Dear Mr. Evangelisti:
This letter is written in response to your letter of February 19, 2016, requesting approval to do exploratory
work on the above -mentioned 1.05-acre parcel for the purpose of preparing a geotechnical engineering
report in order to construct a new home replacing a structure damaged by fire. A letter and accompanying
materials request the Director's written approval to drill one geotechnical boring approximately 50 feet in
depth in the middle of the existing house footprint. The proposed bore hole, B-1, will be located within
geologically hazardous areas and include the erosion and landslide hazard areas.
Pursuant to Federal Way Revised Code (FWRC) 19.145.120(2), the subsurface exploratory work is
conditionally approved. You are hereby authorized to complete the exploration work identified in your
application, subject to the following conditions per the Planning and Development Services Divisions:
1. At a minimum, the following erosion control measures shall be implemented before, during, and
after construction: minimal soil disturbance and brush clearing (not grading) to access the test
site(s); wattles and/or silt fence installed around the test site(s) prior to excavation; backfill of test
locations per Washington State Department of Ecology (DOE) specifications; and a minimum of
three inches of straw spread over the disturbed areas.
2. Disturbance of the geologically hazardous area shall be minimized and the test pit restored
immediately to the previous condition after completion of the boring.
This letter does not approve any other land surface modification within the geologically hazardous area
for additional exploratory work or septic design. Also, note the improvements shown on the submitted
test pit plans are not approved under this decision. Please do not hesitate to contact Leila W.-Oakes at

path to extinguish a home fire in February 2014, it did significant damage to the roadway in a single
trip. One can only imagine the damage resulting from commercial vehicles heavily laden with building
materials.

SW. Trenching into a steep (60%+ grade), inherently unstable, moisture laden hillside is obviously
fraught with risks (Oso comes to mind).
Third, the court, in Jones vs. Heisell clearly stated that the easement at the northern end of 23rd Ave
shall never for any reason be intentionally blocked. It is quite obvious that the installation of 350+ feet
of sewer line in the easement would cause prolonged blockage, and thus deny me access to my
property (tax parcel 012103-9090-03).

I'll bring over the marked up copy of the report I grabbed out of the SF review stack. I flagged a number of pages with
discrepancies that should be resolved by the applicant.
From what I see, both in the inconsistencies between the plans and Geo report, and also in the writing of the report, I
am fairly sure that Geo Resources did not review the house plans, foundations, etc.. I would recommend that something
be required from them that they are ok with the plans. The plans do not incorporate a number of concerns they
outlined, related to both the foundations, erosion and drainage.
Regarding the drainage, we need to determine if it is permissible to discharge via a tightline pipe to the Puget Sound as
they are proposing per our standards. Given that is outstanding, the storm design may have to change anyway. Geo
Resources recommended that they connect to the tightline in the street, not what is proposed on the plans. I don't see
enough elevations on the plan to know if that option is feasible. In the event that they are permitted to go to the Sound,
this would involve construction of a drainage outfall pipe, anchors and outfall structure within the GHA and shoreline
management area. I am fairly sure that this would be a new disturbance to that area. I don't know what on your end, if
anything, needs to happen to permit that, if you are in agreement that it is even permissible.
From what I see between the report and the images on the King County GIS info, the existing structure that burned
down was a 1 story structure on a combination of stilts and a foundation. Basically it appears it was originally
constructed as a small summer home along the water. From the pictures, it appears that it was a fairly light structure
and probably contained minimal HVAC, piping, etc. that all add weight to the structure. What they are proposing is
essentially a 3 story house within the same +/- footprint using modern construction techniques with all the equipment
required to meet building codes. AKA, a substantial increase in structural loading above the top of slope.
Geo Resources simplified logic is that the former house was there for a long time and that they are staying in the same
footprint therefore it should be ok. They did do several test pits to 6-7 feet to classify soils and said that further
supported their logic. They also said the completed a simplified slide analysis and it is acceptable. The report includes no
laboratory data, no slide analysis input or output to support their conclusion and the test pits are shallow relative to the
depth of the proposed basement and adjacent slope to the OHWM.
Given the increase in load alone adjacent to the top of slope I would 'recommend this be sent to one of the third party
Geo companies for their review. While Geo Resources may be completely correct, all their assumptions and
recommendations, based on the limited information they submitted and the large'increase in loading that doesn't really
appear anywhere in their report, I think this one should probably'get sent out.

Dear Ms. Martin (Sommerville):
Please find the enclosed consultant task authorization and scope of work for review of the `Sommerville
Rebuild' geotechnical engineering report, prepared by GeoResources on September 20, 2014, there are
forthcoming study revisions as requested by the City to be completed by applicant. The city requires a third
party review of the report in order to proceed with building permit review. The department's on -call
consultant, Landau Associates, Inc. was requested to provide an estimate to review plans and the submitted
report. Landau's fee determination summary is enclosed.
When authorized by the applicant, the City will set up an account funded by the applicant and drawn down
by the work performed by Landau Associates, Inc. If any funds are not used, they will be returned to the
applicant. A check in the amount of $1, 500.00 made payable to the City of Federal Way and a signature on
the consultant's authorization form (original) must be submitted before the peer review will begin.
In November 2015 the Public Works Department (Drainage and Development Engineering Review) and
Planning Division will provide technical review comments on the site plan and geotechnical report submitted,
other division comments are forthcoming (i.e. Building). All submitted items shall be revised to reflect the
technical comments of the city. If the third party reviewer requires revisions to the proposal's design, the City
comments may be subject to change. Please note the owner's applicant or agent shall coordinate all
consultants involved throughout project and/or study resubmittals.

If they plan to place any structure along or waterward of the bulkhead they will need an HPA. Additionally, Im
not sure the gabion baskets will be permitable without further review. If they place a structure (such as gabion
baskets) on the shoreline they typically need to mitigate by removing a similar footprint of something like
debris (old tires, broken concrete sections, bricks, non-native angular rocks, etc.).

Landau Associates (LAI) is pleased to present this additional scope of services and cost estimate
for drainage design services for the Sommerville Residence (Fire Rebuild) project in Lacey, Washington.
This scope and cost estimate are presented as an amendment to our Proposal for Geotechnical
Engineering Services submitted on December 8, 2015. The additional scope presented in this letter is
based on discussions with and information provided by you, and telephone conversations with the City of
Federal Way (City). Presented below is a summary of our project understanding, and a description of our
proposed scope of services.
PROJECT UNDERSTANDING
We understand that Prime NW Construction has proposed to build a new residential structure to
replace the previous residence that was damaged in a fire. The project is located in Federal Way,
Washington. The new residence will consist of a basement and two stories with an attached garage. Total
livable space of the new residence will be approximately 6,800 square feet occupying approximately
2,050 square feet in plan area. Previously identified steep slope, erosion, and landslide hazard areas
occupy the site to the north and south of the proposed residence. LAI is currently under contract with
Prime NW Construction to provide geotechnical engineering services for this project, including a
geotechnical evaluation and report.
Based on feedback from the City on the previous site drainage design submitted by
GeoResources LLC, the proposed site drainage controls require additional engineering review and
revisions in order for the City to issue a construction approval.

SCOPE OF SERVICES
The following sections define Landau Associates' proposed tasks for drainage design services to
support design and construction of the project. Task 1 consists of the current authorized scope for
geotechnical services.
Task 2 - Review of Existing and Proposed Drainage: LAI will compile and review readily
available site drainage information, including regional topography, City GIS data (including below grade
pipe sizes and alignments, and catch basin locations), and construction site plans that include current and
proposed impervious areas. This informational review will also include a review of regulatory drainage
criteria from the King County Drainage Manual, including the applicable modeling criteria and design
storm for sizing the site conveyance structures.
Following the initial informational review, we will perform an onsite assessment of the current
drainage system, which will include a video survey of the existing below grade pipe that outfalls into
Puget Sound. It is anticipated that this pipe is at least 8 inches in diameter and approximately 350 linear
feet. This survey will be used to confirm the diameter, material, and condition of the current drainage
system.
LAI will also develop a hydrological model of current and post -construction site runoff to
confirm whether the existing outfall pipe has sufficient capacity to convey the additional flow from the
new impervious areas. It is anticipated that we will use either the rational method or the Western
Washington Hydrological Model to predict peak flows.
Following the modeling and video pipe survey, LAI will prepare a brief technical memorandum.
This technical memorandum will define the modeling assumptions, as well as include the detailed
modeling results and associated calculations. Additionally, the technical memorandum will include the
results of the video pipe survey which will include information on damage to the existing line, existing
connections, and existing pipe size. In conclusion, the technical memorandum will address suitability of
the existing drainage pipe to accept the flow from the proposed construction.
Assumptions:
• One stormwater outfall to the Puget Sound already exists, and adding new discharge to this
outfall will require no new permits or authorizations beyond City drainage review.
• Onsite access will be granted by the owner.
■ Prime NW Construction or the owner will provide proposed impervious area and plans
showing roof downspouts.
■ Prime NW Construction or Owner will provide 1-foot contour survey data.
• Prime NW Construction or Owner will provide any as -built or design information on the
currently permitted pipe and outfall.

Deliverables:
• One electronic (PDF) copy of the above -referenced technical memorandum.
Optional Task 3 Drainage Plan Set: If, based on the results of Task 2, the onsite drainage is
insufficiently sized to accept the predicted post construction storm flows, LAI will prepare a drainage
design to manage site flows. In this effort, LAI will review the previously prepared drainage designs, as
well as the geotechnical report recommendations prepared under Task 1 and the King County Drainage
Manual criteria. Following the review, LAI will prepare a draft plan set for permitting level review by the
City. It is anticipated that this plan set will include the following:
• Cover sheet
• Plan view sheet
• Detail sheet
■ Temporary and erosion control measure sheet
• Construction notes sheet.
This plan set will be created in accordance with Federal Way Municipal Code, King County
Code, and outfall requirements established by the United States Army Corps of Engineers. The draft plan
set will be submitted by Prime NW Construction or the Owner for permitting review by the City. LAI will
review the City review comments and incorporate the agreed upon changes into a final construction level
plan set. It is anticipated that these changes will be minor edits that do not require additional sheets.
Assumptions:
■ No construction specifications will be provided.
• Prime NW Construction or the Owner will be responsible for submitting plan sets for permit
review, and paying all associated permitting fees.
Deliverables:
■ One permitting level draft drainage plan set
• One construction level final drainage plan set.
COST ESTIMATE
We estimate the additional cost for our proposed scope of services for Tasks 2 will not exceed
$12,500. We have included the costs for an Optional Task 3 that will not exceed $16,800. The previously
authorized Task 1 will not exceed $17,446. The breakdown of the budget is as follows:

We propose to provide the above -described services on a time -and -expenses basis according to
the budget set forth above and the attached fee determination summary sheets. In the event the project
requirements change, or unexpected conditions are disclosed that appear to require further field effort,
study, or analysis, we will bring these to your attention and seek your written approval for an addendum
to the scope of services and costs prior to performing additional services.
PROJECT ASSUMPTIONS
We have assumed the following as the basis for preparation of our scope of services and
estimated cost:
■ Prime NW Construction will provide Landau Associates the current project civil and
architectural plans in AutoCAD (if available) or PDF format.
■ Consultation and support for stormwater discharge permitting is not included.
■ The City of Federal Way will be copied on all written correspondence, including emails,
between Landau Associates and Prime NW Construction.
SCHEDULE
It is anticipated that Task 2 can be completed within three weeks of notice to proceed. If Task 3 is
required and authorized, it is anticipated that the permitting level draft designs will be completed within 3
to 4 weeks. Following permitting review by the City, the agreed upon changes will be implemented and
final construction drawings will be issued within 2 weeks.

one signed original of this proposal amendment.

Expert professional testimony in court, deposition, declaration, arbitration, or public testimony is charged at
1.5 times the hourly rate.
Rates apply to all labor, including overtime.
Equipment
Field, laboratory, and office equipment used in the direct performance of authorized work is charged at unit rates.
A rate schedule will be provided on request.
Subcontractor Services and Other Expenses
Subcontractor billing and other project expenses incurred in the direct performance of authorized routine services
will normally be charged at a rate of cost plus a twelve percent (12%) handling charge. A higher handling charge for
technical subconsultants and for high -risk field operations may be negotiated on an individual project basis;
similarly, a lower handling charge may be negotiated on projects requiring disproportionally high subconsultant
involvement.
Invoices
Invoices for Landau Associates' services will be issued monthly. Interest of 1% percent per month (but not
exceeding the maximum rate allowable by law) will be payable on any amounts not paid within 30 days.
Term
Unless otherwise agreed, Landau Associates reserves the right to make reasonable adjustments to our compensation
rates overtime (e.g., long-term continuing projects).

GENERAL CONDITIONS [A ASSOCIATES
SERVICES TO BE PROVIDED — Landau Associates agrees to provide Client, for Client's sole benefit and exclusive use, the consulting services
identified in Landau Associates' proposal. This Agreement gives no rights or benefits to anyone other than Client and Landau Associates.
CLIENT FURNISHED INFORMATION — Client shall provide to Landau Associates information regarding the property location, property limits, the
location of any buried utilities or structures, and any requirements for entry or work permits, security clearances, licenses or any other required
permissions. Landau Associates shall not be liable for damage or injury arising from damage to subterranean structures (pipes, tanks, pipelines,
etc.) that are not identified by Client. If the property is not owned by Client, Client shall obtain right -of -entry for the purpose of our services.
OWNERSHIP OF DOCUMENTS — Unless otherwise agreed, all logs, notes, calculations, reports and other documents prepared by Landau Associates
are the property of Landau Associates. Client is responsible for appropriate use of the information and recommendations contained in Landau
Associates' reports and other written correspondence. Any and all such information and recommendations are provided for and are relevant to
specific projects, as identified; any reuse of such information for extensions of a project, or disregard for or deviation from Landau Associates'
recommendations or for any other project shall be at Client's sole risk and without liability or legal exposure to Landau Associates.
STANDARD OF CARE AND LIMITATION OF LIABILITY — Landau Associates' services will be performed with the degree of skill and diligence normally
employed by engineering professionals performing similar services in the Northwest at the time services are performed. No other warranty or
representation, either express or implied, is included or intended in our proposals, contracts, reports, and communications.
To the fullest extent permitted by law, Client expressly agrees to limit any and all claims of Client, including but not limited to claims alleging
negligence, breach of contract, or breach of warranty against Landau Associates and/or its employees, for all losses of any kind, including economic
loss, to an amount not to exceed the total fee paid under this Agreement or $50,000, whichever is greater. If Client desires a higher limit, Landau
Associates may agree to an increased limitation for additional consideration. In the event Client makes a claim against Landau Associates, at law or
otherwise, for alleged negligence, error, omission, breach, or other act arising out of the performance of professional services, and Client fails to
prove such claim, Client shall pay all costs incurred by Landau Associates in defending itself against the claim.
CLIENT INDEMNIFICATION —Client acknowledges that Landau Associates is not responsible for the creation or presence of contamination or
pollution, if any, at the property. Client agrees to indemnify, defend, and hold harmless Landau Associates and any of its officers and employees
from and against any claim, suit, action, or liability due to or related to contamination conditions at the property except to the extent such claim,
suit, action, or liability is caused by the negligence of Landau Associates. For the purposes of this clause, contamination conditions shall mean the
actual or alleged existence, discharge, release, or escape of any irritant, pollutant, contaminant, or hazardous substance into or upon the
atmosphere, land, groundwater, surface water, or sediment of or near the property. Landau Associates will promptly notify Client of contamination
conditions, if identified.
SITE SUPERVISION — Landau Associates has no overall supervisory authority or actual and/or direct responsibility for the specific working
conditions at the site and/or for any hazards resulting from the actions of any trade contractor. Unless expressly provided in the scope of services,
Landau Associates has no duty to inspect, supervise, note, correct, or report any health or safety deficiencies of Client, contractors, or other
entities or persons at the project site not employed or subcontracted by Landau Associates.
PAYMENT— Invoices for Landau Associates' services will be issued monthly, payable upon receipt. Interest of 1'% percent per month (but not
exceeding the maximum rate allowable by law) will be payable on any amounts not paid within 30 days, payment thereafter to be applied first to
accrued interest and then to the principal unpaid amount. Any attorney's fees or other costs incurred by Landau Associates in collecting any
delinquent amount shall be paid by Client.
SAMPLE RETENTION — Unless other arrangements are made, uncontaminated samples will be discarded in accordance with applicable regulations
30 days after testing is complete. Contaminated or hazardous materials samples not destroyed by testing remain the property of Client and will be
returned to Client or project site for disposition as directed by Client.
SUSPENSION OR TERMINATION — If Client requests suspension or termination of our services prior to completion, Landau Associates reserves the
right to complete such analyses and records as are necessary to place the files in order, and, when necessary to protect our professional
reputation, to complete a report on the services provided to date. Client shall compensate Landau Associates for personnel time and all reasonable
expenses at current rates required to accomplish such closing.
TIME BAR TO LEGAL ACTION —The parties agree that all legal actions by either party against the other concerning the services provided under this
Agreement shall be barred two (2) years after the completion of services by Landau Associates.
SEVERABILITY AND SURVIVAL — In the event that any provision of this Agreement shall be held invalid and unenforceable by a decision of a court
of competent jurisdiction, the remaining provisions shall be valid and binding. All terms of this Agreement allocating or limiting liability shall survive
the completion of the services hereunder and the termination of this Agreement.
PRECEDENCE —These general conditions shall take precedence over any inconsistent or contradictory provisions contained in any proposal,
contract, purchase order, notice to proceed, or like document regarding Landau Associates' services.
