We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal Way Revised Code (FWRC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWRC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION Proposal to subdivide a 12,750 sf parcel into two lots (Proposed Lot 1: 15,000 sf; Proposed Lot 2: 11,250 sf). The subject property contains a single family home serviced by septic and two accessory structures. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. Planning Division A new single-family residential dwelling unit is not a permitted use on Lot 2. Mr. May October 13, 2016 Page 2 of 9 • Public Works Development Services Division When development of the parcel occurs, Flow control and water quality treatment will be required as outlined in the 2016 King County Surface Water Design Manual. A downstream conveyance system nuisance problem has been identified downstream of this project. Previous analyses are available for the engineer's review. If the same conclusion is reached for this project, flow control requirements will be increased to Level 3. Public Works Traffic Division The applicant shall constrict street frontage improvements along the property frontage on 20"' Avenue SW (FWRC 19.135.040). DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions, please contact the representative listed for that section. PLANNING DIVISION (Leila W-Oakes, 253-835-2644, Lei la.Willou2hbv-Oakes rr eitvoff'ederahvay.com 1. Existing Site Conditions — The subject property is zoned Neighborhood Business (BN) and contains a legal non -conforming residence and accessory structures (garage etc.). The existing parcel takes access off of 20"' Avenue SW and does not contain street frontage improvements. 2. Procedural Information — Pursuant to FWRC 18.20, binding site plan applications are administratively reviewed by the Department of Community Development pursuant to the short subdivision regulations of FWRC 18.30. The administrative review process requires that the Community Development Director issue a decision on the binding site plan request, establishing compliance with the decisional criteria of FWRC 18.30.110(2). After the Permit Center accepts an application, Planning Division staff will conduct a review and issue a letter of completeness or incompleteness requesting additional information within 28 days of receipt. A master land use application and binding site plan submittal checklist are enclosed; relevant code sections are available at the city's website at ww w.cityoffederalwgy.con under Title 18 `Subdivision.' 3. Public Notice — Public notice of a Binding Site Plan proposal is required per FWRC 18.30.080, and a 15-day public comment period is provided. The city will prepare and post a notice board on the subject property. Copies of the Notice of Application will also be posted at the city's designated public notice boards and published in the Federal Way Mirror. Binding site plans do not require mailed distribution to abutting residential property owners. 4. Binding Site Plan Approval Duration — Binding site plan approvals expire five years from the date of the Community Development Director's decision per FWRC 18.30.260(1). The binding site plan must be recorded within the five-year time period. No less than 60 days prior to the lapse of approval, the applicant may request a two-year time extension for the binding site plan approval pursuant to FWRC 18.05.090(1)-(6). State Environmental Policy Act (SEPA) — The two -lot BSP proposal is exempt from the requirements of SEPA review per Washington Administrative Code (WAC) 197-11-800, Categorical Exemptions. 16-10443 1 -00-PC Doc ID: 74687 Mr. May October 13, 2016 Page 3 of 9 6. Critical Areas —There are no environmentally critical areas on the subject property. Lot Size/Coverage — Pursuant to FWRC 19.215 there is no minimum lot size in the BN zoning district, except for the following uses: • Churches, synagogues or other places of worship (7,200 sf minimum). • Self -storage facilities (I acre minimum). ■ Schools, day care facilities, commercial, and animal kennels or animal care facilities (no breeding of animals allowed) (7,200 sf minimum). Instead of a maximum lot coverage, the buildable area will be determined by other site development requirements (i.e., required buffers, parking lot landscaping, surface water facilities, etc.). Please note any areas established as an ingress/egress easement, pipestem, or access tract for each property will subtracted from the underlying parcel size. Please include the "net" lot area on the lot closures and binding site plan drawing for preliminary approval. 8. Other General `BN' Zoning Requirements (Future Development) — Please refer to the use zone charts within FWRC 19.215. They contain lists of permitted uses and their corresponding bulk zoning requirements (i.e., height, parking, setbacks, and special notes). Different uses in the BN zone have different zoning requirements. 9. Existing Structural Setbacks — The existing legal non-conforining detached dwelling unit shall maintain a side -yard setback of 5 ft. from the new property line per FWRC 19.200.010. 10. Existing Septic (Single Family Residence) — During the BSP process, the applicant will obtain King County Health Department approval and a King County Health District signature on the approved BSP drawing/title block prior to recording. 11. Comprehensive Plan Amendment/ Rezone [Meeting Follow-up] — The applicant expressed interest in applying for a rezone from a commercial zone (BN) to a residential zone. In order to rezone, a comprehensive plan rnap amendment would be required concurrently, in addition to a rezone request. The applicant would request a comprehensive plan designation change. Proposed Comprehensive Plan Amendments are processed once per calendar year (`Docketing Process') under a Use Process VI `Council Rezone' land use application (see enclosure). The rezone and comprehensive plan map amendment would be processed concurrently. Comprehensive plan amendments are subject to a public hearing at the Planning Commission and council approval. 12. Clearing, Grading, and Tree and Vegetation Retention — The binding site plan is subject to the provisions of FWRC 19.120, "Clearing, Grading, and Tree and Vegetation Retention." 13. Preliminary Landscape/Vegetation Plan Inventory — Pursuant to FWRC 19.120.040 the applicant shall provide a separate drawing, containing an inventory of natural vegetation existing on site and a preliminary landscape and tree retention/replacement plan (Bulletin #043). 14. Tree Density Requirements — The two -lot binding site plan is subject to the tree density requirements of FWRC 19.120.130(1). Thirty tree -units per acre are required per lot in the Neighborhood Business (BN) zone. In the case of this 0.60-acre site, 19 tree units are required (30 x 0.60 acres = 19, as the calculation results in a fractional quantity, it shall be rounded up to the next higher whole number). Please see a tree unit credit overview below (Table 2, FWRC 19.120.130-2). A tree unit is a value assigned to existing trees retained on the property or replacement trees. The larger the tree, the greater value it is assigned. Required tree density can be composed of retained trees t:l Zn and replacement plantings per FWRC 19.120.130. The plan must clearly show where the tree units Z� will be located. Per FWRC 19.120.130.3, the total number of tree units required by a regulated activity shall be calculated by multiplying gross site acreage, minus any proposed public or private streets. The Table below identifies tree unit values for retained and replacement trees. Please note one tree unit does not always equal one tree. Recording —The city will record the binding site plan with the King County Division of Records and Elections, subsequent to an administrative land use decision by the Community Development Director. Prior to recording requirements found in FWRC IS. 120.060 shall be satisfied, please find the King County Recorder's recording requirements enclosed; ensure all drawings and location maps are legible. 16. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Kevin Peterson, 253-835-2734, kevin.peterson@cityoffederalway.com) Land Use Issues — Stormwater I . Surface water runo ff control and water quality treatment will be required per the 2016 King County Surface Water Design Manual (KCSWDM) and the City of Federal Way Addendum to the 2016 KCSWDM. This project meets the requirements for a Full Drainage Review. At the time of land use site plan submittal, a preliminary Technical Information Report (TIR), addressing the relevance of the project to the nine core and five special requirements of the KCSWDM will be required. A Level I downstream analysis shall also be provided in the preliminary TIR. The project lies within a Conservation flow control area, thus the applicant must design the flow control facility to meet this performance criteria. In addition to flow control facilities, Best Management Practices (BMP's) are required as outlined in the KCSWDM. The project also lies within Enhanced Basic Water Quality Area. Water Quality Treatment shall be designed to meet the treatment criteria of the Enhanced Basic Water Quality Menu. A downstream conveyance system nuisance problem has been identified downstream of this project. Previous analyses are available for the engineer's review. If the same conclusion is reached for this project, flow control requirements will be increased to Level 3. 3. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. 4. Detention and water quality facilities for private commercial developments outside the City Center Core must be above ground (i.e. open pond). Underground facilities are allowed only with approval from the City of Federal Way Public Works Department. 5. Show the proposed location and dimensions of the detention and water quality facilities on the preliminary plans. 6, If more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination System (NPDES) construction stormwater pen -nit may be required. Information regarding this permit can be obtained from the Washington State Department of Ecology at lrttp://www.ecy.wa gov/�ro gms/�lglstomiwater/construction/index.litm1 or by calling 360-407- 6048. Right -of -Way Improvements See the Traffic Division comments from Erik Preston, Senior Traffic Engineer, for traffic related items. 2. If dedication of additional right-of-way is required to install street frontage improvements, the dedication shall be conveyed to the City through a statutory warranty deed. The dedicated area must have clear title prior to recording. 3. All stormwater treatment and detention requirements outlined above may apply to any improvements within the public right-of-way. Engineering (EN) Permit Issues Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be reviewed and approved by the City. Engineering review fees are $1,125.00 for the first 12 hours of review, and $93.75 per hour for additional review time. A final TIR shall be prepared for the project and submitted with the engineering plans. Both the TIR and the plans will require the signature/seal of a professional engineer registered/licensed in the State of Washington. In addition to engineering approval, short plats and subdivisions are required to obtain a separate pen -nit for grading. Details and fees may be obtained from the Building Department. 16-1044 3 1 -00-PC Doc ID: 74687 Mr. May October 13, 2016 Page 6 of 9 The Federal Way Public Works Development Standards Manual (including standard detail drawings, standard notes, and engineering checklists) is available on the City's website at: www.cityoff-ederalwqv.com/node/1467 to assist the applicant's engineer in preparing the plans and T1R. 4. Bonding is required for all street improvements and temporary erosion and sediment control measures associated with the project. The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and held for a two-year maintenance period. The developer will be responsible for the maintenance of all storm drainage facilities (including the detention and water quality facilities) and street systems during the two-year maintenance period: During that time, the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. Upon satisfactory completion of the two-year maintenance period, the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the responsibility of the City. Maintenance for private roads and drainage facilities, including short plats, remain the responsibility of the individual property owners. When topographic survey information is shown on the plans, the vertical datum block shall include the phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.," on all sheets where vertical elevations are called out. 7. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. Site plans shall be drawn at a scale of I" = 20', or larger. Architectural scales are not pennitted on engineering plans. 8. Provide cut and fill quantities on the clearing and grading plan. 9. Temporary Erosion and Sediment -control (TESL) measures, per Appendix D of the 2009 KCSWDM, just be shown on the engineering plans. 10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. PUBLIC WORKS TRAFFIC DIVISION (Erik Preston, 253-835-2744, t ril:.I)reston�ia.citN offederalway.com) Transportation Concurrency Analysis (FWRC 19.90) 1. At this time, based on the submitted materials for one additional lot of unknown use, the proposed project is estimated to generate no new weekday PM peak hour trip. As such, a concurrency permit is not required until a specific development is proposed. 2. A concurrency pen -nit will be required when this becomes a development project. At that time the PW Traffic Division will perform concurrency analysis to determine if adequate roadway capacity exists during the weekday PM peak period to accommodate the proposed development. Please note that 16-10443 1 -00-PC Doc ID: 74687 Mr. May October 13, 2016 Page 7 of 9 supplemental transportation analysis and concurrency mitigation may be required if the proposed project creates an impact not anticipated in the six -year Transportation Improvement Plan (TIP). 3. The concurrency application fee must be paid in full at the time the concurrency permit application is submitted with land use application. The fee is based on the new weekday PM peak hour trips as identified in the concurrency trip generation. The applicant has the option of having an independent traffic engineer prepare the concurrency analysis consistent with City procedures; however, the fee remains the same. Transportation Impact Fees (TIF) (FWRC 19.91) Based on the submitted materials at this time for no additional square feet of commercial development, there is no traffic impact fee required. Please note, the actual impact fee will be calculated based on the fee schedule in effect at the time a building permit application is filed and must be paid prior to permit issuance. Street Frontage Improvements (FWRC 19.135) 1. The applicant/owner would be expected to construct street improvements consistent with the planned roadway cross -sections as shown in Map III-6 of the FWCP and Capital Improvement Program (CIP) shown as Table III-19 (FWRC 19.135.040). Based on the materials submitted, staff conducted a limited analysis to determine the required street improvements. The applicant would be expected to construct improvements on the following streets to the City's planned roadway cross -sections: 20th Avenue SW is a Minor Collector planned as a Type "S" street, consisting of a 36-foot street with curb and gutter, 4-foot planter with street trees and 5-foot sidewalks with streetlights in a 60-foot right-of-way (ROW). Assuming a symmetrical cross section, no ROW dedication is required, but half street improvements are required as measured from the street centerline. Streetlights may not be required depending on the design of adjacent streetlight improvements proposed on the east side of 20th Ave SW. 2. The applicant may make a written request to the Public Works Director to modify, defer, or waive the required street improvements (FWRC 19.135.070). Information about right-of-way modification requests is available through the Public Works Development Services Division. These modification requests have a nominal review fee currently at $160.00. Access Management (FWRC 19.135) Access management standards are based on roadway safety and capacity requirements. FWRC 19.135.280 provides access standards for streets based on planned roadway cross -sections. Please note that access classifications are per Drawing 3-1A in the Public Works Development Standards. CITY OF TACOMA WATER (Jesse Angel, Utility Service Specialist, 253-502-8280, �an2el ci.taeoma.wa.us} Tacoma Water has the following comments regarding the proposed 2-lot binding site plan: • The existing home is served by Tacoma Water. Their existing water service is located at the end of 27"' St. NE and then runs through private property to the proponent's lot. * The subject property parcel is located in the Lakehaven Utility District water service area. 16-10443 1 -00-PC Doc ID. 74687 Mr. May October 13, 2016 Page 8 of 9 • Any new water services must be coordinated with Lakehaven Utility District and Tacoma Water. • If the existing water service is no longer needed as part of this development then Tacoma Water crews will retire the water service on a T&M basis at the proponent's costs. LAKEHAVEN UTILITY DISTRICT (Brian Asbury, 253-946-5407, BAsbury(allakehaven.ort] Please find Lakehaven's comments below, regarding the proposed 2-lot binding site plan on parcel 252103-9027. Water • Lakehaven issued a Certificate of Water Availability for the proposed project/property on 8/26/16; Certificate is valid for one-year from date of issuance. • The site has an existing water service connection provided by the City of Tacoma, however the site is within Lakehaven's water service area boundary. For site redevelopment, this existing water service connection needs to be disconnected from/by City of Tacoma, and any new connection made to Lakehaven water main/system. Applicant can submit a request to allow the existing City of Tacoma water service connection to remain; such application will be reviewed by Lakehaven & City of Tacoma concurrently to determine if such a request could be approved. • A water service connection application submitted separately to Lakehaven is required for each new service connection to the water distribution system, in accordance with standards defined in Lakehaven's current `Fees and Charges Resolution'. Non -single-family properties require separate domestic (per building), irrigation (if irrigated landscaped areas are incorporated into the site development), and fire protection (if required or installed) water service connections & meters. • If the existing City of Tacoma water service connection is allowed to remain, private water easement will be required to be reserved on the recorded BSP across the new southern lot, for the benefit of the portion of the new northern lot's water supply line on the new southern lot. Sewer • Lakehaven issued a Certificate of Sewer Availability for the proposed project/property on 8/26/16; Certificate is valid for one-year from date of issuance. ■ The site does not have an existing sewer service connection. Lakehaven has approved sewer construction plans for adjacent property for new low-pressure sewer main in 20th Ave S that will directly benefit this subject property. That adjacent project must be accepted by Lakehaven, prior to any new sewer service connections to this proposed sewer main. Status of that adjacent project is: construction pending. • A separate Lakehaven sewer service connection pennit is required for each new connection to the sanitary sewer system, in accordance with standards defined in Lakehaven's current `Fees and Charges Resolution'. Minimum pipe slope for gravity sewer service pipe is 2%. Sewer service for this property will require installation of privately owned, E/One grinder pump for each lot. In addition to all other sewer service installation standards, installation of a Type 1, 48" monitoring manhole is typically required on the private building sewer line, for all new or modified non- residential connections.
