The proposed modification includes the extension of the fill limits approximately 50 feet to the fence line and adds a 4-foot ecology block retaining wall along the eastern property line. The existing security fence, which is situated on the property line, will be secured to the new retaining wall. A perforated storage/drain pipe is shown in the plan to allow collection and dispersion of runoff entering the lower yard from paved areas upslope in the yard. The footprint of the gravel area is the same as originally proposed, and the remainder of the fill area will be seeded with grass to remain pervious. Since the November 14, 2014, approval of the original Use Process decision, the City has assumed ownership of the two sewer mains on the parcel up to, but not including, the southern man hole as outlined on the modified site plan. The facilities have been conveyed and the easements vacated by Lakehaven Utility District. CODE REQUIREMENT Pursuant to Federal Way Revised Code (FWRC) 19.120.120(6) rockeries and retaining walls shall be set back a minimum of 3 feet from adjacent public rights -of -way. Given this requirement, you are requesting a modification to the setback requirements for rockeries and retaining walls. In accordance with FWRC 19.120.050, modifications to the clearing, grading, and tree and vegetation code can be administratively approved by the Director of Community Development. Your site plan modification request is hereby approved based on the following conclusions: Interstate 5 is approximately 130 feet east of the proposed wall location, but existing native vegetation is both mature and dense preventing the wall from being visible from the freeway. Therefore, the proposed retaining wall along the east property line will result in the same or less impacts than meeting the standards per FWRC 19.120.050(1)(b). As depicted in the submitted materials, the retaining wall will be approximately 425 feet from the public right-of-way at 28t1i Ave S and is not visible from the road due to the distance from the road and change in elevation. Further, the wall will be screened from the properties to the north and south by the mature and dense vegetation. The revision pertains to grading at the lower yard as described in this email. The original design was to fill a portion of the lower yard and tie in to existing grades with 3:1 fill slopes at the edge of fill. The design modification extends the fill limits approximately 50 feet to the fence line and adds a 4-ft ecology block retaining wall at the eastern property line as shown in the attached exhibits. The existing perimeter security fence will be mounted to the wall. The revision increases the amount of fill to grade the lower yard to an estimated 470 yards, but remains under the 500-yard threshold for SEPA. A perforated storage/drain pipe is shown in the plan to allow collection and dispersion of runoff entering the lower yard from paved areas upslope in the yard. The footprint of the gravel area is the same as originally proposed, and the remainder of the fill area will be seeded with grass and remain pervious. To address section 19.120.120 of the City's revised code, the wall will be less than six feet tall and meet all setback requirements. The block wall will be approximately 425 feet from the public right-of-way at 28th Ave S and is not visible from the road due to the distance from the road and change in elevation. Three photos are attached from 281h Ave S showing the view looking east from the three driveway entrances to the maintenance yard. The fill area and proposed wall are behind (southeast of) the house shown in the north driveway photo and will not be visible. In the middle driveway photo, the fill area and proposed wall will be left of the light poles seen in the middle of the photo and not visible from the road. The fill area will be left (north of) the covered storage buildings seen in the south driveway photo and will not be visible.
