After evaluating the existing conditions in the neighborhood, review of Federal Way Revised City Code (FWRC) provisions (Section 19.135.030 through 19.135.070), and direction provided by the City Council, the Public Works Department hereby modifies the requirements for the street improvements as follows. Code Section (FWCC) 19-135.070, Modifications, Deferments, and Waivers, allows the Public Works Department to grant a request to modify, defer, or waive the required street improvements only after consideration of four specific reasons. The reason most applicable here is contained in FWCC Section 19 135.070 (1), "The improvement as required would not be harmonious with existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or city as a whole." After careful consideration by staff and the applicant's engineer, it was determined that the interior short plat road should be placed along the south side of the property to best serve both the applicant and circulation within the neighborhood as a whole. The road should conform to City of Federal Way Roadway Section "W", which requires a 28-foot wide paved roadway, with curb, gutter, four -foot wide planter strips with street trees, five-foot sidewalks, three-foot utility strips, and street lighting on both sides, all within a fifty-two foot wide public right-of-way. However, since the property immediately south of this lot is already developed with fenced back yards facing the proposed street, sidewalk, street trees, and streetlighting would be of limited value along the south side of the road. A cul-de-sac and full 28-foot wide paved roadway with curb and gutter is required to provide adequate circulation and parking. A minimum four -foot wide landscaped strip shall separate the road from the south property line. Bioretention may be incorporated into this area for drainage. Total right-of-way width shall be 44-feet. The conditions of this right-of-way modification will be applicable for a period of one year from the date of this letter. If a building permit is not issued within the one-year time limit, this waiver will be void and a new request for modification must be submitted. Comments provided by the City in the pre -application letter stated that the proposed internal street must meet requirements of a Type "W" local street; that a 52-foot wide right- of-way is required. However, after discussions with staff present at the meeting, they suggested the use of a reduced right-of-way to serve the project. We are proposing a 40-foot wide right-of-way dedication along the southern portion of the site. This 40-foot right-of-way will include 24 feet of paved travel lane, a vertical curb and gutter, 5-foot wide planter strip and 5 feet of concrete sidewalk. ESM does not anticipate traffic to exceed 90 new daily trips for the proposed 9-lot subdivision. Therefore, the proposed R-O-W improvements will provide sufficient room for all improvements, infrastructure and functions as characterized in the Local Streets matrix found in FWRC 19.135.250. Additionally, the 9-lot subdivision is proposing to utilize a 26-foot wide hammerhead turnaround with 28-foot turning radius adequate for fire apparatus and civilian vehicles. In contrast to a cul-de-sac turnaround, a hammerhead turnaround will maximize the available space for the stormwater tract.
