10-17-2023 Council Minutes - RegularCITY of Federal Way Centered on Opportunity CITY COUNCIL REGULAR MEETING AGENDA City Hall - Council Chambers October 17, 2023 - 6:30 p.m. 1. CALL MEETING TO ORDER Mayor Ferrell called the meeting to order at 6:31 p.m. City officials in attendance: Mayor Jim Ferrell, Council President Linda Kochmar, Deputy Mayor Susan Honda, Councilmember Lydia Assefa-Dawson, Councilmember Paul McDaniel, Councilmember Hoang Tran, Councilmember Jack Walsh, and Councilmember Jack Dovey. City staff in attendance: City Administrator Brian Davis, City Attorney Ryan Call and City Clerk Stephanie Courtney. 2. PLEDGE OF ALLEGIANCE Mayor Ferrell led the flag salute. 3. CEREMONIES & RECOGNITION a. Key to the City — Rose Ehl, Dave Ehl, and Karla Kolibab Mayor Ferrell was pleased to present the Key to the City to the founders of the Federal Way Farmers Market Rose Ehl, Dave Ehl, and Karla Kolibab noting the market is celebrating its 20tn anniversary. He spoke kind words about the impact the market has had on the community and thanked them for their dedication and support, especially during COVID. Rose, Dave, and Karla each spoke to thank the Mayor and reflect on the many years and memories they have made in the past 20-years. They extended a genuine thank you to the countless volunteers and supporters of the market. b. Police Department Swearing -In Ceremonies Police Chief Hwang introduced and provided backgrounds on officers who have been promoted to Lieutenant and appointed as Corporals. Mayor Ferrell administered the oath of office and congratulated the officers. At 7:05 p.m. Mayor Ferrell announced the Council would take a brief recess to honor Rose, Dave, and Karla. The meeting resumed at 7:19 p.m. 4. MAYOR'S EMERGING ISSUES AND REPORT Community Development Director Keith Niven provided an update on the Day Center following a Federal Way City Council Regular Minutes Page 1 of 6 October 17, 2023 meeting with the center leadership; the site has seen improvements following that meeting. Mayor Ferrell reported on a very successful Food Drive at the Twin Lakes Fred Meyer. He thanked the Council, volunteers, Fred Meyer staff, and Waste Management curbside collection for the efforts that resulted in nearly 15,000 pounds of food and $1,165 in cash that will benefit the Multi - Service Center Food Bank. Mayor Ferrell reported on recent community events and provided information on upcoming events in the community. 5. PUBLIC COMMENT Susan Strong addressed homeless congregating around a business located on Highway 99. Melissa Hamilton shared about a recent call to 911 and the extended response time; she asked Council to consider whether police staffing is sufficient. Allison Fine recommended the Council review the Code of Ethics for potential updates following transphobic remarks made at the October 10 Parks, Recreation, Human Services, Public Safety (PRHSPS) Council Committee meeting. Saudia Abdullah shared a quote by Barbara Jordan. She also expressed disappointment in comments made at the October 10 PRHSPS meeting. Ken Blevens expressed gratitude to the current Council and their work the past few years; he would still like to see police staffing increased. Geoffrey Tancredi shared his views of the advantages and disadvantages of the Day Center, and believes the negative impacts outweigh the positive. T_renise Rogers provided information on programs funded by King County that benefit the community; she is pleased to see the county honoring John Conna and his family for their historical contributions. Tirzah Idahosa raised concerns about statements made previously regarding the Diversity Commission and questioned staffing decisions. She thanked King County Metro for the John Conna mural installed on South 320th Street. Kevin Morris voiced concerns about car thefts and carjacking in Federal Way. Anna Patrick proposed a community discussion group to engage in deeper and respectful conversations to address stereotypes and genuine concerns. Najma (not provided), shared a personal story and advocated for better practices to prohibit the removal of religious coverings. 6. PRESENTATIONS a. Proclamation: Domestic Violence Awareness Month — October 2023 Deputy Mayor Honda read and presented the proclamation to Cynthia Ricks-Maccotan, Program Manager for St. Francis Hospital. Ms. Ricks-Maccotan thanked the Council and acknowledged the need in the community for more awareness, volunteers and Federal Way City Council Regular Minutes Page 2 of 6 October 17, 2023 organizations to eradicate domestic violence. 7. COUNCIL COMMITTEE AND REGIONAL COMMITTEE REPORTS Parks/Recreation/Human Services/Public Safety Committee (PRHSPS) — Councilmember Walsh reported on the items passed through Committee; the next meeting will be November 14. Land Use/Transportation Committee (LUTC) — Councilmember Dovey thanked Keith Niven and Bill Vadino for the presentation made regarding ADU's at the Marine Hills Association meeting. The next committee meeting is Monday, November 6. Finance, Economic Development Regional Affairs Committee (FEDRAC) - Councilmember Tran reported the next meeting will be October 24. Lodging Tax Advisory Committee (LTAC) — Councilmember Assefa-Dawson reported on the recent meeting. She noted the success of. the Pacific Raceways event for the city and looks forward to a continued relationship with them. The next meeting will be November 8. Deputy Mayor & Regional Committees Report — Deputy Mayor Honda reported on the Senior Advisory Commission and the new Senior Connection meeting at the Federal Way Community Center. She reported on her attendance at various regional meetings including Regional Transit Committee and the Seattle -King County Board of Health. Council President Report — Council President Kochmar reported on a recent community meeting regarding addiction treatment options. She will be attending the Master Builders Association of King and Snohomish County. 8. CONSENT AGENDA a. Minutes: October 3, 2023 Special and Regular Meeting Minutes b. COUNCIL BUSINESS a. Performing Arts and Event Center Venue Management Contract Federal Way City Council Regular Minutes Page 3 of 6 October 17, 2023 Community Relations Liaison/Contract Administrator Autumn Gressett provided background information on the proposed renewal of the management contract for the Performing Arts and Event Center with Global Spectrum/Oakfield Group. Finance Director Steve Groom provided financial information regarding existing debt and how the city pays the existing subsidy for this community asset. Current General Manager Brian Hoffman spoke to the negotiated terms of the new contract. He noted Global Spectrum looks to continue to partner with the city for this wonderful facility. In response to a question, Parks Deputy Director Jason Gerwen clarified the original plan from the Blue -Ribbon Panel included fundraising support from a non-profit organization which was estimated to contribute a substantial amount of funding each year. No such efforts have been made, creating a larger funding gap for the city. Mayor Ferrell provided context on the value of the facility in comparison to the low debt balance. He shared the importance of professional management for the success of the facility. Councilmembers thanked Ms. Gressett, Mr. Groom, and Mr. Hoffman for the information and asked various clarifying questions including the term options presented. COUNCILMEMBER WALSH MOVED TO AUTHORIZE STAFF TO NEGOTIATE A CONTRACT WITH GLOBAL SPECTRUM WITH A 5 YEAR TERM WITH THE OPTION TO EXTEND AN ADDITIONAL 5 YEARS AND AUTHORIZE THE MAYOR TO EXECUTE THAT CONTRACT; SECOND BY COUNCILMEMBER DOVEY. Department of Commerce Climate Planning Grant - Authorization to Apply Senior Planner Evan Lewis provided information on the opportunity to apply for a Department of Commerce Climate planning grant with no required local match. New requirements set by HB1181 requires compliance in the city's Comprehensive Plan by 2029. Council Bill #862/Hi hline Water District Franchise Ordinance AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, GRANTING HIGHLINE WATER DISTRICT, A NONEXCLUSIVE FRANCHISE TO OCCUPY RIGHTS -OF -WAY IN THE CITY OF FEDERAL WAY, WASHINGTON, WITHIN THE SPECIFIED FRANCHISE AREA FOR THE PURPOSES OF CONSTRUCTING, MAINTAINING, OPERATING, REPLACING, AND Federal Way City Council Regular Minutes Page 4 of 6 October 17, 2023 REPAIRING A PUBLIC WATER SYSTEM WITHIN AND THROUGHOUT THE CITY OF FEDERAL WAY. Development Services Manager Cole Elliott provided information on the proposed ordinance for a franchise agreement in order to provide water distribution in the northern portion of the city. The proposed franchise has a 10-year term with two 5-year extensions possible. No public comments were received. City Clerk Stephanie Courtney read the ordinance title into the record. Surface Water Quality Program Supervisor Kevin Du provided information on the annual assessments which are administered through the King County Assessor. The proposed ordinance sets the deadline at May 10 each year, and outlines interest and penalties. No public comments were received. COUNCIL REPORTS Councilmember Dovey no report. Councilmember Walsh reported on attending a great fundraiser and is pleased to see people in Federal Way doing good across the world. Councilmember Tran spoke to defend former colleagues and Councilmember against accusations made during public comment; defunding the Police Department was not discussed by the previous Council. He cautioned against false accusations. Councilmember McDaniel reported on a regional event he attended and provided follow-up on a homeless gentleman he is assisting. He reported missing street lights and asked for them to be addressed as soon as possible. Councilmember Assefa-Dawson thanked Councilmember Tran for his comments. She asked how the Police Department will prioritize the mobile surveillance trailers to the business community; Chief Hwang responded. Deputy Mayor Honda thanked the South King Tool Library and reported on their planned expansion. She asked for a retail safety meeting. She also noted the opening of the new Federal Way Memorial Stadium. Council President Kochmar would like to see Neighborhood Connections meeting restart after the new year. She encouraged people to donate to the Multi -Service Center over the holidays. 12.
