Federal Way, WA 98003 RE: Permit #07-103904-00-SM; STEEL LAKE CREST 30642 28th Ave S Right -of -Way Modification Request Reconsideration Dear Ms. Elder: Thank you for your January 24, 2008 letter requesting the City to reconsider a waiver of the pedestrian and non -motorized block perimeter requirement. We have reviewed our original Right-of-way Modification Response your request for reconsideration, and are unable to grant you such modification for the following reasons: As indicated before, per FWCC 20-157, the connection is required. The City does not believe that this connection meets any of'the modification criteria contained in either FWCC 20-157(c) or FWCC 22-1477. There are several Comprehensive Plan Policies that encourage the use of non motorized trips including and not limited to the following: TP29. Reduce reliance on the single occupant auto by prioritizing and implementing supportive local -level transit, HOV, and non -motorized improvements. TP 30: Identify and plan for multi -modal freeway, arterial, and collector street improvements which ensure more efficient use of existing roads and enhancement of HOV, transit, and related non -motorized operations. TP52. Work to extend the existing system of sidewalks, bikeways, and equestrian ways in the city to provide safe access to public transit, neighborhood and business centers, parks, schools, public facilities, and other recreational attractions. Now that the City has granted the project the other modifications requested (eliminating the vehicular access to the east and eliminating the second access point to resolve sight distance), the need for this pedestrian connection becomes more crucial. From a safety point of view, this connection could be used as an emergency access should 28th Avenue S become blocked due to a natural disaster or any other reason. L: \CSDC\DOCS\SAVE\6536278098. DOC The connection may also encourage the use of other modes of transportation including walking and transit. The pedestrian connection is required to have a low level illumination that is not necessarily attractive to intruders to the proposed neighborhood. Hence, it would be designed as a safe connection. DOC January 24, 2008 Mr. Ken Miller City of Federal Way Deputy Director, Public Works P.O. Box 9718 Federal Way, WA 98063-9718 Project: Steel Lake Preliminary Plat Reference: Permit No. 07-103904-00-SM Steel Lake Crest — 30642 28" Ave S Right -of -Way Modification Request (2) (Pedestrian and Non -Motorized Block Perimeters) Dear Mr. Miller: I am one of the property owners represented by Mr. Schweikl on the above referred Steel Lake Crest Preliminary Plat application. I am writing with regard to your denial of our request to waive the pedestrian and non -motorized vehicle path that would potentially connect Military Road South and 28"' Avenue South through the proposed plat. In particular, I would like to comment on the cited reference to both the safety and convenience of the citizens of Federal Way. In my opinion, citizens of Federal Way walking southbound on Military Road would have no easier or quicker access to either the City center or Steel Lake park by bypassing the South 3041t' to 28" Ave South route and walking further south to connect with a pedestrian walkway from Military Road S to 28t" Ave South. There are no sidewalks on either side of Military from South 304" to our property. Additionally, Pat's Plumbing, located on the west side of Military in this area has upwards of 30 service vehicles coming and going out of their place of business from early morning until late afternoon and evening. This is definitely not a safe situation for pedestrians. Individuals that might be coming under the freeway overpass from the area east of Interstate 5 might have quicker and easier access (though certainly not safer) but at the present time they are not citizens of Federal Way. Also, in my opinion, the "access" itself presents a safety factor for those new citizens of Federal Way that will be living in the Steel Lake Crest Subdivision. We have lived in this location for over 30 years. In that period of time we have been robbed twice. Both times the perpetrators accessed our home from Military Road South through the back of our property where there was no obvious view of them from anyone who might have noticed and contacted the authorities. We are now looking at a subdivision, whose residents would not be well -served by having obscured "easy' access from Military Road South provided to their homes via a pedestrian pathway for any unsavory persons who might be so inclined to use it. If I were going to live in this development I would not be happy about opening myself up to this vulnerability. And I guess I have to ask you what your thoughts would be if you were planning to make your home in Steel Lake Crest? This being said, it would be appreciated if you would reconsider your ruling and approve our modification request. Specifically, the request addresses three items, which are as follows: 1. You are requesting relief from vehicular block perimeters, which shall be no longer than 2,640 feet for motorized circulation. This would require an east -west vehicular connection from 28`h Avenue South to Military Road South. Reference Federal Way City Code (FWCC) 20-151(d), FWCC 20-180(e), Public Works Development Standards (PWDS) 1.3.2(c.4), and PWDS 3.2.11. 2. You are requesting relief from pedestrian and non -motorized block perimeters, which shall be no longer than 1,320 feet. This would require an east -west pedestrian connection from 281h Avenue South to Military Road South. Reference FWCC 20-151(d), FWCC 20-156(a) and (c), PWDS 1.3.2(c.4), PWDS 1.3.4(c) and PWDS 3.2.11. You are requesting relief from the requirement to provide two access connections to the public street system if the development generates more than 250 trips per day (25 single family lots). These codes also require a Street Cross Section Type "U" for an average daily traffic of between 250 and 500 trips. With Street Cross Section Type "W", this would require a preferred secondary connection from the site to Military Road South, or a non -preferred dual access from the site to 28t` Avenue South. The other alternative is a Street Cross Section Type "U" with one access point to the existing right-of-way. Reference PWDS 1.3.2(c.5), FWCC 22-1474, FWCC 22- 1528. FWCC 22-1477; Modifications, deferments and waivers allows the Public Works Department to grant a request to modify, defer, or waive the required street improvements only after consideration of four specific reasons. FWCC 20-156(c) and 20-180(e) allow the requirement to provide vehicular and pedestrian block perimeters to be modified only after consideration of three specific reasons. After evaluating the existing conditions along the referenced streets, review of FWCC provisions, and direction provided by the City Council, the Public Works Department hereby makes the following decisions regarding the requirements for the street improvements as follows: L:\CSDC\DOCS\SAVE\3409561077.DOC Mr. Brant Schweikl, P.E. Schweikl & Associates, PLLC RE: Permit No. 07-103904-00-SM January 16, 2008 Page 2 of 3 Vehicular Block Perimeters. This modification request has been approved, and the requirement has been waived. In order to meet this requirement, the site would need a vehicular connection from 28t' Avenue South through the site to Military Road South. WSDOT limited access right- of-way abuts the eastern edge of the property, leaving a small area where the property abuts Military Road South right-of-way where the City has jurisdictional control. This proposed road connection to Military Road South would occur on the northeast corner of the site. This vehicular connection could promote and have a potential for cut -through traffic. The WSDOT limited access for I-5/Military Road South overpass will create possible sight distance and channelization issues for a road intersection at this location. The more specific reasons for the City's decision are stated in FWCC 22-1477(1) the improvement as required would not be harmonious with existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or the city as a whole, and FWCC 22-1477(2) Unusual topographic or physical conditions preclude the construction of the improvements as required, and FWCC 20-180(e.3) adjacent development is not being conducive. Pedestrian and Non -Motorized Block Perimeters. This modification request has been denied. The development shall provide an east -west pedestrian connection from 28`h Avenue South to Military Road South through a combination of internal roads and Street Cross Section Type "ZZ". As stated above, the connection location would be at the northeast corner of the site. The connection to Military Road South would allow pedestrian traffic coming from Military Road South to travel to the west, creating a quicker and easier pedestrian route towards the city center area and to Steel Lake Park. A pedestrian connection from the site to Military Road South pavement can safely and technically be made by the development with no required permission from WSDOT. The channelization of Military Road South would not need modified, and sight distance is not an issue with a pedestrian connection. The location of the proposed storm water pond can be moved to the west or the south to accommodate 'the required 20-foot cross section. The City does not believe that this connection meets any of the modification requirement criteria contained in FWCC 22-1477 or FWCC 20-156(c). Dual Access Connections and Street Cross Section Type "U". This modification request has been approved. The development shall provide one access connection from the site to 28`h Avenue South that meets sight distance criteria and safety requirements. All internal roads may be designed and constructed to Street Cross Section Type "W". No on -street parking will be allowed from the new road intersection with 28'h Avenue South to the internal loop road intersection approximately 170 feet east. You have demonstrated through submitted information and analysis that a northerly access point to 28th Avenue South would not meet sight distance requirements without a significant construction cost of lowering the crest of 28th Avenue South. City staff has determined that a vehicular access connection to Military Road South is not feasible due to sight distance concerns, and to WSDOT involvement. Staff has also determined that this connection is not desirable due to the possibility of potential for cut -through traffic. The site will have at most 29 single family lots, thus creating approximately 290 average daily trips. The proposed single -access design can accommodate this development's proposed amount of traffic with a Street Cross Section Type "W" if the first block (from 28th Avenue South to the internal intersection approximately 170 feet east) does not have any on -street parking. The more specific reasons for the City's decision are stated in FWCC 22-1477(1) the improvement as required would not ... function properly or safely or would not be advantageous to the neighborhood or the city as a whole, and FWCC 22-1477(2) Unusual topographic or physical conditions preclude the construction of the improvements as required, and FWCC 20-180(e.3) adjacent development is not being conducive. Specifically, the request addresses three items. Those items are as follows: 1. You are requesting relief from vehicular block perimeters, which shall be no longer than 2,640 feet for motorized circulation. This would require an east -west vehicular connection from 281h Ave. S. to Military Road S. This would require an east -west pedestrian connection from 28th Ave. S. to Military Road S. Reference FWCC 20-151(d), FWCC 20- 156(a) and (c), PWDS 1.3.2(c.4), PWDS 1.3.4(c) and PWDS 3.2.11. 3. You are requesting relief from the requirement to provide two access connections to the public street system if the development generates more than 250 trips per day (25 single family lots). These codes also require a Street Cross Section Type "U" for an average daily traffic of between 250 and 500 trips. With Street Cross Section Type "W", this would require a preferred secondary connection from the site to Military Road S., or a non -preferred dual access from the site to 28th Ave. S. The other alternative is a Street Cross Section Type "U" with one access point to the existing right-of-way. Reference PWDS 1.3.2(c.5), FWCC 22-1474, FWCC 22-1528. After evaluating the existing conditions along the referenced streets, review of FWCC provisions, and direction provided by the City Council, the Public Works L:\CSDC\DOCS\SAVE\3409561077. DOC Department hereby makes the following decisions regarding the requirements for the street improvements as follows: 1. Vehicular Block Perimeters. This modification request has been approved, and the requirement has been waived. In order to meet this requirement, the site would need a vehicular connection from 28th Ave. S. through the site to Military Road S. WSDOT limited access right-of-way abuts the eastern edge of the property, leaving a small area where the property abuts Military Road S. right-of-way where the City has jurisdictional control . This proposed road connection to Military Road S would occur on the northeast corner of the site. This vehicular connection could promote and have a potential for cut -through traffic. The WSDOT limited access for I-5/Military Road S. overpass will create possible sight distance and channelization issues for a road intersection at this location. The more specific reasons for the City's decision are stated in FWCC 22-1477(1) the improvement as required would not be harmonious with existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or the city as a whole, and FWCC 22-1477(2) Unusual topographic or physical conditions preclude the construction of the improvements as required, and FWCC 20-180(e.3) adjacent development is not being conducive ems_ 2. Pedestrian and Non -Motorized Block Perimeters, This modification request has been denied. The development shall provide an east -west pedestrian connection from 28" Ave. S, to Military Road S. through a combination of internal roads and Street Cross Section Type 'ZZ: As stated above, the connection location would be at the northeast corner of the site. The connection to Military Road would allow pedestrian traffic coming from Military Road S. to travel to the west, creating a quicker and easier pedestrian route towards the city center area and to Steel Lake Park. A pedestrian connection from the site to Military Road S. pavement can safely and technically be made by the development with no required permission from WSDOT. The channelization of Military Road S. would not need modified, and sight distance is not an issue with a pedestrian connection. The location of the proposed storm water pond can be moved to the west or the south to accommodate the required 20-foot cross section. The Citydoes not believe that this c-opR &'' -- meets any of the modification requirement criteria contained in FWCC 22-1477 or FWCC 20-156(c). ❑ual Access Connections and Street Cross Section Type "U". This modification request has been approved. The development shall provide one access connection from the site to 28`h Ave. S, that meets sight distance criteria and safety requirements All internal roads may be designed and constructed to Street Cross Section Type "W': No on -street parking will be allowed from the new road intersection with 28'h Ave. S. to the internal loop road intersection approximately 170 feet east. You have demonstrated through submitted information and analysis that a northerly access point to 28th Ave. S. would not meet sight distance requirements without a significant construction cost of lowering the crest of 28th Ave. S. City Staff has determined that a vehicular access connection to Military Road S. is not feasible due to sight distance concerns, and to WSDOT involvement. Staff has also determined that this connection is not desirable due to the possibility of potential for cut -through traffic. The site will have at most 29 single family lots, thus creating approximately 290 average daily trips. The proposed single -access design can accommodate this development's proposed amount of traffic with a Street Cross Section Type "W" if the first block (from 28th Ave. S. to the internal intersection L:\CSDC\DOCS\SAVE\3409561077.DOC approximately 170 feet east) does not have any on -street parking. The purpose of this request is to obtain a waiver from installing a required Type "ZZ" pedestrian connection between 28"i' Avenue South and Military Road South. This letter is thus the written formal request for modification mandated by Federal Way City Code (FWCC) 22-1477. Specifically, the applicant is requesting modification from FWCC 20-151(d), minimum block perimeter requirements. During the preapplication conference held January 25, 2007, discussions concerning FWCC 20-151(d) took place between the City of Federal Way's Development Review Committee (DRC) and the applicant. FWCC 20-151(d) states "Block perimeters should be no longer than 1,320 feet for nonmotorized access, and 2,640 feet for streets". The applicant is not proposing (nor wants) any direct access between the development and Military Road South. The DRC claims that per FWCC 20-151(d) access is required. When the Preapplication Conference Summary letter dated February 6, 2007 was received, item 11, Access and Traffic Circulation, under the heading Public Works Traffic Division (Raid Tirhi, PE), stated because of block perimeters ..."an east/west connection between 28 h Avenue South and Military Road would be required. However, in order to reduce the potential for cut -through traffic and due to the Washington State Department of Transportation (WSDOT) limited access for I-5/Military Road bridge and possible sight distance and channelization issues, the Traffic Division determined that only a type "ZZ" pedestrian connection would be required. A modification request may be submitted to the Public Works Director to modify or waive this requirement..." From these statements the DRC is essentially modifying FWCC 20-151(d) by eliminating half of its requirements. The applicant strongly believes due to the circumstanc that the other half of the requirements should also be eliminated. Ed %vw JUL 1 6 2007 CITY OF FEQWd36d.dm BUILDING DEPT.' FWCC 22-1477 gives four reasons that allows for modifications or waivers to be granted to projects. The proposed project has three separate issues with reason one. First, is a pedestrian connection (path) from a new fully improved (curbs, sidewalks, street lights, etc.) residential street to the guard railed shoulder of an existing principal arterial with no curb or sidewalk, (basically a non -friendly pedestrian environment) a "harmonious" joining of improvements? Second, there is an issue of safety. The Traffic Division Engineer has already stated there is a possible sight distance problem on this section of Military. Because of a drainage ditch, I-5 overpass bridge piers and WSDOT right-of- way restrictions (absolutely no access to I-5 right-of-way per Felix Paliso, WSDOT, Northwest Region) pedestrians are forced to walk on the shoulder, along an outside curve, between a guard rail and lanes of traffic. This is a dangerous situation. By providing this connection, a path is open that could allow children from homes in the development to put themselves in jeopardy. The final issue the project has with reason one is that of security. By requiring this access, a backyard alley way for crime is made available. Theft, vandalism, litter, etc would all most likely increase. In this case, the applicant feels the benefits of not having the connection are far more advantageous to the proposed neighborhood than the potential risks involved with having one. Reason two allows for a waiver to be granted if unusual topographic or physical conditions exist. The project site is a relatively square shaped piece of land that is approximately 6.72 acres in size. It is bounded on the north and south by private properties. For nearly 400 feet of its approximate 500 foot eastern property line the site abuts state owned right-of-way which contains 1-5. This land is non -accessible. Only about 110 feet of frontage exists between the Military Road right-of-way and the northeast comer of the site. This is also the natural location for discharge from the site, as topographically the northeast corner has the lowest elevations. Logically, this would dictate that the detention pond be located here. Per the preliminary site plan, this is exactly how the design of the development is foreseen. The applicant feels that screening and/or isolating the eastern site boundary (for obvious visual and noise reasons), and focusing the development west towards Steel Lake / Steel Lake Park and access onto 281' Avenue South, would be much more advantageous. The required Military Road connection would then have the added complexity of having to negotiate around the proposed detention pond. The applicant believes the project, and ultimately the citizens of Federal Way who will live here in the finished development, will be better served without having a pedestrian connection between 28`h Avenue South and Military Road located here. In summary the applicant would ask that the Director please review this modification request and carefully consider what the impacts would be of requiring a minimum nonmotorized block perimeter standard to this project. In light of the fact that the DRC has already ruled that a minimum street block perimeter would not be required, the applicant feels justified in asking for this modification and is confident upon examination of the circumstances that the director will grant its approval. 2 06066 Block Mod.doc If you determine it would assist you to meet with the project owners and/or myself, we would be willing to gladly arrange for that at your convenience. In summary the applicant would ask that the Director please review this modification request and carefully consider what the impacts would be of requiring a minimum non - motorized block perimeter standard to this project. In light of the fact that the DRC has already ruled that a minimum street block perimeter would not be required, the applicant feels justified in asking for this modification and is confident upon examination of the circumstances that the director will grant its approval. With a revision to the proposed preliminary plat layout that eliminates the initial northerly internal road access onto 28th Avenue South due to limited sight distance the preliminary plat now has only one ingress/egress point located at the original southerly access point. With this modification it was pointed out by City Staff that with the internal road looping back to itself the traffic levels are such that it would warrant a larger street section that the original "W" Street section proposed for that portion where all of the project trips will combine. The section being approximately 145 feet in length between the 28th Avenue South right-of-way (ROW) and the internal road intersection at STA: 12+47.47. During a September 20, 2007 meeting to discuss limited sight distance options with City Staff it was agreed that the "W" Street section could be maintained over this section of the internal road if there was to be no parking on either side of the street. It was agreed that by restricting the parking it would allow for sufficient pavement width to address combined traffic volume from the proposed 28 single-family homes and the ingressing and egressing turning movements at the proposed entrance to allow for safe unrestricted maneuvering within the throat of the entrance to the plat. The proposed revision to the preliminary plat layout has already reduced the proposed lots from 29 to 28 single-family units. If required, an increased street section in this access throat for the project would require the elimination of another single-family residence due to the geometric configuration of the existing parcel boundary and the necessity for the project to dedicate additional 9-feet for public ROW and provide a 10-foot private landscape tract adjacent to the 28th Avenue South ROW. In summary we are in agreement with City Staff that by eliminating the parking in the throat of the project internal road a "W" Street section will provide sufficient and safe maneuvering area for vehicles to safely ingress and egress the project without inhibiting vehicle movements along 281h Avenue South. In light of the mutual agreement between City Staff and the applicant, we feel justified in asking for this modification and we are confident upon examination of the circumstances that the director will grant its approval. 3 06066 Block Mod 071102.doc If you determine it would assist you to meet with the project owners and/or myself, we would be willing to gladly arrange for that at your convenience. Specifically, the applicant is requesting modification from FWCC 20-151(d), minimum block perimeter requirements and to allow a "W Street section at the remaining entrance to the plat as preliminarily verbally approved by City Staff during the Septet 20, 2007 meeting held at the City to discuss sight distance alternatives for the project. r During the preapplication conference held January 25, 2007, discussions concerning FWCC 20-151(d) took place between the City of Federal Way's Development Review Committee (DRC) and the applicartt. FWCC 20-151(d) states "Block perimeters should be no longer than 1,320 feet for nonmotorized access, and 2,640 feet for streets". The applicant is not proposing (nor wants) any direct access between the development and Military Road South. The DRC claims that, per FWCC 20-151(d) access is required. When the Preapplication Conference SummAry letter dated February 6, 2007 was received, item 11, Access and Traffic Circulation, under the heading Public Works Traffic Division (Raid Tirhi, PE), stated because of block perimeters ..."an east/west connection between 28'h Avenue South and Military Road would be required. However, in order to 06066_Block Mod 071102.doc reduce the potential for cut -through traffic and due to the Washington State Department of Transportation (WSDOT) limited access for I-5/Military Road bridge and possible sight distance and channelization issues, the Traffic Division determined that only a type "ZZ" pedestrian connection would be required. A modification request may be submitted to the Public Works Director to modify or waive this requirement..." From these statements the DRC is essentially modifying FWCC 20-151(d) by eliminating half of its requirements. The applicant strongly believes due to the circumstances stated below that the other half of the requirements should also be eliminated. FWCC 22-1477 gives four reasons that allows for modifications or waivers to be granted to projects. For nearly 400 feet of its approximate 500 foot eastern property line the site abuts state owned right-of-way which contains I-5. This land is non -accessible. Only about 110 feet of frontage exists between the Military Road right-of-way and the northeast corner of the site. This is also the natural location for discharge from the site, as topographically the northeast corner has the lowest elevations. Logically, this would dictate that the detention pond be located here. Per the preliminary site plan, this is exactly how the design of the development is foreseen. The applicant feels that screening and/or isolating the eastern site boundary (for obvious visual and noise reasons), and focusing the development west towards Steel Lake / Steel Lake Park and access onto 28th Avenue South, would be much more advantageous. The required Military Road connection would then have the added complexity of having to negotiate around the proposed detention pond. 2 06066 Block Mod 071102.doc The applicant believes the project, and ultimately the citizens of Federal Way who will live here in the finished development, will be better served without having a pedestrian connection between 28`h Avenue South and Military Road located here. The section being approximately 145 feet in length between the 28 h Avenue South right-of-way (ROW) and the internal road intersection at STA: 12+47.47. If required, an increased street section in this access throat for the project would require the elimination of another single-family residence due to the geometric configuration of the existing parcel boundary and the necessity for the project to dedicate additional 9-feet for public ROW and provide a 10-foot private landscape tract adjacent to the 28`h Avenue South ROW. In summary we are in agreement with City Staff that by eliminating the parking in the throat of the project internal road a "W" Street section will provide sufficient and safe maneuvering area for vehicles to safely ingress and egress the project without inhibiting vehicle movements along 28a' Avenue South.
