Please be advised that a right-of-way permit from the City of Federal Way is required prior to any right-of-way construction work. In addition, a final landscape inspection is required upon completion of all landscaping work. Background The applicant's proposal includes the following: replace dead trees and invasive plant material with groundcover in the northern and western landscaped areas of the site; alter the interior parking circulation by creating a loop; add landscape islands to the end of a parking row; add two handicap accessible parking stalls; construct a wooden fence to enclose trash receptacles; replace lawn area south of existing building with shrubs, trees, and groundcover; replace tree and additional plant material in landscape island near the 3201h driveway with shrubs and groundcover; expand the 3201h driveway; replace wooden fence along the west and north property line; construct a security driveway gate in the northern portion of the site; and other associated site improvements. The following Federal Way City Code (FWCC) sections are the basic criteria used to review the proposal. 1. The proposed project is subject to FWCC Section 22-340, which states that no nonconformance may, in any way, be enlarged, expanded, increased, intensified, compounded, or in any other way made greater, except as specifically permitted in Article IV. - 2. In accordance to FWCC Section 22-32.2, the proposed site rehabilitation and landscape improvements do not change the use of the site; do not reduce the required amount of landscaping, buffering, open space, public areas, or parking; do not change the location of utilities, easements, or pedestrian connections; do not affect the architectural design; nor impact sensitive areas or significant trees. Therefore, based on the City's review, the proposed site rehabilitation and landscape improvements are hereby conditionally approved. Within 60 days of this decision, the applicant shall install one drought tolerant tree' in the landscape island near the 3201h driveway. Upon completion of landscape work, please contact the Department of Community Development Services for a final landscape inspection. 2. Within 60 days of this decision, the applicant shall install three evergreens and one deciduous tree in the west perimeter landscape area. In addition, all removed shrubs (28) must be replaced in the west perimeter landscape area and must be a minimum of 12 inches in height at the time of planting. Upon completion of landscape work, please contact the Department of Community Development Services for a final landscape inspection. 3. The proposed security gate with a lock box located at the north end of the site must remain open during King County Library business hours. Additional Comments In your October 21, 2004 letter, you voiced safety/visibility concerns in response to FWCC requirements pertaining to the landscape island near the 3201h driveway. Per email sent by Raid Tirhi on October 26, 2004, the line of the sight triangle for vehicular traffic entering and exiting the public right-of-way is not affected by the landscape island. Therefore, cars exiting the subject property do not experience any sight constraints. If you feel parked cars experience sight constraints, you may want to consider eliminating the parking stall directly north of the landscape island. In order to mitigate sight/visibility concerns, staff recommends maintenance of shrubs and trees in the landscape island in such a way as to have a clear space free of branches and leaves between the heights of 31/2 feet to 8 feet. Pursuant to FWCC Section 22-1564, landscaping areas shall contain at least four inches of topsoil at finish grade. In addition, soil in parking lot landscaped areas must be noncompacted to a depth of 18 inches prior to planting of any shrubs, trees, or groundcovers. In your October 21, 2004 letter, you stated that such code requirements would kill or injure existing plant materials. In consideration of this concern, please apply the code requirements to existing landscape areas in a reasonable manner so as to ensure newly planted material a suitable environment in which to grow. In response to vehicular safety issues previously brought to the City's attention by the King County Library System, staff recommends a half "pork chop" to be placed in the driveway in order to further discourage illegal left turns. Landscape Modification In your October 21, 2004 letter, you requested a landscape modification for the landscape island near the 3201h driveway and for the west perimeter landscaping. In your November 8, 2004 letter, you officially withdrew both landscape modification requests. Therefore, no action will be taken by the City on this matter. 1 Pursuant to FWCC Section 22-1564, evergreen trees at the time of planting shall measure six feet in height. Deciduous trees at the time of planting shall have a caliper of 1.5 inches measured 4.5 feet above the root ball or root structure. 04-103894 Doc. Landscape Island Near Driveway, including FWCC Section 22-1567: In as much as this requirement constitutes a clear and demonstrable danger, as recognized by multiple other municipal codes, the Library District vigorously opposes this requirement. The practice of insisting on obscuring objects, whether they be planting, berms, or any other object of such a nature as to diminish or eliminate a clear view of oncoming traffic is both contradictory from a point of safety and from a point of liability. If this demand remains, King County Library System shall disavow itself on any and all liability for the inevitable traffic accidents that will ensue, and the city of Federal Way will assume same. If you would like to see a landscape code addressing this clear and present danger in a responsible fashion, I suggest you observe the City of Tucson Landscape Code, including requisite site triangles and the method of calculations inherent therein. The following responses are relevant to those comments that apply. It is not clear, however, that the intent of the work the Library Service is doing at this site is understood. The intent is to maintain the grounds and provide additional and safe access to the Library - it is not to do new work in the planted areas. I mention this because of comments such as those found in the General Landscaping section. The beds are already in place, merely cleaned of the newly listed noxious weed, Hedera helix. We will be putting plants into existing landscape areas, and not adding three inches of topsoil, nor, with the exception of the new parking lot islands, digging to 18" depth, as existing plant materials would be injured or killed. Likewise, we find the code requirements for the Landscape Island near the driveway a potential cause for accidents from 320th, a relatively fast street. For this we are asking for a Landscape Modification, or at least onsite review where the requirements of the code are understood against the existing conditions. We removed a maturing pine from this same location for safety/visibility reasons, and are proposing to lower the existing berm because you can't see over it to enter/exit the library. City Proposed Parking Island Near Drop Boxes: Two parking stall have been removed and a new planting island added to the design. Refer to revised plan sheet L-3.9A b. Landscape Island Near Driveway: We are requesting a landscape modification per section 22-1570 and section 22-1564 General Landscape requirements (r). The existing landscaping is being altered to increase visibility at point of ingress/egress. Replacing with 5' of Type III landscape or 3ft berm would create an unsafe condition. The design has been revised adding (6) additional shrubs to the planting bed. c. Landscape area South of Existing Building: The existing planting of shrubs and trees along 320`h varies in width from 13ft to 34ft. The modification we are showing is to remove only the lawn area (13ft wide) in the area abutting the public right of way and replace it with Salal a native drought tolerant shrub. All other plantings south of the building are outside of the required landscape areas, though they also consist of native plant material. d. West Perimeter Landscaping: The existing vegetation along the west perimeter includes mature Pacific Wax Myrtle, Strawberry Trees, Tall Oregon Grape, Rhododendrons, Salal, as well as Douglas Fir and Western Red Cedar trees. We are requesting a Landscape Modification per Section 22-1570 (b)(4), English Ivy is taking over the native Salal and girdling the significant trees on the site. The groundcover is being replanted per code and will be planted using triangular spacing where possible. The removal of the dead trees along the west perimeter is for safety concerns. Several mature douglas fir trees and cedars are located close to where the trees are being removed. Further disturbance to the site as mentioned in paragraph e(2) concerning adding (18) inches of topsoil to all existing landscaping would only harm the existing shrubs and possibly kill the significant trees. e. General Landscaping: (4) inches of topsoil required: The only "new planting" area to receive plants will be the City Proposed Planting Island by the drop boxes that will receive (18) inches of topsoil per code. All other areas have existing topsoil that is supplemented by mulch and maintained by the King County Library System. We will be amending existing lawn topsoil with 3" of new topsoil incorporated to a depth of 8" for the plantings on the south side of the building. (I8) inches of topsoil required: The new plans showing the planting island by the drop boxes will include provisions for the (18) inches of topsoil. (above) for description of existing site topsoil conditions. Permanent Curb: We are not aware of any landscape areas within or abutting parking areas that do not already have a permanent curb. We have indicated a small length of curb that needs to be replaced because of damage. Evergreen Tree Height Requirement: We have revised our planting schedule size note to read 6ft ht. in lieu of 5-6ft ht. Deciduous Tree Caliper Requirement: Our reviewed plan set did not include deciduous trees so a revision should not be necessary. We may include deciduous trees as part of the new planting island and will specify 1.5 cal. per code if needed. Shrub Height Requirement: We have revised our plant schedule to indicate plant height. Ground Cover spacing requirements: The plans have been revised showing a triangular spacing detail on the planting detail sheet. Site Distance: New planting will not be installed in critical site distances. Note paragraph b (above), City recommendation for installing type III landscaping or a 3ft. berm at the point ingress/egress would compromise this code paragraph, creating an unsafe condition. No plant Material 12 " or greater: The drawings have been revised with a note for this requirement. Garbage and Recycling Facility: All issues have been addressed. Building Department Comments: a. One additional tree shall be planted for landscape islands up to 305 square feet. Tree, shrub, and groundcover spacing shall be appropriate for the species type. Pursuant to 22-1567 landscape islands shall be a minimum size of 64 square feet and a maximum of 305 square feet, and a minimum width of six feet at the narrowest point for islands at the end of 90-degree parking rows. Pursuant to FWCC Section 22-1567 all landscape islands within parking areas shall use drought tolerant trees, shrubs, and groundcovers. General Landscaping o Pursuant to FWCC Section 22-1564, landscaping areas shall contain at least four inches of topsoil at finish grade. You have proposed to use three inches of topsoil at finish grade. You have proposed to use evergreen trees that measure five to six feet in height. If necessary, please revise the plans to meet the code requirements. o Pursuant to FWCC Section 22-1567, no plant material greater than 12 inches in height shall be located within two feet of a curb or other protective barrier in landscape areas adjacent to parking spaces and vehicles use areas. Since your plans do not indicate this information, please include it in the revised plans in order to meet the code requirements. o Pursuant to FWCC Section 22-1564, at least 25 percent of new landscaping materials shall consist of drought tolerant species. Your plans indicate that you are in compliance with this code requirement. If any changes in quantity or type occur to the planting schedule, please be sure to revise the plans in such a way as to continue meeting this code requirement. Garbage and Recycling Facility: Provide written response and revised site plans to address the following item: Pursuant to FWCC Section 22-949, recycling receptacles are required to be placed on site and must meet a minimum size of 65 square feet. Pursuant to FWCC Section 22-1564 all trash enclosures shall be screened by a 100 percent sight -obscuring fence and appropriate landscape screen. As presented in the submitted plans, you currently meet the screening requirements of FWCC Section 22-1564. You have proposed to enclose the garbage and recycling facility with a 100 percent sight - obscuring wooden fence. I am sorry you are being inconvenienced by the improvements to the library. Unfortunately, the contractor was doing construction without a permit form the City and went beyond what the City considers maintenance. We were forced to stop the project until they acquire the proper permits. The contractor has been told what they need to do and we'are waiting for them to submit the plans. It is a fairly straight forward project so it shouldn't take us long once we have their submittal. Maybe in the meantime, you could ask that they add a temporary screen. I am one of the residents that live behind the King County library on 320th where construction of a fence line and other things are being constructed at the Library. I saw that there was a cease and desist order enacted upon the contractors and the library till appropriate changes were made on work that was originally bought off by everyone, including the city. As a resident living behind the library feel our privacy has been invaded by the contruction, we were dealing with that issue. But now a stop work order was enacted by the city and we have no idea of how long it is going to be before the project will be finished. The Architect says the original 3-4 week issue will now be around 45 more days. We are just a little tired of headights in our dining and living rooms and people staring into our property and braking our privacy. Can anyone with the City of Federal Way please tell me what is happening? I feel this whole issue has been unfair to the residents, and certain things stated at meetings that were held with the contractor and the King County library folks for the residents privacy were not addressed as per stated.
