Dear Ms. O'Connor,
This letter responds to your request to waive and/or modify the required street improvements along 6th
Ave SW, which abuts the above -referenced property. After evaluating the existing conditions along the
referenced street, review of Federal Way Revised Code (FWRC) provisions (Sections 19.135.070 and
19.135.090), and direction provided by the City Council, the Public Works Department hereby modifies
the required improvements, as noted below.
Code Section (FWRC) 19.135.070; Modifications of Improvements Along Property Frontage, allows the
Public Works Department to grant a request to modify, defer, or waive the required street improvements
only after consideration of four specific reasons. The reason most applicable here is contained in FWRC
Section 19.135.070(1), "Improvements as required would not be harmonious with existing street
improvements."
6th Avenue Southwest is classified as a Minor Collector, corresponding to Federal Way Roadway Section
"S". This roadway section requires a 36-foot paved roadway, 4-foot planter strips,-5-foot sidewalks, and
a 3-foot utility strip, all within a 60-foot right-of-way. The existing roadway improvements along your
property frontage are an approximately 20-foot wide paved roadway within a 60-foot right of way. The
existing roadway is constructed within the eastern half of the right of way. Existing improvements to the
south of your parcel include a 20-foot paved roadway, with rolled curb and gutter and a 5-foot sidewalk
that ends at your southerly property line.
The following address the various elements of your request:
■ Your request to eliminate the 4-foot planter strip along your frontage is approved. The applicant
will be required to construct curb, gutter, and 5-foot sidewalk along the property frontage, and
eliminate the 4-foot planter strip;
■ Your request to install rolled curb and gutter is denied. The existing rolled curb and gutter that
lies to the south of your project was constructed before City incorporation, and the City only
allows vertical curb and gutter in its new roadway sections. It's acknowledged that some form of

transition from rolled- to vertical- curb and gutter will be required at the south end of the
improvements, and this transition section will need to be shown on the final engineering plans;
The current engineering plan shows the proposed curb, gutter and sidewalk to `veer' slightly back
to the west, into the northbound lane of travel. Given that the existing roadway is fairly narrow in
nature, veering of the alignment is a potential safety hazard and is not allowed. The proposed new
improvements will need to align with the existing improvements to the south of your project.
Additional property may need to be dedicated to the City so that the new sidewalk is completely
within the City right of way. The City will waive the required 3-foot utility strip behind the
sidewalk in order to minimize the amount of property needed for right of way, however, the
applicant may need to provide an easement along the property frontage in order to install other
utilities;
Your request to waive street lighting is denied. A streetlight shall be installed at the intersection
of the proposed shared access driveway and 6th Ave SW. The streetlight would have to be behind
the new sidewalk, so an easement may have to be granted to the City where the streetlight is
located. Alternatively, if it can be shown through a photometric plan that meets City lighting
standards, a streetlight mounted to an existing utility pole in the immediate vicinity of the noted
intersection, may be allowed;
Additional Condition of Approval:
The existing 6-foot high board fence on the property to the south of your applicants (at 538 SW
317t' Place) causes a sight -distance obstruction for vehicles exiting the proposed short plat shared
access road. In order to mitigate this obstruction, the applicant will have to remove/relocate that
section of fence to obtain a clear sight distance. Alternatively, the shared access roadway may
need to be relocated so that a clear sight distance can be obtained without removal of that fence.
The conditions of this right-of-way modification will be applicable for a period of one year. If
preliminary short plat approval is not issued within the one year time period, this waiver will be void, and
a new request for modification must be submitted.

Chernikov/Burlakov/Lisitsyn Short Plat.
Based on the letter received from the City on July 25, 2016, we have compiled the
updated documents for resubmittal to allow continued processing of the Short Plat
application which was previously submitted on May 27, 2016. The following items are
being resubmitted for your consideration:

Show the necessary street frontage improvements on 6th Ave SW frontage for a Type 'S"
stree4 consisting of curb and gutter, 4-foot planter strip with street trees, 5-foot sidewalks,
and street lights; or make a written request to the Public Works Director to modify, defer,
or waive the required street improvements (FWRC 19.135,070) Information about right-of-
way modification requests is available through the Public Works Development Services
Division. These modification requests have a nominal review fee currently at $160.00.
With this letter and accompanying fee the applicant requests a modification to the
street frontage improvements that are required along 6th Ave SW. The short plat
has 164 linear feet of frontage along 6th Ave SW. There are currently no frontage
improvements on either side of the road along the site frontage or the frontages
to the north. To the south of the site there is rolled curb and a 5' sidewalk on the
east side of 6th Ave SW. There are no planter strips or street lights along 6th Ave
SW. The rolled curb and sidewalk end at approximately the southwest corner of
this proposed short plat. We request that the City grant a modification to allow
the applicant to construct street frontage improvements that match the existing
improvement to the south of the site. This includes the construction of rolled
curb and 5' wide sidewalk along the east side of 6th Ave SW for approximately 164
linear feet. We request that the City waive the requirement for street lights and
planter strip along the frontage. These improvements will be consistent with the
surrounding neighborhood and will provide for safe walking conditions along the
front of the property.

Request The applicant is requesting that the City modify its standard for frontage
improvements along 6th Ave S W by allowing them to `match' the existing improvements that are
constructed to the immediate south of their project site. Those existing improvements are rolled
curb and gutter with a 5-foot sidewalk adjacent to the back of cub. The applicant is also asking
that we waive the planter strip and street lighting along their frontage.
Staff Analysis 6th Ave SW is classified as a Minor Collector, corresponding to City Standard
Street Section Type `S', requiring a 36-foot roadway, 4-foot planter strip, 5-foot sidewalk, and 3-
foot utility strip in a 60-foot right of way. The existing conditions along the subject property are
a 20-foot paved roadway within a 60-foot right of way. Based on the survey provided, the 20-
foot roadway lies entirely within the eastern half of the existing 60-foot right of way.
A copy of a portion of the preliminary engineering plan is attached for reference. Note the `jog'
at the proposed connection to the existing curb and sidewalk to allow the requested modified
improvements to be completely within right of way. Also please also note the location of the
existing 6-foot high wood fence on the adjacent property as it relates to the proposed access road
on the south side of the plat. The fence could pose a sight distance obstacle for drivers looking
south from the access road. Should this road location also be addressed in the mod response?

Traffic and Development Services Divisions have considered your request identified in item #3, below, and provides the
following explanation for our decision: As noted in our letter, given that roadway is only about 20-feet wide, we feel that
'jogging' the curb and gutter back towards the center of the paved section creates a safety hazard for vehicles traveling
along that section, by potentially causing northbound drivers to abruptly steer toward the middle of the road in order to
avoid hitting the new curb. Furthermore, the new improvements (curb, gutter, and sidewalk) need to be within the
City's right of way, which prompts the required additional dedication of your clients land for adequate right of way to
incorporate the new improvements, while maintaining the alignment of the existing curb, gutter, and sidewalk.
The only other way to avoid having your client dedicate right of way, would be to re -align that segment of the existing
curb and gutter and roadway, back to a point that would provide an appropriate taper/transition section up to your
clients property, and then again provide a transition back to existing alignment past the north end of the project. This
would also require additional pavement along the west side of the roadway in order to maintain a minimum of 20-feet
of roadway width. If you think this option is more desirable than dedicating the right of way, let me know and I can
gather additional information as to what that taper/transition distance might be.

Thanks for the comments/decisions in the attached letter for the Chernikov Modification Request. I have a few
questions/comments and hope to get your input:
1. No planter strip. Ok.
2. No rolled curb but transition to vertical curb. Ok.
3. Curb alignment and right of way. As it is now the improvements (paved surface, curb, sidewalk) are severely off -
center to the east and the new sidewalk would end up on the private property even though there is a full 60'
right of way available. By requiring the improvements it will create an extra burden on the property by requiring
±3' of additional right of way. It will also result in an uneven right of way through this area. We request some
justification from the city for this request for additional right of way when sufficient right of way exists.
4. A street light will be required. We would like to pursue the option of installing a street light on the pole across
the street and will prepare a photometric plan. Can you please provide a reference to where we can find the City
Lighting standards?
Lastly, we have met with our client and they have decided to pursue a small redesign of the project to locate the
driveway to the north side of the property just south of the stormwater pond. This should alleviate any sight distance
issues. We hope to have the revised plat resubmitted early next week. Please let us know what you can on the above.
