bulkhead establishing the highwater mark. The application is a result of the King County Shoreline survey identifying
shoreline work.

regulated due to the biologically sensitive nature of shorelines/salmon under the state Shoreline
Management Act, and in turn under our local regulations the City Shoreline Master Program and
development code.
If the work appears to fit within the definition of regular maintenance and repair a shoreline substantial
development permit exemption may be issued. I am assuming the structure has not been increased in
height?

I am in receipt of your letters May 13, 2014 and January 16, 2015 concerning our house at 5426 SW
3151h Street, Federal Way, WA. This apparently concerns work on our bulkhead 12-24 months prior to
the May letter. In reviewing our records, we did replace a rotten board that sits on top of the
bulkhead. It doesn't touch the water or the beach, and it never dawned on us that we would need a
permit for such a simple repair. We may have also replaced some boards on a walk way that leads to
our house, although that is not near the bulkhead or the water. I can take some pictures, if you like,
but will be out of state until January 30.

The Community Development Department kindly requires the submission of a complete shoreline
exemption application to address unpermitted shoreline work at 5426 SW 315th Street, Federal Way.
Per email correspondence with you on January 28, 2015, action on the subject property included the
repair on an existing bulkhead with no height increase and the replacement of walkway boards leading to
the house. The normal maintenance or repair of existing structures or developments satisfies exemption
outlined in Washington Administrative Code (WAC) 173-27-040(2)(b)&(c).
We request a timely application submittal by March 17, 2015. Please submit the enclosed application
with a site plan, bulkhead/seawall and walkway pictures, and a brief project narrative to the Permit Center
(253-835-2607). The application fee is $105.50 payable to the City of Federal Way. I can be reached at

The City of Federal Way notified the owners of 5426 SW 315nh Street, Federal Way, in May of 2014 regarding
code compliance issues on the subject property. Unfortunately, the correspondence was returned as the
property was unoccupied at that time. Enclosed please find the initial code compliance letter providing
further details on the waterfront improvement constructed without associated permits and shoreline
management program land use approvals. If the property owners have since changed, please advise the
Community Development Department.

The latest shoreline survey conducted by King County in 2012 identified that repair of an existing wood
bulkhead has been done on your waterfront property in the last 12-24 months. Our records indicate that
shoreline and building permits were not obtained for the above referenced improvements. If that is incorrect,
please provide us with evidence to that effect and we will update our records.
Waterfront improvements of this kind typically require permits because of ecological and safety concerns.
With proper permitting, shoreline projects can be carefully designed for minimum impact to the ecological
function of the shoreline.
Within the next two weeks, please contact Planning Manager Isaac Conlen (253-835-2643, or
isaac.conlen@cityoffederalway.coin) to discuss the work that occurred and the permitting process to bring
the site into conformance. Please prepare a site plan drawing/sketch that shows the improvements that have
been made. Photographs may also be helpful.
