Permit No. 10-101600-00-SM; Retreat Meadows Street Modification - 35615 3rd Ave SW Dear Mr. LaBrie, This letter responds to your request to modify and/or waive required street design standards in regard to the above -referenced project. After evaluating your request, review of Federal Way Code provisions, and direction provided by the City Council, the Public Works Department addresses your requests as follows: Block Perimeter Standards for non -motorized access (including bikeways and walkways): The Public Works Department hereby agrees to modify this standard as detailed in your request, and allow the block, created by Roads A, B, C, and D (as shown on the April 20, 2010 drawings), to exceed the City's block perimeter standard of 1,320 feet to approximately 1,500 feet. Second access for a subdivision of 25 or more lots: The Public Works Department hereby denies your request for a single access to the subdivision. Based on the anticipated number of average vehicular trips per day generated by the development, a second access will provide a benefit to the neighborhood. No street or combination of streets shall function as a cul-de-sac longer than 600 feet: The second access to the subdivision is required; consequently, the street systems will not function as a cul-de-sac or dead end street. Additionally, the Public Works Department has the following comments on the April 20, 2010 plan submittal: Streets: 1) Extension of Road B, west of Road A — This roadway extension shall be located further south in order to accommodate the future roadway extension beyond Retreat Meadows. Currently this alignment ends at a developed lot. A southerly shift will allow access to the undeveloped portions of the parcels to the west. Please keep in mind that the remainder of Road B (east of Road A), shall align with this extension, and not create an off -set intersection. Mr. Eric LaBrie ESM Consulting Engineers, LLC RE: Permit No. 10-101600-00-SM June 2, 2010 Page Two 2) Road A connection to SW 3561h Street — This roadway shall be constructed to its full - width, per City Standard 3-2S. 3) Show the proposed future connection of the Lifeway Church access road to Road A. 4) Road E — City Standard 3-2Y cannot exceed 150-feet in length, and shall be located within a private tract. Verify Fire Department (South King Fire and Rescue) requirements for turnarounds and/or sprinkler systems. Storm Drainage: Public Works will not approve this revision for the following reasons: 1) The project does not provide adequate on -site flow control facilities for each drainage basin. The project site (existing) is divided into three separate threshold discharge areas, as defined in the 1998 King County Surface Water Design Manual. The narrative in the TIR (page 4-1) suggests that two of these three threshold discharge areas (basins A and C) reconnect within '/4 mile downstream of the site. However, the Overall Drainage Basin Map (located in the back pocket of the TIR), which shows the off -site flow paths, indicates that Basins A and C flow paths do not reconnect within'/4 mile downstream, but rather on the order of % of a mile downstream of the site. This is well beyond what the City would consider to be an allowable tolerance to allow combining the on -site flow control facility into a single pond, and therefore we cannot support the current single pond concept. 2) Further Technical Review comments will be forwarded under cover of the preliminary plat process (City File No. 08-101729-00-SU). We understand that this project is vested to the prior version of the FWMC; therefore, all code citations will reflect the old numbering system, which differs from the newly adopted Federal Way Revised Code. Specifically, the code citations in this letter refer to the Public Works Development Standards, Chapter 3, dated February 2005. The redesigned preliminary plat of Retreat Meadows meets all of the required road design standards except the following: 1.3.2 Streets C. Alignment and Location. 4. Block perimeters should be no longer than 1,320 feet for non -motorized access and 2,630 feet for streets. The proposed perimeter distance for the internal block bound by proposed Roads A, B, C and D is 1,720 feet, as measured along the centerlines. The true "perimeter" of this block is 1,483 feet when measured along the right-of-way, and even shorter when measured along the actual sidewalk.. Providing an internal non -motorized connection between Roads A and D does not appear to provide any benefit to the layout or non -motorized circulation within this development as it would only shorten the walking route for a very few, select lots. More than one connection to the existing public street system will be provided for any development, or part thereof, of four acres or more, or generating more than 250 trips per day or more (25 single-family lots). If not otherwise infeasible, each connection will be to a different street Since this project is only bound by one public street (SW 356th Street) and the length of frontage is only approximately 326 feet, two connections are not practical to this arterial roadway. This project is proposing to stub public roads to the east, west and southern boundaries in order to provide future connections to, and expansion of the public street system as perimeter properties develop in the future. Expansion of the existing private road along the western property boundary (3`d Ave. SW) was previously analyzed to provide a second connection to SW 356th Street; however, the intersection of Sd Ave SW and SW 3561h Street occurs on the inside of the horizontal curve and would require dedication of private property from adjacent landowners, which is outside the control of the applicant Furthermore, expansion of 3"d Ave. SW could cause turning conflicts with traffic from 41h Ave. SW and 2n" Ave. SW, both of which are within 335 feet of this intersection. There are also other improvements (a rock wall and vegetation) that hinder the existing sight distance at this intersection. This request meets the standards for granting a modification because a second connection to the existing public street system would not function as safely as combining the access points to align with the existing intersection of 2nd Ave SW. G. Cul-de-sacs and Dead-end Streets. No street or combination of streets shall function as a cul-de-sac longer than 600 feet. The cul-de-sac nature of this project is a temporary condition and will be relieved when adjacent properties develop. In order to provide for future connectivity and expansion of a grid -style road network in this area, this project is stubbing public roads to its east, west and southern boundaries. Phase 1 will provide for three separate "hammer -head" style turnarounds at the intersections of Road A with Roads E, B and C. During Phase 2, an internal loop will be created providing greater turn -around and circulation options, and a continued roadway stub to the east This request meets the standards for granting a modification because the unusual configuration of the property and lack of adjacent right-of-way preclude the construction of a secondary access. li i Mr. Matthew Herrera April 16, 2010 Page Three 1.3.4 Bikeways and Walkways C. Pedestrian and bicycle access shall be provided to develop a non -motorized network with a block perimeter of no greater than 1,320 feet, as measured on the centerlines. This requirement may be modified if connections cannot be made due to: 1. Topographic constraints 2. Environmentally sensitive areas 3. Adjacent development not being conducive. This modification request comes out of the traffic section within the August 8, 2008 letter from Matthew Herrera and Sarady Long to ESM Consulting Engineers. The following items are part of this modification request: Under item #1 of the Traffic Section, we request a modification from any improvements to -SW 356t" St. from the existing road section to the Type "C" road section. The existing SW ��" 356t"St. road has been improved over recent years to include four travel lanes and a middle turning lane, curb, gutter and sidewalks. The existing street functions safety and n adequately for the neighborhood and the city as a whole and does not need 4 improvements at this time or in the near future. The requirement for 11 feet of right-of-way l� dedication is not being opposed. Under item #2 of the Traffic Section, 2nd Ave. SW between SW 358t" St. and SW 350" St is proposed be constructed as a half street improvement of a Type "W" street. This would include 24' paved street with vertical curb, 4' planter strip with street trees, 5' sidewalk, and I streetlights. Ten feet of these improvements would be built on an access, utility easement Qwithin the Lifeway Church property. This easement would be recorded prior to preliminary plat approval. This same half street improvement and 10' easement is proposed for SW lb 358t" Street between 2nd Ave. SW and the easterly property line. Under item #3 of the same Traffic Section, the section of the proposed SW 358t" St. between 2nd and 3`d has been called out as "W" street section. Since this section of 358th will not be extended west dues to existing homes in the area, this wide road section is ^ not warranted. A request to modify this road section is proposed. Instead of a 52 foot i� right-of-way, 28 feet of roadway, curb, gutter and sidewalks and a 3 foot utility strip the following is proposed; a 40 foot right-of-way, 24 feet of roadway, curb, gutter, sidewalk and a 3 foot utility strip is proposed. A modification to the standard hammerhead is requested. The request is to offset the temporary hammerhead from the centerline of the 24' paved street north 28 feet (to stay within the future right-of-way) and south 62 feet into the 23' wide pedestrian corridor. The overall length of the hammerhead will meet the minimum required 90'. The south radius would meet the 28' min., but the north radius would be 16.0'. After evaluating your request, review of Federal Way City Code (FWCC) provisions (Section 22- 1477, 22-1496), and direction provided by the Public Works Director, each of your specific requests to modify the roadway sections for this project are addressed below, with the City's response following each: Requesting waiver of the required street improvements associated with SW 356d' Street, and agreeing to dedicate right-of-way along SW 3560 Street, adjacent to the project: The City hereby waives the construction of required street improvements, with the additional 11-feet of right-of-way to be dedicated to the City at final plat recording. Request to place the east 10-feet of the 27d Avenue SW improvements (north of SW 3560 Street) and the north 10-feet of the SW 358`" Street improvements (east of 27d Avenue SW) within 10-foot easements on the adjacent Lifeway Church property, rather than dedicate the entire width as right-of-way. (Applicant is agreeing to construct the required half -.street improvements along these roadway sections ) The City hereby denies this request per the requirements of FWCC Section 20- 180(a), which states that'Streets within an approved land division shall be within a dedicated public right-of-way.' The entire half -street improvements must be within right-of-way, and shall be dedicated to the City at final plat recording. Future development on the adjacent parcel to the north and east of the plat will require 2'd Avenue SW and SW 358th Street to be developed to a City Standard Type `S' street section, rather than a Type 'W', if future traffic warrants the expanded section. However, the expanded street section would only affect the future development and does not affect this project since it is constructing 24-feet of paved roadway. Requesting modification of SW 35e Street between 3`d Avenue SW and 2'd Avenue SW from a City Standard Type 'W street to a 24-foot roadway with sidewalks on both sides adjacent to the roadway (no planter strip), and 3-foot utility strips, all within a 40-foot right-of-way. The City hereby denies this request per the requirements of FWCC Section 20- 180(b), which states that 'All streets within the public rights -of -way shall be improved to the standards as specified in FWCC 22-1471 et seq., regarding required improvements to rights -of -way.' The roadway section that you are requesting does not meet adopted City standards. This section of roadway shall be constructed to meet the requirements of City Standard Street Section Type AW, Requesting modification of the required turnaround at the east end of the pmposed SW 35e Street. The City, with input from the South King Fire and Rescue Fire Marshal, hereby denies your proposed layout for a modified fire apparatus turnaround (hammerhead). A hammerhead turnaround can be approved if it meets the dimensions as depicted in current City Standards (Standard Detail 3-46). Additionally, per the Fire Marshal, any new homes on those lots that abut that roadway (currently lots 53-56) shall be sprinkled, should a standard hammerhead be approved and constructed. Furthermore, your requests for modifications do not meet any of the criteria identified under FWCC Section 22-1477: "Modifications, deferments and waivers The Public Works Director may modify, defer or waive the requirements of this article only after consideration of a written request for the following reasons (1) The improvement as required would not be harmonious with existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or city as a whole. In addition, Public Works staff determined that the proximity of the proposed dual access points at SW 356th Street and 3rd Avenue SW (existing private access road just west of the proposed 3rd Avenue SW) presents a safety issue that shall be addressed by combining the existing private driveway with the new 3rd Avenue SW roadway. This access management issue shall be addressed and a proposal presented to the Public Works Department for review and approval, prior to preliminary plat approval. The conditions of this Right -of -Way Modification will be applicable for a period of one year from the date of this letter. If a permit for this project is not issued within the one-year time limit, this waiver will be void and a new request for modification must be submitted.
