Good Afternoon Julie - That is unfortunate to hear as we have been upfront and have provided our scope items in a
timely manner, in our opinion, and have gone above and beyond our contracted scope of work in providing guidance to
what is needed in addition to the geotechnical and stormwater memorandum to obtain the critical areas permit. The
last item required from Landau Associates for the permit submittal is a review letter stating that the permit submittal
package incorporates our geotechnical recommendations.
Unfortunately to complete that last task we need the submittal package from the rest of the design team — not just the
plans from Erik Ainsworth but the plans from the home designer as well and a stamped copy of the survey. After
submitting the Geotechnical report, I emailed you a list of "next steps" that you requested on March 291h 2016. In that
email I requested this same information.
It would be prudent to remind Pamela Sommerville that we are very close (based on recent emails from Erik and others),
and if she chooses to go with a new team it will further delay the process — probably by several more months as she
would essentially be starting over with a new permit application. Additionally the new geotechnical report would have
to go through a third party review which will add even more time and additional costs.
I talked with the City yesterday and was informed that Landau Associates is the reason the permit application is still
open due to us copying the city on all correspondence and that there has been very little communication regarding the
permit with Prime NW or Mrs. Sommerville.
Please let me know the status of the work as you receive it.

Our client, Pamela Sommerville, has stated that she wants another company to come in and take over the
permitting process. We have emailed her to advise her against this but have not heard back. Our hands are
pretty much tied until she makes a decision and tells us that we can move forward.
I believe you need the site plan as well as specifications on the drain repair. Erik Ainsworth is in charge of both
of these things. I will ask him to email you with an update.

Please note rip rap is difficult to permit as it is hard armoring, it is on the applicant to address and meet the following
criteria, this includes geotechnical reporting on this aspect of the project:
15.05.050 Shoreline modifications. U SHRRE
(1) Shoreline stabilization. Shoreline stabilization may be permitted in the shoreline residential environment. Hard armoring
(e.g., bulkheads and riprap) is subject to a shoreline conditional use permit in the urban conservancy environment. Soft -shore
stabilization may be permitted in the urban conservancy environment. Shoreline stabilization proposals shall address the
following:
(a) Shoreline stabilization, including bulkheads. shall not be considered an outright permitted use on the cit 's
shorelines. In order for shoreline stabilization to be permitted the city must find that:
(i) The applicant shall provide a geotechnical report, prepared by a qualified professional, that estimates the rate of
erosion and evaluates alternative solutions; and the urgency associated with the specific situation; and
(ii) Soft -shore stabilization alternatives such as slope drainage systems, vegetative growth stabilization, gravel
berms, and beach nourishment shall be prioritized over structural options such as bulkheads and riprap. The
"softest" effective alternative shall be utilized; and
(iii) In the case of proposed hard armoring stabilization solutions (e.g., bulkheads and riprap), erosion from waves
or currents presents a clear and imminent (damage within three years) threat to a legally established primary
structure, one or more substantial accessory structures, water -dependent development, ecological restoration/toxic
clean-up remediation projects, or public improvements; and
(iv) In the case of bulkheads and riprap, the proposed shoreline stabilization is located landward of the ordinary
high water mark; and
(v) The proposed shoreline stabilization is the minimum size necessary to protect existing improvements; and
(vi) The applicant shall demonstrate that impacts to sediment transport are minimized to the greatest extent
possible; and
(vii) Shoreline stabilization shall not have an adverse impact on the property of others and shall be designed so as
not to create the need for shoreline stabilization elsewhere; and
(viii) Shoreline stabilization shall not significantly interfere with normal surface and/or subsurface drainage into the
water body and shall be constructed using an approved filter cloth or other suitable means to allow passage of
surface and groundwater without internal erosion of fine material; and
(ix) Shoreline stabilization shall not be used to create new lands; and
(x) Use of chemically treated wood is prohibited for any shoreline stabilization proposal within fresh water lake
shorelines; and
(xi) Use of creosote treated wood is prohibited within marine shorelines; and
(xii) Revegetation with native plants is required as part of the shoreline stabilization project; and
(xiii) Shoreline stabilization shall not otherwise result in a net loss of ecological functions.
(b) When a bulkhead or other structural alternative is permitted subject to subsection (1)(a) of this section, the following
standards shall apply:
(i) The maximum height of the proposed bulkhead or other stabilization structure is no more than one foot above
the elevation of mean higher high water on tidal waters, or one foot in height above the elevation of ordinary high
water mark on lakes, measured from grade on the waterward side of the bulkhead or structure; and
(ii) When a bulkhead or other stabilization structure has deteriorated such that the ordinary high water mark has
been established by the presence and action of water landward of the existing bulkhead, then the replacement
bulkhead or structure must be located at or landward of the ordinary high water mark.
(iii) Repair of an existing bulkhead or other stabilization structure is permitted provided that the repaired bulkhead
or structure is not relocated further waterward or increased in height.
(iv) If an existing bulkhead or other stabilization structure is destroyed it may be replaced as it existed prior to
destruction, provided application for required permits is made within one year of destruction. Additions to or
increases in size of existing shoreline stabilization measures shall be considered new structures.
(v) Soft -shoreline stabilization measures that provide restoration of shoreline ecological functions may be permitted
waterward of the ordinary high water mark.
(vi) The project satisfies the provisions of FWRC 15.05:040(5)(b).

(elevation and site plant) into the sound (total coverage, height and materials, and ordinary high water mark). If you
have not retained professional land/shoreline consulting help you may need to do so in order for the applicant to
comply with Title 15- Shoreline Management, as the City is the review agency we unfort. cannot provide design advice.

Hello Leila,
If they plan to place any structure along or waterward of the bulkhead they will need an
HPA. Additionally, Im not sure the gabion baskets will be permitable without further review. If they
place a structure (such as gabion baskets) on the shoreline they typically need to mitigate by
removing a similar footprint of something like debris (old tires, broken concrete sections, bricks,
non-native angular rocks, etc.).

Julie,
If you intend to repair the existing pipe, you may want to confirm with the City they will consider that
an acceptable approach for managing site drainage before you invest the money in the repair. Landau
Associates' assessment of the pipe didn't include enough detail for me to know what the scope of the
repair would need to be. Our investigation was limited to the top portion of the pipe (about 32 linear
ft). We did not observe the downslope portion of pipe or the toe of slope outfall (if it exists). It seems
reasonable that if repair is possible, this pipe could manage the necessary flow (as we concluded in
the drainage memo). However, it is possible that the existing outfall may not meet all of the County's
erosion protection requirements (velocity dissipation, above -grade tight lining, etc). The City would
have to determine if the outfall could be grandfathered in, or if they would require you to reconstruct
it in accordance with current requirements.

A Certificate of Water Availability shall be provided at the time of application indicating the fire flow
available at the site. A hydraulic fire flow model shall be requested from the water district.
Fire apparatus access roadways shall be required for every building when any portion of an exterior
wall of the first story is located more than 150 ft. from fire apparatus vehicle access.
Fire apparatus access roads:
1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical
clearance of not less than 13 feet 6 inches.
2) Shall be designed and maintained to support the imposed load of a 75,000 pound fire
apparatus and shall be provided with a surface so as to provide all-weather driving
capabilities.
3) Shall be not less than a 32 foot inside turning radius and not less than a 40 foot outside
turning radius.
4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac at
the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter.
EXCEPTION: A modified turnaround can be approved when the building is
protected with an approved automatic fire sprinkler system.
5) Gradient shall not exceed 15 percent.
EXCEPTION: When buildings are protected with an approved automatic fire sprinkler
system the travel distance can be increased 20 percent.
Access road gates shall comply with South King Fire and Rescue Administrative Policy Guideline
No. 10.001.
An NFPA 13D automatic fire sprinkler system is required for this residence.
Automatic fire sprinkler systems shall be installed in Group R, Division 3 occupancies:
