Dear Ms. McDonald:
This modification responds to your request to revise the original permit exemption scope of work, which
included the replacement of one of three creosote float pilings associated with an existing pier and
floating dock located on the marine shoreline of the above -referenced address, to the replacement of all
three float pilings. The creosote pilings are proposed to be replaced with 10-inch galvanized steel pilings.
The modification request is hereby approved as the proposed piling replacement continues to meet
exemption criteria set forth in the initial exemption letter by this agency dated January 25, 2011 The
replacement of three creosote pilings with three galvanized steel pilings is consistent with the city's
Shoreline Master Program as it relates to replacement, alteration, or reconstruction of nonconforming use
or development.
The modification remains exempt from State Environmental Policy Act review as it continues to meet
exemption WAC 173-11-800(3) for minor repair of piling, ramps, floats, and docks.
Closing
This letter does not exempt the applicant from any applicable state or federal permitting requirements that
may be needed. The state Department of Fish and Wildlife and Army Corps of Engineers have their own
requirements for construction activities in and near shoreline areas and should be consulted prior to

Dear Mr. Drangsholt and Ms. Woloshyn:
This exemption responds to your request to repair an existing 8' x 80' floating dock located at 200 SW
292"d Street on the Puget Sound shoreline. The scope of the repair is limited to the replacement of one
failed piling caused by storms during November 2010.
Shoreline Substantial Development Permit Exemption
The state Shoreline Management Act codified in Washington Administrative Code (WAC)173-27-040
identifies actions exempt from substantial development permit requirements. WAC 173-27-040(2)(b)
exempts normal maintenance and repair of existing structures caused by accident, fire, or elements. This
exemption is limited to repairs that restore structures "to a state comparable to its original condition,
including but not limited to its size, shape, configuration, location, and external appearance, within a
reasonable period after decay or partial destruction, except where repair causes substantial adverse effects
to shoreline resource or environment."
The exemption is approved based on the following findings:
1. the repair is needed due to damage by weather;
2. the scope of the repair is limited to the replacement of one piling resulting in restoration
comparable to its original condition; and
3. there is no evidence that this activity will result in substantial adverse impacts to shoreline
resources or environments. Therefore, repair of these piers is considered an exempt action and
does not require a shoreline substantial development permit.
State Environmental Policy Act (SEPA) Exemption
WAC 173-11-800 specifically exempts minor repair of piling, ramps, floats, and docks. Due to the limited
scope of repair identified above, in which the city has concluded is minor, the proposal is exempt from
SEPA review.
Nonconforming Development Standards
The city's current Shoreline Master Program development standards codified in Federal Way Revised
Code (FWRC)15.05.050(5)(a) does not allow docks on the Puget Sound shoreline. As stated in the
proposal, the dock was originally constructed in 1967 prior to current regulations; therefore, the dock is
considered a nonconforming structure. FWRC 15.05.150(2) allows reconstruction of damaged
nonconforming structures only if the repair is below 75 percent of fair market value of the structure;

otherwise it may only be constructed per current regulations, which would result in the removal of the
entire structure due to the current prohibition of residential docks along the marine shoreline.
You have indicated replacement value of the floating dock at $35,000.00 to $45,000.00, which represents
fair market value. The cost of the proposed repair work is approximated at "several thousand dollars."
Assuming several thousand dollars represents an amount less than $10,000.00, the 75 percent threshold is
not exceeded and the nonconforming dock may be repaired as proposed.

Dear Mr. Conlen,
We have lived at the above address since December 1993, and own the home at the premises.
Our home is located on the waterfront of Puget Sound and we have both a stationary and floating
dock that was constructed after our home was originally constructed in 1967 by the Elvin family.
On December 30, 2010, our most outside wood piling, which was weakened in the November
storm, fell over, and was broken completely in half. Our 8 x 80 foot floating dock was
connected to this piling and it is critical to the structural integrity of the dock structure. We need
to replace the piling as soon as possible to prevent further damage to entire dock structure.
Another strong Northerly wind storm could potentially severely damage the floating dock.
Mark has talked with Keith Dearborn, a maritime attorney in Seattle, and your own planner,
Janet Shull, and both have advised us to ask for a shoreline exemption to allow for the immediate
replacement of the piling. Depending upon the type of piling, the cost for replacement should be
far below 75% of the total cost of the replacing the entire floating dock, which would cost about
35,000- 45,000 dollars. Placement of a single piling, we have been advised, will not cost more
than several thousand dollars, at the most.
We've attached a 1996 aerial photograph of the dock and current photos showing the
presence/lack of an outside piling. I've also enclosed a check for $91.50 to pay for this
