Dear Mr. Butko:
The City of Federal Way has reviewed your waiver request dated October 7, 2019. After evaluating the
existing conditions along the referenced streets, review of the Federal Way Revised Code (FWRC)
provisions (Section 19.135.280; 19.135.040), and the direction provided by the City Council, the Public
Works Department hereby provides the following response to your request:
Request to waive street improvements along 25" Ave SW
The Public Works Department hereby approves your request to waive frontage improvements
along 25' Avenue Southwest with the following condition: Prior to Certificate of Occupancy the
applicant shall sign a Local Improvement District Waiver of Protest Agreement.
The Local Improvement District Waiver of Protest Agreement will be provided under separate cover.
The conditions of this modification will be applicable for one year from the date of this letter. If a
building permit is not issued within the one-year time limit, this modification waiver will be void, and a
new request for modification must be submitted.

Request The applicant is building a new single family residence on an undeveloped lot. He is
requesting a waiver of street improvements on 25a' Ave SW based on Federal Way Revised Code
(FWRC) Section 19. 135.070 criteria (1) "improvements as required would not be harmonious
with existing street improvements..."
Staff Analysis:
25th Ave SW is classified as a type "W" street requiring 28 feet of paved travel way, 4 foot wide planter
strips, and 5 foot wide sidewalks within a 52 foot wide public right-of-way. Existing right-of-way is
estimated at 50 feet, with 27' of pavement and standard curb. There is grass and other vegetation where
the planter strip and sidewalk would normally be. The property has 53.50 feet of frontage.
This mostly -developed neighborhood does not have planter strip. Sidewalk is limited to SW 347 h Street,
about 180 feet to the south. This is not on a "safe route to school".
A waiver of all improvements was approved for the adjacent Lot 12 on June 8, 2018 and has since
expired. The new owner is requesting the same waiver.
Requirements / Conditions of Approval
Staff recommends approval of this request to waive improvements, with a condition that an LID
Waiver of Protest Agreement is signed.
