Please incorporate into your letter to the applicant: This is a response to your January 24, 2008 letter requesting the City to reconsider a waiver of the pedestrian and non -motorized block perimeter requirement. We apologize we are unable to grant you such modification for the following reasons: As indicated before, per FWCC 20-157, the connection is required. The City does not believe that this connection meets any of the modification criteria contained in FWCC 22-1477. There are several Comprehensive Plan Policies that encourage the use of non motorized trips including and not limited to the following: TP29: Reduce reliance on the single occupant auto by prioritizing and implementing supportive local -level transit, HOV, and non -motorized improvements. TP 30: Identify and plan for multi -modal freeway, arterial, and collector street improvements which ensure more efficient use of existing roads and enhancement of HOV, transit, and related non - motorized operations. TP52: Work to extend the existing system of sidewalks, bikeways, and equestrian ways in the city to provide safe access to public transit, neighborhood and business centers, parks, schools, public facilities, and other recreational attractions. Now that the City has temporarily granted your project the other modifications you requested (eliminating the vehicular access to the east and eliminating the second access point to resolve sight distance), the need for this pedestrian connection becomes more crucial. From a safety point of view, this connection could be used as an emergency access if 28'b Avenue S is blocked in a natural disaster or any other reason. The connection may also encourage the use of other modes of transportation including walking and transit. The pedestrian connection would be required to have a low level illumination that would not necessarily be attractive to intruders to the proposed neighborhood. Hence, would be designed to be a safe connection. Finally, attached is a general information sheet titled "The Transportation System and Street Connectivity". You may find it helpful to understand the position we are taking. Specifically, the request addresses three items, which are as follows: 1. You are requesting relief from vehicular block perimeters, which shall be no longer than 2,640 feet for motorized circulation. This would require an east -west vehicular connection from 281h Avenue South to Military Road South. Reference Federal Way City Code (FWCC) 20-151(d), FWCC 20-180(e), Public Works Development Standards (PWDS) 1.3.2(c.4), and PWDS 3.2.11. 2. You are requesting relief from pedestrian and non -motorized block perimeters, which shall be no longer than 1,320 feet. This would require an east -west pedestrian connection from 28`h Avenue South to Military Road South. Reference FWCC 20-151(d), FWCC 20-156(a) and (c), PWDS 1.3.2(c.4), PWDS 1.3.4(c) and PWDS 3.2.11. You are requesting relief from the requirement to provide two access connections to the public street system if the development generates more than 250 trips per day (25 single family lots). These codes also require a Street Cross Section Type "U" for an average daily traffic of between 250 and 500 trips. With Street Cross Section Type "W", this would require a preferred secondary connection from the site to Military Road South, or a non -preferred dual access from the site to 28`h Avenue South. The other alternative is a Street Cross Section Type "U" with one access point to the existing right-of-way. Reference PWDS 1.3.2(c.5), FWCC 22-1474, FWCC 22- 1528. FWCC 22-1477; Modifications, deferments and waivers allows the Public Works Department to grant a request to modify, defer, or waive the required street improvements only after consideration of four specific reasons. FWCC 20-156(c) and 20-180(e) allow the requirement to provide vehicular and pedestrian block perimeters to be modified only after consideration of three specific reasons. After evaluating the existing conditions along the referenced streets, review of FWCC provisions, and direction provided by the City Council, the Public Works Department hereby makes the following decisions regarding the requirements for the street improvements as follows: L:\CSDC\DOCS\SAVE\3409561077-DOC Mr. Brant Schweik], P.E. This modification request has been approved, and the requirement has been waived. In order to meet this requirement, the site would need a vehicular connection from 28`h Avenue South through the site to Military Road South. WSDOT limited access right- of-way abuts the eastern edge of the property, leaving a small area where the property abuts Military Road South right-of-way where the City has jurisdictional control. This proposed road connection to Military Road South would occur on the northeast corner of the site. This vehicular connection could promote and have a potential for cut -through traffic. The WSDOT limited access for I-5/Military Road South overpass will create possible sight distance and channelization issues for a road intersection at this location. The more specific reasons for the City's decision are stated in FWCC 22-1477(1) the improvement as required would not be harmonious with existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or the city as a whole, and FWCC 22-1477(2) Unusual topographic or physical conditions preclude the construction of the improvements as required, and FWCC 20-180(e.3) adjacent development is not being conducive. 2. Pedestrian and Non -Motorized Block Perimeters. This modification request has been denied. The development shall provide an east -west pedestrian connection from 28'h Avenue South to Military Road South through a combination of internal roads and Street Cross Section Type "ZZ". As stated above, the connection location would be at the northeast corner of the site. The connection to Military Road South would allow pedestrian traffic coming from Military Road South to travel to the west, creating a quicker and easier pedestrian route towards the city center area and to Steel Lake Park. A pedestrian connection from the site to Military Road South pavement can safely and technically be made by the development with no required permission from WSDOT. The channelization of Military Road South would not need modified, and sight distance is not an issue with a pedestrian connection. The location of the proposed storm water pond can be moved to the west or the south to accommodate the required 20-foot cross section. The City does not believe that this connection meets any of the modification requirement criteria contained in FWCC 22-1477 or FWCC 20-156(c). 3. Dual Access Connections and Street Cross Section Type "U". This modification request has been approved. The development shall provide one access connection from the site to 28'h Avenue South that meets sight distance criteria and safety requirements. All internal roads may be designed and constructed to Street Cross Section Type "W". No on -street parking will be allowed from the new road intersection with 28'h Avenue South to the internal loop road intersection approximately 170 feet east. You have demonstrated through submitted information and analysis that a northerly access point to 28"' Avenue South would not meet sight distance requirements without a significant construction cost of lowering the crest of 28`h Avenue South. City staff has determined that a vehicular access connection to Military Road South is not feasible due to sight distance concerns, and to WSDOT involvement. Staff has also determined that this connection is not desirable due to the possibility of potential for cut -through traffic. The site will have at most 29 single family lots, thus creating approximately 290 average daily trips. The proposed single -access design can accommodate this development's proposed amount of traffic with a Street Cross Section Type "W" if the first block (from 28`h Avenue South to the internal intersection approximately 170 feet east) does not have any on -street parking. I am writing with regard to your denial of our request to waive the pedestrian and non -motorized vehicle path that would potentially connect Military Road South and 28"' Avenue South through the proposed plat. In particular, I would like to comment on the cited reference to both the safety and convenience of the citizens of Federal Way. In my opinion, citizens of Federal Way walking southbound on Military Road would have no easier or quicker access to either the City center or Steel Lake park by bypassing the South 304th to 28"' Ave South route and walking further south to connect with a pedestrian walkway from Military Road S. to 2Wh Ave South. There are no sidewalks on either side of Military from South 304th to our property. Additionally, Pat's Plumbing, located on the west side of Military in this area has upwards of 30 service vehicles coming and going out of their place of business from early morning until late afternoon and evening. This is definitely not a safe situation for pedestrians. Individuals that might be coming under the freeway overpass from the area east of Interstate 5 might have quicker and easier access (though certainly not safer) but at the present time they are not citizens of Federal Way. Also, in my opinion, the "access" itself presents a safety factor for those new citizens of Federal Way that will be living in the Steel Lake Crest Subdivision. We have lived in this location for over 30 years. In that period of time we have been robbed twice. Both times the perpetrators accessed our home from Military Road South through the back of our property where there was no obvious view of them from anyone who might have noticed and contacted the authorities. We are now looking at a subdivision, whose residents would not be well -served by having obscured "easy' access from Military Road South provided to their homes via a pedestrian pathway for any unsavory persons who might be so inclined to use it. If I were going to live in this development I would not be happy about opening myself up to this vulnerability. And guess I have to ask you what your thoughts would be if you were planning to make your home in Steel Lake Crest? This being said, it would be appreciated if you would reconsider your ruling and approve our modification request.
