The language below is excerpted from pages 2 and 3 of the model ordinance. In talking to Graham Anderson at the Port of Everett, it is unclear how this process will unfold. Under current procedures, the National Marine Fisheries Service (NMFS) would act as a reviewing agency under Section 7 and Section 10 of the Endangered Species Act (ESA) for the Army Corps of Engineers, and are isolated from direct contact with applicants. The process described below suggests that NMFS will have direct contact with applicants, and issue approvals to them directly. If you don't adopt Option # 1 or #2, I would assume NMFS jurisdiction would be limited to the exiting Special Flood Hazard Area, not including the Channel Migration Zone and expanded Riparian Habitat Zone that they have included in their newly defined term "Regulatory Floodplain". The Biological Opinion A background on how floodplain development can affect habitat is included in Appendix H. On September 22, 2008, the National Marine Fisheries Service (NMFS) issued a Biological Opinion that recommended changes to the implementation of the National Flood Insurance Program in order to meet the requirements of the Endangered Species Act (ESA) in the Puget Sound watershed. Excerpts from the Opinion are in Appendix E and a checklist for communities is in Appendix G. "Sic utere tuo ut alienum non laedas" "So use your own property that you do not injure another's property." Courts have followed this maxim, which characterizes overall landowner rights and duties'pursuant to common law nuisance, trespass, strict liability, negligence, riparian rights, surface water law rights and duties, and statutory liability. At common law, no landowner (public or private) has a right to use his or her land in a manner that substantially increases flood or erosion damages on adjacent lands except in a dwindling number of jurisdictions applying the "common enemy" doctrine to diffused surface or flood waters. From No Adverse Impact and The Courts: Protecting the Property Rights of All Model Washington NFIP-ESA Ordinance — 3 — January 2010 The Biological Opinion offers two ways to meet the ESA requirement: 1. Prohibit all development in the floodway and other areas. 2. Enact regulations that allow development that meet the criteria specified in the Biological Opinion by either: a. Adopting this Model Ordinance, or b. Enforcing the same requirements in other ordinances, such as the growth management, zoning, or critical areas regulations. If a community chooses not to enact regulations under the two options described above, then a third option of showing compliance with ESA on a permit by permit basis will be required. This will typically involve requiring applicants for floodplain development permits to develop in the Special Flood Hazard Area to submit permit applications to the National Marine Fisheries Service. (Emphasis added) Option 2 is generally preferred by most communities. Option 2.b. may be an easier route for those cities and counties that have critical area and shoreline management regulations. For those communities, the checklist in Appendix G can be used to identify if they need to amend their existing regulations to meet the Biological Opinion's criteria. If the checklist shows that additional regulations need to be adopted, language from the noted section in the Model Ordinance can be used. It should be noted that the NFIP regulations (44 CFR 60.3(a)(2)) require participating communities "to assure that all necessary permits have been received from those governmental agencies from which approval is required by Federal or State law." Under options 2.a. and b, NFIP communities must ensure that permit applicants meet the criteria established in the Biological Opinion. If option 3 is chosen, NFIP communities must ensure that permit applicants have consulted with N.MFS and received approval before issuing a flood lads iii development permit.. Importance: High ALL: I am writing this e-mail on behalf of my City of Everett folks, but with a suspicion that the concerns Everett is expressing will be shared by a number of my other cities. Additionally, from a lengthy conversation I had Wednesday with Gerry Ervine of Everett's planning department, I understand Gerry has spoken to — and picked up similar concerns from — Bellingham, the Port of Everett, and the WA Public Ports Assn., among others. The issues involves a Draft Model Ordinance that FEMA has put out with respect to flood plains and flood -plain development (Kent and Renton folks on this e-mail — my understanding is that this is SEPARATE from, and in addition to, their mapping process). Draft comments are due back by Monday, April 5, so we are unlikely to be able to affect that part of the Model Ordinance process much. However, what Gerry Ervine tells me is that the model is hundreds of pages of long, and with the exception of the very biggest cities -counties -ports, jurisdictions have very little in the way of staff resources or ability to cover all of this page by page. Gerry has been part of a group that has met with FEMA and there have been focus groups as well. Gerry has a whole series of concerns, detailed both below and in the PowerPoint I've attached which he is presenting at an upcoming Law Seminars International conference on land -use issues. The concerns include: • Significant conflicts between this Model Ordinance and the tenets of the Growth Management Act; • A failure to recognize the urban development, working waterfront and water -dependent uses that are part and parcel of urban communities along the waterfront • An attempt to re -define flood plains back to "pre -development conditions" — as Gerry notes in his PPT • A failure to recognize fish -friendly efforts and processes already put into place by jurisdictions • Significant limitations on public access improvements that would be allowed w/in the flood plain area — in Everett, which had a major update of its Shoreline Plan and heard a loud hue and cry from residents about increased public access, this is a major concern Buffer definitions that don't make sense for some areas, and overall limitations on development area In short, I think that Everett, and other cities I work for, care a lot about stewardship and resource protection and habitat protection. But all these factors need to be balanced with allowing for water -dependent uses, public access, and responsible development in urban areas that have to juggle resource protection goals with those of the GMA. I am reaching out to this group — cities counties Ports • AWC WSAC and WPPA — because I wonder if we might have some common themes oafs and obiectives and have some interest in Joining forces. For one thing, perhaps there is a way to combine forces for legal assistance in going through the entire FEMA Model Ordinance in careful detail, and summarizing a series of concerns that a whole body, of us could take to FEMA in terms of perhaps reining in the Model. I am hoping those on this e-mail can look over this information — the PPT, the Model Ordinance links and info below, etc. — and consult with their technical folks, and let me know whether there is interest in some kind of combined effort.... I have major concerns about the definition of "development" on page 13 and the definition of "protected area" on page 16 of the model ordinance. The buffers in Section 3.4 do not make sense. I also have problems with requiring hydrologic and hydraulic studies for floodplains such as Everett's, where a floodway (required to carry flood volume) and flood fringe (can be filled without causing a one foot rise in flood elevation) are already established. Section 5.2 requires all new structures to be located outside the Regulatory Floodplain if a lot has buildable area beyond the floodplain. This does not work for water-dependent/water related uses located on the shoreline. In that same section the low impact storm drainage requirement may not be practical or feasible. Section 7.6 requires compensatory storage of flood waters. This issue has already been addressed by FEMA in establishing a floodway in Everett, is redundant. Appendix F, sections 4 and 5 spell out the limitations on development in response to the Biological Opinion. gal) c@ci.yelm.wa.us; Gates, Tim (COM); Dolores; Warren Perkins Subject: FEMA Region X Open Comment Period for Draft Biological Opinion Model Ordinance and Regional Guidance Documents In September of 2008, The National Marine Fisheries Service issued a Biological Opinion that determined that implementing the National Flood Insurance Program (NFIP) causes jeopardy to several species of Puget Sound Salmon and Orca Whales as well as adverse modification to their habitat. In the Biological Opinion NMFS provided a Reasonable and Prudent Alternative to modify the implementation of the NFIP in a manner that would remove the jeopardy situation. FEMA has been working diligently to produce and execute an implementation plan that was outlined in a letter from FEMA Headquarters to the NMFS in April 2009. FEMA has produced the model ordinance and other accompanying documents in accordance with the implementation plan. The model ordinance and associated documents were developed with the assistance of a focus group representative of Puget Sound communities, including a tribal community, NMFS, and the Washington Department of Ecology. The intent of the focus group is to insure that the model ordinance and other documents are useful to those that will be using the documents. All of the documents are available to be downloaded at: httpalwww.ferna.pov/regionx/nfipesa.shtm. The model ordinance incorporates a simple and direct set of rules to protect human development from floods while minimizing the impact of new construction and redevelopment on aquatic and riparian habitat. The ordinance is one of several options available to local communities to demonstrate ESA compliance, and can be adopted whole cloth, or in segments to complement existing regulations. Accompanying the model ordinance are regional guidance documents that provide communities further guidance on complying with the Biological Opinion. The Re ionol Guidance for Habitat Assessment and Miti ation is designed to assist qualified habitat professionals, representing both permit applicants and permit officials, in ensuring that new development will not adversely impact protected threatened and endangered species or their habitat in flood prone areas. The Re Tonal Guidance for N droia is and Hydraulic Studies is provided to assist local officials and developers to determine the most appropriate ways to prepare flood hazard data that meet the requirements of the NFIP and the ESA. The CRS Credit for Habitat Protection_ guidebook provides local officials an overview of activities that a community can receive credit for under the CRS program that encourage good aquatic and riparian habitat management as well as good floodplain management. The improvement is within 200 feet of the ordinary high water mark of Puget Sound. The above -referenced property has been designated `Rural' by the City's Shoreline Master Program (SMP).1 PROPOSAL The applicant proposes to construct a detached 964 square -foot cabana 53 feet landward from the ordinary high water mark. The construction proposal includes connecting to the existing on -site septic system. The site is developed with a single-family residence, a detached garage, and other accessory structures. The proposed height of the structure does not exceed 30 feet above average building elevation; grading for the septic upgrades will not exceed 250 cubic yards and will not involve the placement of fill waterward of the ordinary high water mark. SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT EXEMPTION Washington Administrative Code (WAC) 173-27-040 identifies actions exempt from the requirements to obtain a shoreline substantial development permit. WAC 173-27-040(2)(g) exempts, under specific circumstances, the construction on shorelands by an owner of a single-family residence and normal appurtenances. Following review of submitted site plans, staff has concluded the proposed improvement meets the terms of the referenced exemption and is consistent with the policies of the SNIP and the State's Shoreline Management Act; therefore, a shoreline substantial development permit is not required. STATE ENVIRONMENTAL POLICY ACT (SEPA) EXEMPTION WAC 197-11-800(1) specifically exempts the construction of any residential structures up to four dwelling units. The city has determined the proposal is exempt from SEPA review. CONDITIONS OF APPROVAL 1. The ordinary high water mark must be staked prior to footings and setback inspection. 2. All construction work, stockpiling of construction materials, and vehicle access must be landward of the staked ordinary high water mark. 3. Construction debris shall not be disposed of on the beach. 1 Please note that a new SNIP was adopted in early 2012; however, this permit is vested to the older regulations.
