A 120-day time -line for reviewing the project has started as of this date. The City has 120 days from the date that an application is deemed complete to take action on the application. As you are aware, the 120- day time -line may be stopped if the City determines that additional information is required to meet the requirements of the FWCC. PUBLIC NOTICE PROCEDURE A notice of land use application will now be posted at the site, published in the official City newspaper, and posted at each of the City's official notification boards. REQUEST FOR INFORMATION Various staff have conducted an initial review and identified some issues that need to be addressed. You will need to provide further information, as described below. Per FWCC 20-178(a), a 10-foot-wide Type III landscape strip along all arterial streets to shield new residences from arterial streets must be installed. Said landscape strip shall be provided in a separate tract to be owned and maintained by the homeowners. Type III landscaping, per FWCC 22-1565(c)(2), shall be a mixture of evergreen and deciduous trees interspersed with large shrubs and groundcover. Tree, shrub, and ground spacing shall be appropriate for the species type. Please provide a landscaping plan showing the buffer. 2. The lot design must be reconfigured so that Lots 1 & 2 are accessed from a single pipe -stem from Lot 3. Mr'Wilson- Mar+`h f 8,"2009 Page 2 The front yard setbacks for Lots 1 & 2 must be measured from the western property line. 4. Front yard setback for Lot 3 begins at the intersection of the pipe -stem and the main lot, where the front yard setback will be measured 20' north of that point and 20' feet from the western property line. Please see the enclosed handout for determining building setback lines on flag lots. Additionally, the southern building setback line of Lot 3 may be extended south to within 5' of the southern property line to create a larger buildable area. 5. Lot 1 must have a 10' setback from the southern property line as it fronts an arterial street. Additionally, the eastern building setback line may be increased easterly to within 5' of the eastern property line to create a larger buildable area. It is not clear whether or not this area is encumbered by any easements like the easement on Lot 2. 6. Lot 2 may extend its building setback lines on the southern side to within 5' of the property line to create a larger buildable area. 7_ Please specify whether or not the "concrete wall" on the eastern side of proposed Lot 1 is existing or proposed. 8. Please specify whether the wood sheds along the eastern property line of proposed Lot 2 belong to the property owner or the adjacent neighbor_ 9. Please submit a preliminary clearing and grading plan. 10. Please specify whether or not the existing home is to remain or be demolished. IL Per FWCC Section 20-156(b), all residential subdivisions shall be required to provide open space in the amount of 15% of the gross land area of the subdivision site. A fee in lieu payment may be made to satisfy open space requirements at the discretion of the parks director after consideration of the city's overall park plan, quality, location, and service area of the open space. The fee in lieu of open space shall be calculated on 15% of the most recent assessed value of the property. In the absence of an assessment, the market value shall be based on an appraisal conducted by an MAI certified appraiser or another professional appraiser approved by the parks director. Please redesign the short plat to include open space as specified in FWCC Section 20-156 or submit a written request to Steve Ikerd (Park Planning & Development Manager) for the fee in lieu option. Upon approval, and before the recording of the plat, an assessor's or an MAI certified appraiser's assessment of the property must be submitted to the city and 15% of the assessedlappraised value of the property paid to the city per the fee in lieu agreement. Preliminary Engineering Comments 1) The east leg of the hammerhead turnaround is shown completely on Lot 2; however, on the Short Plat drawing, the east leg is shown to be split on both Lots I and 2. This discrepancy shall be clarified. 2) The east leg of the turnaround does not meet City standard 3-46, which calls for a 55-foot leg from the centerline of the north -south road to the end of paved surface. 3) Show the hammerhead curve radii (20-foot minimum required) on the preliminary plans. Pursuant to FWCC Section 22-34, if an applicant fails to provide additional information to the City within 180 days of being notified that such information is requested, the application shall be deemed null and void and the City shall have no duty to process, review, or issue any decisions with respect to such an application. Please note that on February 9, 2009, a reorganization of the Federal Way City Code (FWCC) became effective. Further, please be advised that these changes may affect your application since you are not vested to the pre-existing code. We have not yet received the codified version; however, we would be happy to provide you with the electronic copies of the adopted ordinances related to the reorganization of the Code. Since then, conditions # 1 and #2 have been reconsidered and need to be amended to meet applicable code sections. This letter amends two of the three conditions of approval and provides technical comments required to be addressed prior to recording the final short plat. Amended Condition #1 The required 10-foot landscape tract is counted towards 2% of the open space requirement, Federal Way Revised Code (FWRC) 18.55.060, Open space and recreation. The site is located at 2220 South 312`h Street. The city received your application on February 12, 2009, and deemed the application complete on March 12, 2009. During the course of review, the city sent request -for - information letters, to which your final response resubmittal was made on June 25, 2009. The City of Federal Way hereby grants preliminary approval of the Momotyuk Short Plat, subject to the conditions noted below. This approval corresponds to the Short Plat Map and Conceptual Drainage Plan, date -stamped as received June 25, 2009. You may now proceed with engineering design of improvements. This decision of the director is based on the enclosed Statement of Facts and Conclusions and in accordance with decision criteria listed in Federal Way Revised Code (FWRC) 18.30. CONDITIONS OF APPROVAL As required by the Directors of Public Works and Community Development Services, prior to recording the short plat, all of the following conditions shall be completed, inspected, and approved by the City. 1. These trees could be removed upon development of each lot at the time of building permit approval, but will be subject to the regulations of FWRC 19.120.130. When submitting engineering review, please remove the aforementioned significant trees from the "to be removed" list. This preliminary approval of the short plat does not constitute approval for land clearing or grading, vegetation removal, or any other activities that otherwise require permits from the city. Prior to construction of any improvements, the applicant must apply for engineering approval for all road improvements, storm drainage facilities, and appurtenances. The engineering plans will be reviewed by the Public Works Department and Lakehaven Utility District. APPEAL PROCESS Pursuant to FWRC 18.130.140, any person who receives a copy of this decision may appeal the decision within 14 days of the date of issuance (September 2, 2009). The decision may be appealed in the form of a letter delivered to the Department of Community Development Services by 5:00 p.m., September 16, 2009 (33325 8"' Avenue South, PO Box 9719, Federal Way, WA 99063). Zoning —The site is located in a Single -Family Residential (RS) 7.2 zone (minimum lot size requirement of 7,200 square feet). The use zone chart for this zone (FWRC 19.200.010) lists setback and lot coverage requirements. Future building permit applications will be reviewed for compliance with this use zone chart. As conditioned, the proposed lots meet the minimum requirements of the zone. 4. Comprehensive Plan — The site is designated as Single -Family — High -Density in the Federal Way Comprehensive Plan (FWCP). The proposal is in compliance with the FWCP and related criteria listed in FWRC 18.55. 5. SEPA — Consistent with FWRC 14.15, the project is categorically exempt from the State Environmental Policy Act (SEPA) process (WAC 197-11-900). 6. Subdivision Design (FWRC 18.155. 010) — This part of the code pertains to streets and traffic. South 312'fi Street was recently improved and right-of-way dedication is not being requested at this time. The proposal has been reviewed by staff of the Public Works and found to be acceptable. 7. - Lot Design (FWRC 18.55:020) —Alt lots of the proposal have access to South 312`h-Street. Density — Pursuant to FWRC 18.55.030, "All lots in conventional subdivisions, both long and short subdivisions, binding site plans, and small lot detached developments shall meet the minimum lot size requirements of FWRC Title 19." Calculation of density in subdivisions shall not include streets or vehicle access easements. The existing lot is 28,627 square feet. Factoring out the access easement area and landscaping tract, the proposal still meets the minimum density requirement. 9.
