Dear Ms. Guffey:
The Community Development Department has completed administrative land use review of the proposed
combined sign package for CVS Pharmacy at 33520 21st Ave SW and Autozone at 33510 21st Ave SW,
Federal Way. The applicant proposes to install two shared freestanding monument signs along 2 1 " Ave.
SW and 336"' St.
The Process III Master Land Use (MLU) application submitted November 14, 2016, and resubmitted on
December 13, 2016Js hereby approved based on the enclosed findings of fact, incorporated into this
decision in frill, and the following conclusions based on those facts:
1. The proposal is consistent with the comprehensive plan;
2. The proposal is consistent with all applicable provisions of Federal Way Revised Code (FWRC);
3. The proposal is consistent with the public health, safety, and welfare;
4. Traffic safety impacts for all modes of transportation, both on and off site, are adequately
mitigated;
5. The combined sign package will provide more coordinated, effective, and efficient signs; and
6. The allowable sign area, sign type, sign height, and numbers of signs are consistent with the
requirements of a multi -tenant complex.
REVIEW PROCESSES REQUIRED
Pursuant to FWRC 19.140.140(5), a combined sign package for adjacent property owners shall be
processed under Use Process III. The Director of Community Development will make the initial land use
decision based on written comments and information gathered during site plan review. Any appeals of the
decision will be decided by the Hearing Examiner after a public hearing.
The proposed combined sign package is categorically exempt from an environmental threshold
determination pursuant to Washington Administrative Code (WAC) 197-11-800(2)(c).
ADDITIONAL PERMITS REQUIRED
The applicant shall obtain sign permits from the city's Department of Community Development forthe
two proposed shared signs. For further information regarding the sign permit, please contact the

APPROVAL DURATION
Unless modified or appealed, the Process III decision is vaI id for five years from the date of issuance of
the decision. Time extensions to the decision may be requested prior to the lapse of approval following
the provisions listed in FWRC 19.15.110.
REQUESTS FOR CHANGE OF VALUATION
Any affected property owners may request a change in valuation for property tax purposes,
notwithstanding any program of revaluation.
APPEALS
The effective date of issuance is three calendar days following the date of this letter, or January 20,
2017. Pursuant to FWRC 19.65.120, this land use decision may be appealed by any person who submitted
written comments or any person who has specifically requested a copy of the decision. Any appeal must
be in the form of a letter delivered to the Department of Community Development with the established
fee and within 14 days after the effective date of issuance of this decision, or February 3, 2017. The
appeal letter must contain a clear reference to the matter being appealed and a statement of the factual
findings and conclusion of the Director disputed by the person filing the appeal. The Federal Way
Hearing Examiner will hear any appeals of the Process III decision.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies. and
standards relating to this development. This Process Ill approval does not constitute approval of a sign

Findings for Process III Project Approval
CVS Pharmacy & AutoZone Combined Sign Package

The Director of Community Development hereby makes the following findings pursuant to content
requirements of the Process III written decision as set forth in Federal Way Revised Code (FWRC)
19.65.100(4). These findings are based on review of existing city documents and submitted items by the
applicant.
1. Proposal — The project applicant, Plumb Signs, proposes to install two shared freestanding
monument signs along 2 1 " Ave. SW and SW 336"' St. for CVS Pharmacy and AutoZone, located
on adjacent parcels, both zoned Neighborhood Business (BN).
2. Review Process — The proposed combined sign package is subject to review pursuant to FWRC
19.140.140(5), Combined sign package for adjacent property owners. The city has reviewed and
decided upon the proposal using Process III `Project Approval, 'pursuant to FWRC Chapter 9.65.
3. Environmental Review — The application is exempt from review under the State Environmental
Policy Act (SEPA) as it meets categorical exemptions set forth in Washington Administrative
Code (WAC) 197-1 1-800(2)(c) for construction or installation of commercial on -premise signs.
4. Public Notice — The application was deemed complete on December 14, 2016, and a Notice of
Application was posted on December 15, 2016. The notice was posted at the subject property,
posted at each of the city's official notification boards, published in the Federal Way Mirror, and
mailed to property owners within 300 feet of the subject property. The comment period due date
was January 3, 2017, and no comments were received.
5. Combined Sign Package — The applicants have submitted for a combined sign package to install
two shared freestanding signs. This collaboration will allow for increased size of a monument
sign. It will also allow for additional frontage exposure. Staff has determined that the combined
sign package will provide more coordinated, effective, and efficient signs.
6. Sign Criteria —The allowable sign area, sign type, sign height, and number of signs is
determined as if the applicants were one multi -tenant complex. The combined sign package
proposal is subject to criteria of a medium profile sign as follows, per 19.140.140(2):
a. Sign Type — Medium profile signs may either be pedestal or monument signs. As
proposed, there will be two monument signs.
b. Sign Height — The height of a medium profile sign is calculated at a rate of one and one-
half feet in sign height for every 10 lineal feet of frontage along a public right-of-way;
however, such height cannot exceed a maximum height of 12 feet. The total frontage for
CVS Pharmacy and AUtoZone is approximately 555 lineal ft. The applicants are allowed,
and propose, the maximum height of 12 feet.
c. Sign Area — For a multi -tenant complex, sign area is calculated at a rate of two sq. ft. per
lineal foot of frontage on a public right-of-way not to exceed a maximum sign area of 128
sq. ft. For CVS Pharmacy and AutoZone Combined Sign Package the total of all sign
faces on each permitted sign with no one sign face exceeding 64 sq. ft. The applicants are
allowed the maximum sign area of 128 sq. ft. per sign. The proposed signs are two-sided
and have a total sign face of approximately 112 sq. ft. for each sign, which meets the
allowed sign area.
d. Number of Signs — A subject property may have one monument sign for each street
frontage. The project has frontage along 2151 Ave. SW and SW 336"' St.; one sign is
proposed along each frontage for a total of two signs.
Construction Standards — Sign construction is consistent with FWRC 19.140.170 "Construction
Standards" based on provisions of the following elements:
a. Both signs meet the setback requirement of three feet from property lines.
b. As proposed, the signs meet the dimensional standards for monument signs.
c. The proposed signs meet applicable design criteria, the sign base is constructed with
brick, and both sign faces are harmonious with the character of the primary structures on
site.
d. The location of the monument signs are not hazardous to a motorist's or pedestrian's
ingress or egress from the buildings or parking area and are located out of the clearview
zone.
e. An area adjacent to the base of each freestanding sign must be landscaped equal to the
sign area. The applicant proposes in excess of 300 square feet of landscaping at the base
of the AutoZone sign. At the base of the CVS sign, over 400 square feet of landscaping
will be installed. The landscaping will include shrubs and groundcover at both signs.
8. Sign Permit —No construction may begin until sign permit approval. As of the date of this land
use decision, no sign permit application has been submitted.
Decision Criteria — Staff finds the proposal is consistent with Process III, Project Approval,
decisional criteria required under FWRC 19.65.100(2)(a) and Combined Sign Package decision
criteria per FWRC 19.140.140(5). The proposal is consistent with the city's comprehensive plan;
applicable provisions of FWRC Title 19 Zoning and Development Code; public health, safety,
and welfare; and streets and utilities in the area are adequate to serve the anticipated demand from
the proposal.
Final construction drawings will be reviewed for compliance with specific regulations, conditions of
approval, and other applicable city requirements. These findings shall not waive compliance with future
City of Federal Way codes, policies, and standards relating to this development.

Dear Ms. Guffey:
On November 14, 2016, the Department of Community Development received your application for
combined signage on the CVS Pharmacy and Auto Zone properties in Federal Way. Upon receipt of the
application, city staff reviewed the submittal packet for completeness based on the requirements for signs
under Federal Way Revised Code (FWRC) 19.140.040(2), "Permit Applications" and Chapter 19.140,
"Signs."
INCOMPLETE APPLICATION
During the course of review, the application was deemed to be incomplete pursuant to the three items
below. These three items need to be corrected in order for the application to be reviewed for approval.
Sign Location — The submitted siteplans have been resized, thereby changing the listed scale. And
the hand -drawn 1"=50' scale is incorrect. Therefore, we cannot determine if the proposed signs
meet the required three-foot minimum setback required by FWRC 19.140.170(7)(b).
2. Landscaping —The submitted siteplans only illustrate landscaping around the CVS Pharmacy
sign. Please submit a siteplan depicting at least 112 square feet of landscaping around the Auto
Zone sign, per the following requirements:
Landscaping around freestanding signs. To improve overall appearance of the sign and
to reduce the risk of motor vehicles hitting the sign or supports of the sign, an area
adjacent to the base of each freestanding sign must be landscaped equal to the sign area;
provided, however, that the city will not require more than 200 square feet of landscaped
area. This landscaping must include vegetation and may include other materials and
components such as brick or concrete bases as evidenced in plazas, patios and other
pedestrian areas, planter boxes, pole covers or decorative framing.
Landscaping can include evergreen shrubs, deciduous shrubs, vines, and groundcover or
grasses. If low shrubs and groundcover are to be used, at the time of planting, a m inimum
of 50 percent of the required landscaped area should be planted with low shrubs and
groundcover such that within two years, 90 percent of the landscaped area is covered. If
all grasses are to be used, the landscaped area must be covered 100 percent at time of
planting. Low maintenance plantings are recommended. (FWRC 19.140.170(5))

3. Sign Materials — Renderings submitted do not indicate sign materials. Please submit a list of sign
materials that satisfy the following requirements:
(1) Sign base. The base of the sign must be done in landscape construction materials such
as brick, stucco, stonework, textured wood, tile or textured concrete or materials that are
harmonious with the character of the primary structures on the subject property and
subject to the administrator's approval. No visible gap shall be allowed between the sign
base and the finished grade or between the sign face or cabinet and the sign base.
(ii) Sign face. The color, shape, material, lettering and other architectural details of the
sign face must be harmonious with the character of the primary structure. (FWRC
19.140.170(3)(c))

2. if the proposed Insured has or acquired actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting the estate or
interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and shall fail to disclose such knowledge
to the Company in writing, the Company shall be relieved from liabillty for any loss or damage resulting from any act of reliance hereon to the

3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties included under the definition of
Insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply
with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B. or [c] to acquire or create the estate or interest or mortgage
thereon covered by this Commitment_ In no event shall such liability exceed the amount stated in Schedule A for the policy of policies committed
for and such liability is subject to the insuring provisions and Conditions and the Exclusions from Coverage of the form of policy or policies
committed for in favor of the proposed Insured which are hereby incorporated by reference and are made a part of this Commitment except as
expressly modified herein.
4. This Commitment is a contract to issue one or more title insurance policies and is not an abstract of title or a report of the condition of title. Any
action or actions or rights of action that the proposed Insured may have or may bring against the Company arising out of the status of the title to
the estate or interest or the status of the mortgage thereon covered by this Commitment must be based on and are subject to the provisions of this
Commitment.

How Information is Collected

maintained by governmental entities that we either obtain
directly from those entities, or from our affiliates or others.
Additional Wavy Information is Collected Through the Website
Browser Log Files. Our servers automatically log each visitor
to the Website and collect and record certain information about
each visitor. This information may include IP address, browser
language, browser type, operating system, domain names, browsing
history (including time spent at a domain, time and date of your
visit), referring/exit web pages and URLs, and number of clicks. The
domain name and IP address reveal nothing personal about the
user other than the IP address from which the user has accessed
the Website.
Cookies. From time to time, FNF or other third parties may
send a "cookie" to your computer. A cookie is a small piece of data
that is sent to your Internet browser from a web server and stored
on your computer's hard drive and that can be re -sent to the serving

We may provide your Personal Information (excluding information
we receive from consumer or other credit reporting agencies) to
various individuals and companies, as permitted by law, without
obtaining your prior authorization. Such laws do not allow
consumers to restrict these disclosures. Disclosures may include,
without limitation, the following:
• To agents, brokers, representatives, or others to provide you
with services you have requested, and to enable us to detect or
prevent criminal activity, fraud, material misrepresentation, or
nondisclosure in connection with an Insurance transaction;
• To third -party contractors or service providers who provide
services or perform marketing services or other functions on
our behalf;
• To law enforcement or other governmental authority in
connection with an investigation, or civil or criminal subpoenas
or court orders; and/or
• To lenders, lien holders, judgment creditors, or other parties
claiming an encumbrance or an interest in title whose claim or
interest must be determined, settled, paid or released prior to a
title or escrow closing.
In addition to the other times when we might disclose information
about you, we might also disclose information when required by law
or in the good -faith belief that such disclosure is necessary to: (1)
comply with a legal process or applicable laws: (2) enforce this
Privacy Notice; (3) respond to claims that any materials, documents,
images, graphics, logos, designs, audio, video and any other
information provided by you violates the rights of third parties; or (4)
protect the rights, property or personal safety of FNF, its users or
the public.
We maintain reasonable safeguards to keep the Personal
Information that is disclosed to us secure. We provide Personal
Information and non -Personal Information to our subsidiaries,
affiliated companies, and other businesses at persons for the
purposes of processing such information on our behalf and
promoting the services of our trusted business partners, some or all

Under California's "Shine the Light" law, California residents who
provide certain personally identifiable information In connection with
obtaining products or services for personal, family or household use
are entitled to request and obtain from us once a calendar year
information about the customer information we shared, if any, with
other businesses for their own direct marketing uses. If applicable,
this information would include the categories of customer
information and the names and addresses of those businesses with
which we shared customer information for the immediately prior
calendar year (e.g., requests made in 2015 will receive information
regarding 2014 sharing activities).
To obtain this information on behalf of FNF, please send an email
message to privacy fnf.com with "Request for California Privacy
Information" in the subject line and in the body of your message. We
will provide the requested information to you at your email address

Please be aware that not all information sharing is covered by the
"Shine the Light" requirements and only information on covered

Additionally, because we may collect your Personal liformation
from time to time, California's Online Privacy Protection Act requires

FNF Compliance with California Online Privacy Protection Act
For some websites which FNF or one of its companies owns, such
as the Customer CareNet ("CCN"), FNF is acting as a third party
service provider to a mortgage loan servicer. In those instances, we
may collect certain information on behalf of that mortgage loan
servicer for fulfilling a service to that mortgage loan servicer. For
example, you may access CCN to complete a transaction with your
mortgage loan servicer. During this transaction, the information
which we may collect on behalf of the mortgage loan servicer is as

payment or user information is incorrect, you must contact
your mortgage loan servicer.
CCN does not share consumer information with third parties, other
than those with which the mortgage loan servicer has contracted to
interface with the CCN application.
All sections of the FNF Privacy Notice apply to your interaction with
CCN, except for the sections titled Choices with Your Personal
Information and Access and Correction. If you have questions
regarding the choices you have with regard to your personal
information or how to access or correct your personal information,
you should contact your mortgage loan servicer.
