On January 12, 2010, the City granted the Song Kang Short Plat preliminary short plat approval subject to
a condition that open space fees are to be paid prior to short plat recording. In 2009, the City of Federal
Way adopted changes to mitigation payment methods that affect the above -referenced project. This letter
amends the timing and amount of open space payment for the Song Kang Short Plat.
Background
The three -lot Song Kang short plat was initially submitted to the city on August 20, 2003.' That
application was vested to those subdivision codes in effect at that time, including codes which allowed the
Parks Director to waive open space requirements for short plat projects.
Engineering, plans for the short plat were submitted in 2005 and reviewed concurrently with the short plat
application. Preliminary short plat approval was granted on November 22, 2005- Short plat approval is
valid for one year, and expired on November 22, 2006. No requests for extensions were received by the
City and engineering review and required improvements were not completed in time. Engineering review
however, inadvertently continued. The applicant was subsequently advised that in order to install
approved infrastructure, a new short plat application was required. On December 11, 2007, a new short
plat application was submitted.
The new short plat application was vested to those subdivision codes in effect at the time it was
submitted. The open space waiver option for short plats was no longer in effect; all subdivision
applications were required to provide on -site open space, or provide a fee in lieu of payment instead of
providing open space on site. Engineering authorization to proceed was granted on September 23, 2008.
Installation of the required engineering improvements was completed, and As-Builts were approved on
October 14, 2009. The new short plat application was granted preliminary short plat approval on January
12, 2010, subject to several conditions, including condition #4 which stated:
"Prior to recording, open space fees in the amount of.$12,600 or 15 percent of the assessed land
value as adjusted at the time of recording shall be paid to the City of Federal Way."

Amended Open Space Requirement
Located in a Single -Family Residential (RS7.2) zoning district, the Song Kang Short PIat consists of three
lots each being 7,492 square feet in size. After right-of-way dedication, available land for the subdivision
totaled 22,477 square feet, leaving no opportunity for suitable on -site open space. In the January 2010
decision, the City calculated an open space fee of $12,600.00 using the original land area and the 2009
King County land valuation. However, in that the need to re -apply for subdivision approval, and thus lose
vested rights that waived the open space fee, was partially the result of city actions, and that a portion of
the property has already been dedicated to the City for right-of-way purposes, an open space fee based on
the 2007 land value and the size of the property after dedication, or $9,962.92 is determined, by the parks
director, to be appropriate. This works out to $3,320.97 per lot.
The City's usual practice when utilizing open space fee -in -lieu payment is to calculate the fees at the time
of plat recording. However, Federal Way Revised Code (FWRC) 19.100.070 leaves flexibility in
determining the timing of open space fee calculation, and given the circumstances described above, it is
appropriate to utilize that flexibility to calculate the fees based on the 2007 land value as described above.
As this residential land division is vested prior to July 2, 2015, open space fee deferment code provisions
that were enacted by the City on November 16, 2010, and codified under section 19.100.070(1)(b) of the
FWRC, are hereby applied to this short plat project. Condition #4 of the approved short plat is amended
to read as follows:
Amended Condition of Approval 44:
"Prior to recording at King County, the approved short plat shall reflect the following: open space
mitigation in the amount of $9,962.92, or $3,320.97 per lot based on a three -lot subdivision is
required; open space fee -in -lieu payment may be deferred, but shall be paid to the City of Federal
Way no later than the closing of sale of each individual house or five years from deferment of the
fee, whichever is earlier; the deferment date shall be the date the short plat is recorded at King
County Records and Elections; and a covenant, prepared by the city, to enforce payment of
deferred open space fees, shall be recorded at the applicant's expense on each lot at the time of
short plat recording."
Next Steps
In order to record the approved Song Kang Short Plat at King County records, the following must be
submitted:
1. Revise the mylar to include the following language:
Open Space —A fee -in -lieu of open space is required to satisfy open space requirements.
Lots in this short subdivision shall be subject to the Covenant of Payment Obligation for
Open Space Fee -in -Lieu recorded under King County Recording #
and
Lot 1 Lot 2 Lot 3
2. Sign and notarize the enclosed covenant(s).
3. Provide one revised mylar, three paper copies of the revised mylar, and signed and notarized copy
of the three (3) covenants with recording fees based on the following:

Per your request, I've looked into some factors for re-evaluating the Kang short plat open space
fee.
Size of the parcel after dedications
The applicant subnutted lot closure calculations that state that the original project was 24,027
square feet in size.
Ten feet of property along the east side of the site was dedicated to the City for the 30`' Street
right-of-way (recording #20090716000544). The lot closure calculations list this as 1,550 SF
(10'xl55' = 1,550). The dedication reduces the size of the property to 22,477 SF (24,027-
1,550=22,477 SF).
The short plat consists of three lots at 7,492 SF each for a total of 22,476 SF.
Prior Assessed Valuations
The 2009 King County assessed valuation was $84,000.00 for the 22,477 square foot property
(the size of the property minus the roadway dedication recorded in 2009). The 2007 King County
assessed valuation was $71,000 for the larger 24,027 SF property. The 2007 valuation year is
appropriate to consider as the applicant re -applied for the short plat application during this
calendar year.
To establish the per square foot value in 2007, that assessed value is divided by the original
property size ($71,000/24,027 = $2.955 per square foot). When this per square foot value is
multiplied by the reduced parcel size, a new assessed value of $66,419.53 is obtained ($2.955 x
22,477 SF = $66,419.53).
Revised Open Space fee
Under FWRC, the open space fee is based on 15% of the assessed value of the land. The revised
open space fee is calculated using the per square foot value of the property as determined in 2007
minus the roadway dedication area (66,419.53 x 15% _ $9,962.92). The short plat open space fee
for the 22,477 SF property using the 2007 assessed valuation of $66,419.53 is $9,962.92.
The open space fee using the original land area and the 2009 valuation is $12,600.00. A fee that
reflects values in 2007 and the size of the property after dedication is $9,962.92, which results in
a savings of $2,637.08 for the applicant.

This letter forwards the response from the Federal Way Parks Director to your January 21, 2010, request
to waive the open space requirement for above -referenced short plat application. This letter also discusses
the process for recording the short plat at King County Records.
Open Space Response
The February 23, 2010, e-mail from Parks Director Cary Roe is enclosed. As discussed in the e-mail, the
Director is unable to grant your request to eliminate the open space requirement for this short plat project.
Recording
At this time, recording fees and a signed short plat mylar have been received. In order to record the short
plat, an open space fee of $12,600.00 must be paid to the City. Alternatively, as noted in the Parks
Director's e-mail, the short plat can be revised to include some open space on the face of the short plat as
long as each lot maintains a minimum lot size of 7,200 square feet. Appropriate language must also be
added to the face of the plat if this option is utilized.

Deb, based on the materials provided on the Kang short plat, it appears the applicant was aware and understood that
providing open space or fee -in -lieu would be a condition of the short plat approval. Knowing this condition, the
applicant decided to move forward with the short plat process and furthermore requested that the open space
requirement be satisfied with an fee -in -lieu. Not until the end of the process did the applicant decide to submit a
request to waive the open space requirement.
While the FWCC does provide the administrative flexibility, I don't believe the code allows me to simply waive the
requirement. Given the history on this project and limitations under the code, I am unable to grant the applicants
request to eliminate the open space requirement. However, as the FWCC provides, if the applicant can provide some of
the open space onsite, this would reduce the amount of fee -in -lieu. Please let me know if the applicant wishes to pursue
this option.

Dear Mr. Houser:
The City of Federal Way has completed the administrative short subdivision review for the `Kang Short
Plat.' The applicant proposes to subdivide one single-family residential lot into three single-family
residential lots, with frontage improvements and payment of an open space fee. The City received your
application December 11, 2007, and the Department of Community Development Services deemed the
application complete March 26, 2008.
The Department of Community Development Services hereby grants preliminary approval subject to the
following conditions based on review of the short plat map, revised date December 1, 2009:
CONDITION OF APPROVAL
1. Prior to recording, the mylar shall be revised to include the King County Recording number
(20090716000544) for the right-of-way dedication on the line provided under Rights -of -Way, in
the tipper left-hand corner of page 1.
2. Prior to recording, the mylar shall be revised to eliminate the note about future improvement of
the right-of-way and modem the dedication note to read: "10' DEDICATED TO THE CITY OF
FEDERAL WAY. " (Refer to the red lined plan).
3. Prior to recording, the mylar shall be revised to include the following information on page I of 2:
"EACH LOT SHALL BE SUBJECT TO ON -SITE INFILTRATION BASED ON THE CIVIL PLAN
PREPARED BYBENNETT PS&E, AND APPROVED BY THE CITY ON SEPTEMBER 15, 2008,
AND FILED UNDER CITY CONSTR UCTION PERMIT NO. 05-106136-00-EN. "
4. Prior to recording, open space fees in the amount of $12,600.00 or IS percent of the assessed
land value as adjusted at the time of recording shall be paid to the City of Federal Way.'
This Decision of the Director is based on the enclosed Statement of Facts (Exhibit A) and in accordance
with decision criteria listed in Federal Way City Code (FWCC) Section 20-91.2
FINAL SHORT PLAT
As of this date, required infrastructure has been installed and as built plans have been approved by the
Public Works Department.' Following receipt of a mylar that corresponds to the conditions of approval

the applicant) with the King County Division of Elections and Records. Please provide a recording fees
check in the amount of $134.004 payable to the City of Federal Way.
APPEAL PROCESS
Pursuant to FWCC §20-94, any person who receives a copy of this decision may appeal the decision
within 14 days of the date of issuance. The decision may be appealed in the form of a letter delivered to
the Department of Community DevelMent Services by 5:00 p.m., January 26, 2010, at the following
address: City of Federal Way, 33325 8 Avenue South, PO Box 9718, Federal Way, WA 98063-9718.
An appeal letter must contain a clear reference to the matter being appealed, along with a copy of the
decision. A statement of the alleged errors in the decision and required appeal fee must be included. Any
additional requirements of FWCC Section 20-94 must be followed.
DURATION OF APPROVAL
This short subdivision approval shall expire one year from the date of issuance of this decision based on
FWCC. However, the applicant may submit a written request in the form of a letter with supporting
documentation to the Department of Community Development Services requesting a one-time extension
of this limit of up to one year, pursuant to FWCC § 20-107.
REQUESTS FOR CHANGE OF VALUATION
Any affected property owners may request a change in valuation for property tax purposes, not
withstanding any program of revaluation.

The Planning Division hereby presents the following Findings of Facts to the Director of Community
Development pursuant to content requirements of the short subdivision decision as set forth in Federal
Way City Code (FWCC) 20-9 1. These facts are in reference to King County tax parcel identification
number 332204-9127 located north of 288th Street on 3dh Avenue South.
1. Proposal — The applicant proposes to subdivide one existing 24,027 square -foot single-family
lot into three single-family residential lots. Lots 1, 2, and 3 are each 7,492 square feet in size
per the lot closure calculations prepared by Robert Bennett and sealed Sept. 26, 2008.
2. Review Process — Pursuant to FWCC Chapter 20 `Short Subdivisions,' the proposed short plat
is subject to administrative review and decision rendered by the Director of Community
Development Services.' The proposal has been reviewed by staff from the Department of
Community Development Services, Public Works Department, Lakehaven Utility District, and
South King Fire and Rescue. City staff has used the following FWCC development regulations
when reviewing the short subdivision application: Chapter 19 `Planning & Development;'
Chapter 20 `Subdivisions;' Chapter 21 `Surface & Stormwater Management;' and Chapter 22,
`Zoning.'
Density & Zoning District Regulations — The subject property is located within a Single -
Family Residential (RS 7.2) zone with a minimum lot size requirement of 7,200 square feet.
The proposal meets the density requirement as noted above. FWCC Section 22-631 "Detached
Dwelling Unit" prescribes setback, height, and parking and lot coverage requirements. Future
building permit applications will be reviewed for compliance with these provisions.
4. Comprehensive Plan — The subject property's comprehensive plan designation is Single -
Family — High -Density Residential. The proposal provides an urban density consistent with the
Federal Way Comprehensive Plan (FWCP) designation. The proposal meets relevant goals and
policies of the FWCP including, but not limited to:
a. LUG3 - Preserve and protect Federal Way's single-family neighborhoods;
b. LUP 14 - Maintain and protect the character of existing and future single-family
neighborhoods through strict enforcement of the City's land use regulations;
c. LUP17 - Encourage the development of transportation routes and facilities to serve single-
family neighborhoods. Special attention should be given to pedestrian circulation.
5. State Environmental Policy Act — The three -lot short plat was exempt from environmental
review per WAC 197-11-800.

6. Open Space — Pursuant to FWCC 20-156(b), all residential subdivisions shall provide open
space in the amount of 15 percent of gross land area of the site or a fee in lieu of the on -site
open space. The open space fee is based on 15% of the current assessed value of the land. In
this case, with the 2009 assessed value at $84,000 and assuming no change in assessed
valuation occurs between now and the time of recording, the required open space value would
be $12, 600. This fee shall be paid to the City of Federal Way prior to recording of the short
plat.
7. Concurrency —The Public Works Department's Traffic Division performed a concurrency
analysis and concluded that the project wouldn't meet the adopted LOS standards with
programmed improvements nor will project related trips impact any projects in the city's six -
year Transportation Improvement Plan (TIP). Therefore, traffic mitigation is not required.
8. Critical Areas — The city's critical areas inventory shows no environmentally sensitive areas
on the subject property.
Landscaping & Significant Tree Retention — As a component of the required street frontage
improvements along 30t` Avenue South, the applicant planted street trees within the four -foot
planter strip. Each individual lot will retain 25 percent or more of identified significant trees;
therefore, no replacement planting is necessary.
10. Street Frontage Improvements —The project proponent installed half -street frontage
improvements along 30`' Avenue South abutting the subject property, and dedicated ten feet of
land to the City of Federal Way to accommodate street frontage improvements.
11. Stormwater — Drainage improvements must meet standards established in the city's amended
version of the 1998 King County Surface Water Design Manual. Each lot will be subject to
infiltration as depicted on the approved Civil plans, dated September 15, 2008. This
information shall be included on the face of the short plat document.
12. Lot Addresses — The city's Building Official has assigned the following addresses to the
proposed lots. Addresses shall be depicted on the face of the short plat document.
a. Lot 1— 28703 30t' Avenue South
b. Lot 2 — 28629 30t' Avenue South
C. Lot 3 — 28623 30th Avenue South
13. Design Criteria— The proposed short subdivision satisfies applicable design standards
pursuant to FWCC Chapter 20, Article III `Design Criteria' including, but not limited to, land
division design, lot design, density, and open space subject to conditions being met.
14. Decisional Criteria —The proposal is consistent with all items listed in FWCC 20-91(b), which
include the following: (1) FWCP; (2) Applicable provisions of FWCC Chapter 20
`Subdivisions"; (3) The public health, safety, and welfare; (4) Design criteria, Improvements,
Chapter 58.17 of the Revised Code of Washington, and other applicable ordinances or
development regulations of the City

Notice is hereby given that pursuant to Federal Way Revised Code ("FWRC") 19.100.070(l)(b),
the City of Federal Way (the "City") and the Grantor voluntarily agree to a deferred payment obligation
for an Open Space Fee -in -Lieu Covenant against the above -described real property. By entering into this
agreement, Grantor waives on behalf of itself, its heirs, successors and assigns, its right to a refund or to
contest how the fee(s) are used by the City to address the impacts for which the fee(s) were paid.

(including but not limited to the cost of litigation and attorney fees) incurred by the City in the
enforcement of this Covenant shall be paid by Grantor. Venue shall be King County.
All payments shall be made payable to the City and shall be directed to the City of Federal Way
Permit Center, 33325 8"' Avenue South, Federal Way, WA 98063.
Upon the receipt of notification that a sale is pending and fee(s) are to be paid, the City agrees to
deposit into escrow a fully executed Release of Covenant, substantially in the form attached hereto as
Exhibit B. The escrow officer shall record the Release of Covenant when funds are disbursed from
escrow to pay the outstanding fee(s). The City may provide separate escrow instructions consistent with
this Covenant. Otherwise, the City will release this Covenant upon Grantor's payment of the above
identified fee(s).

Thank you for submitting additional information for the Kang Short Plat on October 12, 2009. I have reviewed the
Tree Retention and Landscaping Plan and find that one more replacement tree will be required to meet minimum
standards of the Federal Way City Code (FWCC) 20-186. The code requires that the replacement ratio is 25% of
the total trees on site "prior to development", not on the number removed. Please submit a statement identifying
the size, species, and location of the additional tree.
You also submitted a letter requesting the "fee in lieu of for the 15% open space requirement for this plat.
Review of the submittal identifies that the proposed fee is based on the current assessed value of the land,
$ 84, 000; so the required open space value would be $12, 600 (15% of $ 84, 000):
The site plan must be updated to include any recent changes that have been requested by Planning and/or Public
Works. Some of the changes needed are: printing the official logo of the City in the upper right hand comer of the
plat; current date; location of driveways for each lot; and, location of the street light.
In response to your recent resubmittal, comments were received from Soma Chattopadhyay, Traffic Division,
requesting the following information:
• The City of Federal Way requires a detailed streetlight plan showing streetlight connections, height,
location, type, and spacing of the new streetlight from existing streetlight. Please show the proposed road
cross section with streetlight.
• Please submit a photometric plan.
Although the streetlight and infrastructure have been installed, we still need the requested information to verify
that the light was installed properly and according to code requirements.
Once you submit the additional information and make the corrections requested above, you can submit a revised
plat layout for final review. If deemed correct, we will notify you to submit the final mylars with the open space

Due to the small size of the property being developed we are requesting the "fee in lieu option" to satisfy the
open space requirement for this short plat. The total parcel area of this lot is 22476 sq/ft, with the requirement
of 15% set aside for open space, which would be 3371 sq/ft. According to the most recent property appraisal
by the county the property value is $84,000.00, which would make the approximate value of the 15% set
aside $12,600.00.

Dear Mr. Houser:
Thank you for coming in to discuss the status of this application. The application was deemed complete as
of March 26, 2008. However, there were technical issues identified in previous correspondence to the
applicant. You submitted revised plans on June 23, 2008. I circulated the latest site plan you submitted to
other departments for comment in July 2008. I sent another memo to other city departments this morning
to identify if there were any outstanding technical issues that needed resolution for this project to move
forward. I will forward those comments to you as soon as they are received.
I have reviewed the file and fmd there is still the outstanding issue of the tree removal on the site. Federal
Way City Code (FWCC) 20-186 requires that a landscaping plan, prepared by a licensed landscape
architect, shall be submitted with each application for a land division. However, on this site you need to
submit a tree retention plan. The plan shall identify how many significant trees are located on the
property, how many will be cut down, and how many will be retained and/or replaced. A tree retention
plan has never been submitted for this application. What we have received is a site plan prepared by the
surveyor that lists the number of trees on site. For this proposal, there appears to be 16-17 significant trees
on site. The landscaping plan must identify the location, size, and species of each tree on the property,
which ones will be removed, and if any of the trees will be replaced. When you are resubmitting
information, providing a narrative explanation in addition to the requested plans is helpful in reviewing
the resubmittal.
You have submitted a letter requesting the "fee in lieu of" for the 15% open space requirement for this
plat. Please submit additional information what that area requirement would be (15% of total parcel area)
and the total value of that area, using current assessments of the property. We will then forward your
request to the Parks Department for review and approval.
Also, the site plan, prepared by the surveyor, is dated 2003. The site plan must be updated to include any
recent changes that have been requested by Planning and/or Public Works. Including the most recent
comments listed below.

application was determined to be complete on March 26, 2008. However, several technical items

In the event that the improved street section provides for the back of sidewalk to be at the new

the short plat will need to indicate and identify on -site Lakehaven easements for the water meters
and include template language in accordance with Lakehaven's standards.
General — Separate service connection applications will be needed for each lot. Effective January
1, 2008, Lakehaven's Capital Facilities Charges for water and sewer will be $3,000 and $2,891
respectively, for each single-family residence (equivalent residential unit or ERU). A water
system capacity credit is available for the property based on payment of a General Facility Fee
(GFF) for the property's existing water service connection and as set forth in Lakehaven's current
Fees and Charges Resolution.
PROJECT CANCELLATION
Please be advised that pursuant to Federal Way City Code (FWCC) Section 22-34, if an applicant fails to
provide additional information to the City within 180 days of being notified that such information is

Thank you for your April 21, 2008, comment letter regarding the City's notice of application for the Kang
Short Plat. Your letter was forwarded to City staff and the applicant for review and response. Your
questions are repeated below with City responses provided in bold.
1. Will the natural tree line and tree located in the NW corner remain?
City response: Sheet 5 of 6 as prepared by Bennett PS&E, Inc. submitted by the applicant
on March 14, 2008, depicts the location of existing trees on the subject property. (See
enclosed copy.) According to this plan, there are 26 trees on the subject property with 17 of
them meeting the definition of a significant tree.' Of those 17 trees, 2 will be removed in
conjunction with installation of new roadway improvements. All of the other significant
trees are proposed to remain on the site during plat construction. However, you should be
aware that the city code does permit removal of significant trees in conjunction with house
construction, with tree replacement required per FWCC Section 22-1568(c)(5). It appears
likely that some of the trees on proposed lot #3 next to your property will need to be
removed to facilitate house construction. In that case, the applicant must replace the
removed significant trees with one replacement tree required for every 4 removed,
providing up to 25% of the initial number of significant trees after platting. Deciduous
replacement trees must be a minim of three-inch caliper and evergreen replacement trees
must be a minimum of 10 feet in height.
2. Will this new development cause any changes to our sewer lines, phone lines, or other utilities?
Response: Lakehaven Utility District, who handles water and sewer for the City, notes that
there would be no anticipated changes to any existing sewer mains or service lines in the
area. This would also be true for any existing water mains or service lines, with the possible
exception of the existing water service connection/line/meter for the subject property/
development. No changes are anticipated to any other utilities in the area.
A significant tree shall be defined as.. (1) Twelve inches in diameter or 37 inches in circumference measured four and one-
half feet above ground; and (2) In good health; and (3) Not detrimental to the community (e.g_, is not diseased, dying, or likely of
falling into public open space or right-of-way, etc.) or obscuring safe sight distance requirements. Significant trees shall not
include red alder, cottonwood, poplar or big leaf maple.

3. Will we be required to install any upgrades or changes?
City Response: No upgrades or changes would be required of adjacent property owners
when the subject property develops.
4. Will mailboxes be moved?
City Response: The Postmaster regulates the location of mailboxes in Federal Way. Contact
Postmaster Cathy Dela Cruz at 253-924-1692 for information about mail box locations.
5. What type of homes will be built?
City Response: To date, building permits have not been submitted for these new building
lots so we do not have details about the type of homes that will be constructed. The site is
zoned residential single-family, and any house must be setback a minimum of 20 feet from
the front property line and 5 feet from the side and rear property lines. The maximum
height for the new houses is 30 feet above average building elevation, and there can be no
more than 60 percent of each lot covered with impervious surfaces.
6. Is the name of the builder available?
City Response: The owner/developer is Song Kang, phone number 206-910-5111. The
contractor is listed as KS Construction, phone number 253-927-3593.
Can and will speed humps be added to the road?
City Response: 30"' Avenue South would have an increased potential for through traffic
when the street is connected and paved. However, the street is a minor collector in the
City's Comprehensive Plan, so it is planned to accommodate this through traffic. Although
traffic calming elements can be considered when the street is completed, a stretch of gravel
road would remain south of the subject site. In addition, the segment being constructed to
the north is not effective at reducing travel speeds or volumes. Therefore, speed bump
installation is not recommended for construction as part of this development.
8. Will the City maintain the road and roadsides?
City Response: The road improvements will eventually be maintained by the City.
However, the developer will be responsible for the maintenance of the roadway
improvements that they installed for the first two years after project completion.
If more children move into the area, will the school boundaries change?
Response: School boundaries and related school bus stops are designated by the Federal
Way School District. Both are subject to change as student needs increase and roads are
developed. Contact Geri Walker at the Federal Way School District (253-945-2071) to
discuss school boundaries. The Applicant will be required to pay school impact fees before a
residential building permit can be issued. The collection of school impact fees will mitigate
impacts to school service delivery. The 2008 school mitigation fee is $4,077. The fees are
adjusted annually.
Project Status
At this time, the short plat application has been determined to be complete. Additional technical
comments from City staff will be forwarded in response to the applicant project revisions. As of this date,
the short plat application has not received approval. The City will notify the applicant once the short plat
drawing has received preliminary approval. As a party of record, you will be copied on this letter. Prior to

any construction activity, engineering plans must be approved. Following installation and inspection
approval of the required street construction and utility installation, the short plat can be recorded at King
County and building permits can be issued.

The City of Federal Way has reviewed documents submitted on December 11, 2007, for the three -lot short plat
on 30`h Avenue South in Federal Way, and revisions submitted on March 14, 2008. Pursuant to Federal Way
City Code (FWCC) Section 22-85, the City must determine whether the application is complete within 28 days
of receiving an application_
COMPLETE APPLICATION
Based on the completeness items identified in FWCC Section 20-83, the application is deemed complete as of
March 26, 2008. A notice of land use application will now be posted at the site, published in the official City
newspaper, and posted at each of the City's official notification boards. The FWCC does not require that
neighboring property owners be individually notified of the land use application.
ADDITIONAL INFORMATION REQUESTED
While the short plat application is determined to be complete, response to several technical comments provided
in the City's January 7, 2008, letter are still required in order for the City to complete its review of the short
plat application. Staff are in the process of reviewing your March 14, 2008 resubmittal; formal comments
should be available in 30 days.
TIMELINE
As previously noted, the City can grant preliminary approval of the short plat once all outstanding technical
items are resolved. Engineering plans based on the preliminary approval shall be submitted to the City for
review. Following approval of engineering plans, the applicant must construct the required improvements and
fund any mitigation fees. At the conclusion of inspections and the acceptance of the required improvements,
the short plat will be recorded at King County at the expense of the applicant.

1. Except to the extent that specific assurance are provided in Schedule A of this Guarantee, the Company assumes no liability for loss or damage by reason of the following:
(a) Defects, liens, encumbrances, adverse claims or other matters against the title, whether or not shown by the public records.
(b) (1) Taxes or assessments of any taxing authority that levies taxes or assessments on real property; or, (2) Proceedings by a public agency which may result in taxes
or assessments, or notices of such proceedings, whether or not the matters excluded under (1) or (2) are shown by the records of the taxing authority or by the public
records.
(c) (1) Unpatented mining claims; (2) reservations or exceptions in patents or in Acts authorizing the issuance thereof; (3) water rights, claims or title to water, whether
or not the matters excluded under (1), (2) or (3) are shown by the public records.
2. Notwithstanding any specific assurances which are provided in Schedule A of this Guarantee, the Company assumes no liability for loss or damage by reason of the
following:
(a) Defects, liens, encumbrances, adverse claims or other matters affecting the title to any property beyond the lines of the land expressly described in the description set
forth in Schedule (A), (C) or in Part 2 of this Guarantee, or title to streets, roads, avenues, lanes, ways or waterways to which such land abuts, or the right to maintain therein
vaults, tunnels, ramps, or any structure or improvements; or any rights or easements therein, unless such property, rights or easements are expressly and specifically set forth
in said description.
(b) Defects, liens, encumbrances, adverse claims or other matters, whether or not shown by the public records; (1) which are created, suffered, assumed or agreed to by
one or more of the Assureds; (2) which result in no loss to the Assured; or (3) which do not result in the invalidity or potential invalidity of any judicial or non -judicial
proceeding which is within the scope and purpose of the assurances provided.
(c) The identity of any party shown or referred to in Schedule A.
(d) The validity, legal effect or priority of any matter shown or referred to in this Guarantee.
GUARANTEE CONDITIONS AND STIPULATIONS
1. Definition of Terms.
The following terms when used in the Guarantee mean:
(a) the "Assured": the party or parties named as the Assured in this Guarantee, or
on a supplemental writing executed by the Company.
(b) "land": the land described or referred to in Schedule (A) (C) or in Part 2, and
improvements affixed thereto which by law constitute real property. The term "land"
does not include any property beyond the lines of the area described or referred to in
Schedule (A) (C) or in Part 2, nor any right, title, interest, estate or easement in
abutting streets, roads, avenues, alleys, lanes, ways or waterways.
(c) "mortgage": mortgage, deed of trust, trust deed, or other security instrument.
(d) "public records" : records established under state statutes at Date of
Guarantee for the purpose of imparting constructive notice of matters relating to real
property to purchasers for value and without knowledge.
(e) "date": the effective date.
2. Notice of Claim to be Given by Assured Claimant.
An Assured shall notify the Company promptly in writing in case knowledge shall
come to an Assured hereunder of any claim of title or interest which is adverse to the
title to the estate or interest, as stated herein, and which might cause loss or damage
for which the Company may be liable by virtue of this Guarantee. If prompt notice
shall not be given to the Company, then all liability of the Company shall terminate
with regard to the matter or matters for which prompt notice is required; provided,
however, that failure to notify the Company shall in no case prejudice the rights of
any Assured under this Guarantee unless the Company shall be prejudiced by the
failure and then only to the extent of the prejudice.
3. No Duty to Defend or Prosecute.
The Company shall have no duty to defend or prosecute any action or proceeding to
which the Assured is a party, notwithstanding the nature of any allegation in such
action or proceeding.
4. Company's Option to Defend or Prosecute Actions; Duty of Assured
Claimant to Cooperate.
Even though the Company has no duty to defend or prosecute as set forth in
Paragraph 3 above:
(a) The Company shall have the right, at its sole option and cost, to institute and
prosecute any action or proceeding, interpose a defense, as limited in (b), or to do
any other act which in its opinion may be necessary or desirable to establish the title
to the estate or interest as stated herein, or to establish the lien rights of the
Assured, or to prevent or reduce loss or damage to the Assured. The Company may
take any appropriate action under the terms of this Guarantee, whether or not it shall
be liable hereunder, and shall not thereby concede liability or waive any provision of
this Guarantee. If the Company shall exercise its rights under this paragraph, it shall
do so diligently.
(b) If the Company elects to exercise its options as stated in Paragraph 4(a) the
Company shall have the right to select counsel of its choice (subject to the right of
such Assured to object for reasonable cause) to represent the Assured and shall not
be liable for and will not pay the fees of any other counsel, nor will the Company pay
any fees, costs or expenses incurred by an Assured in the defense of those causes of
action which allege matters not covered by this Guarantee.
(c) Whenever the Company shall have brought an action or interposed a defense
as permitted by the provisions of this Guarantee, the Company may pursue any
litigation to final determination by a court of competent jurisdiction and expressly
reserves the right, in its sole discretion, to appeal from an adverse judgment or order.
(d) In all cases where this Guarantee permits the Company to prosecute or
provide for the defense of any action or proceeding, an Assured shall secure to the
Company the right to so prosecute or provide for the defense of any action or
proceeding, and all appeals therein, and permit the Company to use, at its option, the
name of such Assured for this purpose. Whenever requested by the Company, an
Assured, at the Company's expense, shall give the Company all reasonable aid in any
action or proceeding, securing evidence, obtaining witnesses, prosecuting or
defending the action or lawful act which in the opinion of the Company may be
necessary or desirable to establish the title to the estate or interest as stated herein,
or to establish the lien rights of the Assured. If the Company is prejudiced by the
failure of the Assured to furnish the required cooperation, the Company's obligations
to the Assured under the Guarantee shall terminate.
S. Proof of Loss or Damage.
In addition to and after the notices required under Section 2 of these Conditions and
Stipulations have been provided to the Company, a proof of loss or damage signed
and sworn to by the Assured shall be furnished to the Company within ninety (90)
days after the Assured shall ascertain the facts giving rise to the loss or damage. The
proof of loss or damage shall describe the matters covered by this Guarantee which
constitute the basis of loss or damage and shall state, to the extent possible, the
basis of calculating the amount of the loss or damage. If the Company is prejudiced
by the failure of the Assured to provide the required proof of loss or damage, the
Company's obligation to such Assured under the Guarantee shall terminate. In
addition, the Assured may reasonably be required to submit to examination under
oath by any authorized representative of the Company and shall produce for
examination, inspection and copying, at such reasonable times and places as may be
designated by any authorized representative of the Company, all records, books,
ledgers, checks, correspondence and memoranda, whether bearing a date before or
after Date of Guarantee, which reasonably pertain to the loss or damage. Further, if
requested by any authorized representative of the Company, the Assured shall grant
its permission, in writing, for any authorized representative of the Company to
examine, inspect and copy all records, books, ledgers, checks, correspondence and
memoranda in the custody or control of a third party, which reasonably pertain to the
Loss or Damage. All information designated as confidential by the Assured provided
to the Company, pursuant to this Section shall not be disclosed to others unless, in
the reasonable judgment of the Company, it is necessary in the administration of the
claim. Failure of the Assured to submit for examination under oath, produce other
reasonably requested information or grant permission to secure reasonably necessary
information from third parties as required in the above paragraph, unless prohibited
by law or governmental regulation, shall terminate any liability of the Company under
this Guarantee to the Assured for that claim.

6. Options to Pay or Otherwise Settle Claims: Termination of Liability.
In case of a claim under this Guarantee, the Company shall have the following
additional options:
(a) To Pay or Tender Payment of the Amount of Liability or to Purchase the
Indebtedness.
The Company shall have the option to pay or settle or compromise for or in the name
of the Assured any claim which could result in loss to the Assured within the coverage
of this Guarantee, or to pay the full amount of this Guarantee or, if this Guarantee is
issued for the benefit of a holder of a mortgage or a lienholder, the Company shall
have the option to purchase the indebtedness secured by said mortgage or said lien
for the amount owing thereon, together with any costs, reasonable attorneys' fees and
expenses incurred by the Assured claimant which were authorized by the Company up
to the time of purchase.
Such purchase, payment or tender of payment of the full amount of the Guarantee
shall terminate all liability of the Company hereunder. In the event after notice of
claim has been given to the Company by the Assured the Company offers to purchase
said indebtedness, the owner of such indebtedness shall transfer and assign said
indebtedness, together with any collateral security, to the Company upon payment of
the purchase price.
Upon the exercise by the Company of the option provided for in Paragraph (a) the
Company's obligation to the Assured under this Guarantee for the claimed loss or
damage, other than to make the payment required in that paragraph, shall terminate,
including any obligation to continue the defense or prosecution of any litigation for
which the Company has exercised its options under Paragraph 4, and the Guarantee
shall be surrendered to the Company for cancellation.
(b) To Pay or Otherwise Settle With Parties Other Than the Assured or With the
Assured Claimant.
To pay or otherwise settle with other parties for or in the name of an Assured claimant
any claim Assured against under this Guarantee, together with any costs, attorneys'
fees and expenses incurred by the Assured claimant which were authorized by the
Company up to the time of payment and which the Company is obligated to pay.
Upon the exercise by the Company of the option provided for in Paragraph (b) the
Company's obligation to the Assured under this Guarantee for the claimed loss or
damage, other than to make the payment required in that paragraph, shall terminate,
including any obligation to continue the defense or prosecution of any litigation for
which the Company has exercised its options under Paragraph 4.
7. Determination and Extent of Liability.
This Guarantee is a contract of Indemnity against actual monetary loss or damage
sustained or incurred by the Assured claimant who has suffered loss or damage by
reason of reliance upon the assurances set forth in this Guarantee and only to the
extent herein described, and subject to the Exclusions From Coverage of This
Guarantee.
The Liability of the Company under this Guarantee to the Assured shall not exceed the
least of:
(a) the amount of liability stated in Schedule A or in Part 2;
(b) the amount of the unpaid principal indebtedness secured by the mortgage of an
Assured mortgagee, as limited or provided under Section 6 of these Conditions and
Stipulations or as reduced under Section 9 of these Conditions and Stipulations, at the
time the loss or damage Assured against by this Guarantee occurs, together with
interest thereon; or
(c) the difference between the value of the estate or interest covered hereby as
stated herein and the value of the estate or interest subject to any defect, lien or
encumbrance Assured against by this Guarantee.
S. Limitation of Liability.
(a) If the Company establishes the title, or removes the alleged defect, lien or
encumbrance, or cures any other matter Assured against by this Guarantee in a
reasonably diligent manner by any method, including litigation and the completion of
any appeals therefrom, it shall have fully performed its obligations with respect to that
matter and shall not be liable for any loss or damage caused thereby.
(b) In the event of any litigation by the Company or with the Company's consent,
the Company shall have no liability for loss or damage until there has been a final
determination by a court of competent jurisdiction, and disposition of all appeals
therefrom, adverse to the title, as stated herein.

(c) The Company shall not be liable for loss or damage to any Assured for liability
voluntarily assumed by the Assured in settling any claim or suit without the
prior written consent of the Company.
9. Reduction of Liability or Termination of Liability.
All payments under this Guarantee, except payments made for costs, attorneys' fees
and expenses pursuant to Paragraph 4 shall reduce the amount of liability pro Canto.
10. Payment of Loss.
(a) No payment shall be made without producing this Guarantee for endorsement
of the payment unless the Guarantee has been lost or destroyed, in which case proof
of loss or destruction shall be furnished to the satisfaction of the Company.
(b) When liability and the extent of loss or damage has been definitely fixed in
accordance with these Conditions and Stipulations, the loss or damage shall be
payable within thirty (30) days thereafter.
11. Subrogation Upon Payment or Settlement.
Whenever the Company shall have settled and paid a claim under this Guarantee, all
right of subrogation shall vest in the Company unaffected by any act of the Assured
claimant.
The Company shall be subrogated to and be entitled to all rights and remedies which
the Assured would have had against any person or property in respect to the claim had
this Guarantee not been issued. If requested by the Company, the Assured shall
transfer to the Company all rights and remedies against any person or property
necessary in order to perfect this right of subrogation. The Assured shall permit the
Company to sue, compromise or settle in the name of the Assured and to use the
name of the Assured in any transaction or litigation involving these rights or remedies.
If a payment on account of a claim does not fully cover the loss of the Assured the
Company shall be subrogated to all rights and remedies of the Assured after the
Assured shall have recovered its principal, interest, and costs of collection.
12. Arbitration.
Unless prohibited by applicable law, either the Company or the Assured may demand
arbitration pursuant to the Title Insurance Arbitration Rules of the American Arbitration
Association. Arbitrable matters may include, but are not limited to, any controversy or
claim between the Company and the Assured arising out of or relating to this
Guarantee, any service of the Company in connection with its issuance or the breach
of a Guarantee provision or other obligation. All arbitrable matters when the Amount
of Liability is $1,000,000 or less shall be arbitrated at the option of either the Company
or the Assured. All arbitrable matters when the amount of liability is in excess of
$1,000,000 shall be arbitrated only when agreed to by both the Company and the
Assured. The Rules in effect at Date of Guarantee shall be binding upon the parties.
The award may include attorneys' fees only if the laws of the state in which the land is
located permits a court to award attorneys' fees to a prevailing party. Judgment upon
the award rendered by the Arbitrator(s) may be entered in any court having
jurisdiction thereof.
The law of the situs of the land shall apply to an arbitration under the Title Insurance
Arbitration Rules.
A copy of the Rules may be obtained from the Company upon request.
13. Liability Limited to This Guarantee; Guarantee Entire Contract.
(a) This Guarantee together with all endorsements, if any, attached hereto by the
Company is the entire Guarantee and contract between the Assured and the
Company. In interpreting any provision of this Guarantee, this Guarantee shall be
construed as a whole.
(b) Any claim of loss or damage, whether or not based on negligence, or any action
asserting such claim, shall be restricted to this Guarantee.
(c) No amendment of or endorsement to this Guarantee can be made except by a
writing endorsed hereon or attached hereto signed by either the President, a Vice
President, the Secretary, an Assistant Secretary, or validating officer or authorized
signatory of the Company.
14. Notices, Where Sent.
All notices required to be given the Company and any statement in writing required to
be furnished the Company shall include the number of this Guarantee and shall be

On December 11, 2007, the City of Federal Way's Department of Community Development Services
received your application for a three -lot short plat for King County tax parcel number 332204-9127.
Pursuant to Federal Way City Code (FWC) Section 22-85, within 28 days of receiving an application, the
City must determine whether the application is complete based on the submittal requirements of FWCC
Section 22-83.
INCOMPLETE APPLICATION
During the course of the City's review, the following items were found to be incomplete. In order for your
application to be considered complete and ready for processing, the following items must be provided.
1. Two copies of the computation sheet (with surveyor's seal) that provides the square footage of all
streets, individual lots and tracts, and total area contained within the subject parcels, i.e. lot closure
calculations.
2. Two copies of a title report, not older than 30 days from date of application including any easements
or restrictions affecting the properties with a description, purpose, and reference by auditor's file
number and/or recording number; parties of interest; and any restrictions or covenants running with
the property.
3. Two copies of certificate of water and sewer availability, signed within a year of the date of application.
4. A copy of the current county quarter -section map for the area. (These maps can be found at
www.metrokc.gov.)
5. Five copies of a grading and clearing plan submitted in conformance with FWCC Section 22-179.
6. Five copies of a landscape plan submitted in conformance with FWCC Section 22-186. Tree
information is depicted on the face of the short plat and must be transferred to the landscape plan,
which must also show street trees in conformance with the FWCC.

TECHNICAL COMMENTS
In addition to the completeness items discussed above, preliminary short subdivision review comments
are provided below. These issues were identified in reviewing the application for completeness.
Responses to these items will be helpful in reviewing the project when the City begins formal review.
Planning Division, Deb Barker, 253-835-2642
1. Open space is now required for short plat applications. Fifteen percent of the gross land
area must be set aside in open space pursuant to FWCC Section 20-156(b), or alternatively,
the applicant can make a fee -in -lieu of payment prior to recording of the short plat pursuant
to the FWCC. Please indicate how the open space requirement will be met for this proposal.
2. Information on the tree table is four years old and must be updated to reflect current
conditions.

1. The short plat shall be drawn on the City's current title block page with current logo and
contain the file number 07-106670-SU.
2. The surveyor's certificate is not current.

1. A concurrency permit must be submitted. Refer to the enclosed application form.
2. Frontage improvements for 30th Avenue South must be shown on the face of the plat map.
Lakehaven Utility District, Brian Asbury, 253-946-5407
Water — Water service can be provided from the frontage of the proposed plat along 301h
Avenue South as set forth below. The project's developer will need to secure easement(s)
from South King Fire and Rescue in order to access the existing water main.
Lakehaven's records indicate an existing single-family residential water service connection
for the property. The meter and/or service connection will need to be evaluated by Lakehaven
relative to any proposed changes in usage and/or location.
In the event that the improved street section provides for the back of sidewalk to be at the
new edge of right-of-way (ref. June 29, 2005, Civil Plans per Brian Asbury's July 15, 2005,
email), the short plat will need to indicate and identify on -site Lakehaven easements for the
water meters and include template language in accordance with Lakehaven's standards.
Sewer — Sewer service can be provided from 30th Avenue South as set forth below.

General — Separate service connection applications will be needed for each lot. Effective
January 1, 2008, Lakehaven's Capital Facilities Charges for water and sewer will be $3,000
and $2,891 respectively, for each single-family residence (equivalent residential unit or
ERU). A water system capacity credit is available for the property based on payment of a
General Facility Fee (GFF) for the property's existing water service connection and as set
forth in Lakehaven's current Fees and Charges Resolution.
SUMMARY
After receipt of the requested information noted in the Incomplete Application section of this letter (be
sure to include the enclosed Resubmittal Information form), the Department will notify you within 14
days whether your application is considered complete or what, if any, information is still needed. It is
important to note that the Department cannot begin processing your formal application until all items are
submitted.
PROJECT CANCELLATION
Please be advised that pursuant to FWCC Section 22-34, if an applicant fails to provide additional
information to the City within 180 days of being notified that such information is requested, the
application shall be deemed null and void and the City shall have no duty to process, review, or issue any
decisions with respect to such an application.
