The City of Federal Way has reviewed your waiver request dated September 21, 2018. After evaluating
the existing conditions along 6`h Avenue SW, review of the Federal Way Revised Code (FWRC)
provisions (Section 19.135.040; 19.135.280) and the direction provided by the City Council, the Public
Works Department provides the following response to your request:
Request to waive street improvements along 6th Avenue SW
6t" Avenue SW is classified as a Minor Collector corresponding to City Street Section "T". The
street section requires a 24-foot drive lane, two 2-foot shoulders, two 8-foot ditches, two 5-foot
sidewalks and two 3-foot utility strips within a 60-foot right-of-way.
Currently there is no sidewalk along the eastern side of 6`h Avenue SW but there is a 5-foot
asphalt walking path along the western side of the street.
The Public Works Department hereby approves your request to waive street improvements.
The conditions of this right-of-way modification will be applicable for a period of one year. If a building
permit is not issued within the one-year time period, this modification will be void, and a new request for
modification must be submitted.

Request The applicant proposes to construct a single family residence on a previously
undeveloped lot. The property is located along 61h Avenue SW just north of SW 361" St
(Rosewood Lane). The applicant is requesting a waiver of street frontage improvements along
6th Avenue SW.
Staff Analysis 6th Avenue SW is classified as a Minor Collector corresponding to City Cross
Section Type "T". The street section requires a 24-foot drive lane, two 2-foot shoulders, two 8-
foot ditches, two 5-foot sidewalks and two 3-foot utility strips within a 60-foot right-of-way. The
assessors map indicates the existing ROW is 60-feet wide.
Typically, the applicant would be required to install a half -street improvement so that the eastern
half meets the Section "T" standard. The exiting roadway consists of two 12-foot drive lanes
with a 5-foot paved walking shoulder along the western side. The east and west portions of the
right-of-way also includes a slight storm ditch.
Currently no sidewalk exists along the east side of 61h Avenue SW between SW 3561h Street and
SW 368th Street. There is a sidewalk which begins at the northern portion of Rosewood Lane.
An examination of previous Street Modification applications in the area indicate an approved
waiver (14-103536-SM) along the same side approximately 800-feet south which matched the
current request.
Requirements / Conditions of Approval Development Services staff recommend approval of
this request to waive street improvements with the following modifications.

On behalf of my clients, Mr. and Mrs. Natanael Soto, we are requesting a deferral of the required right-
of-way improvements for their proposed residence at 360XX 61h Ave. S.W. The parcel number is
302104 9064 and the permit number is 18-102138-00-SF.
There are forty-seven lots abutting 6' Ave. S.W. between S.W. 356" St. and S.W. 368' St. All but three
lots are developed. Four lots have right-of-way improvements, as a condition of subdivision approval,
in the Rosewood and Sterling Woods subdivisions. Forty of the forty-seven lots are developed without
right-of-way improvements. Clearly modifications have been granted in the past. One of them, at
36228 6' Ave. S.W., as recently as 2016.
We feel that criteria number 1 best describes our reason for seeking a right-of-way improvement
modification.

DESIGN MODIFICATION REQUEST /ACTION
Modification Description: Modification to KCSWDM C 2.1.1 (20% maximum slope)
Modification Location: 36XXX 6" Ave SW
Modification Type: X SWM ❑ Streets/Traffic ❑ Planning ❑ Building
Request The applicant has requested an adjustment (variance) in the maximum allowed
slope (20%) for a dispersion trench as defined in KCSWDM C2.1.
Staff Analysis FWRC 16.30 allows an applicant to seek an adjustment. To grant an
adjustment the request must meet the two sets of criteria:
1. The approved system must result in a product which meets the requirement of
KCSWDM, City of Federal Way Addendum and be in the public interest
2. The adjustment must meet safety, function, appearance, environmental protection and
maintainability based upon sound engineering judgement.
The site survey indicates slopes in the dispersion area to be between 20 and 35 percent. The
geotechnical investigation indicates mottling in the upper 1-1/2 feet of the soil profile (perched
groundwater).
The applicant has submitted a geotechnical report prepared by GeoResources which recommends
allowing the dispersion trench design in spite of the steep slopes and perched groundwater table.
Staff s review of KCSWDM C 2.1.1 indicates that a geotechnical report can be accepted for
dispersion trenches located on slopes in excess of 15 percent but less than 20 percent. In
accordance with C2.1.1.5 dispersion devices are not allowed in critical area buffers or on slopes
steeper than 20%.
Requirements / Conditions of Approval
Development Services staff recommends denial of this adjustment request due to the high
probability of future erosion issues in a location which will be difficult to monitor.
