When an unanticipated discovery of protected cultural material (see definitions below) occurs, the property owner or contractor will completely secure the location and contact: a. Cultural material that may be protected by law could include but not be limited to: • Buried layers of black soil with layers of shell, charcoal, and fish and mammal bones (Figure 1). Proposal -- The applicant proposes to remove an existing revetment and replace it with a new 54 linear - foot erosion control bulkhead above the ordinary high water mark. Due to recent winter storm activity and deferred maintenance, the existing revetment is partially separated from the shoreline and needs replacement. All removed concrete material will be bared to disposal and the revetment area will be cleaned up to gain approximately 980 sq. ft. of habitat area. 2. Shoreline Designation & Zoning — The proposed improvements are within 200 feet of the Ordinary High Water Mark of Puget Sound. The above -referenced property has been designated `Shoreline Residential' by the city's Shoreline Master Program (SMP). The zoning for the property is Single Family Residential (RS ). 3. Shoreline Modifications — The proposed bulkhead repair has been reviewed and meets the requirements of Federal Way Revised Code (FWRC) 15.05.050 `Shoreline modifications'. The applicant provided a geotech report, prepared by GeoResources LLC, dated June 21, 2012, finding the proposed bulkhead will provide adequate protection to the subject property and adjacent properties, and the removal of the existing revetment will allow the natural beach process to resume. The proposed bulkhead will be placed landward of the OHWM and will meet the maximum height requirements, no more than one foot above the elevation of mean higher high water on tidal waters. 4. State Environmental Policy Act (SEPA) — The proposed bulkhead is a replacement of the existing failing revetment. The bulkhead is an improvement over what currently exists, and as long as it is placed landward of the ordinary high water mark, is considered categorically exempt from SEPA review per WAC 197-11- 800(3) `Repair, remodeling and maintenance activities'. Other Agency Review and Permits — The applicant is in contact with Washington State Department of Fish and Wildlife and is in the process of issuing a Hydraulic Permit approval for the new bulkhead. The Department of Archaeology & Historic Preservation is also aware of the proposal and has submitted to the city a letter requesting an archeological survey of the site. The city has also been in contact with Tribal Archaeologist/Cultural Regulatory Specialist with Puyallup Tribe of Indians. The applicant has hired Lithic Analysts to conduct a cultural resources assessment for the project area and is currently in the process of conducting site visits. Once the assessment has concluded, the applicant is to supply the city with a report of the findings. 6. Building Permit Required — The City's Building Division is currently reviewing the building permit associated with the bulkhead replacement (File #12- 101780-SF). There is a previous recorded archaeological site 45KI732 approximately 140 feet west of the project parcel. Recent archaeological investigations at the site indicate that it continue east. Archaeological resources associated with this site may therefore be present on the project parcel and they may be impacted by the installation of the new bulkhead. 45KI732 consists of a shell midden. Shell middens can be quite extensive and are often associated with human burials. The project area and its vicinity have not been archaeologically survey and the proposed ground disturbing actions would destroy any archaeological resources present. Identification during construction is not a recommended detection method because inadvertent discoveries often result in costly construction delays and damage to the resource. Therefore, we request a professional archaeological survey of the area. We also recommend consultation with the concerned Tribes' cultural committees and staff regarding cultural resource issues. Please be aware that archaeological sites are protected from knowing disturbance on both public and private lands in Washington States. Both RCW 27.44 and RCW 27.53.060 require that a person obtain a permit from our Department before excavating, removing, or altering Native American human remains or archaeological resources in Washington. Failure to obtain a permit is punishable by civil fines and other penalties under RCW 27.53.095, and by criminal prosecution under RCW 27.53.090. Chapter 27.53.095 RCW allows the Department of Archaeology and Historic Preservation to issue civil penalties for the violation of this statute in an amount up to five thousand dollars, in addition to site restoration costs and investigative costs. Also, these remedies do not prevent concerned tribes from undertaking civil action in state or federal court, or law enforcement agencies from undertaking criminal investigation or prosecution. Chapter 27.44.050 RCW allows the affected Indian Tribe to undertake civil action apart from any criminal prosecution if burials are disturbed. The bulkhead is a change from the original proposal submitted on April 5, 2011, to repair a shoreline revetment that, due to recent winter storm activity and deferred maintenance, is partially separated from the shoreline. The new proposal is to completely remove the existing revetment and replace it with a new 54 linear foot erosion control bulkhead, at or above the ordinary high water mark. All removed concrete material will be bared to disposal, and the revetment area will be cleaned up to gain approximately 980 sq. ft. of habitat area. In order to determine if the proposal is exempt from shoreline and/or environmental review, additional information is necessary. ADDITIONAL INFORMATION REQUESTED Work along the Puget Sound shoreline is subject to the Washington State Shoreline Management Act, Federal Way Shoreline Master Program (SMP), and applicable Federal Way shoreline development regulations, as adopted. In summary, pursuant to Washington Administrative Code (WAC) 173-27- 040(2)(c), the construction of a normal protective bulkhead common to a single-family residence is exempt from the shoreline substantial development permit requirements, provided the bulkhead is installed at or near, and parallel to the ordinary high water mark for the sole purpose of protecting an existing single-family residence from loss or damage by erosion. The following information is requested in order to determine if the actions you are proposing meet current shoreline regulations. 1. Per Federal Way Revised Code (FWRC) 15.05.220 `Replacement, alterations, or reconstruction of nonconforming use or development,' modification of a nonconforming use or development (the existing revetment is a nonconforming development) is permitted provided that (a) the modification will make the use or development less nonconforming; or (b) the modification will not make the use or development more nonconforming. In order to determine if the proposed bulkhead is not relocated further waterward or increased in height, therefore increasing nonconformance, the following must be provided. Mr.,Montgomery, , June 5, 2012 Page 2 • Depict on the site plan where the Ordinary High Water Mark (OHWM) is, and that the proposed bulkhead is located landward of the OHWM. • The maximum height of the proposed bulkhead may not be more than one foot above the elevation of mean higher high water (MHHW), measured from grade on the waterward side of the bulkhead. Please provide elevations of the proposed bulkhead and MHHW that depict this measurement. 2. Per FWRC 15.05.050(l)(a)(vii), shoreline stabilization must not have an adverse impact on the property of others and must be designed so as not to create the need for shoreline stabilization elsewhere. Provide a report, prepared by a geotechnical engineer, to demonstrate how the proposed bulkhead will'impact surrounding properties. Per FWRC 15.05.040(6), proposals for ground disturbing activities in areas known to contain an historic, cultural, or archaeological resource(s) or highly suspected to contain archaeological artifacts and data requires a site inspection and evaluation by a professional archaeologist or historic preservation professional prior to issuance of a permit or initiation of disturbance. The City has recently been contacted by the Native American Tribes and State Office of Archeology and Historic Preservation regarding the discovery of archeological resources in the Lakota Beach area. In order to eliminate any potential delays in review of the proposal, if you have not done so already, please contact the tribal authorities and/or the Office of Archeology and provide the city with documentation of the site inspections and/or evaluations. ENVIRONMENTAL REVIEW Environmental review under the State Environmental Policy Act (SEPA) is required for permitted actions unless specifically exempted. Categorical exemptions to SEPA [WAC 197-11-800(3)] states that where a project is undertaken wholly or in part on lands covered by water, only minor repair or replacement of structures may be found to be exempt from the SEPA.1 The proposed bulkhead is a replacement of the existing failing revetment. The proposed bulkhead is an improvement over what currently exists, and as long as it is placed landward of the ordinary high water mark, is considered categorically exempt from SEPA. OTHER AGENCY REVIEW AND PERMITS Several other agencies may have permits and/or approvals required for the proposal. You have already contacted Washington State Department of Fish and Wildlife and they are in the process of issuing Hydraulic Permit approval for the new bulkhead. It is also recommended that you contact the US Army Corps of Engineers for any permit requirements that may be applicable. Be advised that other agency permit and mitigation requirements vary from the City regulations, and will require coordination by your project manager. When resubmitting, please provide 2 copies of any plans and one copy of any reports, along with a cover letter that details how you have addressed the issues in this letter. Included in that review are your April 5 and April 19, 2011, letters with photographs of the site. I conducted a site visit on April 20, 2011. At this time, additional information is necessary in order to determine if the actions you propose are exempt from shoreline and/or environmental review processes. ADDITIONAL INFORMATION REQUESTED You propose to "repair a shoreline revetment area that partially separated from the shoreline that it protects." You propose to fill the area with riprap, fill and cap it with concrete, dig trenches at the head and toe of the revetment, and fill them with concrete. The concrete revetment was installed by a previous property owner, and generally extends the length of your sixty -foot -wide property (sans the boat house) parallel to the shoreline. Work along the Puget Sound shoreline is subject to the Washington State Shoreline Management Act, Federal Way Shoreline Master Program (SMP), and applicable Federal Way shoreline development regulations, as adopted. Under Washington Administrative Code (WAC) 173.27.040(2) (b), work within the shoreline that is classified as normal maintenance or repair can be considered exempt from the shoreline substantial development permit requirements. Also, pursuant to Federal Way Revised Code (FWRC), any shoreline work that involves replacing an existing bulkhead, must conform to the standards of FWRC 15.05.050(9)(b), which requires that shoreline protection be placed along the same alignment as the shoreline protection is it replacing, as well as be subject to the specific criteria of FWRC 15.05.050(9)(b), (i), (ii), and (Ili) [enclosed]. Drawing Requirements In order to confirm that the proposed actions meet the intent of normal maintenance or repair; to ensure that the proposed actions are not an expansion of shoreline protection within the shoreline area; and to ensure that the actions are suitable for the conditions at hand, the following technical information must be submitted: • A scaled plan view drawing showing the existing concrete revetment, and its relation to the shoreline and the lawn. Be sure to note the location of the storm water drain, the septic drain Mr. Pat Montgomery April 26, 2011 Page 2 field, the boat house and its foundation, the fire place, and the bench. Identify the location of the ordinary high water mark (OHWM), if known. ■ A plan view drawing showing proposed repair actions. Identify the locations of proposed trenching, rip -rap, and concrete placement. Note the percentage of revetment proposed for maintenance or repair. Note that work that is water -ward of the OHWM may not be eligible for exemption. • Elevation drawing(s) of the proposed repair actions showing the depth of proposed trenching and concrete installation. ■ Provide a written statement to demonstrate how the proposed work specifically meets the intent of normal maintenance or repair of an existing structure as referenced in WAC 173.27.040(2)(b), and how the proposed work satisfies criteria in FWRC 15.05.050(9)(b)(i), (ii), and (iii). Environmental Review Environmental review under the State Environment Policy Act (SEPA) is required for permitted actions unless specifically exempted. Categorical exemptions to SEPA [WAC 197-11-800(3)] states that where a project is undertaken wholly or in part on lands covered by water, only minor repair or replacement of structures may be found to be exempt from the SEPA. However, the following specific maintenance action is not considered exempt from SEPA review under WAC 197-11-800(3)(b): reconstruction/ maintenance of groins and similar shoreline protection structures. FWRC 15.05.030 defines "Groin " as meaning a barrier type structure extending from the 'oackshore into the water across the beach. The purpose of a groin is to interrupt sediment movement along the shore. The FWRC does not have a definition of "Revetment ". The Army Corps of Engineers does make a distinction between Groins — "structures that extend, fingerlike, perpendicularly or nearly right angles from the shore", and Revetments - "a cover or facing of erosion resistant material placed directly on an existing slope, embankment or dike to protect the area from waves and strong currents." While groins and revetments both are shoreline protection methods, the overall purpose of the groin requires it to be placed perpendicular to the shoreline. Revetments are similar to bulkheads, and are placed parallel to the shoreline. As the minor repair or replacement of a bulkhead is categorically exempt from SEPA requirements, the minor repair or replacement of a revetment would also be considered categorically exempt from SEPA under WAC 197-11-800(3).- Other Agency Review and Permits Several other agencies may have permits and/or approvals required for the proposal. The City permit process is independent of other agency permits. The City is not responsible for determination of other applicable permits; however, you should contact the following agencies regarding permit requirements: Washington State Department of Fish and Wildlife (Larry Fisher, 425-649-7042) for Hydraulic Permit approval, and US Army Corps of Engineers. Be advised that other agency permit and mitigation requirements vary from the City regulations and requirements, and will require coordination by your project manager. The City has recently been contacted by the Native American Tribes and State Office of Archeology and Historic Preservation regarding the discovery of archeological resources in the Lakota Beach area. Therefore, at this time, we request that you contact Stephanie Kramer, Assistant State Archeologist, at State Office of Archeology and Historic Preservation at 360-586-3083 to discuss the proposed revetment repair. The state may request that an archeological analysis be prepared for any work along the shoreline. This email outlines our current ideas for addressing the revetment repair, for which we hope to get permissions from your office, the Corps of Engineers, and the WA Dept of Fish & Wildlife. I have a draft JARPA available if that would be helpful to you. The revetment protects our recently purchased 1930's Tudor -style house and property. You might want to take a look at this time at the attached "Photos describing ... " document for orientation. The MHHW comes up to about the middle of the —12" storm water discharge pipe you see in the attached photos. You can also see the OHWM in the photos. We have a drain field just uphill from the revetment, for which we have a permit from the county clearing the septic system for use supporting up to three bedrooms. We need to maintain the slab to keep the bank from eroding into the drain field, and from there behind our neighbors' sea walls. Much of the concrete revetment slab is in good shape. The prior owner died 2&1/2 years ago at age 99. While he installed the revetment slab himself, he was unable to do much to maintain the slab in his later years, and his heirs (four children) had the property on the market for 1&1/2 years. It doesn't appear that they did much to maintain the revetment during that time. The beach below the revetment is cobble stone, going down toward the water —30 feet (I believe - I need to measure), then turning into sand. The cobble stone / sand beach has a very gradual slope. Based on some old rusted out rails that nearby owners used years ago to launch boats from, there doesn't seem to be much lateral cobblestone shifting. We want permission from your department, the WA Fish & Wildlife, and the Corps of Engineers to repair the revetment to its original condition. In addition, we want to create and fill 2-3 foot concrete &/or riprap trenches at the toe & head, and the side of the revetment adjacent to the large storm water drain pipe. These filled trenches for the purpose of more solidly anchoring the revetment, discouraging undermining in future severe storms. We appreciate any help and recommendations your might be able to give us, to obtain the permissions needed from the city of Federal Way, and if possible from Fish & Wildlife and the Corps of Engineers. There are, up and down the beach from us, several pairs of rusted out rails that used to ramp boats into and from boat houses. It's clearly been many years since any of them have worked, because they are so rusted out, but their otherwise intact positions with respect to their boathouses indicates a minimum of cobblestone shifting to the left or right of the beach. The beach's slope is very gradual, with an "XXV inch tide covering and uncovering about "YYY" feet of exposed cobblestones and sand. It is at the MHHT (Mean Highest High Tide) level, as measured based on a March 23`d Tide table for the area. The bottom of the black storm drain water pipe is also at about that level. The top of the existing slide is "XXX" feet above the MHHT. The slab at its current height, if protected from wave action "backwash", buffers tidal action at its highest in all but the most severe winter storms. I propose filling the rest of the current gap with scrabble rock, then cap it with concrete. I would dig down one foot at the top of the slab, filling it with scrabble and concrete, to anchor the slab against future erosion. I would also routinely maintain the slab. The prior owner, 99 at his death two years ago, did not maintain the slab to as necessary to prevent the gap from opening up as you see in the photos below: The MHHT rock, surface runoff pipe, and rubble in a gap between the west end of the slab and the grassy shore. Dig a one foot wide by two feet deep trench between the revetment and an approx 12" diameter black PVC storm water drainage pipe.. 3. Fill these trenches with a fast -setting concrete and cover them with a heavy gauge plastic to prevent contact between salt water and the curing concrete, on a calm day with a relatively low high -tide. In addition to protecting our property and our two neighbors' property against storm -erosion from Puget Sound, repairing our revetment will also protect our King County approved septic drain field above the revetment. LITHIC ANALYSTS 659 Old Dallas Road a Royal, AR 71968 August 20, 2012 Pat Montgomery 2820 SW 300th Place Federal Way, WA 98023 RE: Proposed Montgomery/Featherstone Bulkhead Project, 2820 SW 300th Place, Parcel 416660-0140, Federal Way, King County, Washington Dear Mr. Montgomery, This letter report describes the results of a cultural resources survey of your property at 2820 SW 300th Place, Parcel 416660-0140, in Federal Way, King County, Washington, in the Lakota Beach neighborhood along the shoreline of East Passage just north of Dumas Bay on Puget Sound (Figures 1— 9). The proposed project is expected to require a shoreline permit from the City of Federal Way. FWRC 15.05.040(6) requires a site inspection and evaluation for ground disturbing activities in areas known to contain historic, cultural, or archaeological resources (Chapin 2012). A precontact shell midden (45KI732) is located nearby. In addition, the Department of Archaeology and Historic Preservation (DAHP) requested a professional archaeological survey of the project area (Kaehler 2012). This report is intended to assist you in providing documentation of the site inspection and results. Project Background The proposed bulkhead project is located along the shoreline of East Passage on Puget Sound in Section 1, Township 21 North, Range 3 East, W.M., USGS Poverty Bay Quadrangle. The landform on which the property is located rises steeply in elevation toward the east and is flanked by relatively high bluffs containing the 35-acre Poverty Bay County Park. The land to the south and southwest towards Dumas Bay is not as steep and slopes more gradually to the beach. Most of the homes along the beach have concrete bulkheads. The project area is situated at the west end of a 60-foot wide parcel of land at a point where the lawn meets the gravel beach of East Passage (Figures 1— 9). The parcel residence (Figure 4) is about in the middle of the parcel facing the shoreline. Two excavated and landscaped terraces are between the house and the shoreline. The lowest terrace is planted in grass. Currently, the shoreline is covered by a concrete revetment, which serves as a limited bulkhead (Figure 3 — 5). The holding tank for an inactive septic system was located near the residence. The septic drain field was below under the lowest terrace now planted in lawn. The fill -sediments from the excavation of the house basement (ca. 1939) were most likely utilized for the drain field above the current concrete revetment (Pat Montgomery, personal communication). Project plans are to remove the concrete revetment replace it with erosion control rockery. Archaeological site 45KI732 (Shong and Cross 2006) is located approximately 130 feet west of your proposed project, also on the shoreline. This precontact shell midden was discovered as a result of archaeological monitoring during the installation of a bulkhead at 2876 SW 300th Place, Federal Way. The archaeological site form states that the site likely continues east toward the adjoining property based on the proximity to the site and the continuation of the low-lying terrace (Shong and Miss 2006). In 2011, the DAHP requested an archaeological assessment for a proposed landscaping project on this adjoining property at 2854 SW 300th Place. Shell midden had been exposed on the shoreline and the northeastern margin of the property. Subsequent investigations revealed shellfish and faunal remains with the potential for buried cultural features, etc. The archaeologists conducting the investigation recommended avoidance and protection measures (Shong 2011). Another archaeological site, 45KI58, is located a little less ant % mile southwest of the project area. This precontact shell midden was recorded on the bank at the mouth of Lakota Creek in 1980 by the University of Washington as part of a cultural resources survey for the Lakota Wastewater Treatment plant proposed outfall (Mourn 1980). A survey for the Lakota Wastewater Treatment Plant Outfall Realignment in 2008 confirmed that the site was still extant (Berger 2008). Another survey on Dumas Bay property near 45KI58 was negative for cultural resources (Dougherty 2006). One other survey was conducted in the immediate vicinity of the current project area for the Lakehaven Utility District Lakota Beach Pressure System (Dampf 2005). Cultural resources were not identified as a result of this survey. The Montgomery/Featherstone property is located within the traditional territory of today's Muckleshoot Indian Tribe who spoke Southern Lushootseed. In addition, the Puyallup Indian Tribe and the Duwamish Tribe also utilized the area (Suttles and Lane 1990). Lushootseed place names are recorded for locations around Dumas Bay and the lower reaches of Poverty Bay. Oral history is attached to a large boulder known as KokowNtsa or Blanket Rock northeast of Dumas Bay. The likely traditional name of Lakota Creek was Stsoxwa'bats or chokecherry (Hilbert et al., 2001) K Survey Methodology and Results Archaeologists J. Jeffrey Flenniken and Pam J. Trautman visited the project area on August 6, 2012. The goals of the survey were to determine if the previously recorded site, 45KI732, extends from its mapped location to the project area and to evaluate the potential for the proposed bulkhead project to affect historic properties. A meandering pedestrian survey of the property including the supratidal and intertidal zone was conducted at low tide under sunny and dry weather conditions. The project area was walked by two archaeologists, and the gravel beach was surveyed for historic and prehistoric artifacts. Artifacts were not found on the gravel beach. Due to the thick grass lawn cover immediately adjacent to the existing concrete revetment, soil ground surface visibility was nonexistent. Three STPs were excavated to determine the potential existence of subsurface archaeological resources. The STPS were excavated slightly away from the revetment, within the lower lawn area which was void of decks or walls and which would likely contain fewer disturbances from beach erosion and concrete placement activities. Thus, this would be a more likely place to locate intact archaeological sediments. Starting at the south end of the property, STP1 (10'amsl; 10YR 4/3 dark brown, dry; 0547542 mE/5242508 mN) was excavated to 65 cmbs (Figure 7). Excavated clay/sand sediments were screened through %" hardware cloth, and produced modern glass, marine shell fragments, rounded pebbles and cobbles, and bits of rusted metal. Cultural resources were not identified from the excavation of STP1. STP2 was excavated just north of STP1. STP2 (10'amsl; 10YR 4/3 dark brown, dry; 0547544 mE/5242508 mN) was excavated to 55 cmbs (Figure 8). Excavated clay/sand sediments were screened through %" hardware cloth, and produced modern glass, marine shell fragments, a spent .22 bullet case, rounded pebbles and cobbles, and bits of rusted metal. Cultural resources were not identified from the excavation of STP2. STP3 was excavated north of STP2. STP3 (10'amsl; 10YR 4/3 dark brown, dry; 0547549 mE/5242517 mN) was excavated to 55 cmbs (Figure 9). Excavated clay/sand sediments were screened through %" hardware cloth, and produced modern glass, marine shell fragments, rounded pebbles and cobbles, and one chunk of rusted metal. Cultural resources were not identified from the excavation of STP3. The excavation of the three STPs revealed the sediments associated with the current bulkhead contained minimal amounts of modern trash and, most likely, were deposited in their current location as fill from the excavation of the house basement. Soil sediments in all STPs were virtually identical (10YR 4/3). Cultural resources were not identified from the surface of the beach to the west of the current bulkhead or from the subsurface sediments just to the east of the current bulkhead. 3 Conclusions and Recommendations Although one pre -contact site has been mapped nearby, this study concludes that site 45KI732 is not located within the project area, which has minimal potential for significant cultural resources. Based on the results of this survey, we recommend that no historic properties will be affected by the proposed bulkhead installation, and no further investigation is recommended.
