Dear Mr. Jensen:
The Department of Community and Economic Development has reviewed your request to reclassify a
drainage course adjacent to the subject property from a Major Stream to a Minor Stream and to remove
setback requirements from the course that is currently within a culvert. The department finds there is
insufficient evidence to reclassify the course to a Minor Stream and denies the request at this time.
The department does concur with the findings that stream setback requirements do not apply to the
culverted reach. The remainder of this letter summarizes the basis for the conclusion.
STREAM DEFINITION AND ANALYSIS
Federal Way Revised Code (FWRC) 19.05.190 defines a stream as "a course or route, formed by nature,
including those which have been modified by humans, and generally consisting of a channel with a bed,
banks or sides throughout substantially all its length, along which surface waters naturally and normally
flow in draining from higher to lower elevations. A stream need not contain water year-round. In a
development, streams may run in culverts or may be channeled in a concrete, rock or other artificial
conveyance system. This definition does not include irrigation ditches, stormwater facilities or other
artificial watercourses unless they are used by resident or anadromous salmonid fish, or the feature was
constructed to convey a natural stream which existed prior to construction of the watercourse.- Those
topographic features that resemble streams but have no defined channels shall be considered streams
when hydrologic and hydraulic analyses done pursuant to a development proposal predict formation of a
defined channel after development."
Analysis — Relief map layers generated by King County iMap services indicate a natural course with
elevations beginning at sea -level (north) and headwaters exceeding 200 feet (south). There are no
indications this course was artificially constructed for purposes of an irrigation ditch or stormwater
facility. Therefore, the channel is considered a Stream as defined by FWRC 19.05.190.
MAJOR STREAM DEFINITION AND ANALYSIS
FWRC 19.05.130 defines a major stream as "any stream, and the tributaries to any stream, which contains
or supports, or under normal circumstances contains or supports, resident or migratory fish. If there exists
a natural (emphasis added) permanent blockage on the stream course which precludes the upstream
movement of anadromous sahnonid fish, then that portion of the stream which is downstream of the
natural permanent blockage shall be regulated as a major stream."

Analysis — The reclassification request notes a permanent blockage within an overflow structure and grate
assembly precluding upstream movement of salmonids. These blockages are human -made fish
impediments and do not qualify as natural permanent blockages. Examples of natural permanent blockage
the city considers for stream classification are waterfalls, high gradient stream sections and subsurface
flow. The following thresholds developed by the Washington State Department of Fish and Wildlife are
used to determine whether the blockages qualify as barriers:

licensed surveyor reflecting one of the referenced thresholds, prior to any stream reclassification. If you

Dear Mr. Appleton:
On December 23, 2011, I met with Terry Jensen of Jensen Construction to review and provide my
opinion on the water course that is to the east of 201h Place SW, just east of the Shelley Residence
located at 29635 201h Place SW. The purpose of the visit was to provide information to Mr. Jensen in
classifying the water course as either a Major Stream or Minor Stream as defined in the Federal Way
Revised Code (FWRC). Based on the analysis detailed below, it is our opinion that the stream is a
Minor Stream and that the appropriate buffer for the open portion of the water course is 50 feet. The
portion of the water course that is within the culvert has no stream setback.
Article V of Section 15; FWRC
The first section of the water course we reviewed was the culvert or piped segment of the water
course. Section 15.10.170 of the Shoreline Management Program provides the buffers for major and
minor streams as 100 and 50 feet respectively. Section 15.10.170(2) also states that "the stream
setback areas established by this section do not apply to any segment of a stream that is presently
within a culvert, unless that stream will be taken out of the culvert as part of development of the
subject property." This is further supported and duplicated in Section 19.165.010 of the Zoning &
Development Code. The proposed construction on the Shelley residence does not propose to
daylight the portion of the water course that is within the culvert. Therefore, it is our opinion that
the portion of the water course from the overflow structure running north to Puget Sound that is
presently within the culvert does not have a required setback. This is depicted on the attached
aerial photo. The overflow structure and culvert are also depicted on the attached photos.
Major Stream vs. Minor Stream
The second portion of the water course we reviewed was the water channel south of the overflow
structure and culvert. This portion is also depicted on the photographs attached to this letter.
Section 15.05.030 of the Shoreline Management Program and Section 19.05.130 of the Zoning &
Development Code define a Major Stream as "any stream, and the tributaries to any stream, which

contains or supports, or under normal circumstances contains or supports, resident or migratory
fish. If there exists a natural permanent blockage on the stream course which precludes the
upstream movement of anadromous salmonid fish, then that portion of the stream which is
downstream of the natural permanent blockage shall be regulated as a major stream." All other
streams not meeting this definition would be classified as a "Minor Stream" [15.05.030 & 19.05.130
FWRC]. The second portion of the Major Stream definition would preclude this water course
from being a Major Stream. There exists a permanent blockage within the overflow structure
and grate that would preclude the upstream movement of anadromous salmonid fish. From this
structure going upstream (south) the water course is determined to be a Minor Stream. The
downstream portion does not require a setback as previously indicated. The first portion of the
Major Stream definition is also relevant to the water course. During our site visit, there was
insufficient water flow in the stream to support resident or migratory fish. Late December would
be the ideal time of year to provide "normal circumstance" yet in the time of the year that provides
the most precipitation, there was insufficient water to support fish. Mr. Jensen also noted that this
water course dries up during portions of the year.
Based on our site visit and the Federal Way Revised Code, it is our opinion that the portion of the
stream that is downstream of the overflow structure is within a culvert and has no required
setback. The portion of the stream that is upstream of the overflow structure has limited
movement due to the blockage to support migratory or resident fish and therefore is classified as
a Minor Stream with a 50 foot setback. These finding are graphically depicted on the attached
aerial photo and the site conditions are documents in the attached site photos. If you have any

Because the King County, old DNR and new DNR systems consider both resident and anadromous salmonid populations, such
