The notifications shall include the applicants name, project location, starting date of work or completion date of work, and the control number of this HPA. 4. POST- CONSTRUCTION NOTIFICATION REQUIREMENT: Within seven days after completion of work, the applicant or their representative shall notify the Habitat Biologist listed below by email (Laura.Arber@dfw.wa.gov), or phone (425)379-2306. The notification shall include the control number for this HPA, applicants name, project location, and the completion date of work. 5. All trash and unauthorized fill, including concrete blocks or pieces, bricks, asphalt, metal, treated wood, glass, floating debris, and paper, below the ordinary high water line (OHWL) in and around the applicant's project area shall be removed and deposited at an approved upland disposal site. EQUIPMENT CORRIDOR 6. Project activities shall be limited to equipment access along the upper intertidal beach to reach private property for upland construction work. 7. Equipment access shall not occur when the access area is inundated by tidal waters. 8. Once equipment has transited the beach it shall access the upland from the existing boat ramp on the property. 9. Use of equipment on the beach shall be held to a minimum, confined to a single access point, and limited to a 25- foot work corridor waterward of the footing. Construction materials shall not touch the beach outside this access corridor. 11. Equipment used for this project shall be free of external petroleum -based products while working around the water. Equipment shall be checked daily for leaks and any necessary repairs shall be completed prior to commencing work activities along the water. 12. This approval is for access only and shall not result in the expansion of the bulkhead. 13. Work to the existing concrete bulkhead in not authorized under this HPA. 14. This HPA does not authorize materials to be stockpiled on the beach. 15. Fresh concrete or concrete by products shall be prevented from entering waters of the state. 16. Beach area depressions created during project activities shall be reshaped to preproject beach level upon project completion. MARINE HABITAT FEATURES 17. All natural habitat features on the beach larger than 12 inches in diameter, including trees, stumps, logs, and large rocks, shall be retained on the beach following construction. These habitat features may be moved during construction if necessary. 18. If removal or destruction of overhanging bankline vegetation is necessary for the construction of the project, new vegetation shall be replanted using native vegetation. WATER QUALITY 19. Project activities shall employ best management practices for temporary erosion and sediment control to minimize turbidity and siltation in the marine environment. 20. If at any time, as a result of project activities, fish are observed in distress, a fish kill occurs, or water quality problems develop (including equipment leaks or spills), immediate notification shall be made to the Washington Department of Ecology at 1-800-258-5990, and to the Area Habitat Biologist listed below. 21. All debris or deleterious material resulting from construction shall be removed from the beach area and bed and prevented from entering waters of the state. 22. No petroleum products or other deleterious materials shall enter surface waters. 23. Wood treated with preservatives, trash, waste, or other deleterious materials shall not be burned below the ordinary high water line. Limited burning of untreated wood or similar material may be allowed at or above the mean higher high water line. 24. Project activities shall not degrade water quality to the detriment of fish life. Any approved minor modification will require issuance of a letter documenting the approval. A minor modification to the required work timing means any change to the work start or end dates of the current work season to enable project or work phase completion. Minor modifications will be approved only if spawning or incubating fish are not present within the vicinity of the project. This site is zoned residential single-family (RS 15.0) and contains a single- family home and two small cabins, which are landward of the ordinary high water mark (OHWM). The proposal is to demolish the two cabins and replace them with an accessory dwelling unit (ADU) and a gazebo in order to correct a nonconforming density condition. The City granted conditional ADU . approval on January 2, 2009t and building permits for the ADU and the gazebo structures were submitted in October 2006.2 The building permits received several extensions and were subsequently renewed and issued in December 2011 under file numbers 11-104820-SF for the ADU and 11-104811-SF for the gazebo. As the building permits never expired, the project remains vested to codes in effect at the time the building permits were submitted. ADDITIONAL INFORMATION REQUESTED Your shoreline exemption request notes that heavy trucks and equipment needed for demolition are proposed to access the cabins via the 2 1 " Avenue SW right-of-way and across private beach property to the subject property. Additional information is requested to evaluate the requested exemption from the Shoreline Substantial Development Permit requirements as follows:i 1. Barge Access to the Site: The cabins are small wooden structures. Further information is requested pertaining to the use of a barge in delivering demolition equipment/removing waste in lieu of beach access. If use of the barge is not feasible from a technical perspective, please explain why that is the case. How many contractors have you consulted? Can you provide written verification from a marine contractor that barge access is infeasible? Use of a barge would negate the need for access across adjacent private property, potential damage to sensitive near shore habitat and right-of-way permits for removal of the 2 1 " Ave SW barrier and is, therefore, the city's preferred alternative. Mr. Scott Miller March 1.2012 Page 2 of 3 2. Beach Access Impacts: The potential impact as a result of heavy equipment traversing the beach area is unknown. The Federal Way Comprehensive Plan (FWCP) states that fish and wildlife habitat conservation areas are considered critical areas and are necessary for either resident animal species, or seasonal migratory animal species. These habitats are extremely important and, if altered, may reduce the likelihood that a given species will survive.a If beach access by truck is authorized, the impact of such access must be quantified. Please provide a report from a qualified biologist detailing how the request will address each of the following: • No net loss of spawning sites; ■ Maintain water quality; Preserve and protect fish and wildlife habitat; • Prevent environmental degradation. 3. Archeological Resources: The Washington State Department of Archeology and Historic Preservation (DAHP) has record of an archeological site in the Lakota Beach area. In addition to the recorded site, a cultural resource site was recently found in the Lakota Beach area. The subject property is located along the shoreline of Puget Sound and in the general vicinity of the two above - referenced cultural resource sites. Will excavation occur with the demolition and/or the construction of replacement structures? If so, a professionally prepared archaeological survey of the project area and report may be requested by DAHP and the Tribes for review prior to ground disturbing activities. Flood Hazard: The building permits were submitted on October 31, 2006, prior to the City adopting flood damage protection provisions under Ordinance #06-536, which became effective on November 16, 2006. The new dwelling unit and gazebo buildings are not subject to these requirements, which require that uses vulnerable to floods be protected against flood damage at the time of initial construction. TECHNICAL COMMENTS The following comments relate to the proposed demolition of the cabins. Geologically Hazardous Areas: The city's critical areas inventory has listed the subject property as a geologically hazardous area due to steep slopes and its susceptibility to erosion from wave action, pursuant to FWRC 15.05.030. However, as stated in finding 43 from the January 2, 2009, conditional preliminary ADU approval (file 06-105592-00-AU), all proposed work is fully within the footprint of the existing improvements and there is no material expansion or change of use; therefore, the work will not need a geotechnical review and is exempt from State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(3). Please note that any work that deviates from and is located outside of the existing building footprints will require submittal of a geotechnical report. 2. Private Property Access: if beach access via 2 1 " Ave SW is authorized (instead of barge access), the proposal will necessitate heavy equipment crossing adjacent privately owned shoreline properties on the beach in order to access the Alavekios property for cabin demolition. It will be the responsibility ' Sand lance and surf smelt spawn in the upper intertidal zone of protected sand -gravel beaches throughout the increasingly populated Puget Sound basin. making these species vulnerable to the cumulative effects of various types of shoreline development. "No net loss" regulations for protection of known spawning sites of forage fish species are included in the Washington Administrative Code Hydraulic Code Rules (WAC 220-110)_ which are applied during permitting of in -water construction activities. Schedule: Provide the City with a detailed schedule of proposed beach access for the demolition work in advance of any demolition actions including the total number of vehicular trips on the beach, specific activity dates and specific times of beach access. 4. Additional Permits: Additional permits maybe required by the US Army Corps of Engineers who can be reached at 206-764-3742 and the Washington State Department of Fish and Wildlife (for hydraulic permits) at 360-902-2537. CONCLUSIONS The request for an exemption of Shoreline Management Act Substantial Development Permit is being reviewed for compliance with the Washington State Shoreline Management Act, and Federal Way Shoreline Master Program and other applicable City regulations. This site contains three, single-family homes (cabins) landward of the ordinary high watermark (OHWM). Two of the homes are immediately adjacent to the shoreline and are proposed to be demolished and replaced with an accessory dwelling unit (ADU) and a gazebo. You inquired about requirements necessary to back the debris container down the beach at low tide and park it in front of the job site; and walk an excavator down the beach approximately 400:feet from the end of the paved roadway to the job site. Background Property owners Jim and Carol Alavekios have obtained preliminary approval to convert two beach cabins into an 800 square -foot ADU and a 520 square -foot gazebo.' On July 6, 2009, the City issued building permits for the new ADU under File 406-105589-SF and for the gazebo under file #06-1055,93- SF. The building permits expire on June 7, 2011. To date, demolition permits have not been obtained. Shoreline Permits A shoreline substantial development permit is not required to construct the new buildings or demolish the existing buildings pursuant to WAC 173-27-040(2)(g) as the new ADU and gazebo are considered to be construction on shorelands by an owner of a single-family residence and appurtenance for their own use, and thus exempt from the shoreline substantial development permit review. The exemption may include limited use of Puget Sound shorelands for demolition and/or construction actions. In order to approve an exemption from substantial shoreline development permits, a formal written request to exempt the project and specific actions from the shoreline substantial development permit process must be submitted to the City for review. The fee for a shoreline substantial development permit exemption is $91.50. CON F 9�� The subject site is located in an RS 15.0 zoning district, which only permits one dwelling unit c i Ft.&�AL31�"Cjssary as there is an existing single-family residence on the subject property located south of the cabin.c� 1 �11JJ Mr. Fasthorse December 16, 2010 Page 2 The exemption request must include the following information: • The timing, extent, and duration of all proposed demolition activity to be conducted from the beach. • The timing, extent, and duration of all proposed construction activity to be conducted from the beach. • The specific type, weight, and age of all vehicles proposed to be on the beach. • How approval to use private portions of the beach will be obtained. • Explain why these actions cannot be conducted from a barge at high tide or from the lawn area south of the cabins. ■ Provide a map of the routes of travel on the beach, all staging areas, all parking areas, and other vehicle use areas associated with beach access including those not located on the beach. Right -of -Way Permits Access to the beach is via the street end at 2 1 " Avenue SW. As this is a city right-of-way, any road closure, or removal of the existing street end barricade will require that a right-of-way permit be obtained from the Public Works Department.
