The Community and Economic Development Department has received your request to allow the
continued use of the vegetation maintenance plan approved for the Buena greenbelt area. The
maintenance plan was originally approved October 21, 1998.
The department has concluded the approved maintenance plan remains valid and is similar in scope to
what was originally approved. Ongoing maintenance of the area will not require new approval if the

property and our neighbors on each side of us. As we discussed, this area

removal is the only real treatment. We have received permission from the owner of the trees.
We would have this done by an appropriate professional with clean up of the branches and with
as little disturbance -of the existing vegetation as possible. Enclosed is a diagram (not to scale) of,
the area and the approximate location of the trees.
We request consideration of this as soon as possible as these trees will be leafing soon and -the
project will be more difficult.

SUBJECT: Temporary Encroachment in Environmentaly Sensitive Area Setback for
Vegetation Control and View Enhancement;
Interpretation
Temporary intrusions within an environmentally sensitive ;area (ESA) buffer are not
specifically contemplated in the Federal Way City Code (FWCC). Traditionally, temporary
intrusions into environmentally sensitive area setbacks ha�e been reviewed subject to the
underlying land use process identified for constructing structures or improvements within an
ESA setback area (Process IV).
Under certain circumstances such as temporary ESA setback encroadhment for view
enhancement and minor vegetation control projects, an extensive review is not warranted and a
Process I (Administrative Review) is most appropriate unless the Director of Community
Development Services determines the nature of the proje4 is so minor, that no formal review
process is required by the City. Process I review equals t�e process identified for minor
improvements in wetland or stream setback areas (FWCC 22-1359(c) & 22-1312(b)).

Discussion
The City has received an increasing number of inquiries regarding vegetation control and view
enhancement within environmentally sensitive area setbacks. Vegetation management projects
which are well designed and executed should result in minimal impact on the function and
quality of ESA setback areas when established guidelines are followed. Temporary vegetation
control projects in an ESA setback shall be reviewed through Process I review and subject to
minimum application requirements and decisional criteria listed below, unless the Director of
Community Development Services determines the nature f the projecris so minor, that no
formal review process is required by the City. r

Dear Mr. Bollaert,
Thank you for the opportunity to serve as your tree care consultants. After reviewing
your site, the objectives that you would like to obtain, and the City requirements, I am
confident that we can help obtain those objectives. Please find below a vegetation
management plan for the numerous alder saplings that have encroached upon your view.
I believe that this plan addresses all of the criteria required by the City.
VEGETATION MANAGEMENT PLAN
The scope of work on this project is the removal of approximately 125 alder saplings in
the storm drainage below your home. There are too many trees to individually identify
on a map; the shaded area on the map denotes the limits of the cuttiiqg area. These trees
are all volunteers; they were not planted nor planned, but simply seeded this area as
pioneer vegetation following the completion of the storm Fain system. The trees will be
cut off close to ground level with chainsaws and removed from the site. They will then
be chipped and hauled away. The stumps will either sprout new growth or be replaced by
new seedlings.
There are only 3 or 4 significant trees on this entire site; none will be cut or trimmed.
There will be no net loss to the function of the tree canopy from this activity. The trees in
question are not yet large enough to be considered a forest. The area to be cleared is too
small to affect the overall vegetative quality. Invasive non-native plants such as
blackberry have already reclaimed most of this area. Native plants in the cutting area
such as ferns and red elderberry will not be damaged.
DECISIONAL CRITERIA
1) The saplings to be removed, 1— 5" in diameter have nol been in place long enough to
have acquired much in the way of water quality improvbment. The trees in question
only Iine the streambed for a distance of about 25 feet. The area to be cleared is in
the least sloped portion of the site. Ample ground vegetation will continue to perform
water retention and erosion control purposes.

2) This is not a significant habitat area. Several potential nesting; trees -are on this site,
but are at least 150 feet from the cutting area.
3) This area is a stormwater drainage area and'was developed as such; the trees in
question do not enhance or impede that function.
4) The steep slope areas do not have trees to be out, and, since this area is, by and large,
manmade, it is likely that the drainage_ was engineered so as to eliminate unstable
earth conditions.
5), 6) This plan provides a means to effectively return the view vista to nearly the level
present following the initial stream bed improvements to provide an adequate stormwater
drainage system. All of the large native trees were either removed then or shortly
thereafter due to decline, death or safety issues. This left a scarified surface upon which
several pioneer species inhabited, including alder, blackberry, grasses, ferns, elderberry
and salmonberry. It is my opinion that these trees have nod been established long enough
to have significantly enhanced this environmentally sensitive area, nor will their removal
be detrimental.

The Department of Community Development Services rece' fed your application on June 30,
1998, to remove some trees in an environmentally sensitive a at the above referenced ,
property. You had 'contacted the city earlier in May, 1997. regarding topping some trees. In
response to your earlier request an interpretation was made by the Director of Community
Development Services to allow temporary encroachments in environmentally sensitive area
setback for vegetation control and view enhancement.
Your current proposal far exceeds the original proposal. The original scope of work was to top
some existing trees. You currently plan to remove about 125 alder saplings. This type of
intrusion within an environmentally sensitive area buffer is addressed by Federal Way City Code
(FWCC) Article XIV. Per FWCC Sections 22-1312 and 22-1359, Process IV (Hearing Examiner
Approval) is the required review process for intrusions into stream and wetland setbacks.
If you want to pursue your current proposal, it cannot be approved under Process I.. You will
need to reapply and meet submittal requirements for Processi IV. Under Process IV the hearing
examiner will make the decision following a public hearing. Please refer to the enclosed Process
IV Handout and Development Application Requirements Submittal Checklist for details.
Processing fee for Process IV is $2,173.
If the scope of work is just to top some trees ,you will need tv modify the current proposal and
provide the following application material in order to further process your application:
A) Owner authorization.
B) A planimetric map, at appropriate scale, denoting the location, type, and caliper of
all trees on the subject property.

Thank you for your reply regarding the topping clearing of trees in the
environmental) sensitive area west of our home to regal our sound view. I was not

fully aware that the arborist wrote the report to remove the trees which was not our
intention as we enjoy the greenbelt but not the height.
I am resubmitting a Process I application with a new report prepared by a
certified arborist, which requests topping of the trees for view restoration. The long
range plan proposed is to have to top the trees every few years to maintain the view but
keep the esthetics of the greenbelt.
Please advise us if any additional information is required. We look forward to

Rebecca Bollaert of 306 S.W. 293' Street, Federal Way has apparently
requested permission from the City of Federal Way to but, trim, top or remove trees
and/ or other vegetation that is blocking Rebecca's view of Puget Sound. Apparently
permission of the city is necessary as some of the trees and or\vegetation involved lies
adjacent to what the City of Federal Way has determined to be a "minor stream."
My partner/owners of the real property involved., hereby notify you that we have
no objection to the cutting, trimming, topping or removal of the said vegetation and trees
so long as Rebecca has the permission from the City of Federal Way and will bear the
cost of the work and the cost of the removal of the trimmings and/or debris from the
property.

Dear Ms. Kliskey and Mr. Bollaert:
The city has completed a review of the proposal submitted on June 30, 1998, to top some frees in
an environmentally sensitive area at the above referenced property. A revised application was
received on October 5, 1998, and additional documentation was submitted on October 14, 1998.
Based on review of the Process I application, the proposal to{top existing alder trees in the area
identified in the enclosed plan and photographs is administratively approved.
The specific proposal is to top some existing alder trees for view enhancement at the above
referenced property. The proposed view enhancement/vegetation control project is located within
an environmentally sensitive area (stream setback). Temporary intrusions within an
environmentally sensitive area buffer are not specifically discussed in the Federal Way City
Code (FWCC). However, a July 31, 1997, administrative interpretation was written to address
temporary encroachments into environmentally sensitive areas for vegetation control and view
enhancement.
The proposal meets the decisional criteria established by the July 31, 1997, interpretation. The
topping of existing trees will not affect the water quality as the tree stems and ground vegetation
are not proposed to be removed. The proposal will not destroy or damage a significant habitat
area. It will also not create unstable earth conditions or erosion hazards, nor will it affect
drainage or storm water retention capabilities as the trees will' only be topped and not removed.
Additionally, topping of these trees is necessary to maintain a pre-existing scenic vista/view
corridor.
Based on review of the Process I application, the proposal to top existing alder trees in the area
identified in the enclosed plan is administratively approved. The enclosed photographs show the
approved extent of tree canopies to be topped. This approval i� not for removal of trees. During
the process of topping the trees, disturbance to the ground vegetation should be minimized.

After topping the trees, please call (253) 661-4082 to schedule an inspection by the city's
Planning Division. The long term vegetation controllmainteriance strategy of topping the trees
every couple of years to maintain the same height needs no aidditional approval. However, if the
scope of the project changes, additional approval will be required.
This decision shall not waive compliance with future City of Federal Way codes, policies, and
standards relating to this project site. The effective date of decision is October 23, 1998. Pursuant
to FWCC Section 22-356, any person who received notice of'the administrative decision may
appeal this decision to the Federal Way Hearing Examiner b�, November 6, 1998.
Hourly Process I application fees of $120 are now due (three hours at $40 per hour). Please be
advised that no work is to be performed until the appeal period is completed and Process I
application fees are paid.

It is my turn to implement the 2009 view enhancement program for
neighbors on 3rd Avenue SW. I am particularly interested in the process,
as Bill and I will soon be selling our home. The water/mountain view will
be the featured selling point for our home, as it; was when we purchased
it in August 1999. We have appreciated the past ten years of working
collaboratively, which began January 1999, followed by 2002 and 2005
when the Alverson's joined this neighborhood process, and now January
2009. We need the greatest financial return possible from the home sale
to enable our next move which is to a retirement community with
assisted living. We are sad to be leaving such wonderful neighbors and
friends and I am sure you can relate to the changes that lie ahead for us
all.
I have retained Thundering Oak (formerly Arbor can), Certified Arborists,
for Tuesday, Wednesday or Thursday Oanuary 2 , 21, or 22) who
successfully completed the work in 1999, 2002land 2005. While topping
the trees to maintain the view, they will keep the esthetics of the
greenbelt, including being thorough in their attention to details, such as
cleanup. Their Vegetation Management Plan first submitted in 1998
describes this in detail. I have attached this and- other documents from
1997 to 2009 related to this storm drain area (which you probably have
but just making sure you have them for review). As in the past, 3rd Ave.
SW families will pay costs.

Dear Mrs. Dobson,
Thank you for the opportunity to serve your tree care needs. After reviewing your site
three years after the work that we did in 1999, I am confi4ent that we can help obtain the
same objectives within the City requirements. The vegetation management plan below
has been slightly modified to account for the trimming done earlier and the current needs.
I believe that this plan addresses all of the criteria required by the City.
VEGETATION MANAGEMENT PLAN
The scope of work on this project is the trimming of approximately 70 alder saplings in
the storm drainage below your home. There are too many trees to individually identify
on a map; the cutting area encompasses all previously cut trees as well as younger
saplings that have now encroached into the view corrmidorl These trees are all volunteers;
they were not planted nor planned, but simply seeded this area as pioneer vegetation
following the completion of the storm drain system. Theltrees will have from to'/Z of
the foliage -bearing stem removed. All cut material will be cleared from the drainage area
and chipped. Contractor will dispose of chips off site. !
There are only 3 or 4 significant trees on this entire site; lone will be cut or trimmed.
There will be no net loss to the function of the tree canopy from this activity. The trees in
question are not yet large enough to be considered a forest. The area of trees to be
trimmed is too small to affect the overall vegetative quality. Invasive non-native plants
such as blackberry have already reclaimed much of this area. Native plants in the cutting
area such as ferns and red elderberry will not be damaged.
DECLSIONAL CRITERIA
1) The saplings to be trimmed, 1— 6" in diameter, have not been in place long enough to
have acquired much in the way of water quality improvement. The trees in question
only line the streambed for a distance of about 25 feet. The area of trees to be
trimmed is in the least sloped portion of the site. Remaining roots and tree stems,
combined with ample ground vegetation will continue to perform water retention and
erosion control purposes.

2) This is not a significant habitat area. Several potential nesting trees are on this site,
but are at least 150 feet from the cutting area.
3) This area is a storm water drainage area and was developed as such; the trees in
question do not enhance or impede that function.
4) The steep slope areas do not have trees to be cut, and, since this area is, by and large,
manmade, it is likely that the drainage was engineered so] as to eliminate unstable
earth conditions.
5), 6) This plan provides a means to effectively return the view vista to nearly the level
present following the initial stream bed improvements to prof ide an adequate stormwater
drainage system. All of the large native trees were either removed then or shortly
thereafter due to decline, death or safety issues. This left a scarified surface upon which
several pioneer species inhabited, including alder, blackbenyb grasses, ferns, elderberry
and salmonberry. It is my opinion that these trees have not been established long enough
to have significantly enhanced this environmentally sensitive !area, nor will the trimming
of several segments to regain some of the original view corridor be detrimental.
