Dear Mr. Irwin:
The Planning Division has reviewed your Shoreline Exemption received April 5, 2017. You propose to
repair a non -conforming shoreline frontage (board replacement, piling sleeves, a new cedar fascia, and
resurface dock with thruflow grated paneling for light penetration, and replace dock framing).
Per city records and on April 17, 2017 staff observed unpermitted improvements within the 50 ft.
shoreline setback including (Figure 2):
➢ Perimeter fencing
➢ Shoreline native vegetation removal
➢ Replacement concrete steps
➢ A new and replaced slate patio area
within the buffer area
➢ New paver retaining walls replacing
existing wooden rail -road ties

On February 5, 2016, the Community Development Department received your Administrative Decision
request (city file 16-100694-AD) to clarify allowable development and permitting requirements within the
shoreline. The city issued the enclosed letter on March 14, 2016, outlining shoreline permit requirements
for landscaping, a new stairway, building development within the drainage flow -path segment and dock
repair. In conclusion, a "Shoreline Substantial Development Permit Exemption application is required to
be submitted along with a site plan and supporting documentation of the proposed landscaping work."

Please submit a narrative describing all work performed without permits, 200 feet landward of the
ordinary high water mark from 2016 to 2017.
2. Environmental Review — An Environmental Checklist will not be required for this proposal per
WAC 197-11-800(3) exemption, "Repair, remodeling and maintenance activities. "
Sheet 2 - Dock Profile — Depict the correct OHWM. The OHWM must be shown landward of the dock.
4. Please list tb- lot coverage of all improvements. Lot coverage, including gravel areas, cannot exceed
60% of the total lot area per FWRC 19.110.020.
5. Shoreline Setback — On the plans, list the cumulative coverage (square feet) within the 50 ft. setback,
including the patio area, block retaining wall, steps, widened gravel pathway and gravel placed on
the beach. The setback is measured from the OHWM landward. Structure footprints and impervious
surfaces are limited within the 50 ft. shoreline setback to 150 sq. ft./structure and 300 sq. ft. for all
impervious surfaces.
Provide proof or documents showing the original impervious area of the non -conforming patio.
Pursuant to FWRC 15.05.220, structures that were legally established and are used for a conforming
use but which are nonconforming with regard to setbacks and density may be maintained and
repaired but cannot be enlarged if it increases the extent of the nonconformity. Additions or,
increases in size of existing structures shall not be considered replacements.
6. Shoreline Mitigation — Please discuss proposed shoreline mitigation pursuant to FWRC
15.05.090(3)(f) and FWRC 15.05.40. The applicant has removed vegetation on the eastern property
line. You may mitigate the removal by replanting and adding native vegetation within the shoreline
setback. A plan shall be prepared by a qualified professional (i.e. biologist or landscape
architect/designer).
FWRC 15.05.070(5) requires applicants conserve a minimum of 70% of native vegetation and 70%
of native trees in the setback and per FWRC 15.05.220 a shoreline modification cannot make the
development more non -conforming.
7. Please reduce the gravel path to the shoreline to the original width. Work within the shoreline cannot
make the property more non -conforming.
8. Chemically treated wood is prohibited in fresh water. Please revise the proposed dock material
(FWRC 15.05050.2 and 15.05.070.5).
9. The removal of an existing wood retaining/railroad tie wall, planter removal, and concrete patio
replacement was not within the scope of permits 14-101247-SF and 14-101262-SH. Per FWRC
15.05.020(2) no development shall be undertaken by any person on the shorelines of the State

without obtaining a shoreline permit from the Community Development Department, or an
authorized statement of exemption.

Good morning,
This email is a follow-up on some questions you had at a site visit meeting on April 17, 2017. Please find the attached
shoreline exemption, photos, and application content requirements. After reviewing the narrative sent dated May 11,
2017, mitigation and restoration of the shoreline will be required including but not limited to native shoreline plantings
and reduction of footprint in the 50 ft. shoreline setback.
Work approved under the 2014 building permit and shoreline exemption does not include what currently exists.
The shoreline master program was in effect at the time of incorporation and under King County. The shoreline
management act was adopted in the 1970's as a way to protect biological processes along shorelines and improve water
quality. Although you are a relatively new owner, as the property owner, you unfortunately inherit any work performed
on the shoreline without permits or that does not comply.
Based on our permitting records and photos on file, it appears prior or current owners imported pea gravel/driveway
gravel — placing it past the ordinary high-water mark— defined as beach nourishment ( artificial replenishing of a beach
by delivery of materials dredged or excavated elsewhere). Beach nourishment is a type of soft -shore bank stabilization,
the softest effective alternative mush be used. Based on our codes unfortunately fill activities water -ward of the
ordinary high water mark (OHWM) are only permitted with a shoreline conditional use permit and based upon approval
criteria, requiring a Hearing Examiner Decision. You best and most expedient course of action is to remove non-native
imported materials.
Overall the SMP's direction is enforce no net ecological loss and reduce hardening of the shoreline. Crushed gravel is
considered impervious surface and does not infiltrate water and also "footprint". Impervious surfaces are limited in the
shoreline setback.

Nourishment
I will be forwarding my observations of a dock repair without permits on your neighbour's property. The city must
evaluate if their dock has been expanded, requires an HPA or was constructed with chemically treated wood/materials.
If you haven't already, please contact the Department of Fish and Wildlife for requirements and/or permits required to

Subject: Shoreline Substantial Development Permit Exemption Application
Location: 2203 S 304th ST, Federal Way WA 98003, Steel Lake
Property History: My home is the second or possibly the third house on this property. The
following information comes from neighbors who have lived next door to this property sincel964
(53 years). The previous home was demolished in 1993. Existing property improvements date
back at least to the early 1960s and include dock, patio, retaining wall with stairs and gravel
path leading to dock/lower yard. Over time, the existing improvements deteriorated and required
repair to be safe and to retain their intended function.
State shoreline regulations allow normal maintenance or repair of existing structures to restore
to a condition comparable to its original condition. (WAC 173-27-040(2)(b). Based on my
interpretation of applicable regulations and information provided to me by a city employee
(identity unknown), I did not apply for a permit for this work.
Work on the patio, retaining wall and path was completed in late November 2016. In February I
added a short fence after our dog left the back yard and was hit by a car on S 304th St. The
fence is 4 ft. high and 20 ft. long running on the west side of the property. Two native plants
along the fence line were not disturbed. This plan includes installation of native vegetation using
the Washington State Department of Ecology website, their publication "Blueprint for a Lake
Friendly Landscape" and the "Washington Lake Book" as guides for plant selection. See
diagram attached.
The following table describes existing and current condition of property improvements.

to the existing concrete patio, landscaping, gravel

The applicant has reconfigured the existing patio,
replaced the existing wooden retaining wall with a
block retaining, it appears fill was placed on the
shoreline overtime, installed fencing, removed flower
beds, added a concrete step into the water and added
more gravel/widen the existing path along the side -
yard to Steel Lake. Overall the applicant has increase
and changed the impervious area configuration with the
50 ft. shoreline setback from the Ordinary Highwater
Mark (OHWM) per permitting records. Applicant applied
for an administrative determination for an outline of
the permitting/ SMP requirements in 2015/2016. Their
consultant did receive a response letter from the
Planning Division, however work was done on the
shoreline without permits.
