After evaluating the existing conditions along the referenced street and surrounding neighborhood, review of Federal Way Revised Code (FWRC) provisions (Section 19.135.070), and direction provided by the City Council, the Public Works Department hereby waives the requirements for the street improvements. FWRC Section 19.135.070; Modifications of Improvements Along Property Frontage allows the Public Works Department to grant a request to modify, defer, or waive the required street improvements only after consideration of four specific reasons. The reason most applicable here is contained in FWRC 19.135.070(1), "Improvements as required would not be harmonious with existing street improvements, would not function properly or safely, or would not be advantageous to the neighborhood or city as a whole." S 308th Street is classified as a Minor Collector Street, corresponding to Federal Way Roadway Section "S". This roadway section requires a 36-foot paved roadway with vertical curb and gutter, 4-foot planter strips with street trees, 5-foot sidewalks, and 3-foot utility strip with street lights, all within a 60-foot Right of Way. Application of the required street improvements would result in an improved street section that is not harmonious with the existing street improvements along that street, which generally consists of a 25-foot paved roadway. The existing right of way along your property frontage is adequate in width; therefore, no additional right of way needs to be dedicated as part of your project. Please be advised that this decision is based on the proposal to subdivide one (1) lot into two (2), and construct 2 new single-family homes on the subdivision. Because the property is zoned RM3600 (multi- family residential), and therefore could be developed to the higher density, the City reserves the right to revisit this decision should we receive an application for multi -family development on this property. The conditions of this modification will be applicable for a period of one year from the date of this letter. The No -protest L.I.D. must be recorded at King County Records prior to issuance of preliminary short plat approval. Please return one (1) `Conformed' Copy of the L.I.D. The nearest curb, gutter and sidewalk on South 308th Street are approximately 360-feet west of the subject parcel. Requirements / Conditions of Approval Development Services staff recommends approval of the deferral/waiver of street improvements as part of the short plat and development of 2 detached single family homes, with the condition that if the developer decides to construct to a higher density (as the zoning allows), the City reserves the right to revisit this decision and may require the street improvements to be constructed as part of any type of multi -family development. Also require the owner record a `No Protest LID Covenant' on the property. The project is located at 1836 S. 308t St. An existing home has been removed to accommodate an even distribution of lot area. The project takes access from S. 308th St. The street frontage in the immediate area is rural in nature on both sides of the road. There are no sidewalks from 18th Ave S on the west to the termination of S. 308th Street at 24th Ave S. to the east Some sidewalks are present with the commercial development on the corner of HWY 99 and S. 308th St. Description of Modification Request. The Applicant requests to defer the requirements of FWRC Title 19, Chapter 135, "Development Improvements". The Applicant requests that the City defer the applicable frontage improvements because they would not be harmonious with existing street improvements and would not be advantageous to the neighborhood until such time as a larger scale capital improvement project is planned for the area. The project frontage comprises only 100' of almost 2000 LF of rural frontage in the neighborhood. The Applicant sees no benefit to disrupting the existing development pattern for such a small area. The applicant is willing to sign a no protest agreement for the formation of a future local improvement district in the area of S. 308th St. to support a more comprehensive improvement program.
