Dear Mr. Sacriste:
This letter responds to your inquiry dated November 10, 2016, regarding the city's interpretation on
Accessory Dwelling Units as it relates to Lennar's Next Gen home plans.
In summary, you have requested the city to continue to issue building permits for your Next Gen homes,
in the same fashion as the City issued permits for similar Next Gen homes in the Plat of Wynstone East in
Federal Way. You have specifically requested to have the Next Gen homes not be considered an
Accessory Dwelling Unit (ADU). Your letter describes the Next Gen homes as meeting the need of
customers who favor multi -generational living.
Federal Way Revised Cade (FWRC) 19.05.010A and 19.265.020 regulate Accessory Dwelling Units. In
summary, the two submitted Next Gen house plans (A4126 and C3162) appear to have components of an
ADU including separate living, sleeping, sanitation, and cooking facilities. After reviewing applicable
FWRC provisions and the City's past practices on implementing ADU regulations, City staff will not
regulate the Next Gen homes as an ADU, subject to the following conditions: the second kitchen area
may not have permanent cooking facilities; and, prior to issuing a building permit, a covenant prohibiting
the Next Gen suite to be used as an ADU shall be recorded at the applicant's expense.
This correspondence does not provide a formal interpretation of the FWRC as discussed in FWRC 19.50.
The intent of this correspondence is to provide clarification of code provisions.

RE: Request for Administrative Decision — Lennar Next Gen Homes at Retreat Meadows Plat
Dear Mr. Davis:
As part of our due diligence efforts, we are trying to obtain clear direction from the City regarding the use
of our Next Gen product at the Retreat Meadows Plat currently owned by Landmark Homes. Our intent is
to waive feasibility in the next few weeks but before we do so, we would like your assistance in
understanding your interpretation of the Accessory Dwelling Unit (ADU) rules as it relates to our homes.
We have been instructed by your staff that in order to get a formal response, we need to apply for a
formal Request for Administrative Decision.
Our question to the City is to find out if you will continue to issue building permits for our Next Gen homes
the same way as it was done at Wynstone East in 2013 and 2014. At that time, building permits were
issued as Single Family dwellings. Here is a detail of those permits for your reference:

For over five years, we have been building Next Gen homes nationwide to meet the need of our
customers who favor multi -generational living. We can share with you may stories of grandparents who
are able to live close to their grandchildren, adult children with disabilities who are able to live with their
parents and many others.

Our request is for the City to be consistent with what has been done in the past and not consider this
concept an ADU.
In general, when we introduce this product in a jurisdiction, we research their ADU policies and adjust our
design to NOT be an ADU. Some of the things we have done in the past to insure this include not
installing cooking facilities in the Next Gen suite or have our customers sign an Affidavit prohibiting the
use of the Next Gen suite as a rental unit.
have attached a copy of the floor plans for the two Next Gen plans we intend to use at Retreat Meadows
for your reference. I have included the one that was previously approved by the City.
I have also included a copy of one of the building permits issued in the past.
We would love the opportunity to work together with you to explore how an affirmative response to this
request can be obtained.
