As a condition of The Hills, a proposed 6-lot short plat, the applicants are required to construct
SW 365a' Street to a cross-section "X" standard and tie into proposed improvements on Monte
Vista Short Plat. They are requesting that the street cross section be modified to include 3/4
street improvements within the property boundaries. Within the panhandle, they propose a
further reduction to eliminate the 8' ditch on the north side and provide vertical curb, gutter, and
sidewalk.
Staff Analysis
The short plat has 626 linear feet of frontage, including a 36-foot wide, 214 foot long panhandle.
SW 365t' Street will be constructed for the length of the property, including the panhandle, and
will connect to Monte Vista Short Plat on the east and 6a' Ave SW on the west.
The type "X" cross section includes a 20' travelway with 3' utility strips, 5'sidewalks, and 8'
ditches on both sides, all within a 52 foot right-of-way. To align with Monte Vista short plat
improvements, along the property frontage the applicant proposes to build a 3' utility strip, 5'
sidewalk, and 8' ditch on the north side, with a 20' travelway and 8' of undeveloped right-of-
way remaining on the south side. The 36' wide panhandle is proposed to include a 3' utility
strip, 5' sidewalk, and vertical curb on the north side, 20' travel way, and 8' of undeveloped
right-of-way on the south side. Instead of a crown, they are proposing to grade the road so that
all the runoff drains toward the proposed 8' ditch on the north side.
Requirements / Conditions of Approval To maintain proper alignment on S 365t' St, staff
recommends approval of this modified street cross section, with the exception that the road will
be crowned and a v-ditch with check dams added on the south side. The v-ditch may be reduced
to six feet wide to allow slopes to tie into existing grade offsite. Vertical curb shall be allowed
only on the north side of the panhandle improvements due to the constrained width.

The City of Federal Way Public Works Department has considered your request to modify or waive
several elements of the frontage improvements required by Federal Way Revised code (FWRC) for the
proposed 6-lot short plat located along SW 365t' Street.
The requests and applicable codes are as follows:
1) Reduce the required type X street cross-section within the property boundaries to 3' utility strip, 5'
sidewalk, 8' ditch on the north side, 20' travelway, and 8' undeveloped right-of-way on the south side.
(FWRC Section 19.135.040; 19.135.070)
2) Reduce the required type "X" street cross-section within the panhandle to 3' utility strip and 5'
sidewalk on the north side, 20' travelway, and 8' undeveloped right-of-way on the south side. (FWRC
Section 19.135.040; 19.135.070). Vertical curb is required to make this cross-section drain properly.
3) Eliminate the crown and slope the road to the ditch along the north side. (19.135.130 and 19.135.07;
Development Standards Section 3.2.7.E)
Staff has determined that FWRC section 19.135.070 "2) Unusual topographic or physical conditions
preclude the construction of the improvements as required" applies in regard to the road alignment. On
the east, the road must tie into proposed improvements for Monte Vista Short Plat, which is currently
under construction. On the west, the panhandle is not wide enough to accommodate full frontage
improvements, but the 20' road width and 5' sidewalk can be provided. The proposed alignment is
appropriate to meet these constraints in both directions. Since eight feet is available on the south side of
the improvements, a ditch is possible. Therefore, the road must be crowned and a modified dich section,
including v-ditch and check dams, must be provided, as feasible to tie into existing grades offsite.
In summary, requests 1 and 2 are granted, and request 3 is denied. The reduced cross sections may be
constructed as proposed, with the exception that the road shall be crowned and ditch provided on the
south side. Vertical curb shall be allowed only on the north side of the panhandle.

The conditions of the right-of-way modification are applicable for one year from the date of this letter. If
the work is not completed within this time period, this decision will be void and a new request for
modification must be submitted.

Dear Mr. Walsh:
On behalf of Veristone Homes 4, LLC, ESM Consulting Engineers, LLC is submitting this
request to modify the required street improvements for The Hills Preliminary Short Plat. The
City of Federal Way Official Zoning Map identifies parcel no. 3021049173 as zoned RS 15
which allows 1 dwelling unit per 15,000 SF. The gross parcel size is 114,190 SF or 2.62
acres. The proposed preliminary short plat seeks to subdivide this parcel into 6 buildable
lots, 1 stormwater tract, and dedicate right-of-way for the extension of SW 365th Street. In
total, the proposed length of right-of-way on The Hills Preliminary Short Plat site will be
approximately 626 linear feet with a variation from 36 feet in width up to 44 feet in width.
This parcel has an existing configuration that represents a typical pan handle lot or flag lot
configuration. The "handle" or "flagpole" of this parcel measures 36 feet wide by 214 feet
long and has direct access onto 611 Ave SW located on the west side. To the east, near the
southeast corner of the parcel, the adjdining property has preliminary short plat approval
(Montevista) for the development of 7 lots and an internal roadway identified as an extension
of Yl Place SW into SW 3651h Street by means of a type "X" local street.
Per the City of Federal Way Street Standards 3-2X, the type "X" local street cross section
contains 3' of utility strip, 5 feet of sidewalk, 8 feet of ditch, and 10 feet of travel way on each
half- all contained in a 52-foot right-of-way. Staff identified during the pre -application
conference that the proposed extension of SW 3651h Street will need to continue with the
type 'Y' local street standards.
Given the pre-existing constraints on the site, Veristone Homes 4, LLC is seeking a modified
type "X" local street for The Hills Short Plat. Where the 214 foot long "panhandle" or
"flagpole" portion lies, the modified street will contain a 3 foot wide utility strip, 5 feet of
sidewalk, vertical curb and gutter, 20 feet of travel way, and 8 feet of native ground to
accommodate 3:1 side slopes and future ROW improvements. The remaining 412 feet of
the right-of-way will contain a 3-foot-wide utility strip, 5 feet of sidewalk, 8 feet of ditch, 20
feet of travel way, and 8 feet of native ground to accommodate 3:1 side slopes and future
ROW improvements. Instead of crowning the asphalt travel way, this modification will warp
the road at a 2% slope towards the 8-foot wide ditch.

Pursuant to FWRC 19.135.070, this letter requests that the director consider modification to
the required street improvements for the following reason:
1. Unusual topographic or physical conditions preclude the construction of the
improvements as required.
Parcel 3021049173 of which The Hills Preliminary Short Plat is located on has been
defined by prior land divisions with King County. The configuration has provided a
36-foot wide section of the parcel with direct access onto 61h Ave SW. Presumably
this configuration was created to prevent this parcel from becoming land -locked by
other parcels. This 36-foot wide access is flanked on either side by parcels under
different ownership from the applicant and their affiliates. Therefore, this narrow strip
of land cannot accommodate the full width right-of-way of a Type X local street unless
additional land is acquired. Future divisions of land or site development of the parcel
to the south may allow for additional right-of-way dedication and full width street
improvements. As currently presented the proposed short plat can only provide a
little less than '/4 or 75% of the local street standard for approximately 214 feet.
Furthermore, the remaining 412 feet of ROW must make proper attempts to align
with adjoining ROW of the Montevista plat. The full street type "X° ROW width cannot
be accommodated because the placement of adjoining ROW alignment is located
too far south. Therefore, 44 feet is the maximum ROW width for this 412-foot
segment.
