This site contains three, single-family homes (cabins) landward of the ordinary high watermark (OHWM). Two of the homes are immediately adjacent to the shoreline and are proposed to be demolished and replaced with an accessory dwelling unit (ADU) and a gazebo. You inquired about requirements necessary to back the debris container down the beach at low tide and park it in front of the job site; and walk an excavator down the beach approximately 400 feet from the end of the paved roadway to the job site. Background Property owners Jim and Carol Alavekios have obtained preliminary approval to convert two beach cabins into an 800 square -foot ADU and a 520 square -foot gazebo., On July 6, 2009, the City issued building permits for the new ADU under File #06-105589-SF and for the gazebo under file #06-105593- SF. The building permits expire on June 7, 2011. To date, demolition permits have not been obtained. Shoreline Permits A shoreline substantial development permit is not required to construct the new buildings or demolish the existing buildings pursuant to WAC 173-27-040(2)(g) as the new ADU and gazebo are considered to be construction on shorelands by an owner of a single-family residence and appurtenance for their own use, and thus exempt from the shoreline substantial development permit review. The exemption may include limited use of Puget Sound shorelands for demolition and/or construction actions. In order to approve an exemption from substantial shoreline development permits, a formal written request to exempt the project and specific actions from the shoreline substantial development permit process must be submitted to the City for review. The fee for a shoreline substantial development permit exemption is $91.50. A master land use application and bulletin #143 - Exemption from Shoreline Management Act Substantial Development Permit Requirement are enclosed. 1 The subject site is located in an RS 15.0 zoning district, which only permits one dwelling unit per lot. An ADU is necessary as there is an existing single-family residence on the subject property located south of the cabins. Mr9 Fasthorse December 16, 2010 Page 2 The exemption request must include the following information: • The timing, extent, and duration of all proposed demolition activity to be conducted from the beach. • The timing, extent, and duration of all proposed construction activity to be conducted from the beach. • The specific type, weight, and age of all vehicles proposed to be on the beach. • How approval to use private portions of the beach will be obtained. ■ Explain why these actions cannot be conducted from a barge at high tide or from the lawn area south of the cabins. • Provide a map of the routes of travel on the beach, all staging areas, all parking areas, and other vehicle use areas associated with beach access including those not located on the beach. Right -of -Way Permits Access to the beach is via the street end at 20 Avenue SW. As this is a city right-of-way, any road closure, or removal of the existing street end barricade will require that a right-of-way permit be obtained from the Public Works Department. If they did not stop, then you would possibly need to call the police ..... as you were very frustrated with the Diaconous refusing to honor the "stop work order' placed on the cabin by the City of Federal Way. Fernando, you discussed with me that you had gone down to the Diaconou cabin and that you allowed them to replace the underside braces and beams on the cabin because the cabin was at risk of falling down. You asked me to advise you if there was any cement work done, as they had to get a building permit to do this foundation repair. I advised the city thru email that Dave Sweet told Jim Alavekios that the Diaconous planned to do a complete remodel of the cabin with new windows, new roof line, stucco exterior, and new foundation. Dave Sweet told Jim that they only needed the electrical permit to redo the wiring as the remainder was only "repairs" and did not need a permit. Please advise us thru email what permits are required for the Diaconous to do the above work on their cabin. I told Fernando that the workers were continuing to use our bulkhead to remove the debris from the Diaconou cabin and place it in the dumpster placed on the Oliver property. I also advised Fernando that the Diaconou's workers had severely damaged our bulkhead taking out large chunks of cement and removing our handrails from the bulkhead without our permission. Both Diaconous and Dave Sweet refuse to put in writing that they will fix the damage to our bulkhead and take responsibility. John Diaconou's main reply was that we should repay him for the debris taken by Dave Sweet from our property and placed in his dumpster. I asked Fernando if the Diaconou's would be getting soil's reports for their cabin permit as we had to, because I just wanted to check that we all have to operate by the same rules of the city of Federal Way. I also told Fernando, that in the past, the Diaconous enjoyed bragging regarding building their home on a well in 1992 without informing the city, telling the city that the rockery on the cliff was found underneath the dirt, and that even tho the city required them to take out the kitchen on the cabin when they built the upper house, they put the kitchen back in the cabin after the upper house was complete. They thought this was quite funny to pull so much on the city ...... but, in the same tone, they seem to want to hold our feet to the fire to enforce every city law and permit which applys to our property. We are writing to you to ask that the Diaconous have to operate by the same rules that we have to abide with. Since we are no longer working with Dave Sweet, due to fraud, please send any communications regarding this issue directly to us. We are quite upset, since to date on this latest project on our cabin, we gave Dave Sweet approximately Greg 1=ewins - Fw: ❑iaconou's Cabin _ _ Page $10,000 on our foundation repair that he did not complete, left our cabin jacked up making it at risk of falling down, and damaged our bulkhead even though we asked him many time to not trespass on our property. We have also spent approximately $5000 for an architect to give the plans on repairing the cabins, and approximately $6000 Dave Salmon .......so far. It doesn't seem fair that the Diaconous don't pay the city any permit fees at all. I'm sure your can understand our frustration. Please keep us updated as to our concerns.
