The lead agency for this proposal has determined that it does not have a probable significant adverse
impact on the environment, and an environmental impact statement (EIS) is not required under RCW
43.21C.030(2)(c). This decision was made after review of a completed environmental checklist, Federal
Way Comprehensive Plan, and other municipal policies, plans, rules, and regulations designated as a basis
for exercise of substantive authority under the State Enviro17117ental Policy Act pursuant to RCW
43.21 C.1 10. This information is available to the public on request.

Community Development (address below). This DNS is issued under WAC 197-1 1-340(2); the lead

SEPA ENVIRONMENTAL CHECKLIST
Purpose of Checklist
Governmental agencies use this checklist to help determine whether the environmental impacts of your
proposal are significant. This information is also helpful to determine if available avoidance, minimization
or compensatory mitigation measures will address the probable significant impacts or if an environmental
impact statement will be prepared to further analyze the proposal.
Instructions for Applicants
This environmental checklist asks you to describe some basic information about your proposal. Please
answer each question accurately and carefully, to the best of your knowledge. You may need to consult with
an agency specialist or private consultant for some questions. You may use "not applicable " or "does not
apply" only when you can explain why it does not apply and not when the answer is unknown. You may also
attach or incorporate by reference additional studies reports. Complete and accurate answers to these
questions often avoid delays with the SEPA process as well as later in the decision -making process.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of
time or on different parcels of land. Attach any additional information that will help describe your proposal

11. Give brief, complete description of your proposal, including the proposed uses and the size of the

The request is for Process III approval to redevelop an existing, unoccupied large
format commercial property into a new self -storage facility. The proposal will include
four (4), two-story self -storage buildings equaling 159,950-sf; the existing structures
will be removed. A customer office area and associated parking area will be
oriented along the 21 st Avenue SW frontage. The office has a customer entry door
facing the 21 st Avenue SW frontage and a pedestrian pathway provided direct
access to the public street. The project will utilize existing driveways onto 21 st
Avenue SW and 19th Avenue SW; the project will also utilize shared access across
adjacent parcels to connect to SW Campus Drive / SW 336th Street. No new
vehicular access points are proposed.
The four buildings will be oriented towards an internal, secured drive aisle. Each
storage building will be limited to 40,000-sf and will be climate controlled. Most
storage units will be accessible via internal hallways; some large units will be
oriented and accessible via the secured drive aisle.

According to the Geotechnical Report prepared by Terracon, the site is underlain by
ice -contact deposits of Vashon age glacial drift. These deposits are generally poorly
sorted and have a silt -rich matrix, and can include local subdivisions of Eskers, Till,
and (less common) advance outwash deposits. The soils encountered during the
subsurface exploration conducted for this geotechnical study were consistent with
the mapped geology in the general project vicinity.
d. Are there surface indications or history of unstable soils in the immediate vicinity? If so,describe.
There is no known history of unstable soils.
e. Describe the purpose, type, total area, and approximate quantities and total affected area of any
filling, excavation, and grading proposed. Indicate source of fill.
A Preliminary Stormwater Technical Information Report (TIR), including a
geotechnical analysis, will be submitted with the Process III application. There will
be approximately 17,550 Cubic Feet of cut and fill. Fill material will consist of
imported structural fill, as well of some on -site fill consisting of sand with variable
amounts of silt and gravel.
f. Could erosion occur as a result of clearing, construction, or use? If so, generally describe.
Some erosion could occur as a result of land development. A Temporary Erosion
and Sediment Control Plan (TESC) will be prepared in association with the project
and implemented through the building permit and construction phases.

construction (for example, asphalt or buildings)?
After project construction, approximately 93% of the site will be covered with
impervious surfaces. The amount of impervious surface will not increase, as the site
is currently almost entirely covered. The project will meet any applicable
landscaping standards.
h. Proposed measures to reduce or control erosion, or other impacts to the earth, if any:
A Temporary Erosion and Sediment Control Plan (TESC) will be prepared for this
project prior to building permit application. The project will follow the 2016 King
County Surface Water Design Manual, and will implement practices (iBMMPs) for
erosion control. T he project will also obtain a National Pollutant Discharge
Elimination System (NPDES) construction permit.
2. Air

The proposal is not expected to involve discharges to surface waters.
b. Ground Water:
1) Will groundwater be withdrawn from a well for drinking water or other purposes? If so, give a
general description of the well, proposed uses and approximate quantities withdrawn from the
well. Will water be discharged to groundwater? Give general description, purpose, and
approximate quantities if known.
Groundwater will not be withdrawn from a well, and there will be no discharges to
groundwater.
2) Describe waste material that will be discharged into the ground from septic tanks or other sources,
if any (for example: domestic sewage; industrial, containing the following chemicals... ;
agricultural; etc.). Describe the general size of the system, the number of such systems, the number

No waste material will be discharged into the ground; the site is connected to
sanitary sewer.

Runoff will result from rainfall. Stormwater detention and water quality treatment will
be provided on site through vaults, and Filterra will be used for water treatment.

Stormwater detention facilities will be used to reduce stormwater discharges. Best
Management Practices for stormwater detention and treatment will be employed.
This will be reviewed as part of the Process III land use review. The project will
follow the 2016 King County Surface Water Design Manual and City of Federal Way
Addendum. A National Pollutant Discharge Elimination System (NPDES)
Construction permit will also be obtained.

sf of groundcover and trees, and 15,689 sf of lawn. Much of it being native shrubs
and groundcovers. Shade trees have been provided in the parking area. Many of
the plantings are drought tolerant and disease resistant.

High efficiency heating and cooling equipment will be used. Additionally, lighting
throughout the project will utilize LED fixtures. This will be reviewed as part of the
building permit phases.
7. Environmental Health
a. Are there any environmental health hazards, including exposure to toxic chemicals, risk of fire and
explosion, spill, or hazardous waste, that could occur as a result of this proposal? If so, describe.
1) Describe any known or possible contamination at the site from present or past uses.
Wasatch Storage Partners engaged Terracon Consultants, Inc. to perform a Phase
I Environmental Site Assessment report for the subject site. The assessment was
conducted in accordance with procedures outlined in ASTM E1527-13, Standard
Practice for Environmental Site Assessments: Phase I Environmental. Site
Assessment Process. As a follow up to the findings of the phase I report, Wasatch
Storage Partners engaged Terracon to perform a Limited Site Investigation by
taking soil borings to evaluate the site soil and groundwater. Both the Phase I
assessment and the soil borings revealed no evidence of site contamination.
There was no further action recommended by Terracon.
2) Describe existing hazardous chemicals/conditions that might affect project development and
design. This includes underground hazardous liquid and gas transmission pipelines located
within the project area and in the vicinity.
No hazardous conditions on site are known.
3) Describe any toxic or hazardous chemicals that might be stored, used, or produced during the
project's development or construction, or at any time during the operating life of the project.

In the short-term, noise may be increased as a result of construction activity due to
the operation of equipment. Noise levels are expected to be minimal to moderate,
and will not exceed the maximum permissible sound levels allowed per the
Federal Way Municipal Code Chapter 7.10.
In the long-term, noise will be associated with vehicular traffic, and is not expected
to increase beyond current levels. Most activities on the site will remain indoors.
3) Proposed measures to reduce or control noise impacts, if any:
Most activities on the site will remain indoors and will not cause any undue
impacts on adjacent properties. During construction, best practices will be used to
limit noise impacts. The use of prefabricated materials will be used when possible
to minimize noise cause by cutting, grinding, drilling, and sawing.

The current land use on the site is a vacant grocery building and associated
parking. The store has been vacant for many years. Various commercial uses
surround the site to the north, west and south. A multi -family residential complex
exists to the northeast of the site. Saghalie Middle School and Park exists
approximately 750 feet to the southeast of the site.
b. Has the project site been used as working farmlands or working forest lands? If so,
describe. How much agricultural or forest land of long-term commercial significance will
be converted to other uses as a result of the proposal, if any? If resource lands have not
been designated, how many acres in farmland or forest land tax status will be converted

The project site has been in an urban area for several decades.

There are no landmarks, features, or other evidence of Indian or historic
use/occupation on the project site, according to the Washington State Department
of Archaeology and Historic Preservation's WISAARD database.
c. Describe the methods used to assess the potential impacts to cultural and historic resources on
or near the project site. Examples include consultation with tribes and the department of
archeology and historic preservation, archaeological surveys, historic maps, GIS data, etc.
Consultation with the WISAARD database was used to evaluate potential sources
and impacts.

If cultural or archeological objects are found during site preparation work, the

If not, what is the approximate distance to the nearest transit stop?
A transit stop exists along the northern frontage of the site on SW Campus Drive
serving the 903 bus line. Another stop exists to the western frontage of the site on
21 st Avenue SW and serves the 179, 181 and 197 bus lines.
c. How many additional parking spaces would the completed project or non -project proposal
have? How many would the project or proposal eliminate?
There are currently approximately 203 parking spots on the subject parcel, and
some of these spots are shared with the adjacent Taco Bell and retail center.
Parking on the site is excessive as much of it was built for the grocery store that is
now vacant. The project will eliminate 157 spots, but will add some parking to the
west perimeter of the site resulting in 62 total parking spots. The project will exceed
parking standards for this use per FWRC Chapter 19.215; only two stalls are
required for the proposed use.
d. Will the proposal require any new or improvements to existing roads, streets, pedestrian, bicycle
or state transportation facilities, not including driveways? If so, generally describe (indicate
whether public or private).
The applicant is proposing to dedicate right-of-way along 21st Avenue SW, 19th
Avenue SW and SW Campus Drive. The applicant will submit a roadway
modification request with the Process III application to be reviewed and approved
by the Public Works Director.
A pedestrian pathway will be provided to allow direct access from 21" Avenue to
the proposed west -facing office.
e. Will the project or proposal use (or occur in the immediate vicinity of) water, rail, or air
transportation? If so, generally describe.
The proposal is not in the vicinity of water, rail or air transportation.
f. How many vehicular trips per day would be generated by the completed projector proposal? If
known, indicate when peak volumes would occur and what percentage of the volume would be
trucks (such as commercial and nonpassenger vehicles). What data or transportation models
were used to make these estimates?
The redevelopment will result in a reduction of trips. According to the Institute of
Transportation Engineers (ITE) trip generation manual -8th edition- the proposed
use will generate approximately 42 new weekday PM peak hour trips. The site was
previously used as a grocery store, which generated 400+ peak hour trips. No new
net trips will be created as a result of this project, as the site's previous use had
much higher traffic impacts. The proposal will apply for traffic concurrency to ensure
that the adjacent streets meet City level of service (LOS) standards.
g. Will the proposal interfere with, affect or be affected by the movement of agricultural and
forest products on roads or streetsin the area? If so, generally describe.

SEPA ENVIRONMENTAL CHECKLIST
Purpose of Checklist
Governmental agencies use this checklist to help determine whether the environmental impacts of your
proposal are significant. This information is also helpful to determine if available avoidance, minimization
or compensatory mitigation measures will address the probable significant impacts or if an environmental
impact statement will be prepared to further analyze the proposal.
Instructions for Applicants
This environmental checklist asks you to describe some basic information about your proposal. Please
answer each question accurately and carefully, to the best of your knowledge. You may need to consult with
an agency specialist or private consultant for some questions. You may use "not applicable" or "does not
apply" only when you can explain why it does not apply and not when the answer is unknown. You may also
attach or incorporate by reference additional studies reports. Complete and accurate answers to these
questions often avoid delays with the SEPA process as well as later in the decision -making process.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of
time or on different parcels of land. Attach any additional information that will help describe your proposal
or its environmental effects. The agency to which you submit this checklist may ask you to explain your
answers or provide additional information reasonably related to determining if there may be significant
adverse impact.
Instructions for Lead Agencies
Please adjust the format of this template as needed. Additional information may be necessary to evaluate the
existing environment, all interrelated aspects of the proposal and an analysis of adverse impacts. The
checklist is considered the first but not necessarily the only source of information needed to make an
adequate threshold determination. Once a threshold determination is made, the lead agency is responsible
for the completeness and accuracy of the checklist and other supporting documents.
Use of Checklist for Nonproject Proposals
For nonproject proposals (such as ordinances, regulations, plans and programs), complete the applicable

The request is for Process III approval to redevelop an existing, unoccupied large
format commercial property into a new self -storage facility. The proposal will include
four (4), two-story self -storage buildings equaling 159,950-sf; the existing structures
will be removed. A customer office area and associated parking area will be
oriented along the 21 st Avenue SW frontage. The office has a customer entry door
facing the 21 st Avenue SW frontage and a pedestrian pathway provided direct
access to the public street. The project will utilize existing driveways onto 21 st
Avenue SW and 19th Avenue SW; the project will also utilize shared access across
adjacent parcels to connect to SW Campus Drive / SW 336th Street. No new
vehicular access points are proposed.
The four buildings will be oriented towards an internal, secured drive aisle. Each
storage building will be limited to 40,000-sf and will be climate controlled. Most
storage units will be accessible via internal hallways; some large units will be
oriented and accessible via the secured drive aisle.

According to the Geotechnical Report prepared by Terracon, the site is underlain by
ice -contact deposits of Vashon age glacial drift. These deposits are generally poorly
sorted and have a silt -rich matrix, and can include local subdivisions of Eskers, Till,
and (less common) advance outwash deposits. The soils encountered during the
subsurface exploration conducted for this geotechnical study were consistent with
the mapped geology in the general project vicinity.
d. Are there surface indications or history of unstable soils in the immediate vicinity? If so, describe.
There is no known history of unstable soils.
e. Describe the purpose, type, total area, and approximate quantities and total affected area of any
filling, excavation, and grading proposed. Indicate source of fill.
A Preliminary Stormwater Technical Information Report (TIR), including a
geotechnical analysis, will be submitted with the Process III application. There will
be approximately 17,550 Cubic Feet of cut and fill. Fill material will consist of
imported structural fill, as well of some on -site fill consisting of sand with variable
amounts of silt and gravel.
f. Could erosion occur as a result of clearing, construction, or use? If so, generally describe.
Some erosion could occur as a result of land development. A Temporary Erosion
and Sediment Control Plan (TESC) will be prepared in association with the project
and implemented through the building permit and construction phases.

g. About what percent of the site will be covered with impervious surfaces after project
construction (for example, asphalt or buildings)?
After project construction, approximately 93% of the site will be covered with
impervious surfaces. The amount of impervious surface will not increase, as the site
is currently almost entirely covered. The project will meet any applicable
landscaping standards.
h. Proposed measures to reduce or control erosion, or other impacts to the earth, if any:
A Temporary Erosion and Sediment Control Plan (TESC) will be prepared for this
project prior to building permit application. The project will follow the 2016 King
County Surface Water Design Manual, and will implement practices (BMPs) for
erosion control. The project will also obtain a National Pollutant Discharge
Elimination System (NPDES) construction permit.
2. Air
a. What types of emissions to the air would result from the proposal during construction,
operation, and maintenance when the project is completed? If any, generally describe and give
approximate quantities if known.
During construction, temporary increases in dust and emission pollution could
occur.
b. Are there any off -site sources of emissions or odor that may affect your proposal? If so,
generally describe.
There are no known or observed offsite sources of emissions or odor.
c. Proposed measures to reduce or control emissions or other impacts to air, if any:
Adequate water supply will be conveniently located to be used for the purposes of
damping down dust. Dust generating activities will be located as far from sensitive
areas or neighbors as possible.
3. Water
a. Surface Water:
1) Is there any surface water body on or in the immediate vicinity of the site (including year-round
and seasonal streams, saltwater, lakes, ponds, wetlands)? If yes, describe type and provide names.
If appropriate, state what stream or river it flows into.
No water bodies are on site or in the immediate vicinity.
2) Will the project require any work over, in, or adjacent to (within 200 feet) the described waters?

Groundwater will not be withdrawn from a well, and there will be no discharges to
groundwater.
2) Describe waste material that will be discharged into the ground from septic tanks or other sources,
if any (for example: domestic sewage; industrial, containing the following chemicals... ;
agricultural; etc.). Describe the general size of the system, the number of such systems, the number
of houses to be served (if applicable), or the number of animals or humans the system(s) are

No waste material will be discharged into the ground; the site is connected to
sanitary sewer.

Runoff will result from rainfall. Stormwater detention and water quality treatment will

Stormwater detention facilities will be used to reduce stormwater discharges. Best
Management Practices for stormwater detention and treatment will be employed.

Addendum. A National Pollutant Discharge Elimination System (NPDES)

sf of groundcover and trees, and 15,689 sf of lawn. Much of it being native shrubs
and groundcovers. Shade trees have been provided in the parking area. Many of
the plantings are drought tolerant and disease resistant.

High efficiency heating and cooling equipment will be used. Additionally, lighting
throughout the project will utilize LED fixtures. This will be reviewed as part of the
building permit phases.
7. Environmental Health
a. Are there any environmental health hazards, including exposure to toxic chemicals, risk of fire and
explosion, spill, or hazardous waste, that could occur as a result of this proposal? If so, describe.
1) Describe any known or possible contamination at the site from present or past uses.
Wasatch Storage Partners engaged Terracon Consultants, Inc. to perform a Phase
I Environmental Site Assessment report for the subject site. The assessment was
conducted in accordance with procedures outlined in ASTM E1527-13, Standard
Practice for Environmental Site Assessments: Phase I Environmental Site
Assessment Process. As a follow up to the findings of the phase I report, Wasatch
Storage Partners engaged Terracon to perform a Limited Site Investigation by
taking soil borings to evaluate the site soil and groundwater. Both the Phase I
assessment and the soil borings revealed no evidence of site contamination.
There was no further action recommended by Terracon.
2) Describe existing hazardous chemicals/conditions that might affect project development and
design. This includes underground hazardous liquid and gas transmission pipelines located
within the project area and in the vicinity.
No hazardous conditions on site are known.
3) Describe any toxic or hazardous chemicals that might be stored, used., or produced during the
project's development or construction, or at any time during the operating life of the project.
No toxic or hazardous chemicals will are allowed to be stored on site.
4) Describe special emergency services that might be required.
There are no known special emergency services needed.
5) Proposed measures to reduce or control environmental health hazards, if any:
The Self -Storage facility prohibits the storing of toxic or hazardous materials.
b. Noise
1) What types of noise exist in the area which may affect your project (for example: traffic,
equipment, operation, other)?
The site is located at a very busy intersection. Off -site traffic noise is expected to
be heard on -site.

2) What types and levels of noise would be created by or associated with the project on a short-
term or a long-term basis (for example: traffic, construction, operation, other)? Indicate what
hours noise would come from the site.
In the short-term, noise may be increased as a result of construction activity due to
the operation of equipment. Noise levels are expected to be minimal to moderate,
and will not exceed the maximum permissible sound levels allowed per the
Federal Way Municipal Code Chapter 7.10.
In the long-term, noise will be associated with vehicular traffic, and is not expected
to increase beyond current levels. Most activities on the site will remain indoors.
3) Proposed measures to reduce or control noise impacts, if any:
Most activities on the site will remain indoors and will not cause any undue
impacts on adjacent properties. During construction, best practices will be used to
limit noise impacts. The use of prefabricated materials will be used when possible
to minimize noise cause by cutting, grinding, drilling, and sawing.
8. Land and Shoreline Use
a. What is the current use of the site and adjacent properties? Will the proposal affect
current land uses on nearby or adjacent properties? If so, describe.
The current land use on the site is a vacant grocery building and associated
parking. The store has been vacant for many years. Various commercial uses
surround the site to the north, west and south. A multi -family residential complex
exists to the northeast of the site. Saghalie Middle School and Park exists
approximately 750 feet to the southeast of the site.
b. Has the project site been used as working farmlands or working forest lands? If so,
describe. How much agricultural or forest land of long-term commercial significance will
be converted to other uses as a result of the proposal, if any? If resource lands have not
been designated, how many acres in farmland or forest land tax status will be converted
to nonfarm or non -forest use?
The project site has been in an urban area for several decades.
1) Will the proposal affect or be affected by surrounding working farm or forest land
normal business operations, such as oversize equipment access, the application of
pesticides, tilling, and harvesting? If so, how:
No, the project site is located in an urbanized, developed area.
c. Describe any structures on the site.
A 43,000 square foot building exists on site. The building is unoccupied and was

landmarks on site. The only structure on site is the vacant grocery store building
which was built in 1982.

of cultural importance on or near the site? Please list any professional studies conducted at the site

There are no landmarks, features, or other evidence of Indian or historic
use/occupation on the project site, according to the Washington State Department
of Archaeology and Historic Preservation's WISAARD database.
c. Describe the methods used to assess the potential impacts to cultural and historic resources on
or near the project site. Examples include consultation with tribes and the department of
archeology and historic preservation, archaeological surveys, historic maps, GIS data, etc.
Consultation with the WISAARD database was used to evaluate potential sources
and impacts.

A transit stop exists along the northern frontage of the site on SW Campus Drive
serving the 903 bus line. Another stop exists to the western frontage of the site on
21 st Avenue SW and serves the 179, 181 and 197 bus lines.
c. How many additional parking spaces would the completed project or non -project proposal
have? How many would the project or proposal eliminate?
There are currently approximately 203 parking spots on the subject parcel, and
some of these spots are shared with the adjacent Taco Bell and retail center.
Parking on the site is excessive as much of it was built for the grocery store that is
now vacant. The project will eliminate 157 spots, but will add some parking to the
west perimeter of the site resulting in 62 total parking spots. The project will exceed
parking standards for this use per FWRC Chapter 19.215; only two stalls are
required for the proposed use.
d. Will the proposal require any new or improvements to existing roads, streets, pedestrian, bicycle
or state transportation facilities, not including driveways? If so, generally describe (indicate
whether public or private).
The applicant is proposing to dedicate right-of-way along 21st Avenue SW, 19th
Avenue SW and SW Campus Drive. The applicant will submit a roadway
modification request with the Process III application to be reviewed and approved
by the Public Works Director.
A pedestrian pathway will be provided to allow direct access from 21 st Avenue to
the proposed west -facing office.
e. Will the project or proposal use (or occur in the immediate vicinity of) water, rail, or air
transportation? If so, generally describe.
The proposal is not in the vicinity of water, rail or air transportation.
f. How many vehicular trips per day would be generated by the completed projector proposal? If
known, indicate when peak volumes would occur and what percentage of the volume would be
trucks (such as commercial and nonpassenger vehicles). What data or transportation models
were used to make these estimates?
The redevelopment will result in a reduction of trips. According to the Institute of
Transportation Engineers (ITE) trip generation manual -8th edition- the proposed
use will generate approximately 42 new weekday PM peak hour trips. The site was
previously used as a grocery store, which generated 400+ peak hour trips. No new
net trips will be created as a result of this project, as the site's previous use had
much higher traffic impacts. The proposal will apply for traffic concurrency to ensure
that the adjacent streets meet City level of service (LOS) standards.
g. Will the proposal interfere with, affect or be affected by the movement of agricultural and
forest products on roads or streets in the area? If so, generally describe.

The city has reviewed the environmental checklist submitted with the Use Process III application for the
demolition of a 41,000 sq. ft. building and construction of four self -storage buildings on 21" Ave SW. It
has been determined that the proposal will not have a probable significant adverse impact on the
environment. As a result, an Environmental Impact Statement (EiS) is not required to comply with the
State Environmental Policy Act (SEPA). A copy of the Determination of Nonsignificance (DNS) is
enclosed.
A 14-day comment period is required by the SEPA rules (WAC 197-1 1-340). A notice inviting comments
will be published in the Federal TVay Mirror, posted onsite, posted on the official public notification
boards of the city and public libraries, and mailed to all property owners within 300 feet of the site on
July 21, 2017. At the end of the comment period, the department will determine if the DNS should be
withdrawn, modified, or issued as proposed. All final determinations may be appealed within 21 days
(August 25, 2017) following the comment deadline. No licenses, pennits, or approvals will be issued until
completion of the appeal period_
Our decision not to require an EIS does not mean that the license, permit, or approval you are seeking from
the city has been granted. Approval or denial of the proposal will be made by the appropriate administrative
or legislative body vested with that authority.
After a final decision has been made on your proposal (i.e., after a permit has been issued), you may, but
are not required to, publish a Notice of Action as set forth in RCW 43.21 C.075. The Notice of Action sets
forth a time period after which no legal challenges regarding the proposal's compliance with SEPA can be
made. A copy of the Notice of Action form and copies of RCW 43.21C.080 and WAC 197-11-680
providing instructions for giving this notice are available from the Department of Community

Thank you for the opportunity to comment on the Determination of Nonsignificance regarding the Federal
Way Self Storage Project. The Department of Ecology (Ecology) reviewed the environmental checklist
and has the following comment(s):
Federal Wa Buildin Demolition:
Construction and demolition activities may result in dangerous wastes that need to be properly
managed and disposed of in accordance with state and federal requirements. Older buildings
often contain leaded paint, leaded pipes, paints containing mercury -based biocides, mercury -
containing fluorescent lamps, asbestos, PCB ballasts, and other dangerous materials. When
buildings are torn down, workers, neighbors, and the environment can be exposed to toxic
chemicals. At a minimum, buildings that are slated for demolition must be assessed (a process
known as waste designation) to determine if they contain or are themselves a dangerous
waste. Some of the most frequently observed demolition related hazardous waste include:
Mercury containing fluorescent lamps - The "Mercury -Containing Lights - Proper Disposal"
law, Chapter 70.275 RCW, requires that all persons, residents, government, commercial,
industrial, and retail facilities and office buildings must now recycle their end -of -life mercury -
containing lights. This includes mercury -containing lamps that do not designate as dangerous
waste, often called "green tip" lights, and glass debris from drum top lamp crushing
operations. Although green tip lights will pass TCLP testing, they still contain
mercury. Disposal to landfills is prohibited for all mercury containing lights.
The law also requires producers of mercury -containing lights to set up a product stewardship
collection and recycling program. This program began operating in January
2015. "LightRecycle Washington" will accept up to ten mercury -containing bulbs per day from
individuals and business at no charge. You must still comply with the regulations for Universal
Hazardous Waste. LightRecycle provides another option for safe disposal of lamps. Please see
the LightRecycle Washington website for more information, including collection site locations,

Asbestos - Old linoleum, ceiling tiles, siding, insulation, and other materials in structures built
before 1977 may contain asbestos. When asbestos deteriorates, falls apart or is disturbed the
fibers can become airborne and are easily inhaled, settling deep into the lungs and may cause
cancer. Prior to demolition the structure must be evaluated for asbestos. If asbestos is identified,
removal and disposal must comply with Clean Air regulations. Contact your local clean air
agency for additional information on asbestos removal:

Lead - Most buildings constructed before 1960 contain heavily leaded paint and buildings
constructed as late as 1978 may also contain lead -based paint. Lead -based paint is the primary
reason a building or its components may be designated as dangerous waste. Buildings intended
for demolition need to be evaluated and possibly tested for lead concentrations to determine if
they exceed dangerous waste thresholds. If the structure or its lead -bearing components
designate as hazardous waste, all related debris must be managed appropriately and cannot be

The lead agency for this proposal has determined that it does not have a probable significant adverse
impact on the environment, and an environmental impact statement (EIS) is not required under RCW
43.21C.030(2)(c). This decision was made after review of a completed environmental checklist, Federal
Way Comprehensive Plan, and other municipal policies, plans, rules, and regulations designated as a basis
for exercise of substantive authority under the State Environmental Policy Act pursuant to RCW
43.21 C.110. This information is available to the public on request.
Further information regarding this action is available to the public upon request from the Department of
Community Development (address below). This DNS is issued under WAC 197-11-340(2); the lead
agency will not act on this proposal for 14 days from the date below. Comments must be submitted by
5:00 p.m. on August 4, 2017.
Unless modified by the city, this determination will become final following the above comment deadline.
Any person aggrieved of the city's final determination may file an appeal. Anyone may appeal this
determination to the Federal Way City Clerk (33325 8th Ave S, Federal Way, WA 98003), no later than
5:00 p.m. on August 25, 2017, by a written letter stating the reason for the appeal of the determination.
You should be prepared to make specific factual objections.
