Dear Kim N. Tran:
The Department of Community Development has completed review of the Accessory Dwelling Unit (ADU)
application submitted to the city on May 26, 2016. The ADU application is hereby approved pursuant to the
findings presented by the department's Planning Division staff and the conclusions based on those findings.
FINDINGS OF FACT
The following findings are based on site and floor plans received with the ADU application on May 26, 2016:
1. Proposal— The applicant proposes to construct an attached ADU above an existing detached garage,
located at 1310 303td Street, Federal Way. Access to the ADU is provided by an exterior stairway.
2. Zoning— The subject property is a 16,510 square -foot (0.38-acre) lot with a Single -Family Residential (RS)
9.5 zoning designation.
3. Floor Plan —The total square footage of the proposed ADU living area is 636 square feet. The principal
dwelling unit building permit identifies the livable area as 1,848 square feet; therefore, the proposed ADU
qualifies for a maximum of 739 square feet of livable area.
4. Water & Sewer — Lakehaven Utility District issued Certificates of Water and Sewer Availability. The
existing 5/s" meter may not be adequate and will need to be evaluated under the uniform plumbing code.
5. Required Yards & Height— The proposed ADU structure is located above the existing garage and all
improvements, including the stairway, meet the required 20-foot front yard, and 5-foot side and rear yard
setbacks.
6. Lot Coverage — The lot coverage of the principal dwelling, driveway, proposed ADU, and stair landing is
3,962 square feet, or approximately 24 percent, which is below the lot coverage maximum.
7. Owner Occupancy — The applicant must submit a signed letter of application and deed restriction stating the
owner shall occupy one of the two dwelling units as a permanent residence for six months or more of the
calendar year.

CONCLUSIONS
The following conclusions are based on the above findings of fact.
1. The proposal is consistent with policies of the Federal Way Comprehensive Plan.
2. The proposal. meets density, square footage, parking, occupancy, and dimensional requirements of the
ADU Use Zone Chart within Federal Way Revised Code (FWRC) 19.200.180.
3. The ADU is subordinate and incidental in size, scale, and design to the primary dwelling unit.
CONDITION OF APPROVAL
Prior to the final building inspection of the new ADU, please record the enclosed Letter of Application &
Deed Restriction with the King County Recorder's Office and return a notarized copy to my attention in
accordance with note #9, FWRC 19.200.180. The ADU restriction will remain recorded against the property.
BUILDING PERMIT REQUIRED
1. Although not a requirement for ADU land use approval, the ADU improvements will require a separate
building permit prior to construction. Please find a building permit application enclosed to submit at your
convenience.
2. Prior to issuance of a building permit, the existing 5/6" x'/a" meter (meter only removed in 2014) will need
to be evaluated under the Uniform Plumbing Code (UPC) to determine if it is adequate for the proposed use.
Water can be supplied to the ADU via the existing water service connection, provided that the UPC
plumbing fixture count of both the single-family residence and ADU do not exceed that allowed for a 5/8"
x'/4" meter. If the UPC plumbing fixture count indicates a 5/8" x'/a" meter would be too small, then the
applicant will need to submit a service connection application to Lakehaven for either a separate (ADU)
service/meter, or a larger (1") service/meter, to supply both the single-family residence and ADU. For
