Your request is granted based on FWRC Section 11.05.080 2.b., which allows the requirement to be waived based on undue hardship, further defined as "the cost of the underground construction outweighs the general welfare consideration in requiring underground construction." This is a reconstruction project for a house that was damaged by fire. An additional 913 square feet of floor area over the original building size is proposed, which triggers this code requirement. To reach the existing power pole, the applicant would need to bore under the street. An estimate of a minimum of $7,200.00 was provided, which is over twice the cost of the service alone. Since this is an established neighborhood where overhead service connections are typical, the cost of the underground construction outweighs the general welfare consideration. Be advised that this approval is applicable to the permit as it was submitted on February 25, 2015, and any expanded scope of work could nullify the waiver. If she were only replacing the house to its current size, code would not require her to underground (FWRC 19.30.130). Since she is adding 913 square feet to the home, and the addition is valued over $20,000, FWRC 11.05.120 requires her to place her service connection underground. She is requesting a variance to the code based on undue hardship: "The cost of the underground construction outweighs the general welfare consideration in requiring underground construction" (FWRC 11.05.080 2.b). The property is located within a well -established neighborhood, where currently the only development applications are occasional remodels or additions. Overhead service connections are typical of the homes in this neighborhood. In this case, poles are located on the opposite side of the street, so undergrounding the service connection would involve trenching or boring to bring underground service to her home. She has submitted an estimate of $2,500.00 for the service and $4,700.00 to install conduit, trench, and patch the road. Streets Department would not allow the trench but would require a bore, which is normally more expensive. Since this is primarily replacement of an existing structure, in a neighborhood where overhead service connections are standard, Development Services Department recommends approval of this request. I am the owner at the property located 32808 2911 Avenue Southwest, Federal Way VITA, 98023. The home suffered major fire damage on June 25, 2014 and was deemed a total lass by the fire department. The cause of the fire was undetermined. 4 am in process of reconstructing the home. Code 11.05.100 states that I must come up to code and put all cables underground. The extent of overhead servicing in the area, and the extensive works to underground wiring beyond the subject property would cause undue hardship. 11.05.080 Variance procedures I am seeking a variance to waive the requirement for underground electric power distribution - The cost of the underground construction outweighs the general welfare consideration in requiring underground constriction. My property is located in a residential subdivision and power distribution is currently overhead in the area, with a power pole across the street from the property. I would need to trench and lay conduit from my house to the power pole across 29111 Avenue Southwest, roughly 90 feet. This would involve demolition of 29th Ave SW for the path of the utilities. This process would cause undue hardship in time completion and money to put utilities underground. Utilities would include electrical cables, phone and internet cables. The cast for utilities underground would be roughly $7,300 or more. I have attached an estimate for trenching, laying the conduit and repairing the street. The insurance company will not pay for the underground cables or any costs associated with the code. Allstate claim # 0331694034. The complex processes would require a longer amount of time and money that is not allotted for, causing undue hardship. If 11.o5.80 variance is accepted, PSE will hang overhead cables, as it was originally, for no cost to me. The new structure will have an additional 913 square feet. The cost of the new structure is similar to the cost of "rebuilding" the old structure. Please see attached documentation that shows the amount to "rebuild" the old structure for 970 square feet and the estimate for the new 1883 square foot home. Roof runoff would need to be controlled onsite, to the extent feasible, with a Best Management Practice ( "BMP" ) meeting 2009 King County Surface Water Design Manual requirements, and frontage improvements would be required. Looking at -the surrounding property, you may not actually have to build new sidewalk, curb and gutter, but you may have to apply for a Right -of -Way Modification.
