Dear Mr. Bridge:
I am in receipt of your September 21, 2011 letter, which is an initial request to remodel an existing boathouse
located on the Puget Sound shoreline of the above -referenced property.
Existing Conditions: You note that the existing boathouse has 6-inch concrete walls on three sides and
appears to have been built at the same time as the adjacent bulkhead. There are remains of a rail system that
was used to transfer boats from the water to the boathouse. The boathouse has a wood deck roof and
measures 13 feet wide x 21 feet long x 7 feet high (13x21 = 273 SF). The boathouse is located 4.5 feet
upland from the face of the bulkhead.
Proposed Improvements: Your client is interested in using the boathouse for boat storage, and you have
inquired about raising the wood deck roof from 7 feet tall to 10.5 feet tall, and about extending the northern
portion of the deck 4.5 feet beyond the boathouse footprint, to the edge of the bulkhead. You note that you
would repair and replace the marine rail system under a separate permit.
(A) Shoreline Regulations: The city regulates development in shorelines of statewide significance including
the Puget Sound Shoreline through its shoreline management regulations, including accessory structures in
the shorelines, nonconforming structures, and boating facilities. The shoreline designation is Shoreline
Residential.
Accessory Structures: A boathouse is considered an accessory structure to a residential property under
shoreline regulations, and is permitted in the shoreline setback subject to specific standards. Pursuant to
standards table in Federal Way Revised Code (FWRC) 15.05.070(6), residential accessory structures
within the required shoreline setbacks may not be taller than eight feet in height' and are limited to 150
square feet per structure and 300 square feet total per lot.
Nonconformance: In the case of the existing 273 square -foot boathouse, the building exceeds the
maximum size of an accessory structure. As an accessory structure that exceeds the square foot size
standards, it is considered a nonconforming structure within the shoreline setback. Under FWRC
15.05.220, modifications to a nonconforming structure may be approved only if
(a) The modification will make the development less nonconforming; or
(b) The modifications will not make the development more nonconforming; and
(c) Structures that were legally established and used for a conforming use but which are
nonconforming as to area, bulk, etc. may be maintained and repaired and may be enlarged or
expanded provided that said enlargement does not increase the extent of the nonconformity by

further encroaching upon or extending into areas where construction or use would not be allowed
for new development or uses.
(B) Analysis of Requests
#1 Height - The height of the boathouse cannot be increased because an increase in height will increase
the overall volume of the nonconforming structure, which already exceeds the maximum size of an
accessory structure, and an increase in height will make the nonconforming structure more
nonconforming.
#2 Roof - The boathouse roof deck cannot be increased in size as the boathouse already exceeds the
maximum size of accessory structures and an increase in the size of the boathouse roof deck will make
the overall boathouse development more nonconforming.
#3 Rail System - Under FWRC 15.05.030 definitions, a rail system is considered a "boating facility" and
is not authorized for single family uses. If the rail system was previously permitted, and if the proposed
work can be classified as "normal maintenance or repair of existing structures or development,
including damage by accident, fire or elements" per Washington Administrative Code (WAC) section
173-27-040(b), the rail system repair could be reviewed as a project that is exempt from the
requirements of a Shoreline Substantial Development Permit z
If rail system repair is determined to be normal maintenance or repair as discussed in #3 above, a SEPA
checklist and a request for an exemption to the Shoreline Substantial Development Permit requirements must
be submitted. A preapplication conference will be required unless exempted under FWRC 19.40.030. Repair
of the boathouse could also be permitted under WAC 173-27.040, with a shoreline exemption request.
Please note that as provided in FWRC 15.05.040(6)(b), proposals for ground disturbing activities in areas
known to contain historic, cultural, or archaeological resources shall require a site inspection and evaluation
by a professional archaeologist prior to issuance of a permit or initiation of ground disturbance. In light of
recent discoveries, the Washington State Department of Archaeology and Historic Preservation (DAHP) will

2 Subsection 040(b)(2) goes on to state that normal maintenance and repair means to restore a development to a state comparable to
its original condition, including but not limited to its size, shape, configuration, location, and external appearance, within a
reasonable period after decay or partial destruction, except where repair causes substantial adverse effects to shoreline resource or
environment. The definition also includes replacement where, "...replacement of a structure is the common method of repair of such
structure."

Dear Deb,
This is an initial request for repair/improvements on the existing boathouse located at
2854 SW 300" Pl, Federal Way.
The existing structure has 6" concrete walls on three sides and appears to be built about
the same time as the bulkhead. There is also the remains of a rail system that was used to
transfer boats from the water to the boathouse. It has a wood deck roof and measures 13'
wide by 21' long by 7' high. It is located 41/2' from the bulkhead face. Please see
enclosed pictures.
We ask that we be allowed to raise the wood deck roof from 7' to 10 %2" and extend
(cantilever) the roof deck 41/2" feet to the edge of the bulkhead. It is our hope to be able
to use the boathouse for its original use, boat storage. We will request repair and
replacement of the marine rail system by separate permit.
