Based on your description and preliminary design plans, the proposed building will be smaller than the existing building and will not be more nonconforming than the existing building. The proposed changes will also require stabilization of the existing slope around the building. After reviewing the proposal, description, and previous review by City staff on a previous similar proposal at the site, the requirements for the replacement cabana are largely the same as identified in the City's June 22, 2015, letter from Planning Manager Isaac Conlen to Karen Kline. All of the review process and permit requirements except as noted below are the same as previously outlined, as no applicable codes have changed since the 2015 review. The following will expand on a couple of potential code issues identified in the June 22, 2015 letter. To clarify, a geotechnical report and review will be required as previously identified in item 1 under potential code issues. When you submit the geotechnical report to the City, we will require third party review of the report by one of the City contracted geotechnical consultants. The applicant will be required to pre -fund review by outside City consultants. An Administrative Decision application (enc.) must be submitted with submittal of the geotechnical engineering report. Four copies of the report plus a copy on disk must be submitted to the City. 2. Items 2 — 5 outlined in the June 22, 2015, letter all apply and must be met and submitted to the City. 3. In accord with state law, the proposal is required to submit a floodplain permit application with a Habitat Assessment. The Habitat Assessment must be prepared by a qualified professional familiar with the assessment process. If any habitat is found to be impacted by the development, then a mitigation plan will have to be prepared, submitted and approved. Any required mitigation must be completed or financially guaranteed before any building permit can be issued. Ms. Kline July 18, 2018 Page 2 4. An affidavit must be provided by the property owner, stating that the cabana will not be used as an accessory dwelling unit. Absent this affidavit, the structure would be required to comply with the ADU requirements and registered as an ADU. 5. With the building permit application for the cabana, provisions for sewer service to the proposed building must be identified. 6. The applicant is responsible for identification and compliance with any applicable state and/or federal permit requirements. The above is not intended to represent permit review comments, but simply to alert you to several issues so that you are aware of the relevant code sections and can address those in your application submittal.
