Please note the Bing Residence and associated with violation file 17-100487-00-VO. I am processing the shoreline
exemption and residential building permit for planning.
The applicant are in fact renting out an accessory dwelling unit in the basement per online rental listings. This is contrary
to your notes listed in Amanda. I am definite you relayed that an ADU is not a part of the building permit review
approval through their voluntary correction? I would like to request some follow-up enforcements action before
proceeding with my reviews.
The Hamblin/Bings must either a) obtain a land use approval through CD and reduce the ADU size (this review will not
be expedited as we service all applicants on a first come first served basis) or b) remove the ADU entirely- if the
applicant does nothing the VO will remain on their property and title.
Pete has stated the ADU depicted in the plans the ADU gross floor area is oversized per the zoning code. In single family
residential zones duplexes are not permitted, accessory dwelling units are intended to be accessory in nature and no
greater than 800 sq. ft. and/or 40% of the primary dwelling unit, whichever is greater, with a covenant recorded on the
property.
I am not sure if the land use review fees are doubled in this case if the land use application is a result of the an
enforcement action.
