We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal Way Revised Code (FWRC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWRC and other relevant codes for all additional requirements that may apply to your project. Otherwise, any general questions about the preapplication and permitting process can be referred to your key contact. PROJECT DESCRIPTION Applicant proposes to clear and grade on three undeveloped single-family lots to construct a driveway prior to obtaining building permits. Intrusion into stream buffer may be necessary for temporary construction and the permanent location of proposed driveway. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions, please contact the representative listed for that section. Mr. LaBrie Page 2 April 10, 2012 PLANNING DIVISION (Matthew Herrera, 253-835-2638, matt.herrera@cityoffederalway.com) 1. Comprehensive Plan and Zoning Designation — The subject property is zoned Single -Family High Density Residential RS 9.6. Future plans for single-family housing on these lots are consistent with the city's land use and density policies for this area. 2. Clearing and Grading Plan Approval — The proposed driveway construction prior to obtaining single-family building permits for the subject properties will require clearing and grading plan approval via consolidated Use Process application as the activity is not expressly exempt in FVWRC 19.120.030. The applicant is required to meet the following criteria for use approval: a. It will not alter or adversely affect critical areas on or off the subject property; b. It will not violate any express policy of the city; and c. It meets at least one of the following criteria: i. It is necessary to correct an erosion or drainage problem on an undeveloped site; ii. It is necessary to create new utility or access corridors; iii. Other unusual circumstances exist which make it reasonable to permit clearing, grading, and/or tree and vegetation removal in advance of the issuance of a development permit. The clearing and grading plan, prepared by a professional engineer, is required to include the following mfo>ivation: a. Identification of existing and proposed grades. b. Location of all existing and/or proposed structures, driveways, right-of-way improvements, utilities, and easements on the subject property. c. Designation of critical areas. d. Areas proposed for clearing and the proposed use for such areas. e. Any proposed grade changes that might adversely affect or endanger trees on the property and/or adjacent properties, and specifications to maintain them. f. A minimum of two cross sections of the site, drawn to scale, depicting the existing and proposed grade and any proposed rockeries and/or retaining walls. g. Location and description of proposed erosion -control devices and structures. h. A statement outlining the purpose of any proposed tree removal (e.g. driveway construction), together with a proposed timetable for when the work will occur. i. A depiction of the spatial limits for tree/vegetation retention areas and details of tree/ vegetation protection measures. j. A depiction of any new vegetated areas to be established. k. The manner in which the cleared areas on the property will be reclaimed with vegetation, specification of any required mitigation plantings, and a timetable for replanting. 1. Calculation of tree unit credits for each lot after driveway construction. 3. Environmental Constraints — As shown on the submitted site plan, two Category III wetlands and one stream is located on the subject property. In January 2007, the city's wetland consultant confirmed the applicant's wetland delineation and Category III classification. The city also identified 50-foot setbacks for each wetland as their sizes were greater than 10,000 square feet. It appears stream delineation was also confirmed but a rating was not established during the 2007 review. 12-101079 Doc. LD. 60649 Mr. LaBrie Page 3 April 10, 2012 As a component of the consolidated Use Process review, the applicant will be required to update the wetland delineation reports and identify any changes to their boundaries and/or classification. The stream will also need to be rated major or minor in order to establish the appropriate mitigation plan for the driveway encroachment. Alternatively, the department can proceed with review without further stream classification analysis and assume the stream is rated major for the purposes of this permitting action. Please be advised any fish blockage must be natural and therefore disqualifies the human made culvert at South 330 Street as the blockage point. Proposed encroachment into the stream buffer will require approval via consolidated Use Process review. The applicant is required to develop a plan that addresses the following criteria set forth in FWRC 19.165.070(3): a. It will not adversely affect water quality; b. It will not adversely affect the existing quality of wildlife habitat within the stream or setback area; c. It will not adversely affect drainage or stormwater retention capabilities; d. It will not lead to unstable earth conditions nor create erosion hazards; e. It will not be materially detrimental to any other property in the area of the subject property nor to the city as a whole, including the loss of significant open space; and f. It is necessary for reasonable development of the subject property. Mitigation plans will likely need review by the city's third party environmental consultant. The applicant is responsible for review costs. 4. Consolidated Use Process IV Application — Review for the clearing and grading plan approval and stream encroachment require different levels of process, Use Process III and Use Process IV respectively. Therefore, the applications will be consolidated into a single Use Process IV application pursuant to FWRC 19.15.060. Under Process IV, the city's hearing examiner will make the initial decision following a public hearing. The applicant has the responsibility of persuading the hearing examiner by a preponderance of the evidence that the applicant is entitled to the requested decision. The Planning Division will notify the applicant of application status within 28 days of submittal. If the application is determined complete, staff will issue a Letter of Complete Application and begin the public notification process. FWRC 19.70.150(2)(b) provides the Hearing Examiner up to 120 days to issue a written decision on the land use application. The 120-day review period will stop whenever staff requests corrections or additional information from the applicant. The review period will begin within 14 days following submittal of requested items. Please be advised that any request for corrections and/or additional information must be provided within 180 days of written notification or the land use application shall expire. In addition to clearing/grading and stream buffer encroachment approval criteria, the applicant will be required to meet the following Process IV decisional criteria: a. It is consistent with the comprehensive plan; b. It is consistent with all applicable provisions of this title and all other applicable laws; c. It is consistent with the public health, safety and welfare; d. The streets and utilities in the area of the subject property are adequate to serve the anticipated demand from the proposal; e. The proposed access to the subject property is at the optimal location and configuration for access; and 12-101079 Doc. LD. 60649 Mr. LaBrie Page 4 April 10, 2012 f. Traffic safety impacts for all modes of transportation, both on and off site, are adequately mitigated. A staff report with analysis of the application and recommendation will be made available to the applicant and public at least seven calendar days prior to the public hearing. 5. Tree and Vegetation Retention — Tree removal within the driveway easement will be exempt from meeting canopy standards. Any tree removal outside the easement will require each lot to maintain the minimum 25 tree unit per acre canopy density. The applicant will be required to demonstrate on the clearing and grading plan that tree unit requirements have or will be met. Tree unit credits are assigned per the following chart for retained and replaced trees. Public Notice — The city will provide a notice of application detailing the proposed action, invite public comment, and make available documents for public review. The comment period will be open for written comments up to the recorded public hearing. The notice will be sent to all property owners within 300 feet of the subject property, published in the Federal Way Mirror, posted on the city notification boards, and posted on the subject property. The applicant is responsible for submitting two sets (one for application and one for public hearing) of stamped mailing envelopes for property owners within 300 feet of the subject property. The city's GIS Division can provide this service for a nominal fee. Please see the enclosed handout for further information. 7. State Environmental Policy Act (SEPA) —As proposed, the project would be exempt from SEPA review as it meets categorical exemption WAC 197-11-800(2)(d) — grading activities necessary for the construction of less than nine dwelling units. 8. Fees —Current fees for the Use Process IV application are $3961.50 and do not include third party environmental review costs or engineering plan review fees. Please contact a Development Specialist in the department's Permit Center at 253-835-2607 prior to submitting your application for updated application fees. 12-101079 Doc. LD. 60649 Mr. LaBrie Page 5 April 10, 2012 PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Ann Dower, 253-835-2732, ann.dower@cityoffederalway.com) Land Use Issues — Stormwater 1. Surface water runoff control and water quality treatment will be required per the 2009 King County Surface Water Design Manual (KCSWDM) and the City of Federal Way Addendum to the 2009 KCSWDM. Assuming this project results in between 2,000 and 10,000 square feet of new impervious area, Targeted Drainage Review, will be required. At the time of land use site plan submittal, a preliminary Technical Information Report (TIR), addressing the relevance of the project to the eight core and five special requirements of the KCSWDM, will be required. A Level 1 downstream analysis shall also be provided in the TIR. The City has 1" = 100', five-foot contour planimetric maps that may be used for basin analysis. 2. The project lies within a Conservation Flow Control Area, thus the applicant must design the flow control facility to meet this performance criteria. Best Management Practices, such as pervious paving, infiltration trenches, etc. as outlined in the 2009 King County Surface Water Design Manual, are encouraged. The project also lies within an Enhanced Basic Water Quality Area. If the new impervious area is 5,000 square feet or more, water quality treatment shall be provided meeting the treatment criteria of the Enhanced Basic Water Quality Menu. 3. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. 4. Detention and water quality facilities must be above ground (i.e. open pond). Underground vault -type facilities are allowed only with approval from the City of Federal Way Stormwater Management Division. 5. Show the proposed location and dimensions of the detention and water quality facilities on the preliminary plans. 6. If more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination System (NPDES) permit may be required. Information regarding this permit can be obtained from the Washington State Department of Ecology at hU://www.egy.wa.gov/12ro,arams/se4lpac/index.htm , or by calling 360-407-6437. 7. If work is to be done below the ordinary high water mark, a Hydraulic Project Approval (ETA) permit may be required. Information regarding this permit can be obtained from the Washington Department of Fish and Wildlife, at h :/Iwww.wa. ov/wdfw/hab/h a a ethtm or by calling the office of Regulator Assistance at 360-407-7037. Right -of -Way Improvements See the Traffic Division comments from Sarady Long, Sr. Transportation Planning Engineer, for traffic related items. 12-101079 Doc LD.60649 Mr. LaBrie Page 6 April 10, 2012 Engineering Permit Issues 1. Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be reviewed and approved by the City. Engineering review fees are $549.50 for the first 8 hours of review, and $68 per hour for additional review time. A final TIR shall be prepared for the project and submitted with the engineering plans. Both the TIR and the plans will require the signature/seal of a professional engineer registered/licensed in the State of Washington. 2. The Federal Way Development Standards Manual (including standard detail drawings, standard notes, and engineering checklists) is available on the City's website at www.cityoffederalway.com to assist the applicant's engineer in preparing the plans and TIR. Bonding is required for all street and storm water improvements associated with the project. The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and held for a two- year maintenance period. 4. The developer will be responsible for the maintenance of all storm drainage facilities (including the detention and water quality facilities) and street systems during the two-year maintenance period. During that time, the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. Upon satisfactory completion of the two- year maintenance period, the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the responsibility of the City. Maintenance for private roads and drainage facilities, including short plats, remain the responsibility of the individual property owners. The City will conduct yearly inspections of the facilities and notify the property owners if cleaning or repairs are needed. 5. When topographic survey information is shown on the plans, the vertical datum block shall include the phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.," on all sheets where vertical elevations are called out. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. All final approved drawings shall be drafted/plotted on 24" x 36" or 22" x 34" mylar sheet with permanent black ink. Site plans shall be drawn at a scale of V = 20', or larger. Architectural scales are not permitted on engineering plans. 7. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures, per Appendix D, 2009 KCSWDM, must be shown on the engineering plans. 8. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. 12-101079 Doe. LD. 60649 Mr. LaBrie Page 7 April 10, 2012 PUBLIC WORKS TRAFFIC DIVISION (Sarady Long, 253-835-2743, sarady.long@cityoffederalway.com) Transportation Concurrency Analysis (FWRC 19.90) A concurrency permit is not required for this project to only construct a driveway for the two adjacent vacant lots; however, a concurrency permit will be required for the two vacant lots at such time building permit applications are submitted. The estimated fee for the concurrency permit application is $344.50 (1 -10 Trips). The applicant has the option of having an independent traffic engineer prepare the concurrency analysis consistent with City procedures; however, the fee remains the same. Transportation Impact Fees (FWRC 19.91) / Access 1. The City of Federal Way has adopted a Transportation Impact Fee (TIF) program effective July 1, 2010. The estimated TIF for the 2 vacant lots is $6.412. 2. All lots shall be accessed by a public street right-of-way (FWRC 18.55.020). In certain cases, lots may be accessed by an ingress/egress and utilities easement or alley subject to the requirements established in the City of Federal Way Public Works development standards. The driveway must be constructed to cross section standards per DWG 3-2CC (Private Driveway Serving 2 lots). 3. A streetlight will be required at the intersection of a vehicular access easement and a right-of-way per FWRC 19.135.100 (3). SOUTH KING FIRE AND RESCUE (Chris Ingham, 253-946-7244, chris.ingham@southkingfire.org) In lieu of a turnaround and 20-foot paved roadway, the two future homes on Lots A and B will need automatic sprinkler systems. CLOSING This letter reflects the information provided at the preapplication meeting and is intended to assist you in preparing plans and materials for formal application. We hope you found the comments useful to your project. We have made every effort to identify major issues to eliminate surprises during the City's review of the formal application. The property has previously been reviewed by the City under file #06-105384-AD. As depicted in the attached BLA, recorded in June of 2005, a seasonal stream encompasses approximately 930 sf of the site. At the time of recording, this was considered a Class III stream requiring a 25-foot buffer. However, this stream is now rated under Federal Way's revised classification system as a Minor Stream and the 50' buffer associated with this stream now encumbers part of the area within the ingress/egress easement previously recorded on the face of the BLA. The applicant wishes to construct a driveway to access lots A and B within the recorded easement. This proposal appears to be the most reasonable way to access these lots without causing greater impacts to other existing onsite wetlands. In order to construct the proposed driveway, construction activities within the stream setback will be required. Process IV — Intrusion into Stream Setback A peer review report prepared by Otak and dated January 29, 2007 identifies the onsite stream and outlines an opinion regarding its classification. Otak states that "although we agree that this ditch is not utilized by anadromous fish, it must be determined that a natural migration barrier occurs downstream of the property" in order to be considered minor. This criteria has been met as the stream is now culverted directly across S. 330 Street downstream of the site. This migration barrier serves as evidence that the onsite stream is a "minor stream" requiring a 50-foot setback from the ordinary high water mark. Per FWRC 19.165.070, an intrusion into a stream setback (other than for essential facilities and minor improvements) may only be granted through Process IV. With this in mind, it is our intention to apply for approval of this proposed intrusion through Process IV.
