cost of Building "B" is $200,000.00. It should also be noted that when just considering the area that ST Fabrication is requesting occupancy for, the prorated cost of the electrical is only $13,700.00. This means that Our real cost for moving into building B and D is $28,700.00. Based upon this we submit that the public improvements described in the 3/15/99 memo are not applicable to our project. "WAC 197-11-800 Categorical exemptions, part (3) allows for repair, remodeling, maintenance, or minor alteration of existing private or public structures, facilities or equipment, including utilities, involving no materials expansions or changes in use beyond that previously existing;" Our position is as follows: Part (3) of this code allows for the following: 1. repair 2. remodeling 3. maintenance 4. minor alterations Any one of these (4) activities are allowed as long as there are no: a. material expansions b. changes in use beyond that previously existing Based upon this, we see each of the (4) activities as distinct, and while they may overlap, they do not have to overlap. This means that repairs may not be remodeling. Remodeling maybe a repair or maintenance, but it may not be a minor alteration. You could have a remodel that is neither repair or maintenance, and not a minor alteration. Our position is that the lift of building "B" was in fact a remodel (2) that did not have any material expansion (a) and also did not change in use beyond thatpreviously existing (b). Where is not change in floor space, footings, number of floors, or surrounding non -permeable space or roof area. A Process III and SEPA review is not warranted in this case. The only reason for our remodel was a safety consideration when moving steel around inside a building. This would apply to steel, wood, plastic or any other project, when moving around inside a low ceiling, there is a potential hazard. This includes the fabrication or manufacturing of steel components by means of the following normal operations at our site: • Transportation operations — generally loading and unloading of steel materials off and on to flat bed trucks and containers. • Manufacturing — fabrication operations including cutting, drilling, sawing, shearing and welding of steel beams, plates, angles, and bars. • Painting — fabricated steel is painted using primer paint only using an electrostatic system approved by Puget Sound Clean Air Agency. • Staging/storage — steel can be stored in designated areas on a temporary or rotating basis in designated areas (non -permeable ground) on racks, bunkers or dunnage. As a manufacturer, we will not be able to move all the steel into the manufacturing flow inside the shop in any given moment. The general process is to unload the raw steel stock onto the bunkers or racks as is appropriate and stage it for production. Steel is moved into the manufacturing processes and eventually a finished part is loaded for transport out. In our shop, we would have steel coming into the south door and smaller steel through the east door. Finished steel would move out the north door and be staged for loading. Racks would be used to store small stock for use as operations require. Steel staging and storage does not increase the non -permeable area of the site at all and is not considered hazardous. Prior operations at this site have used the outside premises for these kinds of operations. The plastics manufacturing company had operational use of the entire site, utilizing all six buildings in there operations. This required materials (hazardous, unlike steel) to be routinely moved between buildings during the normal use of there operations. Pallets were staged with raw materials prior to bringing them into the shop and finished products were likewise staged in bulk in the asphalted areas. in particular, the original owners that still live adjacent to the property ran a heavy construction company out of this facility. Their operations included mining of peat and other earth materials for construction sites. They had multiple areas for storage of materials outside. Just across the street, DBM Construction has their site in the same zoning. Driving through their yard, you can see steel staged all over on permeable ground. Clearly, this is an allowed used in the zone, and we are not asking for anything different. Their yard is similar in nature to ST Fabrication, only ten times the size. In the past a fabrications business operated at the site, and therefore, ST Fabrications (which welds and fabricates metal for bridges and structures, etc), is not considered a change of use. Because they raised the building, without building permits or land use approval, and in order to establish outdoor storage areas on the property, they must now go thru a USE Process II. You might want to take a look at some of the old communications in AMANDA on the property, specifically the Soen You project (which never obtained land use approval).
