Submitted materials depict work will occur within an existing development footprint abutting a public parking lot. FINDINGS & ANALYSIS North Lake is a shoreline of the state. The city reviewed site photos and aerial mapping and concluded the area of work is located within shorelands; approximately 105 feet from North Lake's Ordinary Mghwater Mark.. Therefore, a shoreline exemption application (enclosed) must be subn-dtted and approved in order to replace the toilet. The proposal area is located on or within 200 feet of a regulated wetland. However, as stated, the work will occur within an existing paved surface that was previously approved and it appears the existing developed area is outside of the wetland buffer. As such, your proposal complies with critical areas exemption (Federal Way Devised Code TWRC] 15.10.110[1] [b] P1, "Existing Public Facilities and Utility Structures or Rights -of Way"). Impacts to critical areas and their buffers are mitigated to the extent feasible. CONDITIONAL APPROVAL Your request is hereby conditionally approved per FWRC 15.10.110(1); "Certain Activities Not Subject to Critical Area Standards."' I.D. 77962 18-102615-00-AD WDFW North Lake Access Site Toilet Replacement Project Narrative P#1521019201, Lat 47.307626, Long-122.288821 WDFW is proposing replacement of a single fiberglass vault toilet with a CXT pre -cast concrete vault toilet in the same location. This public access site is located within the City of Federal Way. This project is SEPA exempt under WAC 197-11-800(3) for "Repair, remodeling, and maintenance activities" per WDFW's SEPA coordinator. The current toilet has been requested to be replaced by access area staff. This is an older style toilet and the new pre -cast toilets are ADA compliant, easier to maintain, and are less likely to experience issues. Chapter 15.05 of the Federal Way Revised Code (FWRC) is the guidance for Shoreline Management. Section 3.5.05.130 for Shoreline Exemptions references WAC 173-27-040, "Developments exempt from substantial development permit requirement." The proposal to replace the toilet at this site is exempt under WAC 173-27-040 (b) and (q). (b) Normal maintenance or repair of existing structures or developments, including damage by accident, fire or elements. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. "Normal repair" means to restore a development to a state comparable to its original condition, including but not limited to its size, shape, configuration, location and external appearance, within a reasonable period after decay or partial destruction, except where repair causes substantial adverse effects to shoreline resource or environment. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment; (q) The external or internal retrofitting of an existing structure with the exclusive purpose of compliance with the Americans with Disabilities Act of 1990 (42 U.S.C. Sec. 12101 et seq.) or to otherwise provide physical access to the structure by individuals with disabilities. Chapter 15.10 of the FWRC is the guidance for Critical Areas. Section 15.10.110 for "Certain activities not subject to critical area standards" includes 15.10.110 (1)(b)(iii) as follows: (1) The following activities are not subject to the provisions of this chapter: (a) Emergencies that, in the opinion of the shoreline administrator, threaten the public health, safety, and welfare, where impacts to critical areas and their buffers are mitigated to the extent feasible following the emergency actions; (b) Normal and routine maintenance and repair of the following facilities, for which a maintenance plan has been approved by the public works director; provided, that impacts to critical areas and their buffers are mitigated to the extent feasible: (i) Existing drainage ditches; provided, however, that this exception shall not apply to any ditches used by salmonids other than to permit free migration of salmonids to their spawning grounds; (ii) Surface water facilities; provided, that such activities shall not involve conversion of any regulated wetland not currently being used for such activity; (III) Existing public facilities and utility structures or rights -of -way. The maintenance plan may be designed to address individual facilities or facility components, area -wide facilities, or city-wide systems. The maintenance plan shall identify the nature of the potential maintenance or repair activities, specifications for work which may occur within potential sensitive areas, specifications for restoring and/or mitigating impacts, specifications for timing of maintenance or repair activities, and process for contacting or notifying the city of pending maintenance or repair activities to ensure compliance with the approved plan. The public works director may require that an appropriate bond or security be maintained with the city to ensure restoration of disturbed areas. In addition, the work to be conducted is outside the required buffer distance for Category II and III wetlands (50 and 100 feet respectively, per FWRC 15.10.250 (2)) as mapped on the National Wetland Inventory. An exemption for Critical Areas also exists under FWRC 15.10.260 (2) and (4) if a wetland were to be identified within the parcel. WDFW believes that the project is exempt under shorelines and critical areas regulations.
