NWAA/SWCA Project No. 22459. Project Location and Description NWAA/SWCA was contracted by Michelle and Robert Bessler to conduct archaeological monitoring of landscaping activities at 2854 SW 300th Place in Federal Way, Washington (Figure 1). The project is located along the shoreline of Puget Sound east of Dumas gay in southwest King County in the S the NE X of the SW / of Section 1, T. 21N., R. 3E, Willamette Meridian. The €]epartment of Archaeology and Historic Preservation (DAHP) requested an archaeological assessment of theproperty landscaping, g g� (or) archaeological monitoring during ground -disturbing activities. This request was based on the shoreline setting and proximity to archaeological site 4SKI732, a pre -contact shell midden located approximately 100 feet southwest of the property. Proposed landscaping nduded the excavation of two small benches (patio nooks) and associated erosion control walls into the natural terrace above the shoreline (Figure 2). The proposed excavations would be approximately 10 feet south of the existing concrete bulkhead and approximately 3-4 feet deep. Archaeological background Four pre -contact archaeological sites have been recorded along the Puget Sound shoreline between Dash Point and Redondo. Site 45K158, is a pre -contact shell midden, located mile approximately /, , southwest and composed of eleven different species of shell, a flaked -stone cobble and fire -modified rock (Moura 1980). In 2006, a pre -contact shell midden (45KI732) was recorded approximately 100 feet west of the Bessler property (5hong and Miss 20Q6), The site consisted of a 25 cm (10 inch) thick deposit of charcoal -stained sand and gravel containing shell, bone and fire -modified rock (Shoo 20()6). When recorded in 2006, the site was suspected to likely continue east along the relatively level, low- lying terrace. This area was expected to contain sutistantial intact cultural deposits based on the relatively minimal landscaping and protection from erosion by concrete bulkheads. The Bessler property occupies this low-lying terrace and NWAA/SWCA considered the proposed landscaping activities to have a veryhigh probability for encountering p y g p y ggre-contact archaeological resources. Tribal Coordination Prior to fieldwork, NWAA/SWCA sent letters to the Puyallup and Muckleshoot Indian Tribes to inform therm of the proposed project (Attachment A). The presence of concrete pipe fragments and slightly odiferous sediments tends to corroborate this belief. Conclusions and Recommendations Archaeological field reconnaissance in response to proposed landscaping activities at the Bessler property documented additional pre -contact archaeological deposits associated with site 45KI732. Recent construction of the Bessler residence also appears to have disturbed a portion of the site. Limited subsurface investigation confirmed that archaeological deposits exist beneath proposed landscaping footprints and that ground disturbing activities in these areas would disturb potentially significant pre -contact deposits. NWAA/SWCA has prepared an update to the State of Washington Archaeological Inventory Form for site 45KI732 and submitted the form to the DAHP. Per the NWAA/SWCA scope -of -work for this project, work was stopped on discovery of archaeological deposits, while the findings are reported to DAHP and affected Tribes. This process may initiate consultation, whereby you, as the landowner, DAHP, and the Tribes discuss options to proceed. NWAA/SWCA recommends that the site be avoided and protected. Avoidance of the site will likely require modifications to the existing landscape design. One protection alternative would be to cover the archaeological site area with geotextile fabric and cover the area with fill sufficient to accommodate plantings and other landscaping features. The shell midden exposed in profile along the northeast edge of the property should also be covered with geotextile fabric and protected from further erosion with a rock or concrete barrier. If ground disturbance to any area within 30 (100 feet) of the shoreline cannot be avoided, NWAA/SWCA recommends archaeological testing to assess the significance and integrity of archaeological deposits in that area and to identify the need for further protective or mitigation measures. The DAHP has defined the requirements for an archaeological excavation and removal permit (chapter 25-48 WAC) and has developed an application form. Archaeological excavation permits are reviewed and commented on by both the DAHP and the Tribes. The Department of Archaeology and Historic Preservation (DAHP), in a letter dated November 30, 2011, stipulated that a damage assessment of the site (within the Bessler property) must be performed to document any alteration of the site caused by construction and an excavation permit must be secured before any additional ground disturbing activities or fill placement can occur. In 2006, 45KI732 was recorded just west of the Bessler property. The site was composed of charcoal -stained sand, shell, bone and fire -modified rock observed in profile along the wave - eroded shoreline (Appendix A). In 2011, additional pre -contact archaeological deposits were observed at the Bessler property during field reconnaissance for proposed landscaping activities. Prior to field reconnaissance, the northern margin of the property had been stripped of sod exposing fill and pre -contact shell midden. Recent house construction had also exposed shell midden along the northeastern property margin. The state Archaeological Sites and Resources Act (RCW 27.53) prohibits excavation of an archaeological site without obtaining a written permit. The State has defined the requirements for an archaeological excavation and removal permit (chapter 25-48 WAC) and the DAHP has developed an application form. The following pages present the Archaeological Excavation Permit Application and the explanatory attachments required to accompany the permit application: WAC-25-48-060 1(a-q) Attachment 1(a). Background and summary of previous field investigation, research, and data gaps about the site proposed for excavation. Attachment 1(b). The nature and extent of the work proposed, including how and why it is proposed to be conducted and the methods proposed for excavation and recovery, number and placement of excavation units, proposed excavation volumes, proposed time of performance, location maps, and a completed site inventory form. Northwest Archaeological Associates / S WCA February 9, 2012 CONTAINS CONFIDENTIAL INFORMATION NOT FOR GENERAL DISTRIBUTION Archaeological Excavation Permit Application for 45KI732 Attachment 1(a): Background and summary of previous field investigation, research and data gaps about the site proposed for excavation. In 2006, a pre -contact shell midden (45KI732) was recorded approximately 100 feet west of the Bessler property (Shong and Miss 2006). The site consisted of a 25 cm thick deposit of charcoal -stained sand and gravel containing shell, bone and fire -modified rock (Shong 2006). When recorded in 2006, the site was suspected to continue east along the relatively level, low- lying terrace. This area was expected to contain substantial intact cultural deposits based on the relatively minimal landscaping and protection from erosion by concrete bulkheads. The Bessler property occupies this low-lying terrace and was considered to have a very high probability for containing pre -contact archaeological resources. In November 2011, NWAA/SWCA was contracted by Michelle and Robert Bessler to conduct archaeological monitoring of proposed landscaping activities at their newly constructed house at 2854 SW 300th Place in Federal Way, Washington. An archaeological survey of the property was requested by the DAHP based on the shoreline setting and proximity to 45KI732, however the property owners opted to conduct archaeological monitoring in lieu of a survey. Prior to monitoring, the northern (shoreline) margin of the property had been stripped of sod exposing the underlying soils composed of fill and pre -contact shell midden consisting of dark, grayish - brown charcoal -stained sand with sparse shell concentrated along the terrace edge. Additionally, mechanical excavations, possibly associated with construction of the new house, exposed shell midden in profile along the northeastern property margin. The shell midden exposed in profile consisted of black, charcoal -rich fine to coarse sand with abundant marine shell and fire -modified rock (FMR). Cursory inspection of the exposed profile revealed intact cultural deposits and a possible fire hearth feature near the contact with the underlying soil B- horizon composed of a reddish -brown fine- to medium -grained sand. The midden had a maximum thickness of 35 cm but thinned gradually toward the south as it transitioned into a non -cultural soil A -horizon. Several faunal bone and lithic flakes derived from medium- to fine- grained volcanic material were observed within displaced midden spoil in the northeast corner of the property. The loose, surface midden in this area appeared to have been mechanically pushed over the terrace edge, likely during grading for the new house foundation. A small trench measuring approximately 50 x 150 cm was mechanically excavated in one of two areas proposed for landscaping (Figure 2). This area did not contain exposed shell midden and consisted of a 45-degree slope between the terrace edge and the shoreline bulkhead. The trench revealed a 10-20 cm thick deposit of shell midden sloping toward the shoreline. The midden in the southern half of the trench profile contained very few shells and appeared re- worked (disturbed/displaced) while the northern (down slope) half of the profile contained relatively abundant charcoal, shell and FMR. The cultural deposits capped a presumably intact soil B-horizon composed of light yellowish -brown fine- to medium -grained sand. A 30 cm diameter shovel probe excavated just north of the trench and approximately 1.5 m south of the bulkhead revealed approximately 30 cm of rounded beach gravel overlying the shell midden. The shell midden observed in the shovel probe was not investigated and its thickness and integrity remain unknown. The NWAA/SWCA monitor requested that no further ground disturbing activities take place until the findings were reported to the DAHP and affected Tribes and options to proceed were discussed. NWAA/SWCA prepared a letter report describing the results of monitoring and observed cultural material at the Bessler property (Shong and Miss 2011). NWAA/SWCA also Northwest Archaeological Associates / SWCA February 9, 2012 CONTAINS CONFIDENTIAL INFORMATION NOT FOR GENERAL DISTRIBUTION 6 Archaeological Excavation Permit Application for 45KI732 completed an update to the State of Washington Archaeological Inventory Form for 45KI732 and submitted the form to the DAHP. NWAA/SWCA recommended that archaeological deposits associated with 45KI732 be avoided and protected through modifications to the existing landscape design and covering the exposed archaeological deposits with geotextile fabric and fill sufficient to accommodate proposed landscaping features including plantings, pathways, and placement of small boulders. The DAHP subsequently recommended that a damage assessment be conducted to determine the extent and integrity of archaeological deposits within the Bessler property. The DAHP also required that an archaeological excavation permit be secured before any additional ground disturbing activities or fill placement can occur. To date, archaeological investigation of 45KI732 has been limited to observation of a small section of wave -cut shoreline and observation of mechanical disturbances at the Bessler property. An accurate boundary for 45KI732 has not yet been established and the extent and integrity of archaeological deposits within Bessler property are poorly understood. Field Investigation The proposed archaeological investigations consist of two tasks. Task 1 will focus on evaluating the extent of the site on the property, document the condition of the site, and determine whether the deposits are intact or disturbed. Task 2 will consist of monitoring the placement of fill and sifting any disturbed midden deposits in areas of proposed landscaping. Damage Assessment and Subsurface Investigation The damage assessment will focus on defining the vertical and horizontal boundaries of 45KI732 within the subject property. The assessment will also evaluate the integrity of cultural deposits within proposed landscaping footprints (patio nooks). The assessment will be completed in one day using up to twelve 10-cm diameter auger probes (0.13 m3) excavated across the site and two 50 cm square excavation units (0.10 m3 ) excavated within the proposed patio nook areas (Figure 2). Auger probes will be manually excavated in 20 cm arbitrary levels down to culturally -sterile deposits to determine the depth and character of cultural deposits across the site. Excavation units will be manually excavated in 10 cm arbitrary levels down to culturally -sterile deposits. The location of each test excavation will be recorded with a hand- held Trimble GPS unit. Excavated sediments will be passed through %-inch mesh screen. Auger probes and excavation units will be recorded on standard forms documenting the depth and character of cultural deposits. At least one wall of each excavation unit will be drawn. Cultural material recovered auger probes will be documented in the field and placed back into the hole in which it was found. Cultural material recovered excavation units, with the exception of fire -modified -rock (FMR), will be analyzed at the NWAA laboratory. FMR will be counted and weighed in the field and placed back into the hole in which it was found. Charcoal may be collected from intact cultural features such as fire hearths, or collected from excavation profiles and submitted for radiocarbon analysis. Post Assessment Fieldwork An archaeological monitor will be present during the placement of fill across the site. The monitor will ensure that geotextile fabric is placed on the ground surface prior to the placement of fill. The intent of the geotech fabric is to create a barrier between cultural deposits and the fill. The two proposed landscaping excavations (patio nooks) occur on a 45-degree slope between the terrace edge and the shoreline bulkhead. The central nook area measures approximately 8 x 4 m and the eastern nook area measures approximately 4 x 3 m. Both nooks will be excavated into the hillside between 3 to 4 feet deep. A small trench excavated during the 2011 field reconnaissance suggested this sloping landform may contain re -worked, or displaced cultural deposits. If test excavations conducted as part of the damage assessment determine that cultural deposits within the proposed patio nooks are disturbed and lack integrity, they will be considered non -noncontributing portions of the site and will be sifted through 1/4-inch mesh screen to recover any pre -contact cultural materials and to ensure that no human remains are present. Cultural material recovered from this process will be collected and given to the property owner (see Attachment 3). If human remains are observed, the area will be covered Northwest Archaeological Associates / SWCA February 9, 2012 CONTAINS CONFIDENTIAL INFORMATION NOT FOR GENERAL DISTRIBUTION Excavation Permit Application for 45K1732 and protected until the appropriate legal steps are taken and Tribal and State representatives are consulted (see Attachment 1(e)). Alternatively, if cultural deposits within the proposed landscaping nooks are determined to be intact, and retain data potential, then they will be avoided and protected. The Besslers have indicated that if one or both patio nooks contain intact cultural deposits, they do not wish to engage in data recovery excavations based on the associated costs. Reporting The damage assessment will summarize the field findings in a letter submitted to DAHP, the Puyallup Tribe, and the Muckleshoot Tribe. Based on the results, the letter report will make recommendations for any additional measures that may be needed to prevent damage to archaeological deposits prior to final landscaping. A letter summarizing monitoring and post assessment fieldwork will be submitted to DAHP and the affected tribes. Northwest Archaeological Associates / SWCA February 9, 2012 CONTAINS CONFIDENTIAL INFORMATION NOT FOR GENERAL DISTRIBUTION 10 Archaeological Excavation Permit Application for 45K1732 Attachment 1(c): Summary of the environmental setting and depositional context, with an emphasis on vegetation, past and present available natural resources, geomorphology and formation processes, and their relationship to the archaeological deposits. The site offered a favorable landform for occupation to pre -contact inhabitants with access to fresh water and marine resources. The site occupies a low terrace above the marine shoreline of Dumas Bay in the southern Puget Sound. Several small drainages extend from the hillside behind (south of) the site that are reportedly fed by springs. The site lies within the Tsuga heterophylla (western hemlock) zone characteristic of the Puget Lowlands. Historically, the area was likely covered by evergreen trees including fir, cedar and madrona. Site sediments formed in fine to medium -grained glacial drift and consist of anthropogenic soils (shell midden) overlying a soil B-horizon composed of reddish -brown to yellowish -brown loamy sand and gravel that caps compact glacial deposits. The adjacent shoreline is relatively broad and fully exposed during low tides offering a wide range of marine resources. To date, archaeological materials have been observed within the shell midden comprising the upper 30 cm of the soil profile, however older cultural materials could be present in the upper soil B-horizon beneath the organically -rich sediments. Attachment 1(d): An artifact inventory plan detailing the character of the expected data categories to be recovered including the proposed methods of inventorying the recovered data and proposed methods of cleaning, stabilizing, and curating of specimens and recovered data consistent with the Secretary of the Interior's Standards for Archaeological Curation in 36 CFR Part 79. Expected data categories from the archaeological deposit include lithic debitage and tools, faunal remains (shell and bone), charcoal and other botanical remains and fire -modified rock. Groundstone artifacts and utilized bone, shell, or antler may also be encountered. Charcoal may be collected from intact cultural features such as fire hearths, or collected from excavation profiles and submitted for radiocarbon analysis. Cultural material recovered from auger probes during the damage assessment will be documented and placed back into the hole in which it was found. Documentation will include describing, measuring, weighing, and photographing any cultural material. Cultural materials recovered during any post assessment fieldwork i.e., sifting disturbed cultural deposits, will be documented in the field and collected. Collection is deemed necessary to avoid intermixing of documented cultural material with undocumented cultural material from uninvestigated portions of the site. Cultural materials will be placed in plastic zip -lock bags marked with provenience and will be the property of the landowner (see Attachment 3). If human skeletal remains are inadvertently discovered in the course of this project they would be treated in a manner consistent with the provisions of RCW 27.44; 68.50 and 68.60. Any person engaging in ground disturbing activity that encounters skeletal human remains would cease all activity which may cause further disturbance to the remains, make a reasonable effort to protect the area from further disturbance, and report the presence and location of those remains to local law enforcement and the King County Medical Examiner (ME). The ME would assume jurisdiction over the human skeletal remains and determine whether those remains are forensic or non -forensic. If the ME determines the remains are non -forensic, then the Department of Archaeology and Historic Preservation would take jurisdiction. The State Physical Anthropologist would determine whether the remains are Indian or Non -Indian and report that finding to the affected parties. The DAHP would handle all consultation with the affected parties as to the future preservation, excavation, and disposition of the remains if there is no federal agency involved. MISS, M.A. Principal/Senior Archaeologist Ms. Miss has more than 35 years experience in cultural resources services currently working at SWCA's Seattle, Washington office. Prior to working at SWCA, Ms. Miss was the principal and senior archaeologist for Northwest Archaeological Associates. She is one of the founders of Northwest Archaeological Associates, Inc. and was re- sponsible for day to day operations of the company. Ms. Miss has conducted over 600 cultural resources projects including fieldwork, analyses, and reporting in the Northwest. Much of this work has been related to com- pliance with the National Historic Preservation Act (NHPA). Through this work and federal training pro- grams, she has become expert in application of Section 106 of the NRHP, including evaluation of historic proper- ties for inclusion on the National Register of Historic Places, preparation of programmatic agreements and memoranda of understanding, and adverse effect as- sessments. She has managed and conducted surveys, testing, data recovery and management plans and has also prepared agreement documents. Over the past eight years, Christian Miss has overseen more than 250 transportation projects, including cultural resources studies for towns and cities, counties, state and federal agencies. HISTORICAL AND CULTURAL PRESERVATION (a) Are there any places or objects listed on, or proposed for, national, state, or local preservation registers known to be on or next to the site? If so, generally describe. A pre -contact shell midden, 45KI732, extends onto the Bessler property. The site was originally identified approximately 100 feet west of the Bessler property (Shong 2006; Shong and Miss 2006). The site consisted of a 25 cm (10 inch) thick deposit of charcoal -stained sand and gravel containing shell, bone and fire -modified rock. Because of minimal landscaping and protection from concrete bulkheads, the site was expected to contain substantial intact deposits. The site was considered likely eligible for listing on the National Register of Historic Places (NRHP) under criterion (d) that have yielded, or may be likely to yield, information important in prehistory or history (36 CFR 60.4), based on the presence of shellfish and other faunal remains and the potential for buried cultural features, temporally diagnostic artifacts, and datable carbon that could address research domains such as chronology, settlement, subsistence, technology and trade which could contribute to local and regional prehistory. NWAA recommended that the site be avoided and protected. Recent NWAA investigations documented additional pre -contact archaeological deposits associated with the site and also found that a portion of the site may have been disturbed during construction of the residence. Based on the presence of shellfish and other faunal remains and the potential for buried cultural features, temporally diagnostic artifacts, and datable carbon, NWAA considers that 45KI732 is likely eligible for the National Register of Historic Places under criterion (d) (Shong 2011). The observed portion of the site is located along the shoreline at 2876 SW 300th Place Federal Way, WA 98023. 1 Site # 45 KI 732 SITE DESCRIPTION Narrative Description Temp #: 2876-06-01 The site consists of a 15 cm to 25 cm -thick deposit of shell midden partially exposed along a wave -eroded beach terrace just east of Dumas Bay. The observed midden is approximately 5 cm to 20 cm below the surface and extends for approximately 6.5 m before being obscured by slumping over -bank sediments. Several thin (< 5 cm thick) and intermittent lenses of shell midden were observed 5 m to 10 m west of the main deposit before completely disappearing in the profile. The cultural deposit appears relatively intact based on a distinct layer of shell midden bounded above and below by organically rich sediments. The landform gradually rises in elevation toward the west so that the beaches in this area are flanked by relatively high bluffs. The landform east of the observed midden consists of relatively level and low-lying topography occupied by approximately 10 beach -front homes, most of which have concrete bulkheads protecting the terrace edge. The cultural deposit likely extends toward the east based on the favorable landform and easy beach access. This area could contain substantial intact cultural deposits based on the relatively minimal landscaping and protection from erosion by concrete bulkheads. The DAHP requested an archaeological assessment of the property prior to landscaping, (or) archaeological monitoring during ground -disturbing activities. This request was based on the proximity to site 45KI732 located approximately 100 feet southwest of the Bessler property. The original site form states that the site likely continues east (toward the Bessler property) along a relatively level, low-lying terrace and that this area and could contain substantial intact cultural deposits based on the relatively minimal landscaping and protection from erosion by concrete bulkheads. Observations: Prior to proposed landscaping and archaeological monitoring, the northern (shoreline) margin of the property had been stripped of sod exposing the underlying soils composed of fill and pre -contact shell midden. Additionally, mechanical excavations associated with construction of the new house exposed shell midden in profile along the northeastern property margin. The shell midden exposed in profile consisted of black, charcoal -rich fine to coarse sand with abundant marine shell and fire -modified rock (FMR). Cursory inspection of the exposed profile revealed intact cultural deposits and a possible fire hearth feature near the contact with the underlying soil B-horizon composed of a reddish -brown fine- to medium grained sand. The midden had a maximum thickness of 35 cm, but thinned gradually toward the south as it transitioned into a soil A -horizon with less charcoal and shell content. Sparse shell flecks and FMR were observed in profile approximately 30 m south of the shoreline bulkhead. Several faunal bone and lithic flakes derived from medium- to fine-grained volcanic material were observed within displaced midden spoil in the northeast corner of the property. The loose, surface midden in this area appeared to have been mechanically pushed over the terrace edge, likely during grading for the house foundation. Mixed fill, soil A -horizon material, and loose shell midden comprised much of the sloping landform surface between the terrace edge and the shoreline bulkhead. A small trench measuring approximately 50 x 150 cm was mechanically excavated at a proposed patio -nook landscaping feature near the shoreline to investigate the sub -surface sediments. Then trench revealed a 10-20 cm thick deposit of shell midden sloping toward the shoreline (see attached profile). The midden in the southern half of the trench profile contained very few shells and appeared to be re -worked to some degree, while the northern (down slope) half of the profile contained relatively abundant charcoal, shell and FMR. The cultural deposits capped an intact soil B-horizon composed of light yellowish -brown fine- to medium -grained sand. A 30 cm diameter shovel probe excavated just north of the trench and approximately 1.5 m south of the bulkhead revealed approximately 30 cm of rounded beach gravels overlying shell midden. The shell midden observed in the shovel probe was not investigated and its thickness and integrity remain unknown. A second trench was excavated in front of the newly constructed Bessler residence and just south of the exposed surface midden. This trench revealed heavily mottled loamy sand and gravel fill to a depth of approximately 120 cm. No archaeological deposits or materials were observed in this trench, however several fragments of lumber and concrete drain pipe were encountered. The property owner stated that a septic system associated with the former house may have been removed from this vicinity. The presence of concrete pipe fragments and slightly odiferous sediments tends to collaborates this belief. Based on the presence of shellfish and other faunal remains and the potential for buried cultural features, temporally diagnostic artifacts, and datable carbon, site 45KI732 is likely eligible for listing on the National Register of Historic Places under criterion (d). NVVAA/SWCA recommended �ended to the property owner that the archaeological deposits be avoided and protected through modifications to their existing landscape design. NWAA/SWCA also recommended the following actions to protect the exposed archaeological deposits: * No further ground disturbance to existing sediments should be conducted within 30 m of the shoreline. * Areas with surface -exposed shell midden should be covered with geotextile fabric and capped with fill. * The shell midden exposed in profile along the northeast edge of the property should be covered with geotextile fabric and protected from further erosion with a rock or concrete barrier. A permit from DAHP will still be required under RCW 27.53, to cover and fill the area as this is considered an alteration to an archaeological site. Part of the site was damaged by construction of the house and an archaeological damage assessment is required and should be included in the permit application. It typically takes between 45 and 60 days to receive a permit from DAHP„ however, since the resource is exposed because of the stripping for landscaping, the permit can be expedited. My best guess is that the original house was built in the 40's as was the bulkhead. The original house had a basement with the basement floor being the same grade as the top of the bulkhead. As we removed the original house and excavated for the new house, it appeared that the materials between the bulkhead and new house were imported sand/brown loam mixed fill. The original soils found on the South side are predominately clay/hard pan. Because of the original bulkhead construction, depth of the original basement, and fill materials found, I do not believe there is any original soil remaining between the bulkhead and new house. At least two precontact archaeological sites have been identified in the Lakota Beach area on landforms similar to that of the project area. These sites are within approximately 730 feet of the proposed project area. Please be aware that archaeological sites are protected from knowing disturbance on both public and private lands in Washington States. Both RCW 27.44 and RCW 27.53.060 require that a person obtain a permit from our Department before excavating, removing, or altering Native American human remains or archaeological resources in Washington. Failure to obtain a permit is punishable by civil fines and other penalties under RCW 27.53.095, and by criminal prosecution under RCW 27.53.090. Chapter 27.53.095 RCW allows the Department of Archaeology and Historic Preservation to issue civil penalties for the violation of this statute in an amount up to five thousand dollars, in addition to site restoration costs and investigative costs. Also, these remedies do not prevent concerned tribes from undertaking civil action in state or federal court, or law enforcement agencies from undertaking criminal investigation or prosecution. Chapter 27.44.050 RCW allows the affected Indian Tribe to undertake civil action apart from any criminal prosecution if burials are disturbed. Identification of cultural resources during construction is not a recommended detection method because inadvertent discoveries often result in costly construction delays and damage to the resource. Therefore, we request a professional archaeological survey of the project area be conducted and a report be submitted to DAHP and the Tribes for review prior to ground disturbing activities We also recommend consultation with the concerned Tribes' cultural committees and staff regarding cultural resource issues. Even though it would be a cultural resources impact, not a geological impact, it's still associated with the area. don't believe that either WAC 197-11-908 or 800 limits review to impacts associated with a geologically hazardous area. Are you referring to a critical areas ordinance instead? The DNS (Pg. 5, no. 13) for this project, states that "there is a potential for the presence of historic cultural resources at the site, based on the presence of other know cultural resources in the nearby vicinity, which will be reviewed in conjunction with the shoreline exemption." We appreciate the work that was put into this plan. It appears the Basalt wall will be placed so as not to disturb the midden, which is ideal. My only questions and recommendations would be these: 1. How will the rocks be placed, by equipment on the beach, or from above? Would heavy equipment be driving on the surface of the ground? This could cause some damage to the midden from above, depending upon how far below surface the midden is located. If you could find out about this I would appreciate it. We can discuss strategies if needed. 2. If there is any ground disturbing activity at the top of the staircase, to inset the stairs or bring them to grade, or something of this nature, those activities should be monitored by a professional archaeologist. Subsequent to those decisions, the applicant's Archaeologist identified shell midden in the area proposed for the protective bulkhead. The applicant has redesigned the bulkhead project to address identified cultural issues. Forwarded is a copy of the Shore Erosion and Cultural Deposits Protection Design plan prepared by Myer Biodynamics, Inc. revised date July 10, 2006, and the Archaeologist report prepared by Northwest Archaeological Associates, Inc. dated February 9, 2006. I would appreciate any comments you may have on the proposed development activity in advance of City issuance of an addendum to the DNS. Background - On October 19, 2005, the City issued a Determination of Nonsignificance (DNS) for work proposed to repair an existing shoreline bulkhead at the above -referenced property.' On January 4, 2006, the City of Federal Way issued a Shoreline Substantial Development Permit Exemption for this work.2 On August 15, 2006, following receipt of information about cultural deposits and amended plans, the City issued an Addendum to the DNS, to include cultural deposit protection to the shoreline stabilization proposal. Also, on August 15, 2006, the City issued a letter indicating that work proposed for the shoreline stabilization efforts as well as cultural deposit protection is in compliance with the Shoreline Substantial Development Permit Exemption originally issued on January 4, 2006. The work was conditionally approved on August 16, 2006? Actions - The building permit for the retaining wall repair was issued on October 10, 2006.a Planning staff inspected the installed landscaping on August 8, 2007 following completion, and found it satisfactory. Final building inspection was conducted on December 28, 2007 by Michael Lee. As documented in a November 13, 2007 e-mail from Ann Dower, a separate right-of-way restoration issue has been resolved. The City has documented completion of the work approved with the above -referenced permits and the related files are closed.
