After evaluating the existing conditions along the referenced street, review of Federal Way Revised Code (FWRC) provisions (Section 19.135.280; 19.135.070), and direction provided by the City Council, the Public Works Department hereby approves the following: 1. The applicant requests that 150 foot separation requirement between accesses as outlined in Federal Way Revised Code (FWRC) 19.135.280 to be waived. Discussion: FWRC 19.135.280 applies to streets with access classification of 4 or higher. 18`h Ave S is classified as a Minor Collector, with no access classification. However, it is desirable to provide adequate driveway/intersection separation for safety. FWRC 19.135.290 allows a variance to be made based on the following criteria: (1) The director may grant a modification administratively to reduce spacing standards by up to 20 percent of the tabular values. Criteria are existing accident rates and suspected low number of turning conflicts. With director approval, this would permit the access to be within 120 feet of the existing private roads to the north and south. The applicant proposes to provide two accesses within 113 feet of each other and joined in a "U" road configuration. The proposed northern leg is within 85' of the existing access to the north. The south leg is within 165' of the existing access to the south. While the proposal does not meet separation requirements in all instances, the "U" road is a safer alternative than two separate cul-de-sacs, which is the most likely alternative given the size and shape of the parcels. In addition, this is a low - volume residential area, where accident rates and turning conflicts are low. (2) A formal request for modification shall include documentation of topographical constraints, or inability to secure alternative means of access through easements, dedicated tracts, or roadways of lower classification, and granting the modification will not appreciably reduce roadway safety and capacity. The applicant has approached neighboring property owners to attempt a combined access, and was successful in arranging for one property, parcel ##3674400141, to share access with this development. Attempts with the neighbors to the north and south were unsuccessful. Ben Anstey, P.E., the engineer for this project, has analyzed the situation and states that there is no way to improve the access or to meet the City's driveway separation requirements, and that granting the modification will not appreciably reduce roadway safety or capacity. (3) The director may condition modification requests to require that accesses be closed, or further restricted, when alternative means of access become available through development or redevelopment of other properties. This does not appear to be an option. 2. The applicant requests to modify the Type Y street standard, which requires that the road be a maximum of 150' long with a cul-de-sac at the end. The applicant proposes to extend two roads to approximately 250' long, and connect in a "U" road configuration rather than providing two cul-de-sacs. As discussed above, the "U" road configuration provides better traffic circulation than two shorter cul-de- sacs and is therefore approved as a safer alternative. 3. The applicant further requests to modify the Type Y road standard to reduce the cross-section from 5' sidewalk and 2' utility strip on both sides of the road, to 5' sidewalk and 2' utility strip on one side of the road. FWRC Section 19.135.070 allows the Public Works Director to modify street requirements based on one of four criteria. The most applicable in this case is: 2. Unusual topographic or physical conditions preclude the construction of the improvements as required. The applicant proposes to omit the sidewalk and utility strip on the interior of the "U" road. Due to the long, narrow shape of the parcels, this is critical to achieving buildable lots. Since the only home proposed for the interior of the "U" road is the existing home that is alreadye served by sidewalk and utility strip on 18a` Ave S, sidewalk and utility strip are not critical to the proper function of the road. Therefore, the right-of-way modification is approved as proposed. This approval is valid for a period of one year from the date of this letter. To accomplish that, FWRC 19.135.280 requiring 150' separation between accesses would need to be waived, and the Type Y street standard would be modified from a maximum 150' length with cul-de-sac end to two 250' long roads with a 40' long connection. The applicant also requests that the Type Y street standard to be modified to have sidewalk on only one side. Staff Analysis While it is desirable to maintain driveway/intersection separation, 18th Ave S is a Minor Collector to which this code section technically does not apply. Staff believes the proposed U-road is a safer alternative than two cul-de-sacs, which is the most likely alternative given the size and shape of the parcels. This is a low -volume residential area where accident rates and turning conflicts are low. Staff recommends approval of the U- road. Sidewalk on the inside of the U-road would not actually serve any lots, therefore staff recommends modifying the road to include sidewalk on only one side. Requirements / Conditions of Approval The applicant attempted to combine accesses with multiple neighbors, and was successful with one. An existing access off of 181h Ave S for the property located between the two legs of the U-road will be replaced with access off of the U-road. We would still have the 24 feet of pavement and a 5 foot sidewalk and room for utilities on one side of the road which for this small area should be quite adequate. There is an existing driveway on our north property line and another existing driveway on parcel 0141 which is 92 feet to the south. We are proposing a southern access as the property is not large enough for a practical cul-de-sac so our southern access will be 66 feet south of the access for lot 0141 and 134 feet north of the access for lots 150 and 152. In between is lot 151which is vacant but it does not share the access with lots 150 and 152 so will need an access to 181h Avenue South when it is developed. By providing new accesses to our access road for the house at 29810 18th Avenue SW we are not increasing the number of access or significantly decreasing the separation between accesses onto 18`h Avenue SW.
