This letter responds to your request to modify the required street improvements along 21 st Ave SW,
which abuts the referenced property, as part of the proposal to redevelop the vacant bank building into
new retail space. After evaluating the existing conditions along the referenced street, review of Federal
Way Revised Code (FWRC) provisions (Sections 19.135.070 and 19.135.090) and direction provided by
the City Council, the Public Works Department hereby denies your request, as noted below.
21st Ave SW is classified as a Principal Arterial, corresponding to City Standard Street Section Type `E',
a 54ane road section consisting of a 64-foot paved roadway, 6-foot planter strips, 8-foot sidewalks and 3-
foot utility strip within a 98-foot right of way.
The existing roadway improvements along this property frontage of consist of a 56-foot paved roadway (5
lanes), a 3.5-foot planter strip and 5-foot sidewalk, and 50-feet of right of way along the project side of
the street centerline.
Consistent with the requirements imposed on the development to the north of this project site — Federal
Way Self Storage — the developer will be required to construct the following, modified section:
1) Retain the existing curb and gutter in its current location/alignment;
2) Install the 6-foot wide planter strip (with street trees and street lights), and construct the 8-foot
sidewalk behind the new planter strip;
3) Adequate right of way exists along your property; therefore, no additional right of way will be
required.
Because the project frontage has a large (5'x10') underground PSE vault that will very likely extend (at
least partially) into the new sidewalk aligrmient, the developer may have to adjust the vault lid (and apply
non -slip treatment) to match the elevation of the new sidewalk. There is also a single power pole at the
southern end of the frontage. The sidewalk alignment will have to be adjusted at this end to avoid this
power pole.

The conditions of this right-of-way modification will be applicable for a period of one year. If a land use
approval is not issued within the one year time period, this waiver will be void, and a new request for
modification must be submitted.

Request The applicant is requesting a waiver of street improvements along 21 st Ave SW as
part of the redevelopment of this site.
Staff Analysis 21st Ave SW is classified as a Principal Arterial, corresponding to City Standard
Street Section Type `E', a 5-lane road section consisting of a 64-foot paved roadway, 6-foot planter strips,
8-foot sidewalks and 3-foot utility strip within a 98-foot right of way.
Existing improvements in 21 st Ave SW along this property frontage of consist of a 56-foot paved

Requirements / Conditions of Approval Staff recommends denial of the request, but suggest

On behalf of Confluent Development Company, we are requesting a Right -of -Way Improvement Waiver
Request for roadway improvement requirements outlined in the recent pre -application meeting summary
letter issued by the City of Federal Way for a proposed Commercial Coffee Shop/Retail project located a
33650 — 21st Avenue S.W. The project consists of minor site modifications and tenant improvements to
an existing developed site which was formerly a Umpqua Bank facility.
Based on the information provided by the City, half -street improvements would be required under FWRC
19.135 for a Principal Arterial planned as a Type F street consisting of a 64-foot wide street with curb and
gutter, 6-foot planter strips with street trees, 8-foot sidewalks and street lights in a 98-foot right-of-way.
The current geometrical dimensions of 21st Avenue S.W. is a 5-lane roadway with 56-foot of pavement
consisting of four 11-foot travel lanes and a 12-foot center turn lane, curb, gutter, 3-foot planter strips and
5-foot sidewalks within a 50-foot wide right-of-way on the project side of the street.
The reasons for requesting the Right -of -Way Improvement Waiver Request are as follows as identified in
the City of Federal Way Right -of -Way Modification Request Form:
1. The improvements as required would not be harmonious with existing street improvements,
would not function property or safely or would not be advantageous to the neighborhood or
City as a whole.
2. Unusual topographic or physical conditions preclude the construction of improvements as
required.
The justifications for requesting the Right -of -Way Improvement Waiver Request are outlined below:
1. 21st Avenue S.W. is currently a consistent 5-lane arterial roadway with 56-foot of pavement
width to the north and south of the project site. Attempting to widen the project side of the
roadway by 4-foot from 28-foot to 32-foot for this small length of roadway when the entire
remaining width is 28-foot would not be beneficial to the neighborhood or the City and would I o
create an unsafe and irregular condition.

2. 21st Avenue S.W. is currently functioning adequately as a 5-lane arterial with standard 11-
foot travel lanes and a 12-foot center turn lane. Widening a small portion of this roadway by
4-foot on one side does not provide any public benefit and would be confusing for vehicles
traveling in the north bound direction along the frontage of the project since the widening
would result in an inconsistent width of travel lane for a short length of the roadway.
3. Since 21st Avenue S.W. is a consistent 56-foot wide roadway section extending both to the
north and south of the project site for a long distance with a uniform 3-foot planter strip and 5-
foot concrete walk, there would be no increased benefit to complete major modifications to
the roadway for this short length as it would not be harmonious or consistent with the existing
completed and fully developed roadway section.
4. The existing sidewalk extending along the frontage of the property is in good condition, is
currently functioning adequately to serve the neighborhood and is consistent with the existing
sidewalk to the north and south of the project site along 21st Avenue S.W. Reconstructing
the sidewalk to provide a wider walk and planter strip for the short length of roadway is not
reasonable, would look out of place with the adjacent roadway section and would not result in
a benefit to the neighborhood or the City.
5. Removing and reconstructing a wider sidewalk along the project would result in a vertical and
horizontal conflict with an existing major underground power vault located within the right-of-
way causing an unsafe condition. It would be unreasonable for the developer to be required
to bear the cost of relocating the major vault to widen the sidewalk in this area.
6. Since 21 st Avenue S.W. is a fully constructed arterial roadway and development is built out
on both sides of the roadway north and south of the site, it is not likely that other portions of
the roadway will be improved any time soon to the City's current roadway section. Therefore,
improving the entire roadway to meet the City's current roadway section would be best
accomplished under a city wide CIP project or Local Improvement District. This would
provide for a consistent and uniform roadway project that would benefit the city and the
neighborhood as a whole.
