APPROVAL OF MINUTES Planning Commission Meeting of August 9, 2023 Commissioner Patrick moves to approve the August 9, 2023 minutes as written Second by Commissioner Chynoweth Motion passes 4-0 4. PUBLIC COMMENT None scheduled 5. COMMISSION BUSINESS Chair Bronson opens the public hearing at 5:02pm a. Public Hearing- FWRC Title 19.85 Code Amendments Development Agreements Community Development Director Keith Niven presented on proposed code amendments to 19.85 Development Agreements. Proposed code amendments clarify ambiguities in existing code of what can be included in Development Agreements, clarify when a development agreement may be processed, and remove certain provisions that should not be included in City Code; consistent with the Federal Way Comprehensive Plan. One goal is to provide greater predictability and flexibility to Developers. Proposed updates include 19.85.020- adding minimum requirement of 5 aces and not predominately single family, and when a comprehensive plan amendment is needed with a development agreement, Council must decide on the comprehensive plan amendments one meeting prior to the development agreement if it relates to Chapter 3, Transportation. Proposed updates include 19.85.030- a development agreement can modify city regulations, a development agreement can vest to traffic impact fees to those in effect at the time of execution for 10 years, subject to annual CPI inflation, and a development agreement cannot modify transportation concurrency requirements. Next steps include presenting at LUTC, anticipated 1st reading at City Council, and anticipated 2"d reading at City Council. Public Comment was provided by Grand Peaks and Merlone Geier. Grand Peaks is in favor with one modification requested to 19.85.020 and that Council approval for the Comprehensive Plan and Development Agreement be approved during the same meeting if appropriate. Merlone Geier is but not in favor of the vesting of traffic fees or transportation concurrency and requests to modify to expand authority to initiate development agreements to Mayor and Community Development Director. Deliberations include: Clarification on traffic impact fee vesting, how notice would be given if Mayor initiated a development agreement, lengths of development agreements and decision criteria. Commissioner Patrick motions to recommend approval of the proposed code amendments incorporating the proposed amendment to 19.85.050 as proposed by Merlone Geier, but not including the Community Development Director with reasonable notice provision and including public notice within reasonable time when initiated by Mayor. Commissioner Patrick moves to close the Public Hearing Second by Commissioner Noble-Gulliford Motion Passes 4-0 Chair Bronson closes the public hearing at 5:59pm 6. STAFF BUSINESS Community Development Director Keith Niven shared the Sound Transit OMF Environmental Impact Study is available to view and public comment period is open. It was also announced a potential development agreement is being discussed for the Kitt's Corner Property. 7. NEXT MEETING October 4, 5:OOpm —Regular Meeting 8.
