After evaluating the existing conditions along the referenced street, review of Federal Way City Code (FWCC) provisions (Section 22-1477, 22-1496), and direction provided by the City Council, the Public Works Department hereby waives the requirements for the street improvements. Code Section (FWCC) 22-1477, Modifications of Improvements Along Property Frontage, allows the Public Works Department to grant a request to modify, defer, or waive the required street improvements only after consideration of four specific reasons. The reason most applicable here is contained in FWCC Section 22- 1477(l), "Improvements as required would not be harmonious with existing street improvements." SW 293d St is classified as a residential street, corresponding to Federal Way Roadway Section "S". This roadway section requires a thirty -six-foot paved roadway, a four -foot planter strip, a five-foot sidewalk, and a three-foot utility strip, all w1thin a sixty -foot right-of-way. Application of the required street improvements would result in an improved street section that is not harmonious with existing street improvements, which consists of a twenty -four -foot paved roadway within an eighty -foot right-of-way. The conditions of this right-of-way modification will be applicable for a period Of one year from the date of this letter. If a building permit is not issued within the one-year time limit, this waiver will be void and a new request for modification must be submitted. The applicant must also execute a City of Federal Way Local Improvement Distr�ct Waiver of Protest Covenant ('No -Protest LID'), in the event a future LID is formed to bring SW 293d St. up to required street improvement standards. The No -Protest LID must be signed, notarized, and returned to the City prior to issuance of a building permit. It will be sent under separate cover. I'd like to retain the existing driveway to the property and the existing small parking area. To do this would require a Waiver of the FWRC Chapter 19.135.030. An existing single car garage and its small driveway, both of which are mostly located in the city right-of-way will be removed and replaced with landscaping. The right-of-way improvement as required would not be harmonious with the existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or City as a whole. In addition, unusual topographic or physical conditions preclude the construction of improvements as required. Please see the attached Site Plan which delineates the present property and the present status of the right-of-way, the proposed elimination of the single car garage with its small driveway and the continued utilization of the existing driveway and parking area.
