Minor tenant improvements are proposed inside the building. No site modifications are planned. ZONING COMPLIANCE REVIEW Federal Way Revised Code (FWRC) 19.15.025 addresses a change of use at a developed site as follows: "19.15.025. Zoning and use review process for new tenants — Change of use at a developed site. The purpose of this section is to review and determine compliance with applicable zoning and development code requirements when a new use is proposed to occupy an existing building or site. When a land use changes from one use category in the zoning charts to another use category, a zoning compliance review shall be performed as part of the use process review, when required, or in conjunction with the required business registration and/or building permit review. Each paragraph in a zoning chart is a use category. If the new use is in the same use category as any previous legal use of the site, no zoning compliance review is required." Other nonconforming aspects of the site which are not made nonconforming as a result of the change of use are not required to be brought into conformance as a result of this subsection. CHANGE OF USE ANALYSIS The subject property is zoned City Center Frame (CC-F). Banquet halls are a permitted use pursuant to FWRC 19.230.030, "Entertainment, etc." The site contains a multi -tenant shopping center with shared parking. The previous uses of the tenant space were for retail and church. The request isto locate a banquet hall in the 15,000 sq. ft. tenant space. Use -Specific Regulations and Notes — No external changes to the existing building are proposed. Parking Requirements — Per FWRC 19.230.030, the proposed banquet hall use requires one parking space for each 100 sq. ft. of gross floor area. The tenant space is 15,000 sq. ft., which requires 150 parking stalls. Mr. Li August 3, 2018 Page 2 Under FWRC 19.130.120(1) if parking is shared, the number of parking spaces that must be provided in shared areas must be at least 90 percent of the parking spaces required. As such, the proposed banquet hall would be required to provide 135 parking spaces. Per the statement provided by the applicant, the banquet hall will be used during the evening after 7:00 pm on the weekends, and will never be open during the day. The submitted plans depict 568 parking stalls for the multi -tenant shopping center. The existing parking spaces will be available to the banquet halls since it will be open after the remaining business will be closed. There is adequate amount of parking for the proposed use and existing uses. If at any time the banquet hall hours change, a new parking analysis may be required. Setbacks — Required minimum setbacks for the proposed use in the CCF zone are 0 ft. front, 0 ft. side, and 0 ft. rear. No additions are proposed; the existing building meets setbacks. CONDITIONS The proposed zoning change of use from a "church use" to "banquet hall" is hereby granted conditional approval and is considered to be in compliance with relevant zoning requirements. 1. Hours of operation are limited to after 7:00 pm on the weekends, no daytime use. If at any time the banquet hall hours change, a new parking analysis may be required by the City. CONCLUSION In summary, the proposed zoning Change of Use for this developed site is acceptable. This letter is not intended to identify all issues, as modifications to the building require additional review processes, including, but not limited to, building permit review.
