We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the city's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District, Tacoma Water, and South King Fire and Rescue. Some sections of the Federal Way Revised Code (FWRC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWRC and other relevant codes for all additional requirements that may apply, to your project. PROJECT DESCRIPTION The applicant proposes development of a seven -lot short subdivision on a 1.88 acre site. The property is zoned Single Family Residential RS 7.2. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. Please be sure to read the entire department comments made in the next section of this letter. • Planning Division All residential subdivisions are required to provide open space in the amount of 15 percent of the gross land area of the subdivision site per FWRC 18.55.060(2). All or some of the open space requirement may be satisfied by a fee -in -lieu payment at the discretion of the Parks Director. If open space is provided onsite, it shall be provided in its own tract. As with other tracts, an open space tract cannot count towards the minimum lot area of either lot. Public Works Development Services Division Regulations outlined in the 2009 King County Surface Water Design Manual (KCSWDK currently apply to all projects. The project must meet the Conservation Flow Control and Enhanced Basic Water Quality requirements. Low Impact Development options are encouraged for storm water detention and treatment, particularly on private property. A new manual is anticipated in January 2016. Projects are vested to the regulations in place at the time that a complete application is submitted. • Public Works Traffic Division 1: A Transportation Concurrency permit is required per FWRC 19.90. 2. Traffic Impact Fee (TIF) payment is required per FWRC 19.91. 3. Construct street frontage improvements and dedicate right-of-way along the property frontage on SW 344th Street and 34th Place SW (FWRC 19.135.040). 4. Revise the current proposal to meet the block perimeter requirements (FWRC 18.55.010). Lakehaven Utility District 1. A Certificate of Sewer Availability (application form enclosed) issued separately by Lakehaven may be required to be submitted with any land use and/or building permit applications. 2. A Developer Extension (DE) Agreement will be required to construct new sanitary sewer facilities necessary for the proposed development. 3. The associated DE Agreement must achieve a point of either Substantial Completion or Acceptance, as determined by Lakehaven prior to activating any new sewer service connection(s). • Tacoma Water 1. A new water main will be required to connect the existing main in 34th Place SW to the existing main in SW 344th Street when extending the road to SW 344th Street. 2. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. File #15-102563-00-PC D- ID 469719 R Mr. Tres Kirkebo Page 3 July 1, 2015 Planning Division (Stacey Welsh, 253-835-2634, stace .welsh .citvoffederahva .com) Short Plat Process — Pursuant to FWRC 18.30.010, short plat applications are administratively processed through the Department of Community Development. The administrative review process requires that the Director of Community Development issue a decision on the short subdivision request and confirm conformance with FWRC 18.30.110(2). Public notice of the complete short plat proposal is required per FWRC 18.30.080, and a 15-day public comment period is provided. However, no public hearing will be required unless an appeal is filed. A master land use application and short plat handout are enclosed; relevant code sections are available at the city's website at www.citvoffederalway.com. 2. State Environmental PolicgAct (SEPA) — This short plat application is exempt from the requirements of SEPA review. 3. Fees; —As development fees change annually, please contact the Permit Center at 253-835-2607, or peniutcentex � eitvoffedetalway.cam, for an updated fee list prior to submitting your application. Additional utility fees, school impact fees, concurrency, and engineering plan review fees apply. 4. Lot Si.Ze — The zoning for the subject site is RS-7.2. Minimum lot size for each lotis 7,200 square feet. As depicted, the proposed lots meet the minimum lot size requirement. Property dedicated to the city for right-of-way frontage improvements may not be counted in lot areas either (see the Traffic comments). Also, all residential subdivisions are required to provide open space in the amount of 15 percent of the gross land area of the subdivision site per FWRC 18.55.060(2). If open space is provided onsite, it shall be provided in its own tract. As with other tracts, an open space tract cannot count towards the minimum lot area of either lot (also see note #8, below). 5. Design Criteria — Short plats are subject to the subdivision design criteria of FWRC 18.55.020. 6. Setbacks — Future residences must conform to the following structural setback requirements of FWRC 19.200.010, "Detached Dwelling Units": front yard —twenty feet; side yard —five feet; and rear yard —five feet. Existing structures must conform to the structural setback requirements from newly located property lines. 7. Miscellaneous Sixgl*-FamiyResidential Regxlations — a. Maximum height of structures-30 feet above average building elevation. b. Maximum lot coverage-60 percent. c. Required parking spaces —two per dwelling unit. Meeting follow up. The following FWRC code section details calculating lot coverage: "19.110.020 Calculating lot coverage. "(1) General. Except as specified in subsection (2) of this section, the area of all structures, pavement and any other impervious surface on the subject property will be calculated as a percentage of total lot area, exclusive of the area of any recorded access easements, in determining compliance with maximum lot coverage required in this tide. If the subject property contains more than one use, the maximum lot coverage requirements for the predominant use will apply to the entire development. The following shall be excepted from the provisions of this section: (a) A wood deck will not be considered as an impervious surface for maximum lot coverage proposed if the deck is constructed with gaps between the boards and if there is a pervious surface below the deck. (b) A vehicular access easement, private tract, or that portion of a private driveway located within the "flag pole" or "access panhandle" part of the lot will not be used or considered in determining compliance with the maximum lot coverage requirement of this title. (c) One-half of the area covered with grass grid pavers will be considered as impervious surface in determining compliance with the maximum lot coverage requirement of this title." 8. Open Space — All residential subdivisions are required to provide open space in the amount of 15 percent of the gross land area of the subdivision site per FWRC 18.55.060(2). All or some of the open space requirement may be satisfied by a fee -in -lieu payment at the discretion of the Parks Director, after consideration of the city's overall park plan, quality, location, and service area of the open space that would otherwise be provided with the project. Open space fees shall be paid prior to recording the short plat. If the applicant chooses to provide onsite open space, it shall be provided in its own tract and include a combination of the following types: Open Space Category % of Gross Land Area Usable 10% minimum Conservation No maximum or minimum Buffer 2% maximum Constrained 2% maximum Per FWRC 18.55.060.6, "Open space shall be owned in common undivided interest by all property owners within the land division as members...." As with other tracts, an open space tract cannot count towards the minimum lot area of either lot. 9. Clearing Grading and Tree and Tlegetation Retention —The short plat is subject to the provisions of FWRC 19.120, "Clearing, Grading, and Tree and Vegetation Retention." It is recommended that FWRC 19.120 be reviewed carefully in reference to the proposed short plat. A clearing and grading plan that meets FWRC 19.120.020 and FWRC 19.120.040 must be submitted with the formal short plat application, if clearing and grading work is proposed. 10. Tree Density Requirements — The plat will be subject to tree density requirements of FWRC 19.120.130(1); note that 25 tree -units per acre are required for single-family zoned sites. In the case of the 1.88-acre site, it appears that approximately 47 tree units are required (25 x 1.88 = 47). Tree unit credits are in Table 2 of FWRC 19.120.130-2. The formal application must indicate _what trees are to be removed. A tree unit is a value assigned to existing trees retained on the property or replacement trees. The larger the tree, the greater value it is assigned. Required tree density can be composed of retained trees and replacement plantings per FWRC 19.120.130. The tree and vegetation plan must clearly show where the tree units are to be located. Per FWRC 19.120.130.3, the total number of tree units required to be provided by a regulated activity shall be calculated by multiplying gross site acreage, minus any proposed public or private streets and regulated critical areas (excluding buffers). Fk #15-102563-00-Pc Doc ID 469719 Mr. Tres Kirkebo Page 5 July 1, 2015 If an applicant cannot provide for the minimum tree units per acre on site, off -site mitigation, or fee -in - lieu payment to the city's urban forestry account, may be approved by the director. See F-\X RC 19.120.140 for off -site mitigation and fee -in -lieu payment requirements. 11. Critical Areas— According to city critical area maps, none are located within the project area. 12. Schoollmpact Fees — School impact fees (currently $4,687.00 per single-family home) are due at the time of building permit application for new dwelling units. This fee amount is subject to change as determined annually by the Federal Way School District. 13. Approval Duration — Short plat preliminary approval expires five years from the date of approval. Engineering plans must be approved, improvements constructed, and the short plat must be recorded within the five-year time period. No less than 60 days prior to the lapse of approval, the applicant may request a two-year time extension for the short plat approval. 14. 13ecordzng — The city will record the short plat with the King County Division of Records and Elections subsequent to the Public Works Department approval of submitted as -built plans. Prior to recording the short plat, all surveying and monumentation must be complete. In addition, all other required improvements must be substantially completed as determined by the departments of Community Development and Public Works. Public Works Development Services Division (Ann Dower 253-835-2732 ann.d wer citvoffederalwa .con} Land Use Issues — Stormwater 1. Surface water runoff control and water quality treatment will be required per the 2009 King County Surface Water De ign Manual (KCSWDM) and the City of Federal Way Addendum to the 2009 KCSWDM. Updated regulations are anticipated in January of 2016. Projects are vested to the regulations in place at the time that a complete application is submitted. 2. This project meets the requirements for a Full Drainage Review. At the time of preliminary short plat submittal, a preliminary Technical Information Report (TIR) addressing the relevance of the project to the eight core and Eve special requirements of the KCSWDM will be required. A Level I downstream analysis shall also be provided in the preliminary TIR. The city has 1" = 100', five-foot contour planimetric maps that may be used for basin analysis. 3. The project lies within a Conservation Flow Control Area; thus, the applicant must design the flow control facility to meet these performance criteria. The project also lies within an Enhanced Basic Water Quality Area. Water quality treatment shall be designed to meet the treatment criteria of the Enhanced Basic Water Quality Menu. Low Impact Development (LID) is encouraged on private property and may be considered on a case -by -case basis on a public right-of-way. 4. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. File #13-102563-00-PC Doc 1D #69719 Mr. Tres Kirkebo Page 6 July 1, 2015 5. Detention and water quality facilities for short plats must be above ground (i.e. open pond). Underground facilities are allowed only with approval from the City of Federal Way Stormwater Management Division. 6. Show the proposed location and dimensions of the detention and water quality facilities on the preliminary plans. 7. If more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination System (NPDES) permit may be required. Information regarding this permit can be obtained from the Washington State Department of Ecology at www.egy.wa.gov/programs/sea/paclindex.htrnl, or by calling 360-407-6437. Right -of -Way Improvements 1. See the Traffic Division comments from Senior Traffic Engineer Erik Preston for traffic related items. 2. Right-of-way dedication shall be conveyed to the city through a statutory warranty deed. The dedicated area must have clear title prior to recording. 3. All stormwater treatment and detention requirements outlined above will be applied to new impervious area within the public right-of-way. 4. FWRC 11.05.110 requires that overhead utility lines be relocated underground if over 500 feet, or three spans are affected by a project. This condition will be applied to SW 344th Street. 5. FWRC 19.135.280 requires that driveways serving residential uses may not be located closer than 25 feet to any street intersection. Lots and intersections within new subdivisions or short plats must be designed to meet this standard. Engineering Permit Issues 1. Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be reviewed and approved by the city. Engineering review fees are $824.50 for the first 12 hours of review, and $68 per hour for additional review time. A final TIR shall be prepared for the project and submitted with the engineering plans. Both the TIR and the plans will require the signature/seal of a professional engineer registered/licensed in the State of Washington. 2. In addition to engineering approval, short plats and subdivisions are required to obtain a separate permit for grading. Details and fees may be obtained from the Building Division. 3. The Federal Way Development Standardr Manual (including standard detail drawings, standard notes, and engineering checklists) is available on the city's website at www.cit)offederalway.eani to assist the applicant's engineer in preparing the plans and TIR. 4. The applicant shall provide a geotechnical report that addresses design pavement thickness for the roadways. File #15-102563-00-PC Doc ID #69719 Mr. Tres Kirkebo Page 7 July 1, 2015 5. Bonding is required for all street improvements and temporary erosion and sediment control measures associated with the project. The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and will be held for a two-year maintenance period. 6. The developer will be responsible for the maintenance of all storm drainage facilities (including the detention and water quality facilities) and street systems during the two-year maintenance period. During that time, the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. Upon satisfactory completion of the two-year maintenance period, the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the responsibility of the city. Maintenance for private roads and drainage facilities, including short plats, remain the responsibility of the individual property owners. 7. When topographic survey information is shown on the plans, the vertical datum block shall include the phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.," on all sheets where vertical elevations are called out. 8. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. All final approved drawings shall be drafted/plotted on 24" x 36" or 22" x 34" mylar sheet with permanent black ink. Site plans shall be drawn at a scale of 1" = 20', or larger. Architectural scales are not permitted on engineering plans. 9. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures, per Appendix D, 2009 KCSWDM, must be shown on the engineering plans. 10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. Public Works Traffic Division (Erik Preston, 253-835-2744, erik.ptestonk-eitSroffederalway.com) Transportation Concurrency Analysis (FWRC 19.90) 1. Based on the submitted materials for seven single-family residential lots, the Institute of Transportation Engineers (ITE) Trip Generation - 8th Edition, land use code 210 (Single -Family Detached Housing), and credit for the one existing single-family residence, the proposed project is estimated to generate approximately six new weekday PM peak hour trips. Alternatively, the applicant may submit a site specific trip generation study for the proposed development. 2. A concurrency permit is required for this development project. The Traffic Division will perform concurrency analysis to determine if adequate roadway capacity exists during the weekday PM peak period to accommodate the proposed development. Please note that supplemental transportation analysis and concurrency mitigation may be required if the proposed project creates an impact not anticipated in the six -year Transportation Improvement Plan (TIP). 3. The estimated fee for the concurrency permit application is $344.50. This fee is an estimate and based on the materials submitted for the preapplication meeting. The concurrency fee must be paid in full at the time the concurrency permit application is submitted with the land use application. The applicant has the option of having an independent traffic engineer prepare the concurrency analysis consistent with city procedures; however, the fee remains the same. Transportation Impact Fees (TIF) (FWRC 19,91) Based on the submitted materials for six additional single family lots, the estimate traffic impact fee is $19,231.79. The actual fee will be calculated and paid at the time of the plat recording. The applicant may defer part or all of the impact fee payment amount to either building permit issuance, or to later than closing of the sale of the single family home. If this option is selected, a covenant prepared by the city to enforce payment of the deferred fees will be recorded at the applicant's expense on each lot at the time of plat recording for residential land divisions. Street Frontage Improvements (FWRC 19.135) The applicant/owner will be expected to construct street improvements consistent with the planned roadway cross -sections as shown in Map III-6 of the Federal Way Comprehensive Plan (FWCP) and the Capital Improvement Program (CIP) shown as Table III-19 in FWRC 19.135.040. Based on the materials submitted, staff conducted a limited analysis to determine the required street improvements. The applicant will be expected to construct improvements on the following streets to the city's planned roadway cross -sections: ■ SW 344th Street is a Principal Collector planned as a Type "O" street, consisting of a 34- foot street with curb and gutter, 6-foot planter strip with street trees and streetlights, and 8-foot sidewalks in a 74-foot right-of-way. Assuming a symmetrical cross section, a 5-foot right-of-way dedication and half -street improvements are required as measured from the street centerline, OR the far side edge of the travel way. ■ Thirty-fourth Place SW is a Local Street planned as a Type " W' street, consisting of a 28- foot street with curb and gutter, 4-foot planter strips with street trees, 5-foot sidewalks, and street lights in a 52-foot right-of-way. Assuming a symmetrical cross section, an approximately 26-foot right-of-way dedication and half -street improvements are required as measured from the street centerline, OR the far side edge of the travel way. ■ Extend 34th Place SW to connect to SW 344th Street, continuing the Type "W" street cross-section with a minimum 24-foot paved roadway and half -street improvements in a 52-foot right-of-way and deed the easement shown to the city. 2. The applicant may make a written request to the Public Works Director to modify, defer, or waive the required street improvements (FWRC 19.135.070). Information about a right-of-way modification requests are available through the Public Works Development Services Division. These modification requests have a nominal review fee currently at $105.50. Design Criteria (FWRC 18.55) 1. Block perimeters shall be no longer than 1,320 feet for non -motorized trips, and 2,640 feet for streets (FWRC 18.55.010 and FWCP Policy TP21). No street, or combination of streets, shall function as a cul-de-sac longer than 600 feet (FWRC 18.55.010). Therefore, a second access point is required for this proposed development project. . Additional detail and/or design requirements can be obtained from Lakehaven by completing and submitting a separate application to Lakehaven for either a Developer Pre -Design Meeting, or a Developer Extension Agreement (application forms enclosed). Lakehaven encourages owners/developers/applicants to apply for Lakehaven processes separately to Lakehaven, and sufficiently early in the pre-design/planning phase to avoid delays in overall project development. The associated DE Agreement must achieve a point of either Substantial Completion or Acceptance, as determined by Lakehaven, prior to activating any new sewer service connection(s). Based on the proposal submitted, preliminary estimated Lakehaven sewer service connection fees/ charges/deposits (2015 schedule) will be as follows. Actual connection charges will be determined upon submittal of service connection application(s) to Lakehaven. A short subdivision may be a conventional or cluster subdivision, cottage housing, zerolot line townhouse development, or small lot detached development of nine or fewer lots, as well as a binding site plan. A short subdivision must be approved and recorded before newly created lots may be legallysold. WHO MAKES THE DECISION The director will make the decision on the short subdivision. The application is processed under the provisions of Chapter 18.30 FWRC, "Short Subdivision Plats." Your application will be evaluated on the basis of the informaton you provide, the criteria listed in the pertinent sections of the City's regulations, and inspection of the property. Short subdivisions shall be designed to the standards of FWRC 18.55.010 through 080, and 18.60.030 through 120. Upon determining that the short subdivision application is complete, the director (or his/her designee) shall distribute a notice of complete application. APPEALS Any decision issued by the director can be appealed. The City of Federal Way Hearing Examiner decides appeals of short subdivision decisions after a public hearing. See FWRC 18.30.140, et seq. for detailed information regarding appeals of short subdivision decisions. RECORDING The City records all approved short subdivisions with the King County Division of Records and Elections. A copy of the documents (referred to as a short plat), stamped with the recording number, is then distributed to the applicant, file, and King County Department of Assessments. All fees for such recording must be paid by the applicant before recording. Bulletin #010 — April 22, 2014 Page 1 of 5 k:\HandoutslShort Subdivision COMPLIANCE WITH SEPA Short subdivisions are usually exempt from the Washington State Environmental Policy Act (SEPA). However, a SEPA checklist and corresponding fee will be required if the short subdivision occurs on land covered by wateror the short subdivision is a further subdivision of a previoWy exempted short subdivision. For a detailed explanation of the City's environmental policy, refer to FWRC Title 14. CRITICAL AREAS Projects that involve work within critical areas (e.g., wetkads, streams, steep slopes; and lakes) may require that the City contract out for expert technical assistance. Pursuant to FWRC 19.150.030, the applicant is responsible for providing any information, mapping, studies, and materials, and for paying for inspections or review by a qualified professional acceptable to the City. You will be advised at an early point in the process if your project will be subject to these types of expenses. SHORELINES Short subdivision that are within 200 feet of the ordinary hjh water mark of Puget Sound, Steel Lake, North Lake, or Lake Kilarney require review under the city's Shoreline Master Program. Applicants should speak with department staff for further information regarding shoreline regulations prior to submitting a fomal application. TRAFFIC -RELATED REQUIREMENTS All short subdivisions are subject to transportation concurrency and Traffic Impact Fee requirements. Refer to Concurrency Application Information and Traffic Impact Fee handouts for additional information. PREAPPLICATION CONFERENCE Applicants are encouraged to schedule a preapplication conference to become familiar with FWRC requirements, policies, and regulations. It is also an opportunity to coordinate with City departments and obtain their comments on thEproposed subdivision. Refer to the City's preapplication conference handout for information orthe process.
