This CONCURRENCY DETERMINATION is made this 17'h day of February, 2010, by the City of Federal Way
(COFW), a political subdivision of the State of Washington (hereinafter called the "City").
WHEREAS, the developer intends to develop the property described as Gumiran SP reviewed under City
file CN Number(s) 09-104070-CN (hereinafter called the "development"); and
WHEREAS, RCW 36.70A requires that the City adopt and enforce ordinances which prohibit development
approval if the development causes the level of service on a transportation facility to decline below the standards
adopted in the comprehensive plan, unless transportation improvements or strategies to accommodate the impacts of
the development are made concurrent with the development; and
WHEREAS, the City adopted its comprehensive plan in November 1995; and
WHEREAS, Chapter 19 of the COFW Revised Code was amended by the creation of Chapter 19.90
Division III on June 10, 2006 by Ordinance 06-525 effective January 1, 2007; and
NOW, THEREFORE, a concurrency certificate is issued for the development of 7lot short plat based on
the facts and conditions set forth herein.

Attached for your review is the Transportation Concurrency Analysis for the subject project,
consisting of seven single family lots. The traffic division staff has made the following
determinations:
1. Construct the impacted Transportation Improvement Plan (TIP) projects as attached
prior to the issuance of the certificate of occupancy (C/O).
Or, in lieu of constructing these improvements, prior to the issuance of any building
permit;
2. Pay a pro-rata share contribution in the amount of $13,381.00 toward the impacted
TIP projects.
You have 14 calendar days from the date of this letter to inform us which of the following
Options- you will pursue in response. If you fail to respond to this letter within 14 days of
the date of this letter, your project will not be approved. Please indicate with a checkmark
in the appropriate box of your decision, sign, and date this letter in the space below, and
return a copy to us. If you are providing additional information under Options B or C
below, these submittals are also due within 14 calendar days from the date of this letter.
Once we have reached agreement on the subject project, we will issue a Capacity Reserve
Certificate, allowing your project to proceed with other applicable permit processes.
